CALL TO ORDER: The meeting was called to orde'r by Mayor Hobart M.
Ahbe presiding with Aldermen Carroll, Johnson, Henrich, Loos, Dopheide,
Carlson, Friott, Lemke, Schwanbeck and Campagna responding to the roll call.
Clerk reported all members of the Council present.

The Judiciary and Assessment Committee Charman has given further con-
sideration to the letter of complaint received from the Des•Plaines Realty
Company, one ice of the four bidders submitting proposals on February 3, 1941.
Because the usual procedure of referring letters of -this nature to the
proper committee for careful consideration'and report was not done, it -is
believed that a hasty and not a very thorough consideration was given this
matter at our•last Council meeting. Furthermore, we have three other -
agencies submitting bids in good faith, to -also consider, in any action
this Council might take.
To clearly consider this letter from the complaining agency, that letter
is herein quoted, -with a substantial reply -which shall establish the reasoning
prompting the recommendations of this Committee submitted for your carefull
consideration on March 5, 1941, and accepted by this Council by an affir-
mative vote of S members and negative vote'of 2 members.
The complaining agency which is the Des Plaines Realty Company states in
their -letter of -March 15, 1941, in the paragraph of Item 1, as follows:
"Item -One of your -bid calls for Workmen's Compensation Insurance•to cover
the various employees of the•City. Of this item we were the lowest bidder.
As the City completely disregarded this fact and awarded the policy to the
next highest bidder, in our opinion, you forfeited any rights you may have
acquired as a result of this bid.
Being -the lowest bidder and•complying with -all of the conditions of your
proposal we are'entitled'to the award of this policy."'

If the complaining agency had carefully read the Legal Notice and the
specifications, both of which clearly state in the following quotations That;
-"The said City Council reserves the right to accept or reject any or all

bids; or any part of any such bid," as stated in the Legal Notice, or;
$The City Council of Des Plaines reserves the right to accept or reject
any or all bids, or any part of any cuh bids," as stated in the
Specifications, with no mention of the lowest bid having to be accepted,
this question should not have been raised.
Furthermore after much discussion on the City Council floor, regarding the
advisability of placing Item one, 'Jorkmens' Compensation and Employers'
Liability Insurance, and Item Two, Automobile Liability Insurance, in the
same company, it was ruled and advised by our City Attorney at that time
that these policies should be placed in the same company. The reason
being to avoid controversy or the need for legal action in the event of
claim for compensation under these policies, where the question of
responsibility may be in doubt. Also it can be added, that the placing
of both policies with the same Company was conforming with an established
practice of many years.
Of Item Two the compalining agency does not raise an objection exept re-
greVing not having an opportunity to rebid.
Quoting Item Three of the complaining agency's letter as follows:
"Item Three requested coverage for the Volunteer Firemen and specified a
principal sum of $3,000.00 and weekly indemnity of $25.00.
Our bid was in accordance with your specifications, however, the policy
was awarded to a company Who submitted an alternate bid not in accordance
with the specifications and on which all of the bidders had no chance to
compete. After the bids were opend this company was permitted to change
their bid so that it would comply with the specifications called for in
the original proposal. This entirely disregards all practices covering
sealed bids and tends to defeat its very purpose.
Under the policy accepted the premium is based on a certain charger per
individual member and separate policies are issued to cover each individual
member. If the number of firemen is increased, the premium is likewise in-
creased; whereas, under our policy, which is a blanket form, it covers any
and all members regardless of the number at the same price. Under the
policy accepted, the company's insuring clause provides payment on bodily
injury sustained only while the firmen are actually engaged in performing

