COUNCIL OF THE CITY OF DES PLAINES HELD IN
THE COUNCIL CHAMBERS, MONDAY, MAY 3, 1943,
AT 8100 P.M.
CALL TO ORDER,: The meeting was called to order by Mayor Charles
H. Garland presiding, with Aldermen Carroll, Johnson, Loos,Pflughaupt,
Kehe, Lemke and Campagna responding to the roll -call. (Alermen Dopheide,
Friott and Schwanbeck were absent'during the entire meeting.) The Clerk
feported seven (7) aldermen present.
PEPORIV: The Clerk then read the report for April, 1943 of
Frank F. Scharringhausen, Building Inspector. The Mayor ordered the said
report placed on file.
1140 ZONING ORDINANCE: The Clerk then read the following proposed
ordinance for second reading:
AN ORDINANCE AMENDING AN ORDINANCE ENTITLED "AN ORDINANCE TO
CLASSIFY, REGULATE AND RESTRICT THE LOCATIONS OF TRADES AND INDUSTRIES
AND THE LOCATION OF BUILDINGS DESIGNED FOR SPEC/BIED USES; TO REGULATE
AND LIMIT THE INTENSITY OF THE USE OF LOT AREAS AM TO REGULATE AND
DETERMINE 213 AREA OF YARDS, COURTS AND OTHER OPEN SPACES WITHIN AND
SURROUNDING SUCH BUILDINGS, AND TO ESTABLISH THE BOUNDARIES OF DISTRICTS
FOR THE SAID PURPOSES AND PRESCRIBING THE PENALTIES FOR THE VIOLATION
OF ITS PROVISIONS", PASSED FEBRUARY 5U 1923. AS AMENDED.

=Ms The Zoning Board of Appeals of the City of Des Plaines, at a
meeting duly called and held according to law, considered the ques-
tion of re-classifying from residence district, Area District AA, to
residence district, Area District A, the real estate hereinafter re-
ferred to; and
WHEREAS, The said Zoning Board of Appeals tender their report and state
that after:many meetings they are unable to agree and therefore can-
not make any recommendation, but in lieu thereof submit their report;
and
WHEREA§, The City Council, after considering the report of the said
Zoning Board of Appeals finds, and the Council believes that the high.
est and best use of said real estate would be for single family re-
sidence uses and further finds that the interests of the community as
a whole would best be served making such a reclassification; now, there-
fore:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DES PLAINES, COOK
COUNTY, ILLINOIS.
SECTION 1. That an ordinance entitled *An Ordinance to classify, re..
gulate and restrict the locations of trades and industries and the
location of buildings designed fro specified uses; to regulate and
determine the area of yards courts and other open spaces within and
surrounding such buildings :nd to establish the boundaries of districts
for the siAdipurposes and prescribing penalties for the violations of
its provisions*, passed February 5, 1923, IJIMX as amended be amended by
reclassifying from residence district, Area District AA, to residence
District, Area District A, the following described real estate:
Lots 27 to 37, both inclusive, in Spiking's Subdivision of part
of Blocks 52 and 53 in Des Plaines manor Tract No. 3, a inibdiv-
ision of part of the Southeast quarter of Section 18, Township
41 North, Range 12, East of the 3rd Principal Meridian, lying South
and East of the Chicago and Northwestern Railway Company lands; also
Lot 2 in Block 40 in Des Plaines Manor Tract No. 3, a subdivision of
part of the Southeast quarter of Section 18, Township 41, North, Range
12, East of the 3rd P.M., lying South and East of the Chicago and
Northwestern Railway Company lands; also
Lots 43 to 70, both inclusive, in Cherry Highlands, 2nd Addition,
being a subdivision of the South one-half of Blocks 41, 49 and 50
and Block 51 in Des Plaines Manor Tract No. 3 a subdivision of that
part of the Southeast quarter of Section 18, Township 41 North, Range
12, East of the 3rd P.M., lying South and East of the Chicago and
Northwestern Railway Company lands, except parts of aforesaid Blocks
heretofore conveyed fen the opening of Rose Avenue and Thacker Street.

All of the above described real estate lying between Fifth Avenue and
the Easterly right of way of the Chicago and Northwestern Railway Co.,
on the north side of Thacker Street.
SECTION 2t That said lands as reclassified shall be subject to all limit.
ations and conditions placed upon properties in residence district, Area
District A, as defined in siedl ordinance hereinbefore mentioned.
SECTION 3. Any person, firm or corporation who violates, disobeys, omits,
neglects or refuses to comply with or who residts the enforcement of any
of the provisions of this ordinance shall be fined not less than Twenty-five
($25.00) Dollars nor more than Two Hundred ($200.00) Dollars for each
offense. Eaeh day that a violation is permitted to exist shall constitute
a s4Parate offense.
SECTION 4. This ordinance shall be in full force and effect from and
after its passage, approval and due publication.
The motion was made by Alderman Lemke and secm:ded by Pflughaupt that the
slid proposed ordinance be passed. The Mayor put the question and the
Clei& called the roll with the following result: Ayes; Aldermen Carroll,
Johnson, Pflughaupt, Kehe, Lemke and Campagna. Nays; Alderman Loos.
The Mayor thereupon declared the motion carried and the said ordinance
adopted.

