1 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES HELD IN THECOUNCIL"CHANES ON MONDAY, NOVEMBER 19, 1940 at $:00 PM CALL TO ORDER: The meeting was called to order by Mayor Hobart M. Ahbe; presiding with Aldermen Carroll, Johnson, Henrich, Loos, Dopheide, Carlson, Friott, Lemke, Schwanbeck, and Campagna reporting to the roll call. The Clerk reported all members of the Council present. REPORTS OF STANDING COMMITTEES: None of the standing committees of the Council had reports to offer. CITY ENGINEER TO ATTEND TRAFFIC CONFERENCE: Upon the suggestion of E. N. Fletcher, City Engineer, the motion was made by Alderman Lemke and seconded by Johnson to authorize the City Engineer to attend the Traffic Conference to be held under the auspices of the State Highway Department at the University of Illinois November 26 to 29, 1940, and to authorize an expenditure of not to exceed $25.00 for this purpose. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried. REZONE DO -ALL PROPERTY FOR INDUSTRIAL "A": The Clerk then read in 71-1 full for first reading the following proposed ordinance, rezoning the Do -All �--+ Manufacturing Company property bounded by the Soo Line Railroad, Thacker Street, Oakwood Avenue and the alley between the Soo Line Tracks and Grace - land Avenue as Industrial District "A",: AN ORDINANCE AMENDING AN ORDINANCE ENTITLED: "AN ORDINANCE TO CLASSIFY, REGULATE AND RESTRICT THE LOCATIONS OF TRADES AND INDUSTRIES AND THE LOCATION OF BUILDINGS DESIGNED FOR SPECIFIED USES; TO REGULATE AND LIMIT THE INTENSITY OF THE USE OF LOT AREAS AND TO REGULATE AND DETERMINE THE AREA OF YARDS, COURTS AND OTHER OPEN SPACES WITHIN AND SURROUNDING SUCH BUILDINGS, AND TO ESTABLISH THE BOUNDARIES OF DISTRICTS FOR THE SAID PURPOSE AND PRESCRIBING PENALTIES FOR THE VIO- LATION OF ITS PROVISIONS." Passed on the Fifth day of Feb- ruary, A,D., 1923, as Heretofore Amended. BE IT ORDAINED by the City Council of the City of Des Plaines, Cook County, Illinois: SECTION 1. That an ordinance entitled "An Ordinance to Classify, Regulate and restrict the Locations of Trades and Industries and the Location,of Buildings Designed for Specified Uses; to Regulate and Limit the Intensity of the Use of Lot Areas and to Regulate and Determine the Area of Yards, Courts and Other Open Spaces within and Surrounding such Buildings, and to Establish the Boundaries of Districts for the said Purposes and Prescribing Penalties for the Vio- lation of its Provisions" passed on the fifth day of Feb- ruary, 1923, as heretofore amended, be amended by taking out of the Commercial District, as therein defined, and placing in the Industrial District A the following described premises to wit: Lots 1, 2, 3, 4, 5 in Block Nine (9) in Des Plaines Manor Tract No. One (1) a Sub - Division of part of Section 17 and 20, Town 41 North, Range 12, East of the Third Principal Meridian, according to Plat recorded July 14, 1911 as Document No. 4793563. SECTION 2. All ordinances or parts of ordinances conflicting with the provisions of this ordinance are hereby repealed. 401 402 Ordinance (contd) SECTION 3. Any person, firm, or corporation who violates, disobeys, omits, neglects, or refuses to comply with or who resists enforce- ment of any of the provisions of this ordinance, shall be fined not less than Twenty-five Dollars ($25.00) nor more than Two Hun- dred Dollars (200.00) for each offense. Each day that a violation is permitted to exist shall constitute a separate offense. SECTION 4. This ordinance shall be in full force and effect from and after its passage, approval and publication, according to law. PASSED this 18th day of November A.D. 1940 Edgar J. November 19, 1940 , The motion was made by Alderman Henrich and seconded by Lemke to suspend the rules and place the said proposed orinance upon its final passage. The Mayor put the question and the Clerk called the roll with the following re- sult: Ayes: Aldermen Carroll, Johnson, Henrich, Loos, Dopheide, Carlson, Friott, Lemke, Schwanbeck and Campagna. Nays; none. The Mayor thereupon declared the motion carried, the rules suspended and the said proposed or- dinance before the Council for final disposition. The motion was then made by Alderman Lemke and seconded by Henrich to finally pass and adopt the said proposed ordinance. The Mayor put the question and the Clerk