06/17/1940338 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES HELD IN THE COUNCIL CHAMBERS ON THE 17th DAY OF JUNE, 1940 AT 8:00 P.M. CALL TO ORDER: The meeting was called to order by Mayor Hobart M.Ahbe, presiding, with Aldermen Carroll, Johnson, Henrich, Loos, Dopheide, Carlson, Friott, Lemke, Schwanbeck and Campagna, responding to the roll call. The Clerk reported all members of the Council present. REPORTS OF STANDING COMMITTEES: None of the standing committees of the Council had reports to offer. PARK RIDGE GARBAGE BURNING CONTRACT: The Clerk then read the following rep6rtt To the City Attorney - KennethG.Meyer, at the meeting of the City Council held May 6th 1940 the following matter was referred to you: The matter of preparing a form of contract to be executed between the City of Dos Plaines and the City of Park Ridge under the provisions of which the City of Des Plaines is to incinerate garbage of the City of Park Ridge at a cost of $2.00 per ton. Park Ridge is to deliver said garbage to the Des Plaines Incinerator. Contract to run five (5) years. Very truly yours EDGAR J.FRIEDRICH, CityClerk June 11,1940 To the Mayor and City Council: Your City Attorney has investigated the above and submits herewith an original and duplicate of contract, the execution of which should be authorized by Council resolution and then both copies sent to the City of Park Ridge, with the request that they execute the original and return same to City Clerk. Kenneth G.Meyer City Attorney. and then followed by reading the following proposed contract: CONTRACT WHEREAS the City of Des Plaines owns and operates a garbage disposal plant and; WHEREAS the City of Park Ridge is without facilities for the disposal of the garbage of its inhabitants; and WHEREAS the City of Bark Ridge desires to have its garbage dis- posed of in the garbage disposal plant of the City of Des Plaines; NOW THEREFORE, it is agreed by and between the City of Des Plaines and the City of Park Ridge, as follows: 1. The City of Des Plaines will accept from the City of Park Ridge any and all garbage of the City of Park Ridge for disposal at the incinerator in the City of Des Plaines and the City of Des Plaines will dispose of all of said Garbage for the sum of $2.00 per ton. 2. The City of Des Plaines assumes no responsibility of collecting said garbage, but said garbage is to be collected by the City of Park Ridge and delivered to the incinerator in the City of Des Plaines. 3. The City of Des Plaines will bill the City of Park Ridge on the first day of each month for all garbage disposed of during the preceding month and the City of Park Ridge agrees to pay for said disposal service within thirty days from date of billing. 339 CONTRACT 4. It is expressly understood that all garbage collected in the City of Park Ridge from homes and apartments must be wrapped in paper before disposal into garbage cans or receptacles, as is provided by the Ordinance of the City of Des Plaines governing the collection of garbage. 5. It is further expressly understood that this contract is in no way meant to cover the disposal of rubbish, trash, tin cans or junk. 6. This agreement is to remain in full force and effect for the period of May 1,1940 to April 31,1945. Kenneth G.Meyer City Attorney After which the Clerk read in full for second reading a prdposed ordinance entitled: AN ORDINANCE GOVERNING THE CONSTRUCTION AND MAINTENANCE OF DRIVEWAYS OVER PARKWAYS AND SIDE- WALKt, AND REPEALING SECTIONS 282 TO 287, BOTH INCLUSIVE, OF THE MUNICIPAL CODE OF THE CITY OF DES Plaines of 1928. The motion was made by Alderman Carroll and seconded by Schwanbeck to finally pass and adopt the said proposed ordinance. The Mayor put the question and the Clerk called the roll with the following result: Ayes; Aldermen Carroll, Johnson, Henrich, Loos, Dopheide, Carlson, Friott, Lemke, Schwanbeck and Campagna. Nays; None.The Mayor thereupon declared the motion earried and the said ordinance passed. The motion was then made by Alderman Schwanbeck and seconded by Carroll to order and instruct the Clerk to cause the said ordi- nance to be published in the Des Pains Suburban Times. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried. ATTORNEYS OPINION REGARDING BOECKENHAUER CLAIM: The Clerk then read the following report: To the City Attorney - Kenneth G.Meyer - at the meeting of the City Council held May 6th 1940 the following matter was referred to you: The notice and demand filed with the City Council by John W.Boeckenhauer May 6th 1940 ordering the removal of certain sewer and water improvements from his land. Copy the said demand is typed upon the reverse side hereof. Very truly yours EDGAR J. FRIEDRIC H, City Clerk June 11 1940 Your City Attorney has investigated the above and has had a conference with the attorneys for Mr.Boeckenhauer, and sub- mits with this report results of said interview and his opinion on the subject. KENNETH G.MEYER - City Attorney and followed by reading the following supplemental letter: KENNETH G.MEYER - City Attorney: June 11 1940 City Council City of Des Plaines Gentlemen: In connection with the demand of John Boeckenhauer made upon the City Council to remove certain water mains and sewer pipes from property which he alleges to be his, I wish to advise that it is the contention of Mr.Boeckenhauer that he has title to the south half of Thacker S reet from the easterly right of'way line of Outer Belt Lin6 Railway and the westerly right of way line of Wolf Road. To the best of my knowedge there never was a formal dedication of Thacker Street for street purposes by the owners of the land now used as Thacker Street between the Belt Line and Wolf Road. However, a road can be dedicated for public use without the necessity of a formal written dedication. The Supreme Court has held that where owners of property permit land to be used as a right of way for 341 twenty yeafs and the use is actual, open exclusive,ad- verse and continuous, the property owner is barred from prohibiting the use of the right of way; and likewise, the Supreme Court has held that such usage for a lesser period than twenty years over a piece of land where sub- stantial public improvements have been made thereon amounts to dedication of the strip of land for highway purposes. To the best of lay knowledge the improvements which Mr. Boeckenhauer wishes to have removed from Thacker Street were placed therein when he was not the owner of the property, and only recently Mr.Boeckenhauer res.acquired title to the land surrounded by Thacker Street, Wolf Road, Algonquin Road and the Outer Belt Line Railway, and upon the date that he re -acquired title Thacker Street was openly used as a travelled right of way, and the Supreme Court has held that where one acquires title to land he is charged with knowledge of adverse possession by others and that possession by another has the same effect as a recorded deed. I doubt quite seriously whether Mr.Boeckenhauer could by legal processeject the City from that part of Thacker Street which he claims is his property. How- ever, owever, his attorney stated that if the proper terms could be agreed upon Mr.Boeckenhauer would quit claim any interest he might have in Thacker Street to the City for street purposes. I suggest, therefore, that this matter be referred to the proper committee for further consideration. SUGGESTS FILING SUIT AGAINST R.E.KILBY Co: The Clerk then read the following letter: KENNETH G.MEYER - City Attorney June 12 1940 City Council Des Plaines, Illinois Gentlemen: In 1929 the City instituted special assessment proceed- ings in the Superior Court, which were never completed because of the failure of the contractor to proceed under his contract. This special assessment proceeding is the one under which David B.Maloney claimed his attorneys fees, for which judgment was entered in the Superior Court, which judgment was affirmed by the Appellate Court. In connection with special assessment proceedings the contractor, R.E.Kilby Company, filed a bond with the City, signed by the Metropolitan Casualty Insurance Co. of New York, in the penal sum of $13,500.00, and.under said bond the surety, among other things, agreed to "save and keep harmless the municipality against and from all liability, judgments, costs, damages, attorneys' fees, and expenses which may in any wise accrue against the municipality by reason of any act done or omitted to be done by the contractor**************in performance of said contract***************". It is my opinion that the City has a cause of action against the Metropolitan Casualty Insurance Company 3719 KennethG.Meyer letter (contd) for the amount of the judgment rendered in favor of David B.Maloney, and all costs incurred by the City in connection with said litigation; and it is my ad- vice that the Council pass the attached resolution, making demand upon R.E.Kilby Company and the Metro- politan Casualty Insurance Company for payment of the damages sustained by the City, and upon failure of the surety company to settle our demand I recommend that the suit be filed in order to enforce collection. Very truly yours Kenneth G.Meyer City Attorney and followed by reading the following proposed resolution: RESOLUTION on WHEREAS: heretofore/the 19th day of November, 1930, a certain contract was executed between the City of Des Plaines and R.E. Kilby Company, a caporation, wherein and whereby the said R.E. Kilby Company undertook and agreed to construct, finish and fully complete a local improvement