CALL TO ORDER: The meeting was called to order by Mayor Charles H. Garland,
"Z preseding, with Aldermen Johnson, Pflughaupt, Kehe, Friott, Lemke, Schwanbeck and
Campagna responding to the roll -call. (Aldermen Loos and Dopheide were absent during
the entire meeting, while Alderman Carroll arrived later during the meeting). The
Clerk reported seven members of the Council present.

ENGINEER REPORTS ON FLOODED BASEMENTS: The Clerk then read the following
COMMITTEE REPORTS
To E.N. Fletcher, City Engineer, at the meeting of the City Council,
held September 8, 1942, the following matter was referred to you:
The letter dated Sept. 8, 1942 from Mrs. William Hoeninger (a
copy of which is hyped upon XN the reverse side hereof) was re-
ferred to you with instructions to interview Mrs. Hoeninger and
report your recommendations to the City Council.

To the Mayor and City Council:
Your City Engineer has reviewed Mrs. Hoeninger's letter and re-
commends that her suggestion of restricting the openings in street
drains be carried out. Infect this suggestion was made to your
Superintendent of Sewers sometime back and some work along this
line has already been performed.
In following out Mrs. Hoeninger's suggestions there are several
things which should be considered:
1. The restriction of the street drains must be made in such a
manner as to prevent the eloging of the Inlet Grates with ice and
snow during the winter months. In order to overcome this I re-
commend that the baffle plates be placed in the Catchbasins at the
outlet from the Catchbasin to the Manhole.
2. People will have to be educated to the fact that water standing
on the pavement does not affect their basements.
3. This is not a "Cure -All" for our inadequate storm sewer facilities.
While it may help in some areas it will not help to the extent that
all basement flooding will be eliminated for the following reasons;

a. The majority of the roof drains are connected to our sewers
and on a great number of our streets the roof area exceeds the
paved roadway Surface, therefore, we are controlling less than
half of the storm water going into our -sewers.
• b. Oar -sewers are so cross -connected that it will be necessary to
restrict the flow over a large area, in most cases, in order to
protect any one block.
c, The City of Des Plaines being buill• t along the bank of a river
by its location tends to block the natural drainage into the
river of areas beyond the City Limits. According to law we can
not block a natural drain. We are forced to provide -outlets
for drainage areas beyond IHt our City Limits whose natural
drainage has always been across what is now the City of Des Plaines
and into the Des Plaines River.
The flooding of Forest Avenue area is caused, to a great extent,
by such exterior areas.
In conclusion I recommend that the Superintendent of Sewers continue with
the work of restricting the flow of storm wateb into our sewers wherever
practicable to do so.
I have called Mrs. Hoeninger and thanked her for her constructige criticism
and suggestion.

WHEREAS there are ma rr parcels of real estate situated within the corporate
limits of the City of Des Plaines encumbered with many years of delinquent
taxes and special assessments, and
WHEREAS many of these parcels are so heavily encumbered that such delinquent
tames and special assessments exceed the maximum value of said properties,
and because of this situation, building of homes has been curtailed with the
resultant loss of revenue for corporate purposes, and
WHEREAS it is desired to solve this problem so that all of said property be
restored to the tax rolls, now, therefore,
BE IT RESOLVED by the City Council of the City of Des Plaines, Cook County,
Illinois, that there be and there is hereby created a "PROPERTY TAX INFORMATION
commission" wkich shall IMMIXXXMX consist of tjree persons who shall be appointed
by the Mayor with the consent of the City Council. The members shall serve for
a term of two years and until their successors are appointed.

shall make a study of the existing conditions; shall advise and consult
with the public when called upon to do so; shall examine all requests re-
lating to the foreclosure of special assessments; and shall, from time
to time, make a report of their findings and shall make their recommend-
ations to the City Council for further appropriate action.

effect from and after its adoption.

