CALL TO ORDER: The meeting was called to order by Mayor Charles H.Garland
presiding, with Aldermen Carroll, Johnson, Loos, Kehe, Friott and Lemke responding
to the roll -call. (Aldermen Pflughaupt, Dopheide, Schwanbeck and Campagna were ab-
sent during the entire meeting.) The Clerk reported six (6) aldermen present.
READING OF THE CALL AND WAIVER OF NOTICE: The Clerk then read the

of the City of Des Plaines, Illinois
You are hereby officially notified that upon order of Mayor
Charles H. Garland a special meeting of the City Council will
be held on Monday, November 23, 1942, in the Council Chambers,
City Hall, Des Plaines, Illinois at 7:30 P.M. for the purpose
of officially accepting an offer of settlement in the case of
the City vs B -W Construction Company and the American Surety
Co., and to dispose of such other matters as may require the
attention of the said City Council.

B -W CONSTRUCTION CO. SETTLEMENT ACCEPTED: Frank M. Opeka, City Attorney,
then presented the following proposed resolution which was read by the Clerk:
RESOLUTION
WHEREAS, there is pending in the Circuit Court of Cook County, a
certain suit, case number 38 C 6053, wherein the City of Des Plaines
is the plaintiff and B -W Construction Company and American Surety
Company of New York are the defendants; and
WHEREAS, an offer of settlement by the defendants in the above said
cause has been made whereby the said defendants, B -W Con8truCtion
Company and American Surety Company of New York offer to pay the sum
of Eight Thousand Five Hundred ($8,500.00) Dollars in full settle-
ment of said cause; and
WHEREAS, the City Council has been fully advised as to the advisability
of accepting said offer of settlement;
NOW, THEREFORE, Be it resolved by the City Council of the Qity of
Des Plaines, Cook County, Illinoisr that the offer of the B -W Con-
struction Company and the American Surety Company of New York to
pay Eight Thousand Five Hundred ($8,500.00) Dollars In settlement
of the City's cause of action against the said B -V Construction Co,
and the American Surety Company of New York, Circuit Court of Cook
County Cas no. 38 C 6053, be accepted.
BE IT FURTHER RESOLVED, that upon receipt of said settlement check,
the City Clerk is instructed to pay Rosen, Francis 6' Cleveland,
Attorneys at Law representing the City in said matter, the balance

BE IT FURTHER RESOLVED, that the Mayor and City Clerk are hereby
authorized to execute any and all necessary releases on behalf of the

resolution be adopted. The motion was voted upon by acclamation whereupon the
Mayor declared the motion unanimously carried and the said resolution adopted.
SUGGESTS WIDENING OF GRACELAND AVENUE SOUgTH OF THACKER STREET: Alderman
Kehe then read the following letter:
November 13, 1942
858 Graceland Avenue, Des Plaines
Mr. Henry Kehe - Alderman
Dear Henry:
I wish to call your attention to the bottle neck left in the
pavement on south Graceland beginning directly in front of
my home.
There has been considerable comment on this, as it not only
effects the South Graceland Avenue -residences, but also the
entire south side by-ond the Soo Line Tracks.
The general opinion has been that this section of pavement
should have had preference to Garland Place.
Mill jaou please bear this in mind and present it at the proper
time.

Mayor Garland stated that the improvement referred to in the foregoing letter is
scheduled as the next improvement to be made-with.Motor Fuel Tax Funds, and will
be started as soon as funds permit. He then referred this letter to the City
Engineer with instructions to write Mr. Scharringhausen setting forth the Council's
intentions in -this matter.
SAYS ELLINWOOD STREET NEEDS REPAIR: Airman Loos then pointed out that
a number of holes have developed in the roadway of Ellinwood Street and asked that
the necessary repairs be made before sub -zero weather.

Mayor Garland referred this matter to the Superintendent of Streets for attention.