provided by an ordinanceof this City passed January 20, 1930, and referred to in petition filed in the Superior Court of Cook County in the proceeding known as Docket #512453; and WHEREAS, the said R.E.Kilby Company executed and delivered its bond, this bond in the sum of $13,500.00, with the Metropolitan Casualty Insurance Company of New York as surety, under which bond the said R.E.Kilby Company and the said Metropolitan Casualty Insurance Company of New York undertook and agreet, among other things, to "save and keep harmless the municipality against and from all liability, judgments, costs, damages, attorneys' fees, and expenses which may in any wise accrue against the municipality by reason of any act done orcmitted to be done by the contrgctore************in performance of said contract*********; and WHEREAS, the said R.E.Kilby Company filed, neglected and refused to perform the conditions of said contract heretofore referred to, and whereas David B.Maloney sued this City for attorneys' fees for services rendered in connection with improvement referred to in said contract and the said David B.Maloney recovered judgment against this City in the Superior Court of Cook County,Case #37 S3069, in the amount of $2,593.20 and costs. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Des Plaines that demand be and is hereby made upon R.E.Kilby Company and the Metropolitan Casualty Insurance Company of New York to pay to the City of Des Plaines the amount of $2,593.20 and interest, as well as expenses incurred by this City in appealing said decision to the Appellate and Supreme Courts of the State of Illinois. BE IT FURTHER RESOLVED that a certified copy of this resolution be forwarded by the Clerk of this City to R.E.Kilby Company and Metropolitan Casualty Insurance Company of New York. The motion was made by Alderman Johnson and seconded by Henrich to adopt this proposed resolution. The motion was voted upon by accla- mation whereupon the Mayor declared the motion carried and the said resolution adopted. 313 HEARING OF COUNTY ZONING COMMISSION July 2, 194.0: The Clerk then read the following letter:. CHICAGO REGIONAL PLANNING ASSOCIATION June 13,1940 Mr.Edgar J.Friedrich City Clerk Des Plaines, Illinois Dear Mr.Friedrich: This will confirm arrangements made for the Cook County Zoning Commission to hold the public hearing required by statute for your township in Des Plaines City Hall on July 2, 1940, at 8:00 P.M. May I express my appreciation for your help in making the arrangements for this meeting place. A news item on the hearing and the proposed zoning ordinance for unincorporated areas will be furnished to suburban papers in a few days. ASK SIDEWALK MAINTENANCE IN CU t:ERLAND: The Clerk then read the following letter: Cumberland Maintenance Corporation June 12,1940 City of Des Plaines Des Plaines,Illinois Honorable Mayor and CityCouncil: By resolution adopted by the Board of Directors of the Cumberland Maintenance Corporation on May 6th your attention is respectfully directed to the condition of sinking and canting cement sidewalks in Cumberland. This condition is found to have developed principally where walks are located above or close to sewers laid in parkway or beneath walks. The source of this trouble we attribute to improper specification of the backfill of the sewers or faulty inspection thereof. Similarly at numerous lots one or two squares of sidewalks have also sunk over laterals laid in to the lot lines. These laterals also were laid to the specifications and under inspection of the City of Des Plaines. To permit this condition to continue may result in serious personal injury for which the City may be liable as some of these walks are difficult to walk on when dry and distinctly hazardous if icy or snow covered. In addition, to leave these walks in this tilted or canted condition will almost certainly result in an accelerated and gfeater deterioration of these walks, which we believe it advisable the City avoid responsibility for by timely correction of the condition hereby reported. ILLINOIS MUNICIPAL RETIREMENT FUND: The Clerk then read the following letter: Illinois Municipal Retirement Fund May 6 1940 Board of Trustees Village Hall Des Plaines, Illinois Gentlemen: This fund was created by an act of the 1939 legislature. It provides a sound plan for retirement of employees of municipali- ties in the State of Illinois who are now excluded from Social Security protection. Participation in this Fund is possible only by a refer- endum of the people at the first general or special election following the filing of a written petition of at least 1% of the regular voters voting at the last general election for municipal officers. A number of municipalities have indicated an