DILAPIDATED BUILDING ON CIRCLE AVENUE: The Clerk then read the following reports COMMITTEE REPORT: To the Chairman Kehe- Committee on Subdivisions, Building & Municipal Development Committee, at the meeting of the City Council, held May 4, 1942, the following matter was referred to your committee: The following memorandum submitted to the Council by the Building Inspector; was referred to your committee for investigation and report: "Several complaints have come in by phone and in person regarding the delapidated condition of a 2 story building on the East side of Circle Ave. north of Prospect. This building was formerly used as Commercial first floor.' Would suggest that the municipal development committee visit this'building along with Fire Marshall W.Lagerhausen and make recommendations as to what can be done to correct this situation. June 1, 1942 To the Mayor and City Council: Your Committee on Municipal Development has investigated the above and has found: that the two story building is in a very delapidated condition, with some of the windows broken and closed up with boards, in spite of the fact that two flats are occupied. Fire Marshall W. Lagerhausen has made a definite request that all glass be replaced and that said building be made suitable for living quarters. The old barn has been removed and owner has been notified to also remove an old shed building. This committee together with the Fire Marshall will see that all re- quests made will be carried out. NO COMPLETION BONDS FOR BUILDING PERMITS: The Clerk then read the following report: COMMITTEE REPORT To the Chairman Kehe, Committee on Subdivisions, Building & Municipal Development Committee, at the meeting of the City Council, held on May 4, 1942, the following matter was referred to your committee: 677 (COMMITTEE REPORT - cont'd) The question as to whether or not it would be advisable for the City of Des Plaines to adopt the practice of demanding a sub- stantial cash deposit in connection with the issuance of build- ing permits, to serve as a completion bond for the building to be built under the said permit. The cash deposit could then be used by the City to wreck any such buildings as might not be completed. It was reported that this practice is in operation, in several of our neighboring communities, one of which I believe was Riverside, Illinois. EDGAR J. FRIEDRICH City Clerk Des Plaines, Illinois,June 1, 1942 To the Mayor and City Council: Your Committee on Municipal, Development has investigated the above and has found: I have personally contacted the Building Inspectors of the following cities of: Evanston, Riverside, Winnetka and Wilmette and have been informed by all of the Building Inspectors that they have no such ordinance and there- fore make no request for a cash deposit nor completion bond. All applications for building permit are carefully checked as to their responsibility and consequently have had no uncom- pleted buildings, I.have also taken this matter up with the Aetna Casualty andSurety Co. who informed me that- such a bond could not be obtainable from any Surety Company at this time due to the fact that at the present time there are many govern- ment rules and regulations and could have an effect on the com- pletion of any building. FRIEDDRICH, City Clerk Des Plainesi 1942 Tb the Mayor and City Council: Your Committee on Finance has investigated the above and has found: Two major policies- Workmen's Compensation and Automobile B.I. and P.D. had expired. We invited five local agents to submit bids, all letters being identical. Your committee awarded the Workmen's Com- pensation Insurance to the Des Plaines Agency and the Automobile Insurance to the Des Plaines Realty Company, each being low bidders in the respective policies. A fire insurance policy in the Municipal Building expires June 21, this year. It may be desirable to revise this policy to cover pres- ent needs. We will report on this later. Meyer, City Attorney, at the meeting of the City Council, held May 184 1942, the following matter was referred to you: The following memorandum submitted by the Building Inspect- or was recommitted to you with instructions to conta ct the owner in an attempt to have him finish the job in accordance with his building permit: "Have had several complaints in person and by phone concern= ing a party completed building, at N.E. Corner of Garland Place and Miner Street owned by Fra nk Zaleski, who took out permit to remodel and later another permit to move from original foundation into another portion of lot, house was moved onto excavated basement, no walls under. APPELLATE COURT REMANDS B -W CASE FOR RE-TRIAL1 The Clerk then read the following letter: June 1, 1942 City Council Des Plaines, Illinois Re: B. - W. Construction Company Gentlemen: I am pleased to inform you that on Wednesday, May 27, the Appellate Court of Illinois rendered a decision in favor of the City by revers- ing the ruling of Judge Michael Feinberg of the Superior Court. You will recall that the City sued B. -W. Construction Company for damages for their