the duties of Volunteer Firemen, and while going to or coming from a fire.
Whereas, the policy that we bid would have furnished this coverage, and in
addition provides protection for the firemen on drills, parades, and tests
and trials of any fire fighting apparatus. The policy accepted makes no
reference to indemnity for non -disabling injury; whereas our policy provides
that if injury does not result in any loss of time for which indemnity is
--payable, Our company would pay any medical and surgical costs caused by
this non -disabling accident not to exceed the weekly indemnity of one week."
The criticism expressed in the foregoing regarding alternate bidding is most
unfair reflection on this Council's actions, and furthermore coming from -fie
agency that saw fit to accompany its original proposal with a letter offer-
ing several alternates for consideration, these we elected not to take advan-
tage of at this time, but expected to use the suggestions for future consider-
ation. This brings about a confliction of opinion, which apparently applies
only when favorable to the complainant. The decision made in awarding
this policy was wholly in the interest of judcially expending the publics
money to the greatest good.
In the second paragraph of Item Three as quoted from the complaining
agency's letter, is a lengthy reference to the coverage not being as complete
in the policy of the company to which the award had been made originally,
C.n as it would be in the policy offered by the complaining agency. We have a
C4 letter from the successful bidder which clearly defines this question,
ai}d is quoted herewith as follows;
"In determining coverage under any contract, we naturally go direct to the
insuring clause. The insuring clause of the Fireman's Accident Policy
says that we,insure the member "while he is actually engaged in performing
that duties of a volunteer fireman of the Town or City of or while
going to or coming from a fire." If attending pectice and drills is a duty
of the members of the Des Plaines Department, then the policy covers. If
it is the duty of the Des Plaines Department to maintain a pulmotor or to
do emergency and first aid work, then the individual member is covered
while using the pulmotor or while going to or coming from the scene of any
emergency.
Our coverage is simpler than that of the Bureau, and for that reason I
believe it is really broader. I know that we go to all reasonable
lengths in interpreting the happenings under these policies as within
the purview of th insuring clause."
Following into the next item of the complaining agency's letter, we find
Iter_i Four, which refers to both Item tour -and Five of our specifications
as follows:
"Item Four requested fire and theft protection on the two fire trucks
and again we were the lowest bidder and were awarded this bid; but we do
not feel obligated to accept this award due to the fact that the city
did not award us the other policies on which we were the low bidders. We
would he perfectly willing to -write this business Provided we were awarded
all of the policies on which we were low."
They state their unwillingness to write these policies because of the
failure to award others they believe they are entitled to receive.
It should again be pointed out that they submitted their proposals with
the full knowledge of the right exercised by the Council which is clearly
stated in the specifications, and we again quote herewith:
"The City Council of Des Plaines -reserves the right to accept or reject
any or all bids or any part of any such bids."
Turning to Item Five of the complaining agency's letter which is covered
in Item six of the specifications and known as Owners' Landlords' and
Tenants' Public Liaiblity Insurance, we quote as follows:
"Item Five requested OLT coverage on the signs in the city. We bid a
flat price of $50.00 based on information obtained that the number of
signs exceeded 250. The successful bidder bid a minimum price which is
subject to change based on the number of signs. As all bidders were not
furnished with the correct number of signs to be covered, this appears
to show favoritism in favor of the successful bidder who was able to base
his advance premium on a smaller number of signs to be covered than the
other bidders."

In reply to that foregoing paragraph we draw attention to the last
sentence of the specifications as quoted herewith: "For further infor—
mation and list of signs see the City Clerk." The City Clerk should have
been able to give the latest list and number of signs from records
maintained in his office. —
Having reasonably considered this complaint, together with,due con—
sideration of the other bidders; and also believing that spending of the
Publics money on re—advertising together with the additional cost of ex—
tention of policies under the old rates, is not in the public interest.
Fully realizing that the Council with insufficient time to properly
analyze this complaint, and no doubt acting in haste, should in fairness
to all and to the Public rescind the action of the last meeting of the
Council held March 17, 1941.