interest and are planning on presenting the subject to the people at the fall elections. This letter will serve to inform you of this situation so that if you are interested you will be able to take the necessary steps to obtain the benefits of the system. We have made arrange- ments to supply to any municipality so desiring, for a standard nominal fee, a report indicating the estimated costs of partici- pation. We will be glad to answer any questions concerning the Fund or to supply further information with respect to probable costs of participation. AWARD GASOLINE CONTRACT: Alderman Dopheide requested consider- ation of the bids for gasoline recently referred to the Special Committee. The Special Gasoline Committee then requested a recess and retired to the Committee room. Alter a brief recess the Mayor re -convened the Council meeting. The special gasoline Committee then thru its chairman, Alderman Carroll, recommended that the bid of Westfield Motor Service of 13# (Thirteen Cents) per gallon (prevailing today) be accepted, and that the Mayor and City Clerk be authorized and directed to execute a year's contract with Westfield Motor Service. The motion was made by Alderman Carroll and seconded by Lemke to concur in this recommendation. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried. COOPERATE IN "SOAP BOX DERBY": Alderman Dopheide then submitted the following request of the Des Plaines Motor Sales: That Friday, July 26,1940 be proclaimed as "Des Plaines Soap Box Derby Day" and that permission be granted to block off Ellinwood Street between Pearson Street and Des Plaines Avenue for the purpose of holding the said Derby, and that further permission be granted to con- struct the necessary starting ramp in cooperation with the City Engineer. Public Liability with $10,000.00 and $20,000.00 will be supplied to protect the City. The motion was made by Alderman Dopheide and seconded by Henrich that this request be granted. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried. SUGGESTS RESURFACING CENTER STREET: Alderman Henrich then re - Quested the City Engineer to prepare an estimate covering the re -surfacing of Center Street between Ellinwood Street and Thacker. E.N.Fletcher,City Engineer, then suggested that the holes in the said street be filled and the entire street be given a seal coating. He stated that there is a possibility of getting about $1,000.00 worth of asphalt from the W.P.A. If successful in getting this asphalt W.P.A.labor could be used, and thus the work could be done at relatively small expense to the City. 346 REPORTS BAD SEWER IN CUMBERLAND: Alderman Johnson reported that there is either a tilted or broken sewer in Cumberland. The motion was made by Alderman Johnson and seconded by Dopheide to refer this matter to the Sewer,Drainage and Sanitation Committee for study and report. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried. DISCUSS PEDDLERS LICENSE FEES: Alderman Loos inquired into the matter of peddler's license fees. The matter of such fees was referred to the Police and License Committee for study and report by the Mayor. OBJECTS TO CURB AT LRE STREET AND PRAIRIE AVENUE: Alderman Loos then voiced his dissatisfaction with the curb which was restored by Council order at the northeast corner of Lee Street and Prairie Avenue. The motion was made by Alderman Loos that this curb be removed and re -built in proper manner. However, the Mayor declared the motion lost for want of a second. FILLING STATION USE MAY LAPSE: Frank F.Scharringhausen then reported that the filling station property located on the northwest corner of Northwest Highway and Broadway in Cumberland has not been in use as a filling station for a number of months, that according to the Gasoline Filling Station Ordinance a six -month's lapse in such use will dis- qualify the premises for filling station use. The motion was made by Alderman Lemke and seconded by Johnson to instruct the Clerk to write the Pure Oil Products Company warning the said company of this condition. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried. UNIFORM BUILDING CODE FOR CHICAGO AREA: Frank F.Scharringhausen, building inspector, then informed the council that a number of building Commissioners and inspectors in the Chicago suburban area are preparing a uniform building code to be recommended to all suburbs in that area. He asked the Council whether the members of the Council favor the prepar- ation of such a code. However, no action was taken in this matter. CALL TO ORDER: The meeting was called to order by Mayor Hobart M. Ahbe, presiding, with Aldermen Carroll, Henrich, Loos, Dopheide, Carlson, Friott, Lemke, Schwanbeck and Campagna responding to the roll call. The Clerk reported nine Aldermen present.
