07/20/1942MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES HELD IN THE COUNCIL CHAMBERS, MONDAY, JULY 20, 1942, AT 8:00. P.M. 699 CALL TO ORDER: The meeting was called to order by Mayor Charts H. Garland presiding, with Aldermen Carroll, Johnson, Loos, Pflughaupt, Kehe, Friott, Lemke, Schwanbeck and Campal agna responding to the roll cl. (Alderman Dopheide was absent during the entire meeting.) The Clerk reported nine (9) aldermen present. SEMI-ANNUAL FINANCIAL REPORT: The Clerk then submitted a semi-annual financed report showing the results of operations for the first half of the 1942 Fiscal Year. The report compared appropriations with expenditures and showed the relation between revenues realized and expenditure incurred. Each member of the Council was supplied a copy of the said report. INSURE MUNICIPAL BUILDING AND CONTENTS: The Finance Committee through its chairman Alderman Pflughaupt, then submitted the mum following report: COMMITTEE REPORT To the Chairman Pflughaupt - Finance Committee, at the meeting of the City Council, held June 1, 1942, the following matter was referred to your committee: The matter of making an appraisal of the contents of the Municipal Building for insurance purposes. EDGAR J. FRIEDRICH,City Clerk Des Plaines, Illinois, July 6, 1942 To the Mayor & City Council: Your Committee on Finance has investigated the above and has found: that the contents of the Municipal Building has never been insured. The contents consisting of Office Furniture and equipment, Police Dept. Equipment, files, chairs, records and supplies amount to approx- imately $8000.00. We, your Committee do Finance, therefore have secured the rate covering the contents for fire and extended coverage. The rate is .80 per $100.00 for a three year period, and have placed an order for this in- surance in the amount of $6000.00. The premium amounting to $48.00 On June 25th the insurance expired covering the Municipal Building (City Hall Property). The committee has procured rates and have placed an order for the renewal of this insurance for Fire and Extended coverage "in the sum of $70,000.00. HOUSING IN CONNECTION WITH DOUGLAS AIRCRAFT PLANT: The Committee on Subdivisions, Building and Municipal Development through its chairman Alder- man Kehe then reported that the Federal Housing Administration as well as the National Housing Agency has given tentative assurance that I every possible effort will be made to grant the 500 priorities for defense housing which were requested by the City Council by resolution. However no indication was given as to how many priorities would be allatted to Des Plaines, nor when the allotment would be released. REVIEW OF PENDING LITIGATION: The Clerk then read the following letter: JUly 6, 1942 City Council City of Des Plaines Des Plaines, Illinois Gentlemen: In taking over the duties of City Attorney, I submit herewith the status of pending litigation, -insofar as it has been brought to my attention, and as affecting the City of Des Plaines, as of July 1st, 1942. 1. Special Assessment No. 117, in repetition -of John Boechenhauer, County Court. Set for hearing on July 28th,at 10:oo A.M. 2. -Rexford Hawley, Admr. etc. -vs--City of Des Plaines and others - Circuit Court #41 C 5412. Pending on pleadings. 3. Swedish American National Bank of Rockford - vs- City of Des Plaines. Diversion suit in the Circuit Court #36 C 11712. Judgment for #9959.95 entered on December 19, 1941. Pending for issuance of Certificate of Indebtedness for $1780.12, to be paid out of Special Assessment funds when collected. 4. Cumberland Terrace Sewer. Special Assessment #149. 5 objections filed. Hearing on objections to be set for trial at an early date. Roll confirmed as to all others. 5. Walgreen vs. Charles Galland, etc. Superior Court #42 S 317. Pending on appeal to the Supreme Court. Abstract of Record due in Supreme Court on July 18th,1942. 6. Special Assessment, grading and paving Pine and other Streets. Superior Court $ #512453. Effecting Lot 1 Florence Subdivision upon an award of 33 feet for street purposes. Improvement not completed, and apparently aband- oned. Action to be dismissed. 7. Petition of John Boechenhauer to disannex. County Court #97187. Order to disannex all but 40 ft. s treet,entered on March 11, 1941. Pending for disposition of disputed 40 feet which is part of Thacker Street. 