COUNCIL OF THE CITY OF DES PLAINES HELD IN
THE COUNCIL CHAMBERS, MONDAY, JANUARY 4,
1943.AT 8:00 P.M.

CALL TO ORDER: The meeting was called to order by Mayor Charles H.
Garland presiding, with Aldermen Carroll, Johnson, Loos, Pflughaupt, Dopheide,
Kehe, Friott, Lemke and Campagna responding to the roll call. (Alderman Schwanbeck
was absent during the entire meeting.) The Clerk reported nine (9) Aldermen
present.
REPORTS OF INSPECTORS: The Clerk then read the reports for December,
1942 of the following:
Frank F. Scharringhausen, Building Inspector
Arthur Rieck, Electrical Inspector.
The Mayor ordered the said reports placed on file.
APPROVAL OF BILLS: The Finance Committee, through its chairman, Alder-
man Pflughaupt then introduced the following proposed resolution:

The motion was made by Alderman Pflughaupt and seconded by Johnson to adopt the
said proposed resolution. The Mayor put the question and the Clerk called the
roll with the following result: Ayes; Aldermen Carroll, Johnson, Loos, Pflughaupt,
Kehe; Friott, Lemke and Campagna.. Nays; None. (Alderman Dopheide was out of
the room during this roll call). The Mayor thereupon declared the motion carried
and the said resolution adopted.
RECOVER BACK TAX MONEYS: The Clerk then read the following letter:
January 4th, 1943

Des Plaines, Illinois
Gentlemen:
Please be advised that the -tax objections filed against the 1940 and 1941 1
levy have been before the County Court for hearing on three different occas»
sions, and I hope to see the final order thereon entered tomorrow, January 5th,
1943. Official notice of this proceeding was not received by the City until
just a week before the hearing. Some preparations were made to overcome the
contentions set forth through the alertness of the City Treasurer, Harold Ahbe,
who discovered sometime before notice was received that there were objections
filed and that a substantial amount of tax money was held up.
By agreement with the attorneys for the objectors, a portion of the tax money
was received, namely, the sum of 0,477.0$, and there still remains the sum
of $2,700.00 in the hands of the County Treasurer, pending a ruling on the
objections.
I most strongly recommend that great care be used in setting up appropriation
items, designating the detail purposes, according to law; and to avoid the
making of appropriations for purposes beyond the scope of the municipality and
it's governmental purposes.

APPROVE SEWER FOR LINDEN STREET BETWEEN RIVERVIEW AVENUE AND EVERETT AVE . :
The Clerk then read the following letter and,submitted the plans and specifications
referred to therein:
January 4, 1943
Honorable Mayor and
City Council
Des Plaines, Illinois
Gentlemen:
Enclosed please find for your approval, Plans and Specifications for the
improvement of Linden Street by constructing therein a combined 10 inch
sewer together with 12 house services and other necessary appurtenances.
The proposed sewer will connect to an existing 10 inch sewer at an existing
manhole on Riverview Avenue.
Due to -the fact that this improvement is to be paid for by the subdivider
without expense to the City of Des Plaines and to the fact that the sewer
services for certain lots are to be constructed at the same time the main
sewer is constructed; and, single the street is not now improved with any
surfacing material and will have to be surfaced by the subdivider at a
later date and at his own expense, I recommend that the $10.00 street open-
ing permit be waved on those house services which are constructed at the
time the main 10 inch sewer is laid.

After an informal examination of the plans and specifications the motion was made
by Aldermen Kehe and seconded by Loos that the said plans and specifications be
approved and that the recommendation contained in the foregoing letter be concurred
in.

The motion was voted upon by acclamation whereupon the Mayor declared the
motion carried.
SMOKE ABATEMENT ORDINANCE - FIRST READING: The Clerk then read the
following report:
COMMITTEE REPORT
To Frank Y. Opeka - City Attorney, at the meeting of the City Council,
held December 21, 1942, the following matter was referred to you:
Your instructed to prepare a Smoke Abatement Ordinance and
submit the same to the City Council for consideration.
You will note that the matter of Smoke Abatement is covered
in the Section No. 1038 of Article 5 entitled "NUISANCES DAN*
GEROUS TO HEALTH" on page 62 of the Municipal Code of the
City of Des 1411E Plaines of 1929. The City 0ouncil however
feels that the present ordinance is inadequate.

and then proceeded by reading for first reading the proposed amendment to the
existing smoke ordinance entitled:
AN ORDINANCE AMENDING SECTION 1038 OF ARTICLE V OF CHAPSRR 21
OF THE REVISED ORDINANCES OF THE CITY OF DES PLAINES 1928.

