CALL TO ORDER: The meeting was called to order by Mayor Charles H. Garland presiding, with Aldermen Carroll, Johnson, Loos, Pflughaupt, Diopheide, Friott, Lemke, Schwanbeck and Campagna responding to the roll call. (Alderman Kehe was absend during this roll call but arrived during the early part of the meeting.) REPORT ALLES AVENUE REPAIRED: The Clerk then read the following report: COMMITTEE REPORT To the Chairman Campagna - Streets and Sidewalk's committee, at the meeting of the City Council, held August 3, 1942, the following matter was referred to your committee: The letter quoted below: "About two years ago, the pavement %( of Alles Avenue was being repaired, but before the completion of this task, the repair men were called from their jobs, leaving aboUt'150 feet of the street unpaved. At the present time, the pavement is in very poor condition. We, the undersigned, feel that if prompt attention is given to the re- pairing of the road, the basic pavement can be saved." NOT TO PUMP OUT BASEMENTS: The Clerk then read the following report: To the Chairman Loos, Fire Committee, at the meeting'of the City Council held June 1, 1942, the following matter was referred to your committee: The matter of whether or not the Fire DEpartment should remove water from flooded basements, was referred to your committee for study and recommendation. FRIEDRICH, Cita Clerk Des Plaines, Illinois, August 17, 1942 To the Mayor & City Council: Your Committee on Fire has investigated the aboge and has found: That puOlping water from flooded basements should not be done by fire fighting equipment and firemen, the fire fighting equipment is not designed to pump sewerage water. DOUGLAS AIRCRAFT COMPANY REPLIES ON HOUSING:: The Clerk then read the following letter: Mr. Edgar J. Friedrich City- Clerk, City of Des Plaines City Hall, Des Plaines, I11. Dear Mr. Friedrich: August 4, 1942 May we acknowledge receipt of your letter of July 22nd, enclosing copies of the Resolution of July 6th, regarding the construction of defense homes within the City of Des Plaines. It is very Wilialig gratifying to the Douglas Aircraft Company that the City of Des Plaines is taking the initiative in this problem, as we feel that the local communities are the most qualified to guide the housing programs. As you can understand, the Douglas Aircraft Company must concern it- self primarily with the construction of the factory and the inaugur- ation of production of airplanes within the factory. We feel that we have our hands full in this problem alone and that we are not qualified to take part actively in the housing programs. It is naturally our desire that our employees be comfortably and adequately housed in locales with- in convenient distances from the factory and, therefore, we wish to express our appreciation to the City of Des Plaines for its initiative and activity towards that end. TO REVISE BUILDING CODE FOR DEFENSE HOUSING: The Mayor then pointed out the necessity of revising the City's Building Code if we hope to attract build- ing under the war housing program. He referred this matter to -the Committee on Subdivisions, Building and Municipal Development. STATE APPR0VED CONTRACT FOR M.F.T. * SECTION 9 -CS: The Clerk then read the following letter: August 11, 1942 Mr. Edgar J. Friedrich City Clerk Des Plaines, Illinois Dear Sir: The contract for the above section'was approved by this Department today. This approval only covers the approval required of the Dept. of Public Works and Buildings, State of Illinois, under the Motor Fuel Tax Act, and does not constitute approval under any Federal laws or regulations. This contract covers the construction of a concrete pavement 30 Ft. and 34 ft. in width, with combination curb and gutter and the concrete pave- ment one strip 15 ft. in width with combination curb and gutter which widens angi existing 20 ft. pavement to 36 ft. ttf-f" of curbs, together with the necessary grading and draingge structures, for a length of 1956 ft. on Arterial Streets 4 and 7, Thacker Street from Wolf Road to Fifth Avenue and Garland Place from Miner Strut to Rand Road. (M.F.T.-Section 9 -CS - cont'd) We are authorizing payment. of $13,880.11 which is the present balance available. Additional payments will be made as funds are allotted. We connot, however, assume any responsiblity for such funds being available. Three approved copies of the contract are being returned herewith. Very truly yours, Geo. H. Baker Engineer of County Roads and City Streets Mayor Garland ordered the said letter placed on file. CHARLES FORBERG APPOINTED INSPECTOR FOR M.F.T. SECTION 9 -CS: The Mayor then announced the appointment of Charles Forberg as inspector for M.F.T. Section 9 -CS. The motion was made by Alderman Johnson and Schwanbeck to confirm the said appointment. