RE -CONDITIONING ELLIN 00D STREET: The Clerk then read
the following report:
To City Engineer, E.N.Fletcher, at the meeting of the City
Council, held Nay 20,1940 the following matter was referred to you:
The matter of submitting specifications and a program
of procedure for the re -surfacing of Ellinwood Street as
suggested by Alderman Schwanbeck at the Council meeting
of May 20,1940.

I, as City Engineer have investigated the above and have found:
the north half of Ellinwood Street from Lee St. to Pearson St.to
be in very bad condition and recommend the resurfacing of the north
36 ft. of this street from Lee :'"t. to Pearson St. with 1 inch of
H-1 Asphalt surfacing. The total area to be covered is 2,400 sq.yds.
and the estimated cost of this ;cork is „'1.00 per sq.yd. I also re-
commend that the high curb on the south side of Ellinwood between
Center St. and Pearson St. be lowered by taking out the excess
crown in the street. This could be done by filling in with asphalt
and in a manner that would not affect the present drainage. The
estimated cost of this work is <60C.00.

FORECLOSING TAXES &_ SPECIAL ASSESSMENTS: Kenneth G.Meyer,
City Attorney, then reported that the proposal of Coburn, Lelivelt & Coburn,
attorneys with respect to foreclosing taxes and special assessments was
discussed by the Mayor's special committee on Monday, May 27, 1940. He
further advised the Council to tread cautiously in the matter of be-
coming a party to foreclosing special assessments without the consent
of at least a majority of the bond holders involved. He therefore re-
commended that no action be taken in this matter.

Honorable Sir:
As I understand, there is to be a council meeting tonight
and I am therefore taking this means of communication be—
cause of the shortage of time, as I have a report to make
relative to the foreclosure of certain parcels of land in
the City of Des Plaines.
I talked with Iur.Kenneth G.Meyer on the 'phone today. It
was my understanding that Iur.IIeyer was to confer with the
State's Attorney relative to the liability of the City in
the event that special assessments were foreclosed and in—
cluded in the foreclosure. Ir.Iieyer Reported to me today
on the 'phone that in his opinion, it is not advisable to
include the special assessments in foreclosure for fear
that there may be some liability on behalf of the City.
Under the circumstances, it would be futile to foreclose
merely the general taxes as suggested by Mr.Meyer, as this
relief would not be adequate since it is the purpose of
this procedure to clear the property of all tax indebted—
ness in order to make it marketable and conducive to new
building; nor would it be helpful to clear up the property
that is now tax ridden because of the fact that a large
percentage of the taxes due and unpaid are special assess—
ments.
I would welcome an opportunity to come before your Committee
for further discussion of the matter and will appear at any
time or place your Committee desire to meet.

May 14,1940
On March 5, 1940, we received a letter from Mr. E.N.Fletcher,
Engineer of your City, concerning the proposal for re -paving
and widening Keeney Avenue in your City between River Road
and the Soo Line Railroad. Mr.Fletcher gave several reasons why
this Department should undertake this improvement on its own
responsibility rather than on the basis of a division of cost
in accordance with our previous letter to you of May 19, 1939.
Division of Highvays (letter)
Our Depart�ient has given further consideration to this matter but still
feels that the City should participate in the improvement. This is
on the assumption that the City could use its Motor Fuel Tax Funds
to defray its portion of the cost. the legislature provided that
these funds be given to the municipalities in the State for just
such purposes as this and. the Motor Fuel Tax law provides for the
priority of construction on State highways.
In our opinion the widening and re -paving of Keeney Avenue is the
most urgent project ahead of the City of Des Plaines at this time and
on this basis the Illinois Division of Highways must require that priority
be given this project in the use of Motor Fuel Tax funds. This Depart-
ment is willing to participate in the cost so that the work will not
spread over a long period of time on account of the fact that the
allotment of Motor Fuel Tax Funds to the City of Des Plaines would
not permit of the total consttuction being done in one season if City
funds were used entirely.
Therefore we feel that the City of Des Plaines in programming its Motor
Fuel Tax work should give its next consideration to the re -paving
of Keeney.Avenue on the basis of a division of cost as previously out-
lined to you, which is, that this Department will pay the costs of
grading and paving and the City the cost of building curb and gutter
and such drainage work as is necessary.

