MINUTES OF THE REGULAR MEETTNG OF THE CITY
COUNCIL OF THE CITY OF DES PLAINES HELD IN
THE COUNCIL CHAMBERS ON MONDAY, JANUARY 6, 1941
at 8:00 P.M.
CALL TO ORDER: The meeting was called to order by Mayor Hobart M. Ahbe,
presiding, with Aldermen Johnson, Henrich, Loos, Dopheide, Carlson, Friott, Lemke,
Schwanbeck and Campagna responding to the roll call. Alderman Carroll was absent
during the entire meeting. _
REPORTS OF OFFICERS: The Clerk then presented reports for the month of
December 1940 of the following officers:
Edgar J. Friedrich, City Clerk
Charles M. Larson, City Treasurer
Frank F. Scharringhausen, Building Inspector
Arthur Rieck, Electrical Inspector
The annual reports covering the calendar year of 1940 of Frank F. Scharringhausen,
Building Inspector, and Arthur Rieck, Electrical Inspector were also presented.
The Mayor ordered these reports placed on file.
STANDING COMMITTEE REPORTS: None of the standing committees of the
Council had reports to offer.
ORDINANCE REGULATING DEVELOPMENT OF SUBDIVISIONS: The Clerk then read
the following letter:

of the City Council of
the City of Des Plaines, Ill.
Gentlemen:
Your Plan Commission has received the proposed Subdivision
Ordinance which was referred to the said commission for
study and recommendation, and has had two sessions at
which members of the commission thoroughly discussed the
ordinance.
We feel that such an ordinance is not only desirable, but
necessary and since we should like to go into several de—
tails more thoroughly, we should like to hold another
meeting for final approval of the 'same.
You may expect the commission's recommendation at the
next regular meeting of your Council.

ORDINANCE PROHIBITING TOWING OF BOB -SLEDS ETC. The Clerk then read
for first reading the following proposed ordinance:
AN ORDINANCE AMENDING SECTION 86 OF THE
CITY OF DES PLAINES TRAFFIC ORDINANCE
BE IT ORDAINED by the City Council of the City of Des Plaines,
Cook County, Illinois:
Section I. That Section 86 of the City of Des Plaines
Traffic Ordinance be amended to read as follows:
"SECTION 86. It shall be unlawful for any

person to knowingly drive any vehicle within
the City of Des Plaines to which there is
attached and being towed any bob sled, sled,
toboggan, wagon, or other device occupied by
any person or persons, and it shall be un-
lawful for any person to ride upon any bob-
sled, sled; -toboggan, wagon, or other device'
which is being towed by any vehicle within
the City of Des Plaines.".
SECTION II. Any person found guilty of violating any of the
provisions of this ordinance shall be fined not more than
Twenty-five 025.00) Dollars.
SECTION III. This ordinance shall be in full force and
effect from and after its passage, approval and publication
according to law.

The motion was made by Alderman Campagna and seconded by Friott to suspend the
rules and place this proposed ordinance on passage. The Mayor put the question on
the motion to suspend the rules and the Clerk called the roll with the following
result: Ayes: Aldermen Johnson, Henrich, Loos, Dopheide, Carlson, Friott,
Lemke, Schwanbeck and Campagna. Nays: None. The Mayor thereupon declared the
motion carried, the rules suspended and the proposed ordinance before the
Council for final desposition.
The motion was then made by Alderman Campagna and seconded by Lemke to
finally pass and adopt the proposed ordinance. The Mayor put the question and
the Clerk called the roll with the following result: Ayes: Aldermen Johnson,
Loos, Carlson, Friott, Lemke, Schwanbeck and Campagna. Mays: Aldermen Henrich,
and Dopheide. The Mayor thereupon declared the motion carried and the said or-
dinance passed.
The Motion was then made by Alderman Loos and seconded by Carlson to
authorize and direct the City Clerk to cause this ordinance to be published in
the "Des Plain6e Journal." The motion was voted upon by acclamation whereupon
the Mayor declared the motion carried.
SETTLEMENT - CITY VS B.W. CONSTRUCTION CO: The Clerk then read the
following proposed resolution:
RESOLUTION
WHEREAS there is pending in the Circuit Court of Cook County
a certain suit wherein the City of Des Plaines is the plaintiff and
B W Construction Company and American Surety Company of New York are
the defendants; and' '
WHEREAS an offer of settlement by the defendants in the said cause
has been made whereby the American Surety Company offers to pay
Eight Thousand Seven Hundred and Fifty Dollars ($8750.00) in full
settlement of said cause; and
WHEREAS the City Council has been fully advised as to the advisa-
bility of accepting said offer of settlement;
NOW THEREFORE be it resolved by the City Council, City of Des Plaines,
that the offer of the American Surety Company to pay Eight Thousand Seven
Hundred and Fifty Dollars (w8750.00) in settlement'of the City'a cause