OBJECT TO REMODELLING FOR TWO-FAMILY USE: The Clerk then read the following
recommendation from the Zoning Board of Appeals:

Gentlemen:
The Zoning Board of Appeals of the -City of Des Plaines, at a regularly held
meeting after due notice thereof was given according to law, and at several
subsequent conferences have considered the request of Mrs. Mollie Klein of 1067
Des Plaines Avenue, Des Plaines, Illinois, on her appeal from the Building
Inspector's decision denying a permit for remodelling the above identified pro-
perty for two fa slily usage.
independent field examinations were made by several members of the Board, and
arguments were heard by the'Attorney for the Petitioner, and one resident opposing
the change. One letter opposing the change was received from an adjacent property
owner and one letter favoring the change was received from a similar soured.
The Zoning Board has placed little weight on statements made concerning the manner
in which the remodelling went forward, but concerned itself with the immediate
question of whether such two family usage in an area zoned for single family
dwellings would be detrimental to the health, safety, morals, or property values
in the locality. Along this line members of the Board pointed out that there is
very little river bank property available in Des Plaines and that such locality
is the most scenic in the entire city. It was also pointed out that across the
street in blocks lying westerly of the location in question, there have been old
established two family usages in a single family area, existing before the single
family restriction was INUMZX instituted.
It was particularly -noted that arguments concerning 6he provision of housing space
for defense workers in Des Plaines are unfounded on any demand by a war production
factory for housing its workers. The matter of income to an individual or that
individual's economic status could not be accepted as a reason for making the
variation.
The Board cited the case of Scaduto vs. Town of Bloomfield - Supremapi Court of
New Jersey, June 18, 1941, deriving therefrom a ruling concerning "unnecessary
hardship". In the Zoning Board's opinion, this factor is not valued in the
immediate case. A somewhat parallel case - Anderman vs. City of Chicago, Supreme
Court of Illinois, January 20, 1942, was also examined. The familiar ease of
Merrill vs. City of Wheaton, 356 I11. 457, was also discussed in the Board's de-
liberations.
The major consideration of the Board was the inadvisability of establishing a pre-
cedent for a great volume of two family remodellings which if uncontrolled would
tend to destroy and nullify the purpose of zoning regulation.
On the basis of the foregoing, your Zoning Board respectfully recommends that the
Building Inspector be sustained in denying the permit for remodelling the single
family dwelling for two family usage.

PROPOSE CONTRACT FOR BURNING GARBAGE FOR THE VILLAGE OF MOWNT PROSPECT:
Mr. James Walsh representing the Village of Mount Prospect, Illinois, then submitted
the following proposed contract:
CONTRACT
WHEREAS the City of Des Plaines owns and operates a garbage disposal
plant and;
WH tMAS the Village of Mount Prospect is without facilities for the
disposal of the garbage'of its inhabitants; and
WHIREAS the Village of Mount Prospect desires to have its garbage
disposed of in the garbage disposal plant of the City of Des Plaines;
NOW THEREFORE, it is agreed by and between the City of Des Plaines and
the Village of Mount Prospect, as follows:
1. The City of Des Plaines will accept froth the Village of Mount
'Prospect any and all garbage of the Village of Mount Prospect
,for disposal at the incinerator in the City of Des Plaines and
the City of Des Plaines will dispose of 'all of said MIN garbage
for the sum of $2.00 per ton.
2.r The City of Des Plaines assumes no responsibility of collecting
said garbage, but said garbage is to be`collected by the Village
of Mount Prospect and delivered to the incinerator in the City of
Des Plaines.
3. The City of Des Plaines will bill the Village of Mount Prospect
on the first day of each month for all garbage disposed of during
the preceding month and the Village of Mount Proppect agrees to
pay for said disposal service within thirty days from date of
billing.
4. It is expressly understood that all garbage collected in the Village
of Mount Prospect from homes and apartments must be wrapped in
paper before disposal into garbage cans or receptacles, as is
provided by the Ordinance of the City of Des Plaines governing the
collection of garbage.
5. It is further expressly understood, that this Contract is in no way
EMU meant to cover the disposal of rubbish, trash, tin cans or
junk.
6. This agreement is to remain in full force and effect for the period
