MINUTES OF THE SPECIAL MEETING OF THE
CITY COUNCIL OF THE CITY OF DES PLAINES
HELD IN THE COUNCIL CHAMBERS ON MONDAY,
JUNE 30, 1941 at 7:30 P.M.
CALL TO ORDER: The meeting was called to order. by Mayor Charles H. Garland
presiding with Aldermen Carroll, Loos, Pflughaupt, Kehe, Lemke, Schwanbeck and Campagna
responding to the roll call. (Aldermen Johnson, Dopheide and Friott were absent during
the entire meeting). The Clerk reported seven of the ten aldermen present.
READING OF THE CALL: The Clerk then read the call for the meeting and waiver
of notice as follows:

Gentlemen:
You are hereby notified that upon order of Mayor Chas. H. Garland,
there will be a special meeting of the City Council of the City of
Des Plaines at 7:30 P.M. Monday, June 30, 1941 in the Council Chambers
for the purpose of considering the ordinance in connection with the
Sanitary District Interceptor Sewer in Miner Street, authorizing the
settlement with certain surety companies in a special assessment
diversion suit and for such other matters as may be presented to the
Council for consideration.

We, the undersigned members of the City Council of the City of
Des Plaines, do hereby waive notice of the time, place, date and
purpose of a special meeting of the City Council of the City of
Des Plaines, to be held on the 30th day of June, A.D. 1941 at
7:50 P.M. in the Council Chambers, and do hereby consent to the
holding of such meeting and to the transaction of any and all

CONTINENTAL CASUALTY CO. - SETTLES SA # 97: The Clerk then read the following
proposed resolution:
RESOLUTION
WHEREAS, City of Des Plaines is making claims against Continental Casualty
Company, surety on certain bonds running to said city, and Continental Casualty Company
is denying any liability thereon, and
WHEREAS, Continental Casualty Company has submitted to the City of Des Plaines,
Illinois, the following offer in compromise, to wit:

"The Continetal Casualty Company, in full compromise, settlement, release
and discharge of any and all claims and demands against it and any end all
of its lidility under or upon the official bonds of Otto Rexes, Charles M.
Larson and Otto W. J. Henrich, or any of said bonds, growing out of or in
any wise pertaining to Special Assessment No. 97 of the City of Des Plaines,
Illinois for the grading, curbing, paving and otherwise improving First
Avenue and other streets in said City, will pay to said City the sum of
$800.00, on the following terms and conditions, to wit:
"1. The said payment is not to be considered or construed as
an admission of any liability under the aforesaid bonds.
". The City of Des Plaines will assume the responsibility of
seeing that the aforesaid sum of money is applied and
disbursed according to law in and out of the proper in-
stallments of said Special Assessment No. 97, and on the
bonds, coupons, or interest thereon to which the same is
pllicable.
"3. The penalty of the bond heretofore executed by Otto Rexes, as
principal, and `'ontinental Casualty Company, as surety, to the
City of Des Plaines shall be reduced by the aforesaid sum
of $800.00.
"4. The payment of the aforesaid sum under this compromise shall
not operate to renew, continue or extend any of the aforesaid
bonds, executed by said Continental Casualty Company as surety,
or any contractual or statutory limitations applicable thereto,
or as a waiver of any right or defense that the principal or
surety may have.
"5. The suit of the Swedish American National Bank against the
City of Des Plaines, et al, No. 36C11712 in the ircuit Court
of Cook County, Illinois, and any cross claims or counterclaims
thereunder, are to be dismissed as to the aforesaid Otto Rexes,
Charelis M. Larson, Otto W. J. Henrich and Continental Casualty
Company, and the City is to obtain from the plaintiff in said
suit, and furnish the Continental Casualty Company, a release
and discharge of any and all claims and demands against it and
any and all its liabiltiy under or upon said official bonds of
the said Otto Rexes, Chas. M. Larson, Otto V.J. Henrich and
any of said bonds growing out of or in any wise pertaining
to said Special Assessment No. 97.
"6. The City of Des Plaines will execute and deliver or cause to
be executed and delivered to the Continental Casualty Company
separate releases, releasing said Continental Casualty Company
of all calicos and demands whatsoever and any and all liability
under said official bonds of'said Otto Rexes, Chas. M. Larson,
and Otto W. J. Henrich, and any of said bonds, growing out of
or in any wise pertaining to said Special Assessment No. 97 of
said City.
"7. The City will hold the said Otto Rexes, Chas. M. Larson, Otto W.
J. Henrich and Continental Casualty Company haviesss against the
claims of any bondholders under said Special Assessment No. 97.
"8. Where payments have been made during the term of office of Otto
Rexes on bonds or coupons of said Special Assessment in excess
of the pro rata amount of the collections made in the installment
or installments, out of which said bonds and coupons were payable,
if further collections are made under said Assessment, applidable
to such bonds or coupons, they shall be paid over to the Continental
Casualty Company to the extent of such overpayment, except in so far
as such collections may be applicable to bonds or coupons held by
the Swedish American National Bank.
"9. If the aforesaid offer in compromise is not accepted and approved
by the proper -governing body of the City of Des Plaines within a
reasonalbe"time, it may be withdrawn.

