Garland then stated that the arrangements for honoring the contingent scheduled
to entrain Friday, May 15, 1942 had been assigned,to Mrs. Ella Raymond, Re-
creational Director. Mrs. Raymond reported that a reception will be held at
the Municipal Building in honor of the said contingent at 7:30 P.M. on
Wednesday, May 13, 1942. She further reported that arrangements are being made
to see the contingen off early Friday morning,and requested all members of

CALL TO ORDER: The meeting.was called to order by Mayor Charles
H. Garland with Aldermen Johnson, Pflughaupt, Kehe, Friott, Lemke, Schwanbeck
and Campagna responding to the roll call. (Aldermen Carroll, Loos and
Dopheide were absent during the entire meeting) The Clerk reported seven (7)
Aldermen present.
ARRANGE PAY -ROLL DEDUCTION PLAN FOR PURCHASING DEFENSE BONDS: The
Finance Committee through its chairman, Alderman Pflughaupt then read the
.following petition:
We, the undersigned officials and employees of the City
of Des.Plaines, do hereby express our willingness and
desire to help our country financially during the present
war.
Therefore, we petition your honorable body to pass a re-
solution sanctioning a voluntary payroll deduction plan
for the purchase of war bonds. The purchase of said bonds
by this method to be in effect for the duration of this
war.

After reading the said petition Alderman Pflughaupt introduced the following
proposed resolutions
RESOLUTION
WHEREAS The City Council of the City of Des Plaines has re-
ceived a petition signed by all City employees requesting the
said City Council to institute a pay -roll deduction plan by
means of which Defense Bonds may be purchased by the said
employees automatically by means of moneys deducted from each
pay check and set aside by the City for the purchase of such
bonds,
THEREFORE BE IT RESOVED that the City Council commend the
employees of the City of Des Plaines for their patriotism as
evidenced by requesting such a plan, and
BE IT FURTHER RESOLVED: That the said request of the City em-
ployees be granted, and that the City of Des Plaines institute
a pay -roll deduction plan for its employees for the duration of
the war, to assist the said employees in their purchases of
Defense Bonds, and
BE IT FURTHER RESOLVED: That the Mayor, the City Treasurer and
the City Clerk be authorized and directed to work out the pro-
cedural detail of the said plan and to put the same into operation
as soon as possible.

City Council, held May 4, 1942, the following matter was
referred to you:
Sanitary District of Chicago, "Permit for Sewage System No.942-8"
was referred to you for examination and recommendation.
This permit, as you may realize is the Sanitary District's author-
ity to construct our proposed Cumberland Terrace Sewer.
You will find original copy of the said permit attached hereto.
Please be sure to return the same with your recommendation.

agreement contains the same provisions with respect to our
liability for damages as was contained in the contract for the

is very broad, but the Sanitary District require the same provisions

I, your Attorney, therefore recommend the execution

The following memorandom submitted by the Building Inspector:
"Have had several complaints in person and by phone
concerning a partly completed building, at N.E. corner
at Garland Place and Miner Street owned by Frank Zaleski,

who took out permit to remodel and later another permit
to move from original foundation into another portion of
lot, house was'moved onto excavated basement, no walls under.
Now on blocking, and nothing being done to complete building,
what can be done about this?"

'Your attorney has investigated the above and has found": that
the condition complained of is on private property therefore
the City cannot go upon the property to cause same to be
removed, unless it could be proven that the structure is a
public nuisance and the court would then compel the owner to
remove the building.
While our Building Code (Section 230 to 237) contains a mode
of proceedure to remove unsafe buildings, I advise the Council
to be very sure of their case before proceeding under said
sections, for -the chances of a damage suit are too great.
If the building was not erected in accordance with the building
permit, the courts will compel the compliance with the Building
Code.