failure to proceed with the construction of the water softening plandt and we sued the American Surety Company, who was the surety on their performance bond. At the close of the plaintiff's evidence before Judge Feinberg, he in- structed the jury to find the defendants not guilty on the theory that the City had not made out a prima facie case. We appealed this decision �--� to the Appellate Court and the decision of the Appellate Court sub- stantially mates as follows: 1 - That there was sufficient evidence presented by the City to warrant the case being decided by the jury. 2 - The suit by the City was brought within the proper time. 3 - The ,deflate Court further ruled that the City complied in every respect with the bond and the contract with respect to the requisite notice required to be given by the City in case of a defaulting contractor. The Surety Company contended that the suit shoupild have been filed six months after the B. -W. Construction Company refused to proceed with the work and the City claimed that the six month provision did not apply at all because B. -W. Construction Company failed to perform under the contract and the Appellate Court very definitely agreed with the City on this point. You will recall that the Surety Company has also contended that they were not given the full thirty days to take over construction because we ad- vertised for bids before letting thirty days go by after the BZ -W. Con- struction Company defaulted. It was ter opinion that we had a right to re - advertise for bids. The new contractor did not commence work until after the thirty days expired and the Appellate Court held with us on this point. The entire case was remanded by the Appellate Court to the Trial Court for re -trail so, unless the case is settled, the City will introduce again (but before a different Judge) the same testimony that it introduced at the previous trial. SOO LINE RAILROAD TO REPAIR CROSSINGS: The Clerk read the following letter: Stevens Point, Wis. May 20th, 1942 Mr. Kenneth G. Meyer City Attorney Des Plaines, Illinois Dea r Sir: I have your letter of May 15th in regard to complaint relative to the condition of various crossings in the City of Des Plaines. It is our intention to start in ivery near future putting in hard surface crossings on all streets within the city limits of Des Plaines. The work involves blacktop crossings on both tracks and between. There has been some delay in obtaining 680 (Letter - conttd) material, but it is now .all assembled and will be shipped in the very near future, and I am confident that the work will be completed with- in a period of thirty days or sooner. We have found it difficult to hire section labor in this vicinity and it has been necessary to ship in men from Wisconsin and Minnesota to work on the tack. However, we are about through with our ballasting and tie renewals and figure on getting started on the crossings immediately. This letter was order placed on C&N.W. OIL RIGHT-OF-WAY: The Clerk then read the May 17, 1942 Receipt is acknowledged of your letter of May llth concerning the possibility of our Company taking action soon to otl the track through the City of Des Plaines. I wish that I could give you some definite assurance as to what our program will be this year with respect to track oiling but I can not - bandidly I do not know at this time what we will be able to do. You may perhaps be familiar with the oil situation as it exists today - right at this time we are meeting with difficulty in obtaining oil for our various requirements and while I do not want to appear overly pessimistic there is presently some -doubt as to whether we will be able to obtain the oil that -would be required to permit of our carrying out our usual track oil- ing program. In addition to the oil supply problem there is also the matter of tank car equipment - tank cars today are being moved in prefer- ence to all other traffic - you may be familiar through recent publications in the press with restrictions that are now in effect covering the use of these cars. I can, therefore, only say to you that if there is any improvement in the oil and tank car situation as will permit us to carry out our usual program for oiling track, the necessary attention will•be given to the treatment of our tracks through Des Plaines. WAR PRODUCTION BOARD HALTS CROSSING IMPROVEMENTx Honorable Mayor and City Council Des Plaines, Illinois Gentlemen: The Clerk read the following June 1, 1942 Attached please find letter from War Production Board,dated May 12, 1942 in which fey refuse our request for a priority rating for the construction of the crossing imprtvements at Lee Street, Gra celand Avenue and Pearson St. This letter indicated that this proposed work, plans and specifications for which have been approved by the City Council and by the State Highway De- partment, will have to be postponed until after the duration. I suggest that a copy of the attached letter be mailed to the District Engineer of the C&N.W. Ry. Mr. C. H. Perry, at once in order that arrange- ments may be