VARIOUS STATE HIGHWAY PERMITS: The Clerk then read the
following proposed resolution:

WHEREAS the City of Des Plaines located in the County of Cook;
State of Illinois wishes to locate, construct, operate and main-
tain a cinder sidewalk along the north side of Golf Road under-
pass under the Northwestern Railway tracks and Northwest High-
way starting at the north line of Golf Road and running in a
northerly direction to the Chicago, Northwestern Railroad Station
for a total distance of approximately 600' as more fully described
in the plans attached hereto and made a part hereof,
Which by law comes under the jurisdiction and control of the
Department of Public ':Works and Buildings of the State of Illinois,
and
WHEREAS, a permit from said Department is regt,ired before said
work can be legally undertaken by said City of Des Plaines now
THEREFORE, Be It Resolved by the City of Des Plaines, County of
Cook, State of Illinois
First: That we do hereby recuest from the Department of Public
Works and Buildings, State of Illinois a permit authorizing the
City of Des Plaines to proceed with the work herein described.
Second: That we hereby pledge the good faith of the City of
Des Plaines and guarantee that all work shall be performed in
accordance with the conditions of the permit to be granted by
the Department of Public Works and Buildings of the State of Illinois
and to hold the State of Illinois, Department of P.blic Works
and Buildings, harmless on account of any damages that may occur
to persons or property during the prosecution of such work, and
assume all liability for damages to persons or property due to
accidents or otherwise by reason of the work which is to be
performed under the provisions of said permit.

was made by Alderman Johnson and seconded by Carroll to proceed to receive
bids for the sale of the proposed ;19,000.00 - 1940 Judgment Funding Bond
issue. The motion was voted upon by acclamation whereupon the Mayor de-
clared the motion carred.
Tho said bonds wore then auctioned, the best bid being a bid of
par plus X125.00 for the said bonds with an interest rate of 4 per annum,
submitted by H.C.speer Son. The motion was made by Alderman Johnson
and seconded by Carroll to reject all bids. The motion was voted upon
acclamation whereupon the Mayor declared the motion carried and all bids
rejected.

ELIMINATE CORNE1R DRIVEWAY ENTRY: The motion was made by
Alderman Loos and seconded by Dopheide to instruct the Superintendent of
Public Works to rebuild the curbing on the northeast corner of Lee Street
and Prairie Avenue as to eliminate the existing corner driveway entry to
the Standard Filling Station at that point. The motion was voted upon by
acclamation whereupon the Mayor declared the motion carried.
TRAFFIC LIGHTS AT DES PLAINES AVE AND C c N 'd R R: The
motion -was made by Alderman Loos and seconded by Dopheide to refer to the Des Plaines
Safety Council the matter of studying the possibility of eliminating the
stop and go light on the left side of Des Plaines Avenue for traffic approaching
the C N 7 Tracks from the south. The motion was voted upon by acclamation
whereupon the Mayor declared the motion carried.
The motion was then made by Alderman Loos and seconded by
Friott that the matter of studying the possibility of also eliminating the
stop and go traffic control signal on the left side of Des Plaines Avenue
for traffic approaching the C N W tracks from the north be referred to
the Des Plaines Safety Council for study and report. The motion was voted upon
by acclamation whereupon the Mayor declared the motion carried.
ASK TO ELIMINATE HUMP IN DES PLAINES AVE: The motion was made
by Alderman Johnson and seconded by Dopheide to instruct the Superintendent
of Public Works to eliminate the hump in Des Plaines Avenue just north
of the C c: N Railroad tracks. The motion was voted upon by acclamation
whereupon the Mayor declared the motion carried.

of each year, both principal and interest to be payable at Northern
Trust Company, Chicago, Illinois, and maturing as follows:

we will pay: the par value thereof and accrued interest to date
of delivery. `e understand that the City will provide and pay
