CALL TO ORDER: The meeting was called to order by Mayor Charles.
H. ,Garland presiding,. with Aldermen Carroll, Joinson, Loos, Pflughaupt,
Kele, Lemke, Schwanbeck and Campagna responding to the roll call. Alderman
Dopheide arrived later during the meeting, while Alderman Friott was absent
for the entire meeting.
DESIGNATE TEMPORARY CITY ATTORNEY: IA the absence of Kenneth G.

To the Chairman Kehe A. Special Committee, at the meeting of the
City Council, held on April 22th, 1942, the following matter was
referred to your committee, consisting of Alderman Kehe, Loos,
Lemke, and Pflughaupt:
The matter of Defense Homes with particular reference to the
question of whether or not the City Council should amend the 1939
Building Code so as tp permit Defense Homes to be,constructed
under the provisions of the "Federal Emergency Plumbing Code for
Defense Housing", and such other federal codes as they apply.
This matter was referred to you and your committee as a result
of your letter addressed to the City Council, on the above subject,
dated April 20th, 1942.

Your Committee on "Defense" Homes has investigated the above and
has found: that the construction of Defense Homes is not in
accordance with our City of Des Plaines Building Code
We, your Committee on Building of Defense Homes, therefore re-
commend: That the Building Inspector be instructed not to issue
a permit unless all defense homes be constructed according to
the City of Des Plaines Building Code. We further recommend that
there be no amendment to the 1939 Building Code to permit the con-
struction of defense homes in the City of Des Plaines, unless we
are compelled to do so.

AN ORDINANCE REPEALING ARTICLE XX, ENTITLED "SEPTIC
TANKS", SECTION 200 TO 206, BOTH INCLUSIVE, CON-
TAINED'IN THE SAID ARTICLE XX OF THE BUILDING CODE
OF THE CITY OF DES PLAINES OF 1939 AND PROHIBITING
THE CONSTRUCTION OR INSTALLATION OF PRIVATE SEPTIC
TANKS WITHIN THE CITY OF DES PLAINES.
however, in view of the fact that home building will probably remain at a
stand -still for some time, because of the war, the Clerk was ordered to place
this proposed ordinance on file. _
COUNTER -PETITION OPPOSING RE-ZONINOE: The Clerk then read the

We, the undersigned, owners of property within the Residence
District area, District A, of the City of Des Plaines, Illinois,
object to the change or amendment of the so-called "Toning Ordin-
ance" passed on February 5, 1923, as heretofore amended, by re-
classifying the real estate and premises described ass
The South Half (Si) of Lot Three (3) Section Twenty
(20), Township Forty-one (41) North, Range Twelve
(12), Division of the South West Quarter (SW*) of
Carl Lagerhausen's Estate, East of the Third Princ-
ipal Meridian, situated in the City of Des Plaines,
County of Cook and State of Illinois -
from residende district Area District A, to industrial district,
Area District C, pursuant to petition of LAWRENCE A. DALY, filen
with the Secretary of the Zoning Board of Appeals on April 22,
1942, for following, among other reasons:
Said Ordinance cannot be legally amended to permit the
removal of the property in question from Class "A" dis-
trict under the Zoning Ordinance of the City and the
creation of a separate "C" District zone of this isolated
area.
Such an amendment can be made only where the public good

demands it, and, if made under the present conditions and
circumstances, would permit an arbitrary, unharmonious and
preferred situation to be established and given special
privileges, and would be an invasion of the property rights
of other property owners in the "A" use district, and dis-
criminatory, and therefore, unconstitutional and void.
The validity of the ordinance, as it applies to this pro-
perty, has never been questioned during all the years it
has been in force, nor is it now questioned by petitioner.
Nor has there been any particular change in the district in
which this property is situated since the adoption of this
Ordinance in -February 1923; and property owners in the dis-
trict have the right to rely upon the classification which
exists, and that such classification will not be changed
unless the change is required for public good, and not
merely because someone wants it done, or thinks it ought
to be done.
Such change is not required for public good, but would, in
fact, be detrimental to the public welfare; for, being a
change to a lower classification, it would be detrimental
to other property in the district, and constitute a dis-
crimination against such other property; it would increase
the traffic and fire hazards, and consequently insOrance
rates.

Des Plaines Post No. 36, The American Legion, and the Uxiliary Unit
to hold their annual Poppy Tag Day on May 25, A.D. 1942.
This as you know is to use the streets of our fair city to
tag with the Legion Poppy, the proceeds to be used for assistance to
disabled veterans and needy families in our city.
If this permit is granted will you ask the Honorable Mayor
Charles Garland to proclaim May 25 as Poppy Day?

DISCUSS REMOVAL OF "EYE -SORES": Alderman Kehe, Chairman of the
Committee on Subdivisions, Building and Municipal Development then read the
following letter:

Dear Sirss-
I have several problems, on which I would mppreciate
the assistance of your committee, in trying to solve them.