8. City of Des Plaines vs. B & W. Construction Co. et al. In Circuit Court. CLAIM FOR DAMAGES - EMIL KRANZ: The Clerk then read the following report:, July 20th, 1942 To the Mayor and City Council, Des Plaines, Illinois Re: Claim of Emil Kranz, 1544 Henry Avenue Accident - 6/9/42 • at Prospect & Maple Streets. Collission with man -hole. Gentlemen: Investigation of the above matter referred to me discloses as follows: The catch -basin on man -hole in question is in bad condition, from the stand -point of maintenance and preservation and from the hazard it creates. Immediate steps should be taken to cor- rect this defect thereby eliminating the possibility of a serious claim. The man -hole is located in the south-west corner of the above intersection and is a few inches from the edge of the street, though not paved, is covered with cinders. It is surrounded by large stones and boulders which are visible. If a curb existed at this point, the man -hole would be just inside the curb. It is evident that Mr. Kranz, who was driving east on Proppect made a very short turn south into Maple Street, and in so doing drove the rear of his car into this hole which is open at the edge of the street. A person using ordinary care could not have hit that defect which is off the road. Accordingly, the claimant not being in the exercise of ordinary care, it is recommended that his claim be denied. CUMBERLAND TERRACE STREETS: The Clerk then read the following lettet: June 24, 1942 The City of Des Plaines Des Plaines, Illinois Attention: Mr. Edgar J. Friedrich, City Clerk Gentlemen: We have your letter of June 19th concerning streets in Cumberland Terrace. In the fall of 1941 the officials of the 'ity of Des Plaines ruled that no more building permits would be issued for Cumberland Terrace until the sewer disposal question had been settled to the satisfaction of the city officials. To date this question remains unsolved and in view of this, we have not been able to dis- pose of a considerable number of vacant lots in the subdivision which are still owned by this Trust. When the sewer question has been finally solved and the property is again salable, we will be in a position to cooperate with the city officials and property owners on having a dust proof surfacing applied to streets not treated in the past. VACATING ALLEYS - ORDINANCE REFERRED TO ATTORNEY: The Clerk then read tilr second reading a proposed ordinance entitled: AN ORDINANCE VACATING CERTAIN PARTS OF THE ALLEYS IN BLOCKS TWO (2), THREE (3). FOUR (4). FIVE (5) IN WHITE'S STEEL CAR ADDITION TO RIVER - VIEW. IN SECTION TWENTY-EIGHT (28). TOWNSHIP FORTY-ONE (41 NORTH. RANGE TWELVE (12) EAST OF THE THIRD PRINCIPAL MERIDIAN IN THE CITY OF DES PLAINES. COOK COUNTY. STATE OF ILLINOIS, There being some question with respect to certain facts pertaining to this proposed ordinance, the Mayor referred the same to the City Attorney for further study and recommendation. ADVERTISE FOR BIDS FOR PAVING GARLAND PLACE - M. F. T. SECTION 9 -CS: The Clerk then read the following proposed resolution: A RESOLUTION FOR THE IMPROVEMENT OF THACKER STREET, AND GARLAND PLACE, IN THE CITY OF DES PLAINES AND ESTABLISHING THE PREVAILING WAGE RATE SAID IMPROVEMENT. WHEREAS, the Plans and Specifications for the improvement of Thacker Street (RESOLUTION-cont'd) and Garland Place have been prepared by the Engineer for the City of Des Plaines and approved by the City Council, and WHEREAS, the Plans and Specifications for said improvement have now been approved by the State of Illinois Divisitn of Highways, THEREFORE, BE IT RESOLVED, by the City Council of the City of Des Plaines that an advertisement for Bids returnable before 8:00 P.M., Monday, August 3, 1942, for the Improvement}f of Thacker Street and Garland Place be placed in the Des Plaines Journal Said improvement to be known as Section 9 -CS and to be paid for from money received from the Motor Fuel Tax Fund. EARMARK MONEYS DERIVED FROM SALE OF OLD ORNAMENTAL LIGHT -POST HEADS: Alder- man Campagna, chairman of the Streets and Sidewalks Committee then reported that 60 ornamental light -post heads have been sold to the Village of Hinsdale for the sum of $750.00. The motion was made by Alderman Campagna and Loos that this sum be earmarked for the purpose providing more efficient street lighting units. The Mayor put the question and the Clerk called the roll with the following result: Ayes; Aldermen Johnson, Pflughaupt, Loos, Kehe, Friott and Campagna. THISTLES AND NOXIOUS WEEDS: Alderman Kehe then reported a complaint re- garding Canada Thistles from Mr. John Stueber, and Mr. William Lagerhausen both of the 1100 block on Margret Street, Mayor Garland ordered the Police Department to notify the owners of the property involved to mow the said thistles forthwith.