SAFETY GATES OF LEE STREET, PEARSON STREET AND GRACELAND AVENUE:
Kenneth G. Meyer, City Attorney, then reported that satifactory_progress is be—
ing made in securing crossing gates at the Lee Street, Pearson Street and Grace—
land Avenue crossings of the Chicago and Northwestern Railroad tracks, and that
a meeting will be held in Des Plaines in a few days to discuss further details
regarding such gates with the Railroad representatives.
, CITY VS. B—W CONSTRUCTION CO.: Kenneth G. Meyer, City Attorney then
reported that the City's case against the B—W Construction Co. and the
American Surety Co. is being prepared for trial.

wish to have such trees planted in their parkways, as part of the Lity's V.P.A.

such 'licensee proves to the satisfaction of the Clerk that such tag was defective.

BOTH PARTIES GRANTED SOUND TRUCK PERMIT: ° The motion was made by Alderman
Loos and seconded by Johnson to grant both the People's Choice Party and the
United Coalition Party a permit to operate a sound= -truck upon the streets up to the
day of the City Election, April 15;1941. The motion was voted uptn by acclamation
whereupon the Mayor declared the motion carried and such permits' granted.
' CONTROL OF BANNERS ACROSS STREETS: The motion was made bk Alderman Loos and
seconded by Henrich to instruct the City Attorney to prepare an ordinance controlling
the placing of advertising banners across public streets and alleys. The motion
was Voted upon by acclamation whereupon the Mayor declared the motion carried.
ASKS REPAIR OF ALLEY BEHIND TEMPLE BUILDING: The motion was made by'
Alder'man Carroll and seconded by Johnson to refer"the matter of putting the alley
behind the Temple Building, and the alley outlet behind the Fire Station into good
condition, to the Streets and Sidewalks Committee with full power to act. The motion

APPROVAL OF MINUTES: Each member of the Council having been supplied a copy
of the minutes of the regular Council meeting held Monday, March 17, 1941, Alderman
Carlson asked that the following correction be made in the said minutes: that the
words "Schwanbeck and Campagna - Nays; Aldermen Henrich, Loos" be inserted between
the words "Lemke" and "Carlson" in the fifteenth line from the bottom on the fourth
page of the said minutes.
The motion was then made by Alderman Lemke and seconded by Friott, to approve
the said minutes as corrected. The motion was voted upon by acclamation whereupon the
Mayor declared the motion carried and the said minutes approved.

The moiton was made by Alderman Johnson and seconded by Lemke to adopt this proposed
resolution. The Mayor put the question and the Clerk called the roll with the
following result: Ayes: f_ldermen Carroll, Johnson, Henrich, Loos, Dopheide,
Carlaon, Friott, Lemke, Schwanbeck and Campagna. Nays: None. The Mayor there—
upon declared the motion carried and the said resolution adopted.
ADJOURNMENT: The motion was made by Alderman Lemke and seconded by Friott
to adjourn. The motion was voted upon by acclamation whereupon the Mayor declared
the motion carried and the Council regularly adjourned.

MINUTES OF THE REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF DES PLAINES
HELD IN THE COUNCIL CHAMBERS ON MONDAY,
APRIL 21. 1941 at 8:00 P.M.
CALL TO ORDER: The meeting was called to order by Mayor Hobart M.
Ahbe presiding with Aldermen Carroll, Johnson, Henrich, Loos, Dopheide, Carlson
'Friott, Leake, Schwanbeck and Campagna responding to the roll call. The Clerk
reported all members of the Council present.
REPORTS OF STANDING COMMITTEES: None of the standing committees of the
Council had a report to offer.
CANVASS VOTE OF ELECTION HELD APRIL 15. 1941:_ Mayor Ahbe then appointed
Aldermen Schwanbeck, Friott, and Loos as a special committee to canvass the re-
sults of the general City Election held April 15, 1941, and declared a recess
for the purpose of enabling the said committee to proceed with the said canvass.
After a few minutes Mayor Ahbe re -convened the Council by calling the sane
to order.
The special canvassing committee thou its chairman Alderman Schwanbeck
then introduced the following proposed resolution:
RESOLUTION
The City Council having this day canvassed the votes east for the
candidates for City offices at the general City Election held
April 15, 1941 and the result of said canvas being as follows:
