05/17/1943101 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES HELD IN THE COUNCIL CHAMBERS, MONDAY MAY 17, 1943 AT 8:00 P.M. CALL TO ORDER: In the absence of Mayor Charles H. Garland the meet- ing was called to order by Edgar J. Friedrich,` City Clerk, with Aldermen Johnson, Napieralski, Pflughaupt, Vavrinek, Kehe, Scharringhausen, Lemke, McKay, Campagna and Halverson, responding to the roll -call. The Clerk reported all ten aldermen present. DESIGNATE MAYOR PRO -TEM: The $otion was then made by Alderman Lemke and seconded by Campagna. that Alderman Pflughaupt serve as Mayor pro -tem. The motion was voted upon by acclamation whereupon the chair declared the motion carried. Alderman Pflughaupt thereupon took the chair. SUBMITS SPECIAL ASSESSMENTICLAIM: The Chair then introduced Mr. Ed Gimbel of Elmhurst, Illinois who reported a claim for a rebate in the sum of approximately $84.50 for a special assessment installment paid twice. The motion was made by Alderman Lemke and seconded by Johnson to refer this matter to the City Attorney and the Finance Committee for study and recommendation. The motion was voted upon by acclamation, whereupon the chair declared the motion carried. REPORTS: The Clerk then submitted the report for April, 1943 of Harold J. Abbe, City Treasurer. The Chair ordered the said report placed on file. City Hall, Des Plaines, Illinois Dear Sirs April 5, 1943 As per our telephone conversation, I ani. submitting the following information: We are the owners of three sixty foot lots and the lest Zen feet of another lot, these lots being lots 40, 41, 42 and the lest ten feet of lot 43 in block 7 in Des Plaines Heights, located on the South side of Whitcomb Avenue approximately three-quarters of a block West of River Road. We are desirous of constructing four buildings on this piece of property which means that we will have to redivide, (the total width of these lots being 190 feet) into 47+ feet each. The buildings that will be constructed on these lots will be one family brick buildings. Will you please submit this information to the Des Plaines planning group so that we may receive an O.K. from you to proceed with the 47i -foot lot size. Yours very truly W. WARRANT RIVERVIEW #2: The Clerk then read the following letter: May 17, 1943 Mayor and City Council Des Plaines, Illinois Re: Otto C. Woerter, Receiver Des Plaines State Bank -vs- City of Des Plaines Gentlemen: Suit in the above matter was filed in the Circuit Court on August 27th, 1942. The subject matter involved was for the diversion of funds as pertaining to a Voucher payable out of the 1st installment of UN River- view No. 2. The voucher, as originally issued was in the sum of $2,500.00 and was payable for engineering services. A payment on account reduced the amount due to $1,550.00. A checkup of the records discloses that there was a diversion in the sum of $900.00, for which the City has no defense whatever. The face value of the voucher, together with accrued interest, places a liability of $1,800.00; and in the alternative, the diversion of $900.00, together with interest would make the liability immediately due and payable in the sum of approximately $1,100.00. Your City Treasurer Harold J. Abbe and -myself have devoted considerable time to this matter, and our efforts have made it possible to settle the entire liability for the sum of $700.00. Your concurrence of these efforts, together with the approval of the settlement is requested, together with an order for the payment of this obligation from the Public Benefits Fund.