HAZARDOUS GREASING PIT AT VACANT FILLING STATION: The Clerk

To Kenneth G. Meyer, City Attorney, at the meeting of
the City Council, held May 4, 1942, the following matter
was referred to you:
The following memorandum submitted by the Building Inspector:
"There is an un -occupied filling station at the south
east corner of Des Plaines Avenue and Mill Street. On
these premises there is an open grease pit partly
filled^with water, creating a hazzard as there are
children playing around this un -occupied station,
no one in attendance at station to watch, making it
dangerous for anyone. There is a concrete guard about
8" high around pit, just enough to trip over. Recommend
that some definite action be taken before there is
someone hurt or even drowned.

Your attorney has investigated the above and has found: that
the alleged danger complained of is on private property and the
City would not be liable for any damages that might be sustained.
The City has no legal right to fill in the greasing pit. If the
condition complained of consitutes a public nuisance (and Ydeubt

that it does) the City could file suit to compel the
owner of the property to alote the nuisance.
I recommend that the owner of the property be contacted
and requested to place a cover over the greasing pit.

RESOLUTION
WHEREAS, it has come to our attention that a large number of
our members who are duly licensed to operate taverns in the
State of Illinois, have and will be called to the service of
their country, and
WHEREAS, in certain licalities the licenses for taverns are
limited and are a valuable asset to the business and ordin-
ances on record in'some communities provide that the licensee
shall operate the business continuously, and
WHEREAS, in such instances the licensee has built up a con-
siderable amount of good will and value in his business and
it would be a great loss to these individuals if they had to
forfeit the right of this privilege which may create and undue
hardship on the individual and his family, and
WHEREAS, we are of the opinion that it is a patriotic duty for
the said licensee to serve his country and we believe that we
should co-operate with our members and assist them in protecting
their interests in such a license, now
THEREFORE, we respectfully urge that each Liquor Control Com-
mission where such cases exist, consent to the operation of such
a tavern business by a manager who can quality, be appointed by
such licensee for the duration of his service in'the armed forces
of our country, and

BE IT FURTHER RESOLVED, that each local in the State of Illinois
appoint a committee of three (3) members to co-operate with
the local liquor commission to assist in the protection of the
licensee's interest in -such a license consistent with the
desires of said licensee.

Control Commission for handling.

Dear Mayor Garland:
Referring to your letter of February 10th listing proposed.
items of work for which you wish to secure a WPA Project, I
regret to advise that some of these items are ineligible under
our program of operation.
It is impossible for us to include the item of watchmen`::to
guard various locations as this'is classed as Police and Fire
protection which we cannot undertake under our present arrange-
ments.
The item of material conservation is ineligible at the present
time although there is a change that sometjing may be worked
out along these lines a little later but, at this moment no
definite details have been received.
The balance of the work items you have listed are eligible and
a proposal could be submitted to the WPA for approval providing
all critical materials could be furnished by you.
It would also be necessary before starting this work that clearance
with the War Production Board be secured in accordance -with Con-
struction Conservation Order L-41.
These matters were explained in detail to your Mr. Fletcher upon
receipt of your letter and we will be pleased to hear from you if
there is any further information you desire a t this time.

ORDER ISSUANCE OF BUILDING PERMIT: The Clerk then introduced Miss
L. Bennett representing the L. Bennett Construction Co. who stated that she
had applied for a building permit for the construction of a two -stogy, single
family residence upon Lot 22 and the South one-half of Lot 21 of Block #2 in
Diefendorf's Addition to Riverview (1669 Cora Street), but was denied a
permit because the building inspector demanded a resubdivision of the said lot
and a half into one lot before issuing a permit.
Miss Bennett there promised orally to file a plat of re -subdivision
as soon as the survey can be completed, but asked that she be granted her
permit to avoid harmful delay.
The motion was made by Alderman Pflughaupt and^Lemke to direct the
building inspector to issue the said permit with the district provision that
the pia t of re -subdivision be filed as agreed upon by Miss Bennett as soon
as the said plat can be prepared. The motion was voted upon by acclamation
whereupon the Mayor declared the motion carried.

After a short time Mr. H.T. Bennett, Chairman of the Plan Commission
