11/04/1940MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES HELD IN THE COUNCIL CHAMBERS ON MONDAY, NOVEMBER 4, 1940 at 8:00 P.M. CALL TO ORDER: The meeting was called to order by Mayor Hobart M. Ahbe, presiding, with Aldermen Carroll, Johnson, Henrich, Loos, Dopheide, Carlson, Friott, Lemke, Schwanbeck, and Campagna responding to^the roll call. The Clerk reported all embers of the Council present, 395 REPORTS OF OFFICERS: The Clerk then submitted the following re- ports for the month of October, 1940: The report of Edgar J. Friedrich, City Clerk The report of Charles M. Larson, City Treasurer The report of Frank F. Scharringhausen, Building Inspector The reportt of Arthur Rieck, Electrical Inspector The Mayor ordered the said reports placed on file. REPORTS OF STANDING COMMITTEES: None of the standing cpm- mittees of the Council had reports to offer. C4 FT,ECTRIC CONTRACT FOR WATER PUMPING AND LIGHT: The Clerk then rt read the following report of a joint committee consisting of the Water Committee and the Streets and Sidewalks Committee: COMMITTEE REPORTS To the Chairman Schwanbeck, Streets & Sidewalks and Lemke, Water Committee, at the meeting of the City Council, held September 3, 1940 the following matter was referred to your committee: - The matter of studying and making recommendations regarding the proposed re-newal contract of the Public Service Co. of Northern Illinois for street lighting and power for pumping water expiring September 16, 1945 (rate 105) was referred to a joint committee consisting of the Streets & Sidewalks Committee and the Water Committee. Two copies of the said proposed contract are attached hereto. Please be sure to return both of them with your report. E. J. Friedrich - City Clerk Mr. Lemke: P. S. Since water pumping is the greater part of this con,- tract on-tract I have sent you this notice and am relying upon you to call whatever meeting you may need to consider this contract. EJF Des Plaines, Illinois, October 28, 1940 To the Mayor and City Council: Your Committee on Water & Streets has investigated the above and has found: The Attached contract from Public Service Co is the same rate as last year. The motion was voted upon by acclamation whereupon the Mayor de- clared the motion carried and the said report concurred in. AUTHORIZE LEASE OF CHICAGO AND NORTHWESTERN RAILROAD PARK: The Clerk then read the following report: COMMITTEE REPORTS To Kenneth G. Meyer - CITY ATTORNEY, at the meeting of the City, Council, held October 21, 1940 the following matter was referred to you: The proposed five year maintenance lease agreement (#46665 ex- piring September 1, 1945) between the Chicago Northwestern Rail- road Co. and the City of Des Plaines, covering the six parcels of park lying along the said railroad. between Des Plaines Ave. and Graceland Ave. was referred to you for examination and recommendation. EDGAR J. FRIEDRICH, City Clerk _Des Plaines, Illinois To the Mayor and City Council: Your Attorney has investigated the above and suggested certain corrections in said lease which have been accepted by the Rail- road and made on said lease. Your Attorney, therefore recommends: That the Mayor and City Clerk be authorized to execute the said lease for and in the name of the City of Des Plaines. KENNETH S. MEYER - City Attorney The motion was made by Alerman Henrich and seconded by Friott to concur in the said report. .The motion was voted upon by acclamation whereupon the Mayor declared the motion carried and said report concurred in. The motion was then made by Alderman Henrich and seconded by Dopheide to offer the said lease to the Des Plaines Park Districht on a sub- leasing arrangement for maintenance. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried. ADDITIONAL FIRE HYDRANTS IN CUMBERLAND TERRACE: E. M. Fletcher, City Engineer, reported that the three, additional fire hydrants have been satisfactorily installed in Cumberland Terrace by the Bmeigar Organization. $17.200.00 - 1940 JUDGEMENT FUNDING BONDS - SECOND SERIES: The Clerk then read in its entirety for first reading a proposed ordinance en- titled: ORDINANCE providing for the issuance of Seventeen Thousand Two Hundred Dollars ($17,200) 1940 Judgment Funding Bonds, Second Series, of the City of Des Plaines, Cook County, Illinois, and providing for the collection of a direct an- nual tax for the payment of principal of and interest on said bonds. The motion was made by Alderman Henrich and seconded by Johnson to suspend such rules of the Council as might present the passage of the said proposed ordin- ance at this meeting and to place the said proposed ordinance on final passage. The Mayor put the question on the motion to suspend the rules and place on final passage, and the Clerk called the roll with the follow- ing result: Ayes; Aldermen Johnson, Henrich, Loos, Dopheide, Carlson, Friott, Lemke, Schwanbeck, and Campagna. The Mayor thereupon declared the motion carried, the rules suspended and the said proposed ordinance before the council for final desposition. 