made to maintain the present wood plank crossings. Very truly yours, E.N. SECTION 9 -CS: The Clerk then read the follow- ing letter and submitted the plans referred to therein: June 1, 1942 Honorable Mayor and City Council Des Plaines, Illinois Gentlemen: Attached please find for your approval, complete plans for the improvement of Thacker Street, from Fifth Avenue to Wolf Road and for the improvement. of Garland Place. Said streets to be improved with concrete pavement and concrete curb and gutter in accordance with State Highway Specifications. You will note that all stela has been omitted in this proposed improvement and that the thickness of the pavement has been increased to 10 inches. By omitting all steel we will be allowed to proceed with this work as soon as funds are available and in as much as the slab has been increased in thick- ness there is no decrease in the quality of the pavement. '4 I recommend your approval of these plans for the improvement of streets which 0-4 are hard to maintain and are now in an unsatisfactory condition,, in order that we may improve these streets as soon as possible. 1 1 Very truly yours, E. We have made a diligent search throughlut Des Plaines to acquire an industrial site wherein we could carry on part of our operations but there are no in- dustrial sites available. As an alternative in the matter, we desire to carry on the assembly operations for our files in the premises known as 630 Pea rson Street, Des Plaines, Ili. 682 (Cont'd - LETTER #12) which premises are now zoned for commercial uses. SCHMOHL ASKS SETTLEMENT: The Clerk then read the following letter: 1435 Henderson Street Chicago, May 30, 1942 To Municipal Authorities of Des Plaines The Mayor and Aldermen Gentlemen: A proper settlement of claim against.City of Des Plaines is due F.J. Schmohl who is paying taxes on two lots trespassed upon and as result they are worth- less, for they are unsalable. In the last session something "phony" was put over and the result was no payment of damages for running a steam -shovel through lots 9 and 10 in Block 5 and placing water -pipes about 5 feet from the boundary of said lots. When the lawyer with the Irish Name told me that seven -hundred is all the City can arrange for, and I had hoped it might be more, I was compelled to sign a statment that I would not again sue the City and I received no cas h. I now know the place to report this matter and real justice will result. However, I will suggest you take agtion on the following: that you buy an 8 or 10 foot strip along the right-of-way of the Sioux Rwy, in which the water pipes are, and upon payment of a thousand dollars, I will render a deed for the land. PUMPING OUT FLOODED BASEMENTS: Mayor Garland reported that the heavy rains on May 30 and May 31, 1942,.flooded many basements in the City and brought many requests for the Fire Department to come and pump the water from basements. He requested an expression from the Council as tp what policy the Council, wishes the Fire Department to pursue in respect to such,requeseconded bsy The motion was made Alderman Loos and c wan ec that a a matter of policy the Flue Department shall not respond to calls for pumping water from flood- ed basements. SUGGESTS INSURING CONTENTS OF MUNICIPAL BUILDING: Alderman Kehe then called the Council's attention to the fact that the contents of the Municipal Building is not insured, and that an appraisal of the said contents should be made for insurance purposes. MORE BOYS ENTRAIN FOR ARMY: Mayor Garland then reported that a contingent of Des Plaines boys is scheduled to entrain for the array on Monday, June 8, 1942, at 7:30 A.M. from Park Ridge. He reported further arrangements are being made to honor these boys with a reception and farewell demonstration. REPORT DEATH OF MRS. ROSE RIECK: Alderman Pflughaupt then reported un- timely death of Mrs. Rose Rieck the beloved wife of Arthur Rieck,0o'Elect- rical Inspector. CALL TO ORDER: The meeting was called to order by Mayor Charles H. Garland presiding with Aldermen Carroll, Johnson, Loos, Pflughaupt, Kele, Friott, Lemke, Schwanbeck and Campagna responding to the roil call. (Alderman Dopheide was absent during the entire meeting.) The Clerk reported nine (9) aldermen present. . .HENRY AVENUE DELEGATION PROTESTS FLOODED BASEMENTS: Alderman Pflughaupt then introduced Dr. John M. Hannon as spokesman fora delegation representing the. residents.of the 1600 block on Henry Avenue. Dr. Hannon reported that for years these residents have had sewerage back up into their basements during heavy rains, and that the delegation has come to the City Council seeking relief. After some informal discussion the Mayor referred the matter to the Committee on Sewers, San,- itation and Health for study and recommendation. .REPORT OF FT.FCTRICAL INSPECTOR: The Clerk then read the following report: • June 15, 1942 .To The Honorable mayor & City Council: . r .During the month of May there were twenty;five (25) permits issued for the following installations: Twenty-one (21) new residences and four (4) remodeling.
