CALL TO ORDER: The meeting was called to order by Mayor Charles H.
Garland presiding, with Aldermen Carroll, Johnson, Loos, Pflughaupt, Kehe, Friott,
Lemke, Schwanbeck, and Campagna responding to the roll call. (Alderman Dopheide
was absent during the entire meeting.) The Clerk reported nine (9) Aldermen
present.
TO REPAIR CATER WELL PU1IP: The Clerk then read the following report:

To the Chairman Lemke - Water Committee, at the meeting of the City
Council, held February 15,'1943 the following matter was referred to
your committee:
The matter of pulling the pump on the so-called Cater Well and repair-
ing the same was referred to your committee with full power to act.

of the City Council, held February 15, 1943 the following matter was
referred to your committee:
The report of E. N. Fletcher, City Engineer, pertaining to a letter
from the City Attorney, Frank M. Opeka, dated February 1, 1943 advising
the City Council theat Nir. S. A. Jackson urges some sort of settlement
from the City because a public sidewalk was built 7 feet inside his
lot line by Special Assessment No. 132 in the year 1929.
You will find a copy of the City Engineer's report as.well as a copy
of the letter from the City Attorney attached hereto.

The motion was made by Alderman Pflughaupt and seconded by Lemke to adopt the
said proposed resolution. The Mayor put the question and the clerk called
the roll with the following result: Ayes: Aldermen Carroll, Johnson, Loos,
Pflughaupt, Kehe, Friott, Lemke, Schwanbeck and Campagna. Nays; None. The
Mayor thereupon declared the motion carried and the said resolution nr9opted.
APPROVAL OF MINUTES: Each member of the Council having been
supplied a copy of the minutes of the regular Council Meeting held March 1, 1943,
the motion was made by Alderman Johnson and seconded by Carroll that the said
minutes be approved. The motion was voted -upon by acclamation whereupon
the Mayor declared the motion carried and the said minutes approved.
ZONING FOR DUPLEX RESIDENCES: The Clerk then read the following
recommendation:
REC OMLENDAT ION
To the Honorable Mayor and
Council of the City of
Des Plaines, Illinois:
The need for residential housing in the City of Des Plaines
is a matter of common knowledge. Due to a variety of economic
factors coming to beaur upon the building industry under
present ward conditions-, the many contractors who made a recon -
,n naissance of Des Plaines for prospective building operations tend
toward the erection of dupliexes rather than cheap single family
dwellings.
Inview of a constantly increasing pressure for the rezoning of
signle family residential areas for duplex building, your zoning
board previously recommended changes in certain localities from
area district "A" to area district "B". Area district "B", as it
exists in our present zoning ordinance permits the erection of multiple
family dwellings, whereas the intention of the Board was to strictly
define the use of such areas for single family duplex dwellings only.
This narrow restriction -is deemed necessary because of the many
civic and social problems arising from increasing the density of
of population in the localities inquestion.
It need not be pointed out to the Council that the problem of
schooling, the safety of children, and adult-, and their general
welfare is a vital consideration where increasing the density of
population in a given area is projected.
Your Board feels that under existing conditions, judicious
rezoning of single family areas for duplex building has advantageious
features which out -weigh disadvantages.
Presented herewith is an ordinance for the purpose of creating a new
zoning classification to be known as area district "AA" in which zones
residential dwelling are limited to duplex types. The ordinance among
other things provides for a 4 ft. set -back from side lines of the lot
for purposes of light and air, together with easier accessability
for service purposes, auch as the placing of storm windows and -
painting.
Your Board has also considered the possibility for future communal
driveways between buildings, and recommends that the 4 ft. set -back
be established as the minimum.

The Zoning Board also recommends that in all cases where density of
population is increased, provision of adequate alley facilities or
other means of ingress and egress to the rear yard be made a condition
on which permission to build duplex type buildings is predicated.
In the belief that the above conditions will be fulfilled by the civic
authorities having jurisdiction, your Board recommends the adoption
of the enclosed ordinance creating the zoning classification - Area
District "AA".

