CALL TO ORDER: The meeting was called to order by Mayor Hobart M.
Abbe presiding, with Aldermen Carroll, Johnson,°Henrich, Loos, Carlson, Friott,
Lemke, Schwanbeck and Campagna responding to the roll call. (Alderman Dopheide
was absent during the entire meeting.) The Clerk reported nine Aldermen present.
REPORTS OF STANDING' COMMITTEES: None, of the standing committtees of the
Council had a report to offer.

TREE SURGERY FOR CUMBERLAND: The Clerk then read the following letter:

Gentlemen:
March 17
1941
With reference to our letter of January 3rd and subsequent authorization
by the City Council to pay one—third of the cost of pruning trees when a
local community will sponsor two—thirds the expense to prune all trees
within a specified area, we are pleased to advise that we are agreeable
to pay two—thirds of the cost of pruning all parkway trees in Cumberland.
We have been given bids by four responsible tree pruning services and
have determined the lowest bid to be that of Donald R. Hoyt, 5410 N.
Lovejoy Avenue, Chicago, Illinois. His bid is a sum of $585.00.
His bid covers trimming services which consists of removing all dead,
diseased and interfering branches. Particular attention to raising crowns
properly and to training out trees to develop strong permanent structures.
All wounds to be made properly so the bark will heal over and sealed to
prevent decay. All existing wounds, places wher&the bark has died and
split areas, to be correctly treated and sealed over. To brace trees by
means of cadmium —plated rods, a total of 111 brace rods, 85 of 3/4
inch diameter and 26 of one—half inch diameter. To thoroughly spray
trees with a scale oil at the proper strength to control oyster shell
scale and European elm scale infesting most of the elm trees. To remove
all branches and rubbish from the premises as the work progresses. To
furnish all labor and material and complete this job entirely to our
satisfaction. Mr. Hoyt advises he is insured by the Central Surety &
Insurance Corp. of Kansas City, Mo. Employers Liability and workmen's
dompensation insurafice, also public: liability and property damage, in
the amount of 0,000 and $10,000 each. Agents Quinland and Tyson of
Evanston, Illinois. '
We respectfully request the City of Des Plaines appropriate 195.00 -for
one—third of this'expense and sign a contract immediately with Donald
R. Hoyt so that he can complete the pruning of all the maple trees by
April 1st and all the elm trees by May 1, 1941.

The Cumberland Wd ntenance Corporation is prepared to submit payment of
$380.00 to cover two—thirds of this expense at the direction of the
City.
As covered in our Letter of January 3rd we request that the work be
approved by the Chairman of our Grounds and Parks Committee, Mr. Otto
Damgaard, before its completion is, accepted by the City.

DESIGNATED THE "ANNUAL APPROPRIATION BILL" FOR
- THE FISCAL YEAR COMrENCING JANUARY 1, 1941 AND
ENDING DECEMBER 31, 1941.
The motion was made by Alderman Johnson and seconded by Carlson to finally pass and
adopt this proposed ordinance and cause the same to be published in the "Des Plaines
Journal." The Mayor put the question and the Clerk called the roll with the following
result: Ayes; Aldermen Carroll, Johnson, Henrich, Loos, Carlson, Friott, Lemke,
Schwanbeck and Campagna. Nays; None. The Mayor thereupon declared the motion carried
and the said ordinance passed.
MAYOR Ahbe thereupon approved the said ordinance by affixing his signature
which was attested by Edgar J. Friedrich, City Clerk.
The motion was made by Alderman Henrich and seconded by Loos to instruct the
City Attorney to prepare an ordinance amending the Salary Ordinance so as to makethe
salaries of City Marshall, Police Sergeant and Fire Department lieutenant conform to
the appropriations made therefor in the 1941 appropriation Ordinance. The motion was

RECONSIDER ACTION REGARDING INSURANCE: The Clerk then read the following

Gentlemen:
Referring to your letter of March 10th requesting us to cover two fire
trucks in accordance with our bid of recent date, we desire to state
our position in this matter and wish to call -your attention to the
following.
Item One of your bid calls for Workmen's Compensation insurance to
cover the various employees of the -City. - Of this item we were the
lowest bidder.
As the City completely disregarded this fact and awarded the policy to
the next highest bidder, in our opinion, you forfeited any rights you may
have acquired as a result of this bid.