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried and the said appointment confirmed. FIRST READING - ORDINANCE AMENDING ZONING ORDINANCE: The Clerk then read the following recommendation: To the Honorable Mayor and City Council City of Des Plaines Des Plaines, Illinois Gentlemen: July 24, 1942 Your Zoning Board of Appeals in taking action on a petition signed by a number of residents of Cumberland Terrace Subdivision concerning a tract of land hereinafter described, duly published notice and convened a public meeting for the purpose of hearing objections against a proposed change of zoning from -industrial to residential use. Description of Tract A tract of land bounded on the North by Washington Street, on the South by Maine Line Des Plaines Valley Railroad Track, on the East by the City Limits of the City of Des Plaines, and on the West by the West Wye track of the Des Plaines Valley Railroad. For the information of the Mayor and the City Council, your Zoning Board submits that some three. years ago, the Northyvestern Railroad petitioned that this parcel be zoned for industrial use. Although the opinion of the Zoning Board at that time was that industrial usage for this tract was not its highest and best use, it was necessary to grant the petition in view of the probability that the Railroad was in a position to disannex the, territory in the event that the petition was denied. Consequently the Zoning Board would lose all jurisdiction over this tract and in view of its proximity to one of the best parts of the City, it was deemed advisable to make this concession in the interest of adjacent property owners. Since that time, however, the County Zoning Ordinance came into being which gave municipal bodies control over territories adjacent to their limits. In view of the fact that the obove mentioned necessity is now obviated, the Board voted unanimously restore the original residential zoning of the parcel, and also becuase no objectors to the proposed change appeared at the meeting. The Zoning Board therefore recommends that the necessary council action be taken to reclassify this property to residential zoning District A. T.R. Napieralski, Secretary Des Plaines Zoning Board of Appeals. and followed by reading the following proposed ordinance for first reading: (ORDINANCE --cont'd) AN ORDINANCE AMENDING AN ORDINANCE ENTITLED "AN ORDINANCE TO CLASSIFY, REGULATE AND RESTRBCT THE LOCATIONS OF TRADES AND INDUSTRIES AND THE LOCATION OF BUILDINGS DESIGNED FOR SPECIFIED USES; TO REGULATE AND LIMIT T. INTENSITY OF THE USE OF LOT AREAS AND TO. REGULATE AND DETERMINE THE AREA OF YARDS, COURTS AND OTHER OPEN SPACES WITHIN THE SURROUNDING SUCH BUILDINGS, AND TO ESTABLISH 2HE BOUNDARIES OF DISTRICTS FOR THE SAID PURPOSES AND PRESCRIBING PENALTIES FOR THE VIOLATION OF ITS PROVISIONS" PASSED ON THE FIFT DAY OF FEBRUARY, AL D. 1923, AS HERETOFORE AMENDED. WHEREAS, the Zoning Board of Appeals of the City of Des Plaines, at a MUM meeting duly called and held according to law, considered the question of reclassify- ing from Industrial district, Area District C, to residence district, Area District A, the real estate hereinafter referred to; AND WHEREAS, this Council, after considering the recommendation of the said Zoning Board finds, and this Ciuncil believing that the highest and best use for said land is for residence purposes: THEREFORE, BE IT ORDAINED by the City Council of the City of Des Plaines, Cook County, Illinois: SECTION 1. That an Ordinance entitled "An Ordinance to Classify, Regulate and Re- strict the Locations of Trades and Industries and the Location of Buildings Designed for Specified Uses: To regulate and Limit the Intensity of the Use of Lot Areas and To regulate and Determine the Area of Yards, Courts and Other Open spaces within and Surrounding such Buildings and to Establish the Boundaries of District for the said Purposes and Prescribing Penalties for the Violation of its Provisions" passed on the fifth day of February, 1923, as heretofore amended be amended by reclassifying from industrial district, Area District C, to residende district, Area District A, the following described real estate: The Ej of the E* of the Southwest fractional quarter of Section 18 and all that part of the W2 of the SE* of said Section 18 which lies west of a line drawn parallel with and 800 feet distrant, at right angles easterly from the center line of the r' Test Wye track of the Chicago and NorthWestern Railway Company, as said track is now located and established, and northwesterly of the southeasterly right of way line of the main line right of way of the so- called Des Plaines Valley Company, all EMI situated in Township 41 North, Range 12 East. SECTION 2. That said land as reclassified shall be subject to all limitations and conditions placed upon properties in residence district, Area District A, as defined in said ordinance hereinbefore mentioned. SECTION 3. All ordinances, or parts of ordinances, conflicting with the provisions of this ordinance are hereby repealed so far as they conflict herewith. SECTION 4. Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance she » be fined not less than Twenty-five Dollars ($25.00) nor more than Two Hundred Dollars ($200.00) for each offense. Each day that a violation is permitted to exist shall constitute a separate offense. SECTION 5. This Ordinance shall be in full force and effect from and after its passage, approval and publication, according to law. Passed this day of A .D .1942 City Clerk APPROVED this day of A.D.1942. Mayor The Mayor ordered the said proposed ordinance filed WEE for second reading. ORDER FILING OF ORIGINAL ORDINANCE VACATING ALLEY: The Clerk then read the following letter: (Letter - conttd) Mayor and Members of the City Council Des Plaines, Illinois Gentlemen: August 17th, 1942 Pursuant to your request I have gone into the matter of the Ordinance heretofore passed vacating certain alleys in a portion of the South side commonly called Riverview. Since the city has passed an ordinance vacating these certain alleys, it would not be proper to pass another ordinance, even though referring to the former, inasmuch as the records show the passage of the original ordinance, and therefore, there is nothing