called the roll with the following result: Ayes; Aldermen Carroll, Johnson, Henrich, Loos, Dopheide, Carlson, Friott, Lemke, Schwanbeck and Campagna. Nays; None. The Mayor thereupon declared the motion carried and the said ordinance passed. Mayor Abbe then approved the said ordinance by means of his signature which was attested by Edgar J. Friedrich, City Clerk. The motion was thereupon made by Alderman Henrich and seconded by Loos to instruct the Clerk to cause the said ordinance to be published in the Des Plaines Journal. The motion was voted upon by acclamation where- upon the Mayor declared the motion carried. AUTHORIZE DELIVERY OF $17.200.00 - 1940 JUDGMENT FUNDING BONDS - SECOND SERIES: The Clerk then read the following proposed reso- lution: RESOLUTION with respect to the delivery of Seventeen Thousand Two Hundred Dollars (17,200.00) 1940 Judgment Funding Bonds, Second Series. *********###***** ******#***t WHERAS, This, the City Council of the City of Des Plaines, County of Gook and State of Illinois, heretofore on November 4, 1940, adopted an ordinance providing for the issuance of Seventeen Thousand Two Hundred Dollars ($17,200) 1940 Judgment Funding Bonds, Second Series, to be dated as of November 15, 1940; and WHEREAS. said ordinance has been.duly approved by the Mayor and recorded in the records of said City; and WHEREAS, said ordinance has been duly published in The Des Plaines Surburban Times, a secular newspaper of general circulation in this City saletxxix and which has been regularly published Resolution (contd) in this City for at least six (6) months prior to the adopt- ion of said ordinance, such publication having been made on the day of November, 1940, as evidenced by certificate of publication which is now a part of the official records of this City; and WHEREAS, it is for the best interests of this City that Seventeen Thousand Two Hundred Dollars ($17,200.00) of said bonds be prepared and delivered as promptly as possible to the purchaser and at least a like par amount of said judgments be paid simultaneously therewith. NOW, THEREFORE, Be It and It Is Hereby Resolved by the City Council'of the City of Des Plaines, in the County of Cook and State of Illinois: Section 1. That the facts recited in the preamble hereof are true. Section 2. That sale of Seventeen Thousand Two Hundred Dollars ($17,200.00) of said bonds numbered to C. LMcNear & Company, Chicago, Illinois, at not less than the par value thereof be and the same is hereby ratified, approved and confirmed. Section 3. That the officials of this City are hereby directed to take all steps necessary or proper to procure the prompt execution and delivery of said Seventeen Thousand Two Hundred Dollars'($17,200.00) bonds and the payment and cancellation of at least a like par amount of the judgements to be funded by the issuance of said bonds. Section 4. That a certified copy of this resolution be filed with the Treasurer of this City. Section 5. That all resolutions and parts of resolutions in conflict herewith be and the same are hereby repealed and this resolution shall be in full force and effect forthwith upon its adoption and approval. The motion was made by Alderman Henrich and seconded by Johnson to adopt this proposed resolution. The Mayor put the question and the Clerk called the roll with the following result: Ayes; Aldermen Carroll, Johnson, lenrich, Loos, Dopheide, Carlson, Friott, Lemke Schwanbeck and Campagna. Nays; None. The Mayor thereupon declared the motion carried and the said resolution adopted. SAFETY GATES AT PEARSON STREET, LEE STREET AND GRACELAND AVENUE CROSSINGS: Mrs. Morris Houser, A. C. Kadlec and Charles Garland representing a citizens' committee for obtaining safety gates at Pearson Street, Lee Street and Graceland Avenue crossings of the Chicago and Northwestern Railraod tracks addressed the Council assuring the Council of the comanittees cooperation, and requesting a confirmation of the se- lection of E. P. Reilley, L. F. Meinshausen and William Mercer as checkers in connection with conducting the necessary traffic studies at the crossings in question. The motion was made by Alderman Johnson and seconded by Henrich that the said selection be approved and confirmed. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried. The Clerk then read the following letter: MADDEN, MECCIA & MEYER City Council, Municipal Building Des Plaines, Illinois Gentlemen: In re: Proceedings before Commerce Commission for crossing gates. There is handed you herewith original and in duplicate, a petition to be filed with the Illinois Commerce Commission and which should be signed by the Mayor or City Clerk of 403 404 Letter (contd) the City, whichever is authorized by Council so to sign. I notice, from the local press, that an estimate has been given as to the cost and expense to be incurred in connection with these proceedings, and to my knowledge, the City Council has not authorized or directed the expenditure of any moneys ex- cept to cover the cost of paying those individuals who will make the traffic count. It is true that scale drawings of each crossing will have to be prepared, and I believe that the City Council should have control over the moneys to be expended in these proceedings, for it may develop that some or all of these charges will eventually be presented to the Council for payment. While the article in the press indicated that the money was coming from civic bodies and organizations, I believe there should be some definite understanding on the part of the Council about this matter. With respect to attorney's fees, you are, 1 believe, fully aware that no additional charge is made by me, or can be made by me, for my services before the Commission; and I have not requested the employment of any special attorney, nor do I believe that the*City Council contemplates engaging additional attorneys. If you believe such is necessary, you have the perfect right so to do. 'However, I feel perfectly confident that I can handle this case for you without any extra legal assistance. The proceedings before the Commission for the purpose of obtaining gates at the River Road crossing were handled entirely by me with the assistance of Chief Drexler and those who worked under his supervision, including the Chicago Motor Club. I am informed that the traffic survey will be made immediately, and if such is the case, the enclosed petition can be filed immediately, for it will be at least thirty days before a hearing date is set in this -matter. Friedrich City Clerk City Hall Des Plaines, Illinois Dear Mr. Friedrich: Receipt is acknowledged of certified copy of a resolution 1 Letter (contd) adopted by the City Council of the City of Des Plaines, requesting the relocation of SBI Route 62 through Des Plaines. This resolution will be given careful consideration by the De- partment and I shall be glad to inform you of any action taken by the Department with respect thereto. PROVISION FOR HAULING TREE STUMPS: The Clerk then read the fol- lowing report: COMMITTEE REPORTS To E. N. Flecther, City Engineer, at the meeting of the City Council held September 16, 1940 the following matter was re - C4 ferred to you: �-� The matter of providing a sufficient number of trucks to as- sure prompt removal of tree stumps after, they have been dug up by W. P. A. labor.. EDGAR J. FRIEDRICH, City Clerk. Des Plaines, Ill., Nov. 18, 1940 To the Mayor and City Council: Your Committee on the above matter has investigated the above and has found: that by using a trailer, which one of the Des Plaines business men has offered to donate for this purpose, these tree stumps can be taken care of. We, your Commitee therefore recommend: that the Superintendent of Public Works be authorized to borrow this trailer and to use same for the above work. E. N. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried. The motion was then made by Alderman Dopheide and seconded by Henrich to order that adequate public liability and property damage in- surance be provided for the trailer in question before the same is put to use by the City. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried. COMPLAINTS - LEE-THACKER PEDESTRIAN UNDERPASS: The Clerk then read the following letter: IMMANUEL EVANGELICAL LUTHERAN SCHOOL The Hon. Mr. Hobart Ahbe, Mayor, and the Member of the Council of the City of Des Plaines Gentlemen: Winter with its slush, ice, and snow will soon be upon us. These will greatly aggravate the already extremely bad con- dition of the underpass at Lee and Thacker Streets. 