of action against the B. -W Construction Company and the American
Surety Company be accepted.
BE IT FURTHER RESOLVED that upon receipt of said settlement
check, the City Clerk is instructed to pay Rosen, Francis &
Cleveland, attorneys -at -law representing the city -in said matter,
the balance of their attorneys' fees in accordance with the agreement
heretofore entered into with said attorneys and the City•of Des Plaines.
BE IT FURTHER. RESOLVED that the Mayor and said City Clerk are
hereby authorized to execute any and all necessary releases on
behalf of the City of Des Plaines in connection with said settlement.
The motion was made by Alderman Henrich and seconded by Lemke to adopt this
proposed resolution. The motion was voted upon by acclamation whereupon the
Mayor declared the motion unanimously carried and the resolution adopted.
FREE 1941 VEHICLE LICENSE TAGS FOR FIREMEN: The motion was made
by Alderman Dopheide and seconded by Johnson to authorize and direct the
Clerk to issue a free 1941 City vehicle lincense tag to each member of the
Fire Department. The motion was voted upon by acclamation whereupon the Mayor
declared the motion carried.

CUMBERLAND WANTS TREES TRIMMED: The Clerk then read the following
CUMBERLAND MAINTENANCE CORPORATION
Des Plaines, Illinois

Des Plaines, Illinois
Gentlemen:
Your attention is respectfully called to the necessity of pruning
trees in city parkways along streets in Cumberland.
Approximately 300 American Elm and 150 Hard Maple trees, all of
good grade, were planted in Cumberland by the original sub-
divider at no expense to the City. These trees have had no
regular maintenance or general pruning. All these trees and par-
ticularly the elm trees have in recent years been growing very
rapidly with the result the majority are unbalanced and over-
extended. This has resulted in frequent and repeated wind damage.
After almost every wind storm it has become necessary for the city
to cut out and remove numberous broken limbs. This expense to 'the city
may not be easy to appraise. But if these trees are permitted to
continue to grow without an immediate good pruning, this expense to the
city is going to mount rapoly. In addition many of these trees, which
have become of appreciable value to the city and the community will
be irreparably damaged.
In view of the above condition of these trees, a General Meeting of
the Cuirland Maintenance Corporation on December 3, 1940 author-
ized our Board of Directors to recommend that we together with the
real estate interests in Cui rland share with the City of Des Ple.ines
the expense of pruning all the original trees planted in Cumberland
parkways.
At this time we are pleased to report that the H. M. Cornell Co.
and the Cumberland Trust Co., who own the bulk of vacant property
in Cumberland have indicated a willingness to cooperate in sharing the
expense of pruning all the trees as above indicated with the City.
We in turn ask that the city agree that the work be done satis-
factory to our Chairman of Grounds and Parks Committee, Mr. Otto
Damgard, who is by profession a landscape contractor.
It is appropriate here to indicate that the general good appearance