RESTRICT THE LOCATIONS OF TRADES AND INDUSTRIES
AND TUE LOCATION OF BUILDINGS DESIGNED FOR SPECIFIED
USES; TO REGULATE AND LIMIT THE INTENSITY OF THE
USE OF LOT AREAS AND TO REGULATE AND DETERMINE THE
AREA OF YARDS, COURTS AND OTHER OPEN SPACES WITHIN
AND SURROUNDING SUCH BUILDINGS, AND TO ESTABLISH
THE BOUNDARIES OF DISTRICTS FOR THE SAID PURPOSES
AND PRESCRIBING TIE PENALTIES FOR THE VIOLATION OF
ITS PROVISIONS", PASSED FEBRUARY 5, 1923, AS
AMENDED; AND FURTHER AMENDING SAID ORDINANCE BY
ADDING TIERETO SECTION 14A "AREA DISTRICT AA", AND
RECLASSIFYING CERTAIN LANDS TO BE INCORPORATED INTO
SAID NEW AREA DISTRICT.
The motion was made by Alderman Kehe and seconded by Loos to suspend the rules and
place the said proposed ordinance upon its final pas:age. The mayor put the
question on the motion to suspend the rules and the Clerk called the roll with
the following result: Ayes; Aldermen Carroll, Johnson, Loos, Pflughaupt, Kehe,
Friott, Lemke, Schwanbeck and Campagna. Nays; None. The Mayor thereupon
declared the motion carried, .e,rules suspended and the said proposed
ordinance before the Council for final disposition.
The motion was then made by Alderman Loos and seconded by Campagna to
finally pass and adopt the said proposed ordinance. The Mayor put the question
and the Clerk called the roll with the following result: Ayes; Aldermen Carroll,
Johnson, Loos, Pflughaupt, Kehe, Friott, Lemke, Schwanbeck and Campagna. Nays;
None. The Mayor thereupon declared the motion carried and the said ordinance
passed.
The motion was then made by Alderman Johnson and seconded by Campagna
to publish the said ordinance in the Des Plaines Suburban Times. The motion
was voted upon by acclamation whereupon the Mayor declared the motion carried.
NO APPEAL IN CASE OF CITY VS. HERMAN WOLF: Frank E. Opeka, City
Attorney, then reported that in the case of the City vs. Herman Wolf (Westfield
Motor Sales) the City was awarded its sign fees based upon rates set forth in the
1939 Building Code, and recommended that the case be not appealed. The
motion was made by Alderman Campagna and seconded by Loos to concur in this
recommendation. The motion was voted upqn by a✓clamation whereupon the Mayor
declared the motion carried.
SUGGEST $5.00 FEE WITH ZONING PETITION: The Clerk then read the
following recommendation:

The Zoning Board of A>>pealshas felt for some time that requests for
re -zoning have been made by various realtorsand builders, whose
plans are not fully matured and whose intentions a"e not backed
by sufficient ability to peform.
The. necessity for publishing legal notices and the time consumed in
fruitless meetings of the Board area burden, both on the
Boards appropriation and upon the time of its members.
Since it apparently is a common practice in many cities to require
a petitioner to pay for the printing of a legal notice, your Zoning
I)oard recommends that an ordinance be passed requiring the payment
of a $5.00 fee with each petition to re -zone.

From the publicity given in the local press to the matter of rezoning cer-
tain areas in the City of Des Plaines for Duplex houses we were of the im-
pression that only property south of Oakton Street :could be rezoned. We
feel that designating the above described land as Area AA will adversly af-
fect the pros-io-'r and orderly grotirth and development of the ?West side of the
City `df' Des Plaines and adv`s.sly affect the property values of the resident-
ial property located on the West Side of the City of Des Plaines and accord-
inly we respectfully request thri. City Council of the City of Des Plaines to
repeal it's action just taken to rezone the property above set forth.

This petition vias thoroughly discussed at length. The discussion revealed
that the petition requested repeal, and that by repealing the or?inance in que-
stion the area involved would automatically revert back to "Commercial" instead
of "single family."

Pursuant to our recent conversation, we are enclosing our check
for $400 to be used for the *chasing of the sewer disposal
sight, and we are making this as a donation to the City of Des
Plaines, but not to fulfill or cover any promises made in the
past, but simply to help bring the project to completion at an
early date, as we have been advised that unless we donate the
funds for purchasing this property, the sewer disposal plant
may be held up indefinitely.
