The motion was then made by Alderman Johnson and seconded by Loos to finally pass
and adopt this proposed ordinance. The Mayor put the question and the Clerk

APPROVAL OF MINUTES: Each member of the Council having been supplied
a copy of the mnnites of the regular Council meeting held December 21, 1942
the motion was made by Alderman Lemke and seconded by Loos that the said min-
utes be approved. The motion was voted upon by acclamation whereupon the
Mayor declared the motion carried and the said minutes approved.
MIDDLE STATES TELEPHONE CO.- FRANCHISE: Mayor Garland reported that
the representatives of the Middle States Telephone Company have agreed to meet
with the Council on Frieday, January 15, 1942 at 8:00 P.M. to ggree upon the
terms of franchise. He asked all members of the Council to be present.

was referred to your committee for study and recommendation.

In reply to your letter of December 26, 1942, with the attached re-
solution of the City Council of the City of Des Plaines, dated Dec-
ember 21, 1942, will you kindly inform the Mayor and. City Council of
the City thf Des Plaines that I have requested the Board of Trustees
of the Sanitary District to include in its budget for 1943 a sum suffi-
cient to construct the Inhoff Tank and pumping station to serve the
sanitary sewer system now under construction in Brsnigar's Cumberland
Terrace? This work will probably be done by contract, without WPA
assistance. I have also requested the Chief Engineer, Mr. W.H. Trinkaus
to arrange that the work may begin at as early a date as possible.

DUPLEX RE -ZONING: The Clerk then read the following letter:

Dear Sirs:
At the meeting that was held by the Des Plaines Homes Owners Assoc.
Friday, January 8th, at the Riverview School, the contemplated change
in the zoning ordinance as it pertained to the Riverview District was
read and discussed.
It was noted that it would change the region from an A to a B district.
As we understand it, this was an error on the part of the zoning board.
At the meeting the City officials present agreed that there should be
a change in the zoning ordinance creating a new classification allowing
the erection of Duplex houses only.
We trust that they will act as they verbally agreed.

Gentlemen:
January 18, 1943
Sometime ago the Zoning Board of Appeals tendered their report re-
lative to the change of a cetain area on White and other streets, with
a recommendation that this area be rezoned from Area District A to
Area District B, having in mind, particularly, the construction of duplex
type of residence. The Council concurred in the recommendation and re-
quested an ordinance.
From various discussions, I have reached the conclusion that this
change was desired with a limitation to duplex buildings. To change to
class B or Area District B would mean, under the existing Zoning ordinance,
that any multiple type of building could be constructed, and in direct
conflict with the underlying thought.
To accomplish the objective, it will be necessary to amend the original
Zoning Ordinancd setting up a new residence Area. To do so, it shall
be necessary that such action and contemplated ordinance, with the de-
finite areas described, be advertised and a public meeting held.

Such notice shall be published at least fifteen (15) days prior to
the date of the mee6ing. The Commission or committee holding such
a meeting then readers its report to the Council, together with a
proposed ordinance, if there are no objections, or if the commission
or committee so recommends. Until there is such a public meeting
called, for the express purpose of setting up another classification,
with definite districts or area to be incorporated in the change, the
Council is without power to amend the existing law and set up any area
for such purpose.
Your further instructions in this matter will be appreciated.

On December 30, 1942, after public notice was duly given, the
Des Plaines Zoning Board of Appeals conducted a hearing at the
Municipal Building concerning the reclassification of all lots
lying between Fourth Avenue and the Chicago Northwestern Rail
-road right of way, on the North side of Thacker Street, from
single family residential use (Area District A) to Area District
B.

This action was taken upon petition of Miss L. Bennett, the owner
of a substantial portion of such frontage. No objectors to the
proposed reclassification appeared and because of this fact and
also as the result of a study conducted by the Zoning Board which
took into consideration the character of the surrounding property,
and also because the reclassification conforms to the Board's gen-
eral plan for making available certain areas for duplex dwelling
construction, the Board hereby recommends that the necessary
council action be taken for the preparation and passage of an
ordinance permitting such use in the area in question.

The following is a report of the money turned over to the pension fund by