Being the lowest bidder and complying with all of the conditions of your
proposal, we are entitled to the award of this policy.
Item No of your proposal requested a policy to cover your automotive
equipment. On this bid we were high, and therefore cannot but agree with
your action in giving it to the lowest responsible bidder. Our only
complaint is that we did not have a chance to rebid as was done in
Item Three.
Item Three requested coverage for the Volunteer Firemen and specified
a principal sum of 0,000.00 and weekly indemnity of 25.00.
Our bid was in accordance with your specifications; however, the policy
was awarded to a company who submitted an alternate bid not in. accordance
with the specifications and on which all of the other bidders had no chance_
to compete. After the bids were opened this company was permitted to chang
their bid so that it would comply with the specifications called for in e
the original proposal. This entirely disregards all practices covering
sealed bids and tends to defeat its very purpose.
Under the policy accepted the premium is based on a certain charge per
individual member; and separate policies are issued to cover each in-
dividual member. If the number of firemen is increased, the premium is

is likewise increased; whereas, under our policy, which is a blanket form, it
covers any and all members regardless of the number at the same price. Under the
policy accepted, the company's insuring clause provides payment on bodily injury
sustained only while the firemen are actually engaged in performing the duties
of Volunteer Firemen, and while going to or coming from a fire. Whereas, the
policy that we bid would have furnished this coverage, and in addition provides
protection for the firemen on drills, parades, and tests and trials of any fire
fighting apparatus. The policy accepted makes no reference to indemnity for
non -disabling injury; whereas our policy provides that if injury does not re-
sult in any loss of time for which indemnity is payable, our company would pay any
mdedical and surgical costs caused by this non -disabling accident not to exceed the
weekly indemnity of one week.
Item Four requested fire and theft protection on the two fire trucks and again we
were the lowest bidder and were awarded this bid; but -we do not feel obligated to ac-
cept this award due to the fact that the city did not award us the other policies
on which we were the low bidders. We would be perfectly willing to write this
business provided we were awarded all of the policies on which we were low.
Item Five requested OLT coverage on the signs in the city. We bid a flat price
of $50.00 based on the information obtained that the number of signs exceeded 250.
The successful bidder bid a minimum price which is subject to change based on the
number of signs. As all bidders were not furnished -with the correct number of signs
to be covered, this appears to show favoritism in favor of the successful bidder
who was albe to base his advance premium on a smaller number of signs to be
7r' covered than the other bidders.
As all the rules and regulations covering sealed bidding have been disregarded,
we desire to protest the action of the City Council in awarding these policies
and request earnest reconsideration of your action.

We suggest that all bids be rejected and new bids taken from all bidders based on
specifications prepared irr advance which will limit the bidding to specific
conditions, giving each bidder an equal chance.
Any award should be in accordance with the specifications written, and no
alternates allowed or considered unless requested on the original bid proposal.
The insurance covering the two trunks will be covered by binder until such
time as you can arrange for coverage; however, if you reject all bids and
readvertise, we will be pleased'to arrange to cover all items on binder until
such time as permanent policies can be issued.

Superintendent of Public Works. The motion was voted upon by acclamation whereupon
the Mayor declared the motion carried.
APPROVAL OF MINUTES: Each member of the Council having been supplied
a copy of the minutes, of the regular Council meeting held Monday, March 3, 1941,
the motion was. made by Alderman Carlson and seconded by Loos to approve the said min-
utes as presented. The motion was voted upon by acclamation whereupon the Mayor
