January 2, 1942 City Council City of Des Plaines Subject: Zoning of H.M.Corne]l's Cumberland Sub -division Gentlemen: MAYOR Pursuant to Legal Notice published by the Des Plaines Zoning Board of Appeals respecting the zoning of H.M. Cornell sub -division of Cumberland, the Cumberland Maintenance Corporation gave serious study of the sub- division and by resolution of the Board of Directors on November 11 conveyed to the Des Plaines Zoning Board of Appeals the recommendations covered by our letter of November 17, a copy ofwhich is herewith attached. During the two open public hearings of the Zoning Board of Appeals, we agreed to modification of these recommendations as follows: - Lots 17-23, inclusive, block 9, lots 16-19, inclusive, block 10, lots 8-13, inclusive, block 14, and lots 16-19, inclusive, Block 15; be zoned for commercial. However, this was done only when the Board of Appeals had announced that they had jurisdiction over building line "Set -backs" and after all interested parties had agreed to full block continous 25" building line "Set -backs" from all street property lines involved in these lots. Obviously, we were very disappointed when the Board Appeal granted additional commercial zoning on east side of Braodway, using above concession as a basis of leverage. In addition, it was even more disappointing when the Board of Appeals announced at the conculsion of the meeting, publicly recording their recommendation to the City Council, that they had no jurisdiction to control building line "set -back". In view of this reversal of position that the Zoning Board of Appeals had control over building line "set -back" after all open hearings had been concluded and resolutions covering usage of pro- perty to be recommended to the City Council had been adopted, we regret that we are compelled to make every effort to withdraw the concessions on above mentioned lots. This is to prevent the creation of the very unsightly spectacle of a row of residences Milt to a 251 building line as wovered by ordinance and immediately aalining business lots in same block built up to the street property line. After having been advised by the resolutions covering recommended Zoning of Cumberland adopted by the Zoning Board of Appeals, the Board of Directors of the Cumberland Maintenance Corporation by resolution adopted on December 16 advised the City Council of Des Plaines that they disapprove passing any zoning ordinance which does not within itself or by concurrent resolutions establish 1 (Letter cont'd) appropriate building line "set -backs", and furthermore, that we ob- ject to zoning any area except blocks 12 and 13 for other than class "A" residences. 603 Our objection to zoning any areas in addition to blocks 12 and 13 for commercial usage is that these two blocks zoned completely to business provides 70 business lots. This, on the basis of 100 residents per business, provides for a population of 7000. This, we believe, is more residents than the area north and east of Northwest Highway in this vicinity will have in the next 50 years. However, the Zoning Board's recommendation provides for 110 business lots. Besides providing for more business lots than the reason- able future forecasts, these additional 40 business lots are strung out in four other blocks of whose area over 80% is being recom- mended to be zoned for residence. Objection is also being made to the zoning of Class "B" residents in Blocks 15, 16, 17, and 18. This usage was granted on the appeal of building promotion, interest that,indicated they desired to build so-called "row -houses" on the north side of Seegers Road. We.do not.believe that so-called "row houses" are appropriate in or desirable in an unconjested suburban community. Moreover, we believe neither zoning codes nor building laws of our community clearly define nor provide for proper usage or construction of so- called "row -houses" multi -residential structures. We recommend against experimenting with such structures in Cumberland. It is suggested that the City Council suspend any action on the recommendation of the Zoning Board of Appeals until it decides how jurisdiction over building line "set -backs" is vested and acts as follows: 1. If this authority is determined to be that of the Zoning Board of Appeals, then the subject should be returned to them by the council with the instructions to recommend building line "set -backs", reduce the excessive commercial zoning, and eliminate Class "B" residence areas. 2. If it is determined that the authority over building line "set -backs" is vested in another body, the insturctions respecting reduction of commercial classification and elimination of Class "B" residence should be conveyed to the Zoning Board of Appeals, while the body with authority over building line "set -backs" be instructed to prepare an ordinance covering this element of properties involved in the Cumberland sub-dvision . 3. That adoption of ordinances covering zoning and building line "set -backs" in Cumberland be alopted only after joint or con- current recommendations have been received and considered at the same council meeting. Garland, presiding, with Aldermen Carroll, Johnsoni Loos, Pflughaupt, Kehe, Lemke, Schwanbeck and Campagna responding to the roll call. (Aldermen Dopheide and Friott were absent during the entire meeting.) The Clerk re- ported eight (8) aldermen present. Mayor Garland then stated that this meeting is an adjourned regular meeting held primarily for the purpose of finally passing the 1942 Appropriation Ordinance. - 'ASS 1942 APPROPRIATION ORDINANCE: The Clerk then read for Pim', reading the proposed 1942 Appropriation Ordinance entitled: AN ORDINANCE MAKING APPROPRIATIONS TO DEFRAY THE EXPENSE OF THE CITY OF DES PLAINES FOR MUNICIPAL PURPOSES DESIGNATED THE "ANNUAL APPROPRIATION BILL" FOR THfl FISCAL -YEAR COMMENCING JANUARY 1, 1942 AND ENDING DECEMBER 31, 1942. The motion was made by Alderman Johnson and seconded by Pflughaupt to change item number (C-34) "Expense of City Marshall $50.00" to read "Expense of City Marshall - $200.00/8. The motion was voted upon by acclamation where- upon the Mayor declared the motion carried.