to vacate. And to avoid any other complications, it is suggested that the City Clerk be authorized to record the original ordinance as therein directed, though not complied with by the former clerk, In that manner, the question will be definit- ely established. As far as the use for utilities are concerned, that is a private matter between the ownerw of the vacated portions and the owners of the utilities. The City would have no power at this time to make any reservation because the record disclosed the adoption of that ordinance, and a repealing or- dinance would not cure the matter. COUNTY MAINTENANCE OF SEEGERS ROAD AND CAMP GROUNDS ROAD: The Clerk then read the following letter: said original or - To the Honorable Mayor and Members of the City Council, City of Des Plaines, Des Plaines, Illinois Re: Gentlemen: August 14, 1942 Section 120-0101 Seegers Road Section 126-0505 Camp Ground Road. The Board of County Commissioners of Cook County designated, as an extension of a State Aid Road, Seegers Road between Wolf Road and the East City Limits, and Camp Ground Road from Algonquin Road to the Northwest Highway within the City of Des Plaines, which design- ations were .approved by the State Highway Department. The Road and Bridge Laws of the State of Illinois provided that the County may maintain. such extensions of State Aid Roads within cities and villages upon the respective municipality petitioning the County to assume such maintenance and upon the approval of the State Highway Department. In the event that that procedure is not followed the maintenance of the road is the responsibility of the municipality. I am therefore calling this matter to the attention of your Council with the request that if it is your wish that the County assume the maintenance of the above mentioned streets within your City the accompany- ing ccompanying resolution be adopted and three certified copies returned to me whereupon I will transmit them to the County Board for its conOideration. and action. QUINLAN Superintendent of Highways, Cook County, Illinois RES 0 L U T I 0 N WHEREAS, Seegers Road between Wolf Road and the East City limits, and Camp Ground Road from Algonquin Road to the Northwest tog Highway have been de- signated by the Board of County Commissioners of Cook County as an extenZion of a State Aid Route, and WHEREAS, it is the desire of this Council that the County assume the maintenance of those streets, THEREFORE BE IT RESOLVED that the Board of County Commissioners of Cook County be and is hereby petitioned to assume such maintenance, and ' BE IT FURTHER RESOLVED that three certified copies of this Resolution be trans- mitted to the Superintendent of Highways of Cook County. UNITED MOTOR COACH COMPANY SUBMITS "VICTORY STOP" SCHEDULE: The Clerk then submitted a map prepared by the United Motor Coach Company showing its proposed schedule of so called "Victory Stops" as recommended by the Office of Defense Trans- portation. He further submitted the request of the motor coach company asking that permission be granted to paint the words "Bus Stop" upon the curb to mark each station. The motion was made by Alderman Pflughaupt and^Kehe to refer this matter to the Streets and Sidewalks Committee with full power to act. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried. SUGGESTS AUXILLIARY WATER SUPPLY FROM NEW DOUGLAS AIRCRAFT COMPANY PLANT: Alderman Lemke, chairman of the Water Committee, then reported that the new Douglas Aircraft Company plant at Higgins and Mannheim Roads will be supplied with water from Chicago through a new 36 inch main, and suggested that Des Plaines take advantage of this arrangement and attempt to connect to the said main for emergency purposes. The motion was made by Alderman Lemke andAFriott to authorize and direct the City Attorney to negotiate with theDouglasAircraft Company for an auxilliary water supply for Des Plaines. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried. TO FORM COMMITTEE ON TAX INFORMATION: Upon suggestion of the Mayor the motion was made by Alderman Dopheide andyLemke to instruct the City Attorney to prepare a resolution authorizing the appointment of a committee on tax information. The motion was voted upon by acclamation whereupon the mayor declared the motion carried. ACT TO CLEAN UP N.E. CORNER OF TFT AND PERRY STREETS°'The motion was made by Alderman Carroll andvFriott to instruct the Clerk to write the owner of the premises on the northeast corner of Lee Street and Perry Street ordering him to clean WAX up the premises within ten (10) days. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried. WANT S00 LINE CROSSINGS REBUILT: Alderman Dopheide then reported that while 7 the Soo Line crossings have been repaired after a fashion, they are still far from sat- isfactory. The motion was made by Alderman Dopheide andAFriott to order the City Attorney to file a formal complaint against the Soo Line Railroad with the Illinois Commerce Com- mission petitioning, the said commerce commission to order the said crossings sat- isfactorily repaired. However the motion was made by Alderman Loos andACampagna to instruct the Clerk to first telephorn the Soo Line Railroad officials informing them that such complaint is about to be filed. The Mayor put the question on the amendment and the Clerk called the roll with the following result: Ayes; Aldermen Carroll, Johnson, Loos, Pflughaupt, Depheide, Kehe, Friott, Lemke, Schwanbeck and Campagna. Nays; None. The Mayor thereupon declared the motion carried.
