08/19/1940370 MINUTES OF THE REGULAR COUNCIL MEET' OF THE CITY COUNCIL OF THE CITY OF IIS PLAINES HELD IN THE COUNCIL CHAMBERS ON THE 19th DAY OF AUGUST, 1940 A.D. AT THE HOUR OF 5:00 P.M. CALL TO ORDER: The meeting was called to order by Mayor Hobart M. Ahbe, presiding with Aldermen Johnson, Loos, Dopheide, Friott, Schwanbeck and Campagna responding to the roll call. The Clerk reported six Aldermen present, whereupon Mayor Ahbe declared a quorum present. (Aldermen Carroll, Henrich, Carlson, and Lemke were absent during the entire meeting). report: THE STREETS & SIDEWALKS COMMITTEE: The Clerk then read the following To the Chairman Schwanbeck, Streets & Sidewalks committee, at the meeting of the City Council, held July 1, 1940, the following matter was ref- erred to your committee: The matter of the possibility of re-routing the west side bus so as to have its bus stand in front of the First National Bank on Lee St. was referred to your committee for study and report. E.J. Friedrich, City Clerk To the Mayor and City Council: Your committee on Streets & Sidewalks has investigated the above and has found that after a conference with Mr. Leonard Manuel of the United Motor Coach Co. it is recommended that the "West Side" bus be re-routed as follows: "Ead;on Prairie Ave. to Graceland, north on Graceland to Ellinwood, east on Ellinwood to Lee, south on Lee to a bus stop which is to be created on the west side of the street in front of the Echo Theatre Bldg. Said bus stop is to be on the north side of the driveway between the Thiede Bldg. and the Theatre Building and is to extend 45 feet to the north from that point, also that the Supt. of Public Work be notified to erect proper signs indicating this bus stop. It is further recommended that "NO PARKING ON THIS SIDE OF STREET" signs be erected on the west side of Graceland Ave. from the center of Jef- ferson St. south of Miner St. Signed, Theo. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried and the said report concurred in. THE COMMITTEE ON PUBLIC WORKS, BULDGS. & PLATS: The Clerk then read the following report: To the Chairman Loos, Public Works, Bldgs. & Plats committee, at the meeting of the City Council, held August 5, 1940, the following matter was referred to your committee: The letter from the Henry George School of Social Science dated August 2, 1940, was referred to your committee for study and report. You will find a copy of the said letter typed upon the reverse side hereof. E.J. Friedrich, City Clerk To the Mayor and City Council: Your Committee on Public ':Yorks, Bldgs. and Plats has investigated the above and has found that the Henry George School of Social Science is not a local institution, and that we therefore recommend that the use of the Municipal Building be denied. Signed: F.A. Loos W. Dopheide 371 The motion was made by Alderman Loos and seconded by Alderman Dopheide to concur in this report. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried and the said report concurred in. CORRECTING HOUSE NUMBERS: E.N. Fletcher, City Engineer, then re- ported orally that he has given up hope of obtaining W.P.A. help in the matter of correcting the badly confused house numbers in the City, and that he has therefore proceeded with the correction of house numbers with- out W.P. A. He asked the Council to sanction this work and authorize him to proceed in this matter at the expense of the City without WPA aid. The motion was made by Alderman Dopheide and seconded by Alderman Johnson to grant this request of the City Engineer. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried. SUGGESTS CHANGE IN LAUNDRY SEWER: E.N. Fletcher, City Engineer, then informed the Council that the Perfection Laundry on East Miner Street has connected its sewer into the storm sewer, instead of into the sanitary sewer, and urged that this be corrected. The motion was made by Alderman Schwanbeck and seconded by Alderman Campagna to instruct the Clerk to notify the owners of the premises in writing to correct this sewer con- nection and that the Clerk send copies of the said notice to the Perfection Laundry and to the Superintendent of Public Works. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried. RECOMMEND "LIGHT INDUSTRY" C LSSIFICATION: The Clerk then read the following recommendation: RECOMMENDATION To the Honorable Mayor and City Council of the City of Des Plaines Des Plaines, Illinois Gentlemen: A number of times in the past, it has come to the attention of the Des Plaines Zoning Board of Appeals that the present Zoning Ordinance regarding the use of land for industrial purposes is inadequate in its provision and control of the type of industrial enterprise suitable and desirable for Des Plaines. Under our present ordinance any industry be it light or heavy can be established in the areas zoned for industrial use as long as it complies with certain broad provisions respecting noise, odor, dust and smoke. This City now has a number of small manufacturies located in Commercial Districts which exist by sufferance partly because the line of demarkation between a Commercial and Manufacturing enterprise is not clearly drawn. It appears to the Zoning Board that the creation and defining of an Industrial District restricted to Light Manufacturing usage is vital if proper protection of values and intelligent regulation is to be had. It is therefore recommended to your honorable body that the City Attorney be instructed to draw an Ordinance defining Light Industrial usage and that the City Council pass such an Ordinance creating a Light Industrial Zone within the provisions of our zoning regulations. ZONING BOARD OF APPEALS By Signed: T.R. NAPIERALSKI, Sec. The motion was made by Alderman Dopheide and seconded b;;r Alderman Johnson that the Council go on record as favoring the said recommendation, and that the City Attorney be instructed to prepare an amending ordinance embodying the changes contained therein. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried. RECOMMEND REZONING FOR DO -ALL: The Clerk then read the following recommendation: 372 RECOMMENDATION To the Honorable Mayor and City Council of the City of Des plaines Des Plaines, Illinois Gentlemen: The Zoning Board of Appeals convened a legal meeting August 2, 1940, after due notice therof had been published in the Des Plaines Suburban Times, for the purpose of hearing objections to the proposed rezoning of a Portion of Lots 1, 2, 3, 4 and 5 in Block 9 of Des Plaines Manor Tract # 1. The DoAll Manufacturing Company petitioned the Board to rezone the above described parcel except the North 73 feet thereof for Light Industrial usage. The present zoning of the parcel is for Commercial usage. Several residents of the locality and others interested in the development of this area were given every opportunity to present their views. The only objection, if it could be construed as such, was in the form of a letter from Attorney A.J. Sengstock, written in behalf of Paul and Clara Sengstock, owners of flat buildings at 850 Graceland Avenue and 1235 Thacker Street. This letter did not directly oppose the rezoning, but asked a number of pertinent questions based on the assumption that the rezoning would be permitted. Mr. L.A. Wilkie in his discussion ofthe matter and upon questioning by the Board gave satisfactory reply and evidence which in the Board's opinion would satisfy Attorney Sengstock. Another resident whose property is contiguous to the DoAll prop— erty voiced the opinion that the restored condition ofthe property since the purchase by the Do All Manufacturing Company is an enhancement to the neighborhood. The Board also took into consideration the fact that the existing buildings are of a permanent nature and will exist indefinitely on the parcel. iirther the Sco Line tracks are immediately adjacent to the property rendering it unfit for residential purposes, but probably more suited for Commercial or Light Manuffacturing purposes. In addition to the South ofthe Do All Parcel is established a bulk plant off an oil company and also a seed warehouse. In addition to the above facts, every member of the Zoning Board personally made an examination of the property in the field. On the basis of the foregoing, it is the well considered opinion of your Zoning Board that the requested change is not detrimental to property values, the public welfare, helath and best interests of the City and it is therefore recommended to your honorable body, that the zoning ofthe above described parcel, except the North 73 feet thereof, be changed from Commercial usage to Light Industrial usage. The motion was made by Alderman Dopheide and seconded by Alderman Johnson that the Council go on record as favoring the said recommendation and that the City Attorney be instructed to prepare an amending ordinance embodying the changes recommended therein. The motion was voted upon by acclamation whereupon the Mayor decalred the motion carried. CLEAR LOTS IN CUMBERLAND: The Clerk then read the following: 373 TO THE HONORABLE MAYOR ANL CITY COUNCIL OF THE CITY OF DES PLAINES: Gentlemen: We, the undersigned, being the owners of substantially all of the vacant, delinquent, forefeited lots in H.M. Cornell Co's. Cumberland Subdivision, hereby petition your honorable body to enact the following resolution: WHEREAS - there exists in the City many vacant lots upon which no taxes have been paid for various periods of time ranging from 1928 to 1939; and WHEREAS - this City is in need of the revenue which should normally have been produced by said real estate; and WHEREAS - the City of Des Plaines is not currently collecting any sums whatever from said real estate. THEREFORE BE IT RESOLVED that the Mayor and City Council of the City of Des Plaines, hereby petitions Thomas J. Courtney, States Attorney of Cook County, to institute forfeiture foreclosure proceedings in the appropriat courts to collect the forefeited general taxes due for said real estate, upon all such vacant lots so situated, in H.M. EXCESSIVE WHISTLING BY SOO LINE RAILROAD: Mayor Ahbe called the Council's attention to the excessive whistling by the Soo Line Rail- road. The motion was made by Alderman Friott and seconded by Alderman Dopheide to instruct the Clerk to write the Soo line Railroad demanding compliance with the provisions of the City Ordinances pertaining to excessive whistling. The motion was voted upon by acclaration whereupon the Mayor declared the motion carried. The Mayor thereupon declared the motion carried and the said resolution adopted. APPROVAL OF MINUTES: Each member of the Council having been supplied a copy of the minutes of the regular council meeting held Monday, August 5, 1940, the motion was made by Alderman Dopheide and seconed by Alderman Loos to approve the said minutes as submitted. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried and the said minutes approved. DENY LIQUOR LICENSE: The Clerk then submitted an application for a "one day" liquor license submitted by the 38th Ward Young Republican Club of Chicago to sell beer in connection with a lawn party to be held at 1484 White Street on August 24, 1940. The motion was made b Alderman Loos and seconded by Alderman Schwanbeck to deny this application. The motion was voted upon by acclamation whereupon the Mayor declared the motioncarried and the said application rejected. ADJuURNMENT: The motion was made by Alderman Dopheide and seconded by Alderman Johnson to adjourn.