Mayor Garland referred the said letter and plat to the Plan Commission for
study and recommendation.
RESIGNS FROM ZONING BOARD: The Clerk then read the following re-
signation:

It is with considerable reluctance that I tender you my re-
signation from the Des Plaines Zoning Board of Appeals, to
take up my duties as Aldermen of the First Ward.
In taking my leavd of this post, I feel that I leave behind me

an awakened consciousness on the part of our citizens to the
important influence which zoning exerts upon their welfare and
happiness.
In spite of the travail incidental to zoning procedures, I have
enjoyed every year of my service on the Board and wish to thank
you sincerely for re -appointing me at the expiration of my first
term.
As Alderman, I shall continue to be more than willing to render
such aid and advice as my experience may have given me in any and
all matters pertainineto zoning, should I be called upon to do so.

The motion was made by Alderman Johnson and seconded by Lemke that this re-
signation be accepted. The motion was voted upon by acclamation whereupon
the Mayor declared the motion carried and the said resignation accepted.
The Clerk then read the following letter:

Gentlemen:
T.R. Napieralski, having been duly elected Alderman of the First
Ward of the City of Des Plaines, has tendered his resignation as
Secretary of the Zoning Board of Appeals.
As Secretary of the Board he has rendered a long and faithful ser-
vice to the City and its citizens.
We, the undersiMned members of the Board, wish to take this opport-
unity of expressing to him our deep appreciation for his loyalty,
co-operation and the efficient manner with which he executed the
duties of his office. His keen judgment, his clear thinking and
his careful analysis of the many problems will be missed at our fut-
ure meetings.
The First Ward in particular, and the City in general, is fortunate
in having a man of his ability and wide experience represent them
on the City Council. We vial him every success.

SALVATION ARMY REQUESTS PERMIT: The Clerk then read the following
letter: March 31, 1943

Dear Mayor Garland:
For the past two or three years you have very graciously given a permit
for the Salvation Army to hold an annual tag day in Des Plaines, which
we have greatly appreciated.
We would like to request that permission again be granted us to have a
tag day in Des Plaines on Saturday, September llth.
In these times of war The Salvation Army has greater demands made upon
it than usual and we sincerely trust that favorable consideration will

The motion was made by Alderman Campagna and seconded by Loos to grant this
request. The motion was voted upon by acclamation whereupon the Mayor de-
clared the motion carried and the request granted.
COUNTY TO HOLD ZONING HEARIN: The Clerk then read the following
notices

LEGAL NOTICE OF PUBLIC HEARING
IN MAINE TOWNSHIP
Notice is hereby given that a public hearing will be held on an
amendment to the Zoning Ordinance of Cook County, Illinois, at
5:30 P.M. -(Central War Time) on May 13, 1943, at the Des Plaines
City Hall, Dee Plaines,. Illinois.
The property involved is located on the southwest corner of
Central Avenue and LaGrange Road, legally described as:
That part of the W. 7.14 chains of the S.W. of
Section'33, Township 41 North, Range 12 East of
the 3rd P.M., lying south of the north 703.6 feet
thereof and north of creek (except the north 402.25
feet of the east 180 ft. thereof.
The amendment, as proposed, seeks to rezone the above legally de-
scribed property from its present classification as an F (Farming)
District to a B-1 (Business) District, or such variation as the
Board of Appeals may have the power to grant.
All persons interested should attend and will be given an opportunity
to be heard.

The motion was made by Alderman Pflughaupt and seconded by Kehe to adopt
this proposed resolution. The Mayor put the question and the Clerk called
the roll with the following result: Ayes; Alderman Carroll, Johnson, Loos,
Pflughaupt, Kehe, Lemke and Campagna. Nays; None. The Mayor thereupon de-
clared the motion carried and the resolution adopted.
APPROVAL OF M,TNUTES: Each member of the Council having been
supplied a copy of the minutes of the regular Council meeting held April 19,
1943 as well as a copy of the minutes of the special meeting held April 26,
and the adjourned special meeting held April 29, 1943, the motion was made
by Alderman Lemke and seconded by Pflughaupt that the said minutes be approved.
The motion was voted upon by acclamation whereupon the Mayor declared the
motion carried and the said minutes approved.
ADJOURN SINE DIS: The motion was then made by Alderman Carroll and
seconded by Johnson that the Council adjourn sine die.
Mayor Garland then spoke a few appropriate words of farewell to Aldermen
Carroll, Loos, Dopheide, Ftlorbtand Schwanbeck who retired from the office
of Alderman.
The notion to adjourn sine die was then voted upon by acclamation
whereupon the Mayor declared the motion carried and the Council adjourned
sine die.
INSTALL NEW ALDERMEN: Judge A. L. Sengstock, as master of cere-
monies, then formally introduced newly elected Aldermen Napieralski, Vavrinek,
Scharringhausen, McKay and Halverson, who were officially sworn in by Edgar
J. Friedr, City Clerk
cogyaL RE -CONVENE$: Mayor Garland then re -convened the Council
with Aldermen Johnson, Napieralaki, Pflughaupt, Vavrinek, Aehe, Scharri ng-
hausen, emke, McKay, Campagna and Halverson responding to the roll -call.
The Clerk reported all aldermen present.
ORDER ORDIHAKE PUBLISHED: Mayor Garland then.formally approved the
ordinance reclassifying certain areas on the North side of Thacker Street near
Wolf Road, to Residential,District, area District "A", which was passed earlier
during this meeting.
The motion was made by Alderman Pflughappt and'seconded by Lemke to order
the Clerk to cause the said ordinancd published in "The Des Plaines Suburban
Times". The motion was voted upon by acclamation whereupon the Mayor declared
the motion carried.

by Campagna to adjourn. The motion was voted upon by acclamation whereupon