WHEREAS, after duly considering said offer in compromise, it appears that it
is to the best interest of the City and the holders of bonds and coupons payable out of
special assessment No. 97 that said offer in compromise be approved and accepted
on the terms and conditions therein stated;
N0W, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DES PLAINES,
ILLINOIS, that the aforesaid offer of compromise settlement of said Continental
Casulaty Company be and the same is hereby accepted and approved on the terms and
conditions therein stated, and that said City of Des Plaines, Illinois, does hereby
assume and agree to do, keep and perform, and cause to be done, kept and performed
all matters and things set out in said offer in compromise for it to do, keept and
perform, or cause to be done, kept and performed; and that upon payment of the
aforesaid sum of $800.00 to said City, the Mayor of said City be and hereby is
authorized to execute, and the Clerk be and he hereby is authorized to attest on be-

following proposed resolution:

WHEREAS, The City of Des Plaines, State of Illinois, is making claim
against the Aetna Casualty & Surety Company as surety and Martin A. Behrens,
former City Treasurer of the City of Des Plaines, on a certain bond given by said
Martin A. Behrens as principal and by said Aetna Casualty & Surety Company assurety, and
WHEREAS, said Aetna Casualty & Surety Company denies any liability on said
claim under said bond, and
WHEREAS, the Aetna Casualty & Surety Company has submitted to the City of
Des Plaines, Illinois, the following offer in compromise, to wit:

4. The payment of the aforesaid sum under this compromise shall not
operate to renew, continue or extend the aforesaid bond executed
by said Aetna as surety, or any contractual or statutory limitations
applicable thereto, or as a waiver of any right or defense that
the principal or surety may have.
5. The suit of the Swedish American National Bank against the City of
Des Plaines, et al. No. 36 C 11712 in the Circuit Court of Cook
County, Illinois, and any cross claims or counter claims thereunder,
are to be dismissed as to the aforesaid Martin A. Behrens and Aetna,
and the City is to obtain from the plaintiff in said suit, and furnish
Aetna a release and discharge of any and all claims and demands aginst
it and any and all liability under or upon said official bond of the
said Martin A. Behrens growing out of or in any wise pertaining to
said Special Assessment No. 97.
6. The City of Des Plaines will execute and deliver or cause to be
executed and delivered to the Aetna a release, releasing said Aetna
of all claims and demands whatsoever. and any and all liability under
said official bond of said Martin A. Behrens, growing out of or in
any wise pertaining to said Special Assessment No. 97 of aid City.
7. The City will hold the said Martin A. Behrens and Aetna harmless
against the claims of any bondholders under the said Special
Assessment No. 97.
8. Where payments have been made during the term of office of Martin A.
Behrens on bonds or coupons of said Special Assessment in excess ofthe
pro rata amount of the collections made in the installment or install-
ments, out of which said bonds and coupons were payable, if further
collections are made under said Assessment, applicable to such bonds
or coupons, they shall bepaid over to Aetna to the extent of such
overpayment, exeept in so far as such collections may be applicable to
bonds or coupons held by the Swedish American National Bank.
9. If the aforesaid offer tin in compromise is not accepted and approved
by the proper governing body of the City of Des Plaines within a
reasonable time, it may be withdrawn.

set out in said offer in compromise for it to do, keep and perform, or cause to be done,

`� June 16, 1941 the following matter was referred to you.
The ordinance proposed by the Sanitary District of Chicago granting said
Sanitary District the necessary permission, easements, rights, and_cooperation
for the construe tion of an auxilliary interceptor lead from East Miner St.
to Des Plaines interceptor sewer lying under Des Plaines Avenue. "
The said proposed ordinance was referred to you for examination and recom-
mendation. You will remember that you were supplied a copy of this proposed
ordinance at the Council Meeting June 16, 1941.

