MINUTES OF THE REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF DES PLAINES
HELD IN THE COUNCIL CHAMBERS ON MONDAY,
APRIL 21k 1941 at 8:00 P.M.
CALL TO ORDER: The meeting was called to order by Mayor Hobart M.
Ahbe presiding with Aldermen Carroll, Johnson, Henrich, Loos, Dopheide, Carlson
'Friott, Lemke, Schwanbeck and Campagna responding to the roll call. The Clerk
reported all members of the Council present.
REPORTS OF STANDING COMMITTEES: None of the standing committees of the
Council had a report to offer.
CANVASS VOTE OF ELECTION HELD APRIL 15. 1941: Mayor Ahbe then appointed
Aldermen Schwanbeck, Friott, and Loos as a special committee to canvass the re-
sults of the general City Election held April 15, 1941, and declared a recess
for the purpose of enabling the said committee to proceed with the said canvass.
After a few minutes Mayor Ahbe re -convened the Council by calling the same
to order.
The special canvassing committee thou its chairman Alderman Schwanbeck
then introduced the following proposed resolution:

We believe that you agree with us that the court committed palpable
error in directing the jury at the close of the plaintiff's case.to
find for the defendants. As you know, we have a number of.valid points
of law which, in our judgment, should bring about a reversal of
Judge Feinberg's action by the Appellate Court. We believe that there

is a possibility that we could prevail upon the Appellate Court
that it, instead of reversing and reminding the case for a new
trial, might reverse and enter judgment in that court for the
City's damages.
We therefore, urge most earnestly that we be permitted and in-
structed to perfect an appeal and we should like this authority
as soon as possible, if the City agrees with our views.

AUTHORIZE DECORATING COUNCIL CHAMBERS: The motion. was made by Alderman
Carroll and seconded by Johnson to repair leaks in the roof of the Municipal
Building and decorate the Council Chambers, Council Chamber Annex and hallways,
and to refer this matter to the Committee on Public Works, Buildings and Plats
with full power to act, with instructions to have the work completed before
May 5, 1941. The motion was voted upon by acclamation whereupon the Mayor declared
the motion carried.
APPROVAL OF MINUTES: Each member of the Council having been supplied a
copy of the minutes of the regular Council Meeting {;"Monday. April 21, 1941,