of Cumberland, such as the movwing of vacant lots and all mowing of
parkways, has for over ten years been maintained by the Maintenance
Corp without the City sharing in this maintenance. In spite of the
recent economic adversities, through this upkeep Cumberland has
maintained an attractiveness that contributed to the eventual settle—
ment of four—fifth of the special assessment and will immediately
restore this same proportion oflproperty to the regular tax paying
basis. In addition there is also every promise that Cumberland
will immediately enjoy an excellent home construction activity.
The city in turn is to benefit directly by increased revenues from
taxes, both in arrears and in the future, and indirectly by greater
general business.
To do this pruning at this time will serve to attract more and
better homes to Cumberland within the next several years. This
action will in addition eliminate the liability of possibly even
greater expense to the City in repeated removal of wind blasted
limbs and trees without the benefit of having preserved their
utility and beauty.

CUMBERLAND MAINTENANCE CORPORATION
Mr. Otto Damgard, a member of the Cumberland Maintenance Corporation, a
nurseryman addressedthe Council briefly, stating that the cost of properly
trimming the parkway trees in Cumberland would be about $435.00 of which the
Maintenance Corporation is ready to pay 50%.
The motion was made by Alderman Johnson and seconded by Henrich to
refer this matter to the Streets and Sidewalks Committee for study and report,
with the suggestion that trimming of all parkway trees in the City be given
consideration by the committee. The motion was voted upon by acclamation
whereupon the Mayor declared the motion carried and the matter so referred.
COMMITTEE TO PROVIDE SKATING FACILITIES: Alderman Dopheide then
inquired as to what is being done about providing skating facilities in the
City this winter. Mayor Ahbe referred this matter to a special committee
consisting of Alermen Lemke, Loos and Johnson, with full power to act.
CROSSING GATES FOR PEARSON STREET, LEE STREET AND GRACELAND AVENUE:
Kenneth G. Meyer, city attorney then reported that he together with
Mr. A. C. Kadlec and Mr. Morris Houser of the Citizen's Committee held a
meeting with Mr. Williams and other ranking officials of the Chicago and
Northwestern Railroad Co., and were assured of full cooperation in the matter
of providing gates at the Pearson Street, Lee Street and Graceland Avenue
crossings.
PROPOSE AMENDING LIQUOR ORDINANCE. ' The motion was made by Alderman
Johnson and seconded Lb y Henrich to instruct the City Attorney to prepare an
amending ordinance eliminating from the Liquor Ordinance the provision
that liquor dealers be closed for business during school elections. The
motion was voted upon by acclamation whereupon the Mayor declared the motion
carried.
AUTHORIZE CHANGE IN POLICE RADIO: Upon the request of City Marshall,
Howard A. Becker, the motion was made by Alderman Henrich and seconded by Campagna
to authorize an expenditure of $50.00 for the purpose of making such changes
in the Police Radio as are necessary to permit monitoring the Cook County
Highway Police Station on Milwaukee Avenue and Ballard Road. The motion was
voted upon b acclamation whereupon the Mayor declared the motion carried.
TARRING CRACKS IN STREETS: Alderman Dopheide then urged that more
regular attention be given to the tarring of cracks in street paving. However
no action was taken by the Council at this time.
APPROVAL'OF MINUT:S: Each member of the Council having been supplied
with a copy of the minutes of the regular Council meeting held Monday, December 16,
1940, the motion was made by Alderman Dopheide and seconded by Lemke to approve

the said minutes. The motion was voted upon by acclamation whereupon the
Mayor declared the motion carried and the said minutes approved.

METHODIST EPISCOPAL CHURCH INVITES COUNCIL: Mayor Ahbe then announced
to the Council that Rev. Bohi, pastor of the Methodist Episcopal Church of
Des Plaines has extended an invitation to all. City Officers and employees to
attend a special civic service at his church at 8:00 P. M. Sunday, January 12,
1941, and to take part in a short social program following the service.
ADJOURNMENT: The motion was made by Alderman' Lemke and seconded by
Friott'to adjourn. The motion was voted upon by acclamation whereupon the
Mayor declared the motion carried and the Ccirly adjourned.