The motion was made by Alderman Campagna and seconded by Loos to suspend the rules
and place the said proposed ordinance upon its final passage. The motion to sus-
pend the rules was voted upon by acclamation whereupon the Mayor declared the
motion carried, the rules suspended and the said proposed ordinance before the
Council for consideration.
The motion was then made by Alderman Campagna and seconded by Kehe to finally pass
and adopt the said proposed ordinance.
However the motion was made by Alderman Johnson and seconded by Carroll that the
said proposed ordinance be tabled. The motion to table was voted upon by acclama-
tion whereupon the Mayor declared the motion carried&the said proposed ordinance
tabled.
REZONING FOR DUPLEX HOMES IN "RIVERVIEW": The Clerk then read for first
reading a proposed ordinance entitled:
AN ORDINANCE AMENDING AN ORDINANCE ENTITLED "AN ORDINANCE TO
CLASSIFY, REGULATE AND RESTRIDT THE LOCATIONS OF TRADES AND IN-
DUSTRIES AND THE LOCATION OF BUILDINGS DESIGNED FOR SPECIFIED
USES; TO REGULATE AND LIMIT THE INTENSITY OF THE USE OF LOT'
AREAS AND TO REGULATE TND DETERMINE THE AREA OF YARDS, COURTS
AND OTHER OPEN SPICES WITHIN AND SURROUNDING SUCH BUILDINGS,
AND TO ESTABLISH THE BOUNDARIES OF DISTRICTS FOR TBE SAID pull -
POSES AND PRESCRIBING PENALTIES FOR THE VIOLATION OF ITS PRO-
VISIONS", PASSED ON THE FIFTH DAY OF FEBRUARY, A.D. 1923, AS
AMENDED.
Mayor Garland ordered the said proposed ordinance filed for second reading.
AMEND LIQUOR ORDINANCE: The Clerk then read for first reading a proposed
ordinance entitled:
AN ORDINANCE AMENDING SECTIONS 4, 5 and 9 OF AN ORDINANCE EN-
TITLED "AN ORDINANCE REGULATING THE SALE OF ALCOHOLIC LIQUORS
IN THE CITY OF DES PLAINES AND REPEALING ALL OTHER ORDINANCES
HERETOFORE PASSED REGULATING THE SALE OF ALCOHOLIC LIQUORS.
The motion was made by Alderman Johnson and seconded by Lemke to suspend the rules
and place the said proposed ordinance upon its final passage. The Mayor put the
question on the Motion to suspend the rules and the Clerk called the roll with
the following result: Ayes; Aldermen Carroll,; Johnson, Loos, Pflughaupt, Dopheide,
Kehe, Friott, Lemke and Campagna. Nays; None. The Mayor thereupon declared the
motion carried, the rules suspended and the said proposed ordinance before the
council for consideration.

The motion was then made by Alderman Johnson and seconded by Loos to finally pass
and adopt this proposed ordinance. The Mayor put the question and the Clerk
called the roll with the following result: Ayes; Aldermen Carroll, Johnson,
Loos, Pflughaupt, Dopheide, Kehe, Friott, Lemke and Campagna. Nays; None. The
Mayor thereupon declared the motion carried and the said ordinance passed.
(LIQUOR ORDINANCE - cont'd)
The $otion was then made by Alderman Lemke and seconded by Friott to order the
Clerk to cause the said ordinance published in the Des Plaines Journal. The
motion was voted upon by acclamation whereupon the Mayor declared the motion
carried.
APPROVAL OF MINUTES: Each member of the Council having been supplied
a copy of the munites of the regular Council meeting held December 21, 1942
the motion was made by Alderman Lemke and seconded by Loos that the said min-
utes be approved. The motion was voted upon by acclamation whereupon the
Mayor declared the motion carried and the said minutes approved.
MIDDLE STATES TELEPHONE CO.- FRANCHISE: Mayor Garland reported that
the representatives of the Middle States Telephone Company have agreed to meet
with the Council on Frieday, January 15, 1942 at 8:00 P.M. to ggree upon the
terms of franchise. He asked all members of the Council to be present.
ADJOURNMENT: The motion was made by Alderman Lemke and seconded by
Johnson to adjourn. The motion was voted upon by acclamation whereupon the
Mayor declared the motion carried and the Council re:„ ly adjourned.

1943 AT 8:00 P.M.
CALL TO ORDER:
The meeting was called to order by Mayor Charles H. Garland pre-
siding, with Aldermen Loos, Pflughaupt, Dopheide, Kehe, Friott, Lemke,
Schwanbeck, and Campagna responding to the roll -call. (Aldermen Carroll
and Johnson were absent during the entire meeting.) The Clerk reported
eight (8) Aldermen present.
MAYOR READS ANNUAL MESSAGE: Mayor Galrnad then read his annual
message to the City Council and ordered the same placed on file.
REPORTS OF OFFICERS: The Clerk then read the reports of December,
1942 of the following:

OTHER ANNUAL REPORTS: The Clerk thn read the annual reports for
1942 of the following:

report of the Streets Department, the
Water Department and the Sewer and Sani-
tation Department)
The Mayor ordered the said reports placed on file.