In Re: Intercepting Sewer Ordinance
Gentlemen:
I have examined the ordinance concerning the above subject submitted to the
City of Des Plaines by the Sanitary District and found everything to my satis-
faction exept sub -paragraph "I" of Section 4.
This sub -paragraph refers to water mains which may be encountered in the con-
struction of the sewer, and I was able to induce the Law Department of the Sanitary
District to agree to adding the following proviso to said paragraph "I" of
Sedtion 4 to -wit:
"Provided, however, that no water mains
shall be removed, altered, cut, repaired
or replaced without first obtaining the
approval of the City Engineer of Des Plaines
as to the time, manner and method of making
such removal, alteration, cutting, re-
pairing or replacement"
The ordinance as /corrected and submitted hereiwith is in my opinion in form to
be adopted by the Council.

District of Chicago granting such perpetual easement, right and authority as the said
District requires for the construc tion and maintenance of an auxilliary interceptor
sewer from the Des Plaines Valley Interceptor main to Miner Street east of the Des Plaines
River.
The motion was made by Alderman Carroll, and seconded by Loos to concur in the
City Attorney's recommendation and finally pass and adopt the said proposed ordinance
as revised by the City Attorney. The Mayor put the question and the Clerk calledthe
roll with the following result: byes; Aldermen Carroll, Loos, Pflughaupt, Kehe, Lemke,
Schwanbeck and Campagna. Nays; None. The Mayor thereupon declared the motion carried
and the said ordinance passed as revised.
AMEND SALARY ORDINANCE: The Clerk then read for first reading a proposed
ordinance entitled:

The motion was made by Alderman Pflughaupt and seconded by Kehe to suspend the rules and
place the said proposed ordinance upon its final passage. The Mayor put the question
on the motion to suspend the rules and the Clerk called the role with the following
result: Ayes; Aldermen Carroll, Loos, Pflughaupt, Kehe, Lemke, Schwanbeck and
Campagna. Nays; None. The Mayor thereupon declared the motion carried, the rules sus-
pended and the said proposed ordinance before the Council for final disposition.
The motion was then made by Alderman Pflughaupt and seconded by Kehe, to
finally pass and adopt this proposed ordinance. The Mayor put the question and the Clerk
called the roll with the following result: Ayes; Aldermen Carroll, Loos, Pflughaupt,
Kehe, Lemke, Schwanbeck and Campagna. Nays; None. The Mayor thereupon declared the

AMEND DEPARTMENTALIZING ORDINANCE: The Clerk then read for second reading
a proposed ordinanceentitled:

The motion was made by Alderman Carroll and seconded by Kehe to finally pass and adopt
this proposed ordinance. The Mayor put the question and the Clerk called the roll with
the following result: Ayes; Aldermen Carroll, Loos, Pflughaupt, Kehe, Lemke, Schwanbeck
and Campagna. Nays; None. The Mayor thereupon declared the motion carried and the
said ordinance passed.
APPOINTMENTS: Mayor Garland then announced the following appointments:
CLAUDE C. FREER, as Superintendnet of Garbage, Sewers and
Sanitation.
HENRY GEISEN, as Incinerator Engineer.
The motion was made by Alderman Carroll, and seconded by Pflughaupt to confirm these
two appointments. The motion was voted upon by acclamation whereupon the Mayor
declared the motion carried and the said appointments confirmed.
HOUSE BILL #714 - RIVER DAM: The Clerk then read the following proposed
resolution:
RESOLUTION
WHEREAS, the Des Plaines River courses through the City of Des Plaines and
is adjacent to most of the Forest Preserves area northwest of Chicago; and
WHEREAS, the said Des Plaines River in its present condition is not suitable
for boating or fishing because of the law water level in said river; and
WHEREAS, a Dam constructed south of Des Plaines at or about the location
where Dam No. 4 was heretofore located, sufficiently raises the water level in said