405 406 Letter (contd) We compel our pupils to make use of this underpass, but past experiences have taught us to expect strenuous objections on the part of parents to its enforced use by their children. The walls of the underpass are covered with words and pictures that are not at all conductive to the uplift of the morals of our children. We therefore respectfully urge your august body to take this problem under careful consideration with the view of reaching a reasonable solution of the same. Very truly yours, (Signed) Theodore W. Gentlemen: As secretary of the Board of Education, District 62, I have been instructed to write you with regard to the filthy condition of the pedestrain subway under Lee Street which is used by the children of Central School. The Board is definitely of the opinion that something should be done to remedy the present condition of this subway as well as to ensure proper care in the future. Order the Superintendent of Public Works to clean the walk and floors of this subway, and to provide signs warning against defacing walks, under threat of arrest and fine. 2. Order the City Clerk to write the principals of the re- spective schools involved asking that especially older pupils be warned against defacing the walls of the subway. 3. Refer to the City Engineer the matter of talking steps to keep the floor of the underpass dry. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried. Q.P.A. RECREATIONAL PROJECT DISCONTINUED: The Clerk then read the following • letter: Des, Plaines, Illinois , November 15, 1940 City Council _Des Plaines, Illinois .Gentlemen: ,At a meeting held early this summer, it was decided the Des .Plaines Recreati©nal Council discontinue, its activities. This ,decision was made in view of the difficulty encountered in ,finding a suitable place for the recreational facilities and -because of the discontinuance of W.P.A. assistance. , ,It was further voted to turn over the mosey left in the ,treasury, in the amount of $14.90, to the Des Plaines Nurse & .Welfare Association. The Mayor put the question and the Clerk called the roll with the following result: Ayes; Alderman Carroll, Johnson, Henrich, Loos, Dopheide, Carlson, Friott, Lemke, Schwanbeck and Campagna. Nays; None. The Mayor thereupon declared the motion carried and the said resolution adopted. Alderman Loos then questioned the authority of Paul Fiantago regular garbage truck driver to hire a relief driver for his truck without approval of the superintendent of the department. The motion was then made by Alder- man Henrich and seconded by Schwanbeck to instruct the Mayor and Clerk to de- duct from the next payroll warrant due Paul Fiantago the sum of $11.55 to compensate for an equal sum -paid to Joe Palmer hired by Fiantago. The motion was voted upon by acclamation whereupon the Mayor declared the mthtion carried. APPROVAL OF MINUTES: Each member of the Council having been suplied a copy of the minutes of the regular Council meeting held November 4, 1940, the motion was made by Alderman Dopheide and seconded by Loos to approve , the said minutes as submitted. The motion was voted upon by acclamation , Approval of Minutes (contd) whereupon the Mayor declared the motion carried and said minutes approved. REPORTS DEATH OF E. H. DREXLER, CITY MARSHALL: Alderman Carroll, chairman of the Police and License Committee then officially reported that City Marshall Ernest H. Drexler died on Saturday, November 9, 1940 after having suffered a sudden and unexpected heart attack on the evening of November 4, 1940. The motion was made by Alderman Carroll, and seconded by Dopheide that the members of the Council rise and stand in a brief silent tribute to Ernest H. Drexler as an expression of thanks and appreciation for his untiring efforts for the welfare of the City and its citizenry. The members of the Council as well as the citizens present there arose and stood in a thirty—second silent tribute, whereupon the Mayor declared the motion carried. The motion was then made by Alderman Campagna and seconded by Carroll to instruct the Clerk to write Mrs. Drexler an appopriate letter ex— pressing the Council's sympathy and thanks for the loyal service rendered the community by her late husband in the capacity of City Marshall. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried. ADJOURNMENT: The motion was made by Alderman Lemke and seconded by Carroll that the Council adjourn.