1 Ordinance (contd) The motion was then made by Alderman Johnson and seconded by Carl- son to finally pass and adopt the said proposed ordinance. The Mayor put the question and the Clerk called the roll with the following result: - Ayes: Aldermen Johnson, Henrich, Loos, Dopheide, Carlosn, Friott, Lemke, Schwan- beck, and Campagna. Nays: None. The Mayor thereupon declared the motion carried and the said ordinance passed. Mayor Hobart M. Abbe then affixed his signature to the said or- dinance in approval thereof and Edgar J. Friedrich attested the said approval by affixing his signature and the corporate seal of the City of Des Plaines. CUMBERLAND INTERCEPTOR SEWER EXTENSION: The Clerk then read the following letter: THE SANITARY DISTRICT OF CHICAGO Mr. Edgar J. Friedrich, City Clerk City of Des Plaines Des Plaines, Illinois Dear Mr. Friedrich: The subject of your communication of October 26th as you no Cq doubt are aware is in the hands of our Engineering Department rr and Mr. Pearse is giving consideration to the various phases of policy as well as finance and procedure. This is not as ,tt simple as it would appear to b e on the face of it, for reasons which I think you understand, one of which is that it is totally within the City of Des Plaines and without saying more a bout it be assured that the Board of Trustees I know have a disposition to accord that every possible consideration to not alone Des Plaines but to other municipalities within our jurisdiction and when all of the phases and possiblities of this problem are determined you will hear from us on the subject. I don't know of any other assurance I can give you except to express the hope that in the final analysis it may work out to your satisfaction. Very truly yours, (Signed) Ross A. Woodhull The Mayor ordered this letter placed on file. EXCESSIVE RAILROAD WHISTLING: The Clerk then read the following letter: MINNEAPOLIS, ST. PAUL & SAULT STE. MARIE RAILWAY COMPANY Mr. E. J. Friedrich, City Clerk, City of Des Plaines Des Plaines, Illinois Dear Sir: In connection with your letter of October 26th relative ex- cessive whistling through Des Plaines. You no doubt realize we are obligated by law to do certain whistling for highway crossings etc, and it would be dangerous to stop it. Some cities have passed ordinances forbidding whistling within city limits, but I believe this is a bad thing to do. No doubt the whistle has savied some lives. 398 Letter (contd) Our men may be over -doing it, and we will talk it over with them to see they use their best judgment and cut their whistling down to the minimum with safety. Friedrich, City Clerk, City of Des Plaines, Illinois. Dear Sir: Receipt is acknowledged of your letter of October 26th in the matter of alleged excessive and unnecessary whistling of our locomotives when passing through Des Plaines: The matter will receive immediate attention and steps taken to prevent any unnecessary whistling in your community. WIDENING OF ALGONQUIN ROAD (KEENEY AVENUE): The Clerk then read the following letter: Members of the Des Plaines City Council Des Plaines, Illinois Gentlemen: We want to express our appreciation to our alderman, Mr. Cam— pagna, and to all members of the Des Plaines City Council for their wise action in preventing the widening of Algonquin Road. Your cooperation has been most gratifying. Very truly yours, Oct. 28, 1940 Residents of Algonquin Road Mayor Ahbe ordered the said letter placed on file. SAFETY GATES FOR LEE ST., PEARSON ST., AND GRACELAND AVE. CROSSINGS: Alderman Dopheide then briefly discussed the crying need for safety gates at the Lee Street, Pearson Street, and Graceland Avenue cross— ings of the Chicago and Northwestern Railroad tracks, referring particular— ly to the death of David Schulze, eleven years old, who was struck and killed by a locomotive at the Graoeland Avenue crossing on October 28, 1940. The motion was then made by Dopheide and seconded by Friott to solicit the services and cooperation of the Safety Council, the Chicago Safety Gates (contd) Motor Club, the State Highway Department, and all such other agencies as might be helpful, to induce the Illinois Commerce Commission to cause safety gates to be provided at the Lee Street, Pearson Street, and Graceland Avenue crossings of the Chicago and Northwestern Railroad tracks; (See Council minutes of May 13 and May 20, 1940 for previous action) and to authorize the temporary employment of three (3) men for the purpose of making traffic studies at the said crossings and otherwise gathering such other data as may be helpful in hearings regarding the said matter before the Illinois Commerce Commission. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried. PROTESTS LOW AWNINGS: Alderman Loos'called the Council's attention to the many low awnings along business streets. He stated that according to ordinance all awnings must be at least eight feet above the sidewalk. He further stated that eight feet is perhaps too high and suggested that a more reasonable ordinance might result in better compliance on the part of merchants. Mayor Ahbe referred this matter to the City Attorney with instructions to prepare an amending ordinance for consideration of the Council. VACATIONS OF CITY EMPLOYEES: The motion was made by Alderman Dopheide and seconded by Schwanbeck that in the future vacations of city employees be non-cummulative, and that all vacations be taken during the calendar year in which they are first due. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried. APPROVAL OF BILLS: The Finance Committee, through its chairman, Alderman Johnson then introduced the following proposed resolution: RESOLVED THAT THE FOLLOWING BILLS AND WAGES ARE DUE AND PAYABLE AND THAT THE MAYOR AND CITY CLERK BE AUTHORIZED TO DRAW UPON THE CITY TREASURER THE PROPER WARRANTS IN PAYMENT OF SAME 7148 Des Plaines Publ. APPROVAL OF MINUTES: Each member of the Council having been supplied with a copy of the minutes of the regular Council meeting held Monday, Oc- tober 21, 1940, the motion was made by Alderman Dopheide, and seconded by Henrich that the said minutes be approved. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried and the said minutes approved.