river to,make such river usable for boating, and better fishing conditions; and
WHEREAS, the raising of said water level will increase the use and benefits
of the Forest Preserve District; and
WHEREAS, the State Legislature of the State of Illinois recently passed
House Bill #714, being an appropriation bill for thea division of State water-
ways, appropriating moneys for the construction of dams in the Des Plaines River; and
WHEREAS, this City Council, in the interests of the citizens of the City of
Des Plaines and the public in general, is in favor of the construction of Dam No. 4 in
the Des Plaines River;

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Des Plaines,
that it does hereby request Honorable Dwight H. Green to sign said House Bill #714.
BE IT FURTHER RESOLVED that the City Clerk be instructed to forward a
certified copy of this resolution immediately to Dwight H. Green.
The motion was made by Alderman Pflughaupt and seconded by Loos to adopt this pro-
posed resolution. The motion was voted upon by acclamation whereupon the Mayor
declared the motion carried and the said resolution adopted.

The matter of divising a plan of financing the proposed sewer for Cumberland
Terrace was referred to you for study and report, at the next regular council
meeting.

In re; Method of Financing
Cumberland Terrace Sewer
Gentlemen:
Upon my examination of the law, I wish to advise byzeason of an
amendment to the Sewer Revenue Act, it is possible to issue revenue
bonds affecting a particular locality within a city. The procedure
in connection therwith is substantially as follows:
(1) Council adopts resolution declaring its intention to avail
itself of the provisions of the Revenue Act in question.
(2) The resolution describes the project, the boundaries to be
served, the estimated cost, approves estimated report of engineer
of possible rates to be charged, sets the date for hearing on the
question.
(3) Notices of hearing is sent by mail to all persons who paid
the general taxes for the last preceding year on real estate within
the boundaries to be served by the proposed impavement.
(4) Notice is published for two weeks in a newspaper. The first
publication to be at least fifteen days prior to the hearing.
(5) At the public hearing Council passes a resolution adopting,
amending or rejecting the plan.
(6) Council passes an ordinance covering the entire improvement and
describing the bond and fixing the rates.
It is my opinion that under the present economic conditions the revenue
system is the only feasible plan to finance the proposed sewer. There
is no law for special assessment bonds, and apparently the owners of
property in question cannot work out a means of private financing.

directed to draw the proper warrant upon the City Treasurer in payment
thereof.

tracted illness employees who hold office by virtue of appointment be paid
one month's salary.

However, we have had numerous complaints form farmers regarding the
thistles growing within the corporate limits of the several cities
and villages in the township. We are asking for the cooperation
of the City of Des Plaines in this matter.

ASKS PERMIT TO LIVE IN GARAGE: Alderman Schwanbeck then introduced Mr.
Gordon Buick who asked permission to construct a garage at 1730 White Street, and
live therein during construction of his new residence. The City Attorney pointed
out that the decision in such matters rests with the Building Inspector and the
Zoning Board of Appeals. Mayor Garland therefore referred Mr. Buick to the
Building Inspector.
ADJOURNMENT: The motion was made by Alderman Kehe and seconded by Campagna
to adjourn. The motion was voted upon by acclama •n whereupon the Mayor declared

CALL TO ORDER: The meeting was called to order by Mayor Charles H. Garland presid
with Aldermen Carroll, Johnson, Loos, Dopheide, Kehe, Lemke, Schwanbeck and Campagna.
(Aldermen Pflughaupt and Friott were absent during the entire meeting.) The Clerk re-
ported eight aldermen present.
REPORTS OF OFFICERS: The Clerk then submitted the following reports for the
calendar month of June 1941:

THE STREETS AND SIDEWALKS COMMITTEE THROUGH its chairman Alderman Campagna
submitted the following report:

To the Chairman Campagna - Streets and Sidewalks committee, at the
meeting of the City Council, held June 16, 1941 the following matter
was referred to your committee: the matter of removing nine electrically
lighted stop signs and replacing them with nine reflector button type
stop signs was referred back to your committee for further study and
recommendation.