#1, --
There is a dangerous condition existing on the rear section of the
Echo Theatre Building, on top of the concrete block wall there is
a tile cap which has become loose and sections are falling from
top of wall to ground on either side, one side being next to the
parking lot at rear of Bank Building.
I have placed a warning sign on this building near the hazzard
the same day notified Mr. Fulner manager of The Des Plaines Theatre
pointing out to him the hazzard, he agreed that something should be
done at once, about 2 weeks passed and nothing was done, again I call-
ed'it to his attention, and he assured that very shortly the men would
remove the hazzard, also stated that they expected to take down a por-
tion of the rear end of building. A week later I sent him a latter
asking him to do something about it. To date nothing has been done.
Therefore am asking the City Council what step is to be taken next,
and before someone is inured.?

There is an un -occupied filling station at the south east corner of
Des Plaines Ave. and Mill Street on this premises there is an open
grease pit partly filled with water, creating a hazzard as there are
children playing around this un -occupied station, no one in attend•
ance at station to watch, making it dangerous for anyone. There is
a concrete guard about 8" high around pit, just enough to trip over.
Recommend that some definite action be taken before there is someone
hurt or even drowned.

Have had several complaints in person and by phone concerning a part.
ly completed building, at NE Corner of Garland Place & Miner Street,
owned by Frank Zaleski who took out permit to remodel & later another
permit to remove it from original foundation onto another portion of
lot, house was moved onto excavated basement, no walls under. Now on
blocking, and nothing being done to complete building, what can be
done about this?

Several complaints have come in by phone and in person regarding the
delapidated condition of a 2 story building on the East side of Circle
Aven ue north of Prospect, this building was formerly used as Commer-
cial first floor.
Would suggest that the municipal developement committee visit this
building along with Fire marshall W. Lagerhausen and make recommen-
dations as to what can be done to correct this situation. I would
be glad jo accompany this group on inspection.

The Mayor referred Item #1 and #3 of the above letter to the City Attorney for
investigation and report; item #2 to the Chief of Police; and item #4 to the Com-
mittee of Subdivisions, Building and Municipal Development and the Fire Marshall.
SEEK REMOVAL OF DILAPIDATED VACANT FILLING STATION: Alderman Pflughaupt
then requested that Council action be taken to remove the dilapidated and vacant fill-
ing station located on the northwest corner of Des Plaines Avenue and Riverview
Avdnue. Mayor Garland referred this request to the Building Inspector for invest-
igation and report.
SEEK TO ENFORCE COMPLETION OF FUTURE BUILDINGS: Alderman Dopheide
then requested that some action be taken to force the owner to fill in a hole
dug on a lot on Third Avenue intended as a basement for a residence, which has
been abandoned. The aparent lack of authority of the City to cope with such

conditions brought about a suggestion that a substantial cash deposit be
demanded with every building permit fee, to serve as a completion bond to
be forfeited to the Cit' -in case of non -completion and to be used by the City
to remove the partially completed structure. Mayor Garland referred this
matter to the Committee on Subdivisions, Building and Municipal Development
for study and recommendation.
MEMORIAL SUNDAY: The Clerk then read the following letters

AUTHORIZE REPAIR OF DOG POUND:. The motion was made by Alderman
Carroll and Lemke to authorise the Committee on Sewers Sanitation and Health
to arrange for the repair of the Dog Potnd at a cost not to exceed 0200.00.
The motion was voted upon by acclamation. whereupon the Mayor declared the.
motion unanimously carried.
. REQUESTS PASSAGE OF A "BLACKOUT ORDINANCE": Mr. T.R. Napieralski,
Division Secretary of Civilian Defense requested the council to pass a
"Blackout Ordinance" for the City of Des Plaines. Mayor Garland referred this
matter to the City Attorney with instructions to prepare such an ordinance and
submit the same to the Council as soon as.posaible._
GRANT, USE OF VISIBLE FILE: The, motion was made by Alderman Kehe andA
Loos to grant the Des Plaines Council of Defense the use of the Two "Kardex"
files, purchased for the Health Department,, but, which are nit now in use. The
motion was voted upon by acclamation whereupon the Mayor declared the motion
carried.
SCO LINE RAILROAD CROSSING REPAIRS: Alderman Dopheide.reported the
crossings of the Soo Line Railroad crossings to be in dangerous condition.. The
motion was made by Alderman Lemke and Campagna to instruct the City Attorney to
file a complaint with the Illinois Commerce Commission together with a petition
requesting the said commission to order the said crossings repaired. The .
motion was voted upon by acclamation whereupon the Mayor declared the motion
carried.
OILING RIGHT-OF-WAY OF C&N.W. RAILROAD: Mayor Garland then requested
the Clerk to write the C&N. W. Railroad Co. % Mr. M.J. Byington, requesting the
said railroad company to oil its right-of-way thru the downtown district as
early as possible in order to prevent a dusty condition.
C&N.W. WATER TANK FOR FIRE PROTECTION: Upon the suggestion of Alderman
Loos the matter of getting permission to use the C&N.W. Water Tank.for fire prot-
ection purposes, was referred by the Mayor to the Water Committee for study
and recommendation.
