COUNCIL OF THE CITY OF DES PLAINES HELD IN
THE COUNCIL CHAMBERS, MONDAY, JUNE 15,1942,
AT 8:00 P.M.
CALL TO ORDER: The meeting was called to order by Mayor Charles H.
Garland presiding with Aldermen Carroll, Johnson, Loos, Pflughaupt, Kele, Friott,
Lemke, Schwanbeck and Campagna responding to the roll call. (Alderman Dopheide
was absent during the entire meeting.)- The Clerk reported nine (9) aldermen
present. .
.HENRY AVENUE DELEGATION PROTESTS FLOODED BASEMENTS: Alderman Pflughaupt
then introduced Dr. John M. Hannon as spokesman for'a delegation representing the
residents.of the 1600 block on Henry Avenue. Dr. Hannon reported that for years
these residents have had sewerage back up into their basements during heavy rains,
and that the delegation has come to the City Council seeking relief. After some
informal discussion the Mayor referred the matter to the Committee on Sewers, San-
itation and Health for -study and recommendation.

the property in an effort to have him put a wooden cover over the
same.
If the owner cannot be contacted it may be well for you to see
that it is covered.

CASE OF O'ROURKE VS. CITY DISMISSED: The Clerk then read the following

.Des Plaines, Illinois
Gentlemen:
Please be advised that.the case of OtRourke against the City of
Des Plaines, Circuit Court of Cook County, 41-C-625, was dismissed
without costs on June 5, 1942.
This was an accounting suit filed against the City involving bonds
issued against Des Plaines and was assessment number one -hundred.
The City Treasurer and I were successful in working out an adjustment
with the plaintiff to the mutual satisfaction of the plaintiff and the
City.

EMIL KRANZ; CLAIM FOR DAMAGES: The Clerk then read the following letters
June 10, 1942
City of Des Plaines, Des Plaines, Illinois
Gentlemen:
On Tuesday, June 9th at about 5:45 P.M. one of our assureds, Mr.
.Emil Kranz of 1544 Henry Avenue, Des Plaines, while turning the corner
of Maple and Prospect Avenues, slid into the unprotected sewer at the
corner, and damaged the right runningboard and the right rear fender
of his automobile.
The matter was reported to our local police department.
While the damage to Mr. Kranz's automobile is almost negligible,
we believe it well to report this happening, so that necessary measures
can be taken to prevent.more costly accidents in the future.
We also believe the City of Des Plaines will reimburse Mr. Kranz
to the amount shown on the enclosed estimate for repairs.
We would appreciate your earliest attention to this matter.

To the Mayor and City Council
City of Des Plaines, Illinois
Gentlemen:;
For the past nine and a half years I have had the privilege and pleasure of
representing you and the City of Des Plaines as City Attorney, and have en-
deavored during that term to serve you and the City to the best of my ability.
During the past year my private practice and the legal affairs of the City have
increased to the point where I find it impossible to give both my private
practice and the City's affairs the time they both require. Therefore, I have
decided in the interest of all concerned that it is advisable that I relinquish
the City of Des Plaines as a client, and accordingly herewith tender my re-
signatioh a s City Attorney for the City of Des Plaines to take effect July 1,
1942.
I have had the privilegeduring the past nine years to serve under three mayors
and a great many differedt aldermen. I can sincerely say that I have enjoyed
my -contacts and association and cooperation with all the officials who were in
office while I was Cit; Attorney. -
It is interesting to note that since 1883, the City of Des Plaines has had
nine village or city attorneys, and in the point of continuous service, nr term
of service ranks third, Ning Eley having served sixteen consecutive years and
C. S. Cutting having served ten consecXutive years.
In the nine and a half years of my service, I have witnessed some very bitter
contests on the council floor and also some very harmonious cooperation between
the opposing political fanctions, and in the main, it can be truthfully said
that the supreme effort of all councils has been in the interest and welfare of
the City, and personalities and minor bickering has been subordinate.
I extend to the present administration my sincere thanks and appreciation for
their friendliness and cooperation with me and stand ready as a private citizen
to assist you in any manner within ter ability.

declared the motion carried and the said resignation accepted.
SUGGESTS REDUCIING SALARY OF, CITY ATTORNEY: Mayor Garland then stated
that ){%j he is not prepared to announce the appointment of a city attorney to suc-
ceed Mr. Meyer, but suggested that -the salary of City Attorney be reduced from
$2,500.00 per year to $1,800.00 per year. However, no action was taken regarding
this matter.
GRASS AND TREE CLIPPINGS TO BE COLLECTED: Mayor Garland then called the
Council's attention to the fact that in the past such yard rubbish as grass clip-
pings and tree trimmings have not been gathered by the garbage department even
though the ordinance pertaining to garbage and rubbish removal specifies that "All
trimmings from trees, hedges, shrubs, plants, weeds and grass clippings, and other
miscellaneous waste as cannot be placed in garbage receptacles shall be deposited
in a compact pile near them, so that the same may be removed conveniently." The
Mayor ordered the Superintendent to comply with the ordinance and cause such yard
rubbish to be collected.
AUTHORIZE PURCHASE OF GARBAGE TRUCK: Alderman Carroll, Chairman of the
Committee on Sewers, Sanitation and He.lth then reported that one of the garbage
trucks is in very poor condition, and that Mr. Charles Gatzke has a suitable truck
which he has offered the City for the sum of $585.00. The motion was made by Alder -

man Carroll and Lemke to authorize the Superintendent of Sanitation to purchase
the said truck. The Mayor put the question and the Clerk called the roll with

Friott, Lemke, Schwanbeck and Campagna. Nays; None. The Mayor thereupon de-
clared the motion carried.
DISCUSS SEWER CLEANING EQUIPMENT: Alderman Carroll, chairman of the
Committee on Sewers, Sanitation and Health then suggested that the Council con-
sider purchasing a Sewer -cleaning unit as offered by the Flexible Sewer Rod
Company for the sum of about eight hundred dollars. The motion was made by
Alderman Carroll andAFriott to refer this matter to the Committee on Sewers,
Sanitation and Health for study and recommendation. The motion was voted upon
by acclamation whereupon the Mayor declared the motion carried.
