CALL TO ORDER: The meeting was called to order by Mayor Hobart
M.Ahbe,presiding, :with Aldermen Johnson, Henrich, Loos, Dophe ide,Carlson,

The letter from the Des Plaines Safety Council dated
April 4,1940 containing certain recommendations with respect
to parking regulations for Pearson St., Park Place,Jefferson
St and Center St.
This letter was referred to your committee for study
and recommendation.

above and has found: The attached recommendation from the Safety
Council of the City of Des Plaines, has been found satisfactory
to the Streets and Sidewalks committee.

and recommendation be accepted in its entirety and that the City
Attorney be instructed to prepare and submit the proper ordinance
to provide for same.

THE SEWER, DRAINAGE AND SANITATION COMMITTEE through its chairman,
Alderman Campagna reported that Park Ridge has not accepted the proposition
authorized by the Council setting a rate of $2.50 per ton for burning Park
Ridge's garbage. The motion was therefore made by Alderman Campagna, chairman
of the Sanitary, Drainage and Sewer Committee and seconded by Loos to offer Park
Ridge a five-year contract at a rate of 42.00 per ton, and to instruct the
City Attorney to prepare a suitable contract. The motion was voted upon by
acclamation whereupon the Mayor declared the motion earried.
THE WATER COMI ITTEE had no report to offer.
THE FIRE COMMITTEE had no report to offer.
THE BAND COLIMITTEE had no report to offer.
THE CIT1 DNGI,iEER, Edgar N.Fletcher, report ed that ;with the
help of the Des Plaines Business Men's Association, who furnished elm trees,
grass seed, and black soil, it was possible to put the park area bounded
by Elt.inwood Street, Lee Street, Graceland Avenue and the C & N ",' R R Tracks
into presentab_e condition by means of 7.P.A.labor.
It was suggested that while the Des Plaines Patk District refused to
assume maintenance when the said park was in unkempt condition, the Park Board
may now be ready and willing to assume such maintenance if the Clerk now contacts
the said board regarding this matter.
THE BUILDING INSPECTOR, Fran: F.Scharrinhausen, then reported
that while building has dropped off during April 1940, with a total of only
seven (7) new residences, building; will no doubt improve as soon as the
weather becomes warmer.
THE ELECTRICAL INSPECTOR, Arthur Rieck,then submitted the following
report which was read by the Clerk:

1940 TAX LEVY ORDINNCE PASSED: The Clerk then read in its
entirety, for second reading, the proposed 1940 Tax Levy Ordinance entitled:

PROVIDING FOR THE LEVYING OF AN ASSESS-
MENT OF TAXES FOR THE FISCAL YEAR OF THE
CITY OF DES PLAINES,COOK COUNTY,ILLINOIS
COMIJENCING JANUARY 1,1940 AND ENDING DEC-
EMBER 31st, 1940.
The motion was made by Alderman Johnson and seconded by Dopheide to
pass and adopte the said proposed ordinance. The Mayor put the question
and the Clerk called the roll with the following result: Ayes; Aldermen
Johnson, Henrich, Loos, Dopheide, Carlson, Friott, Lemke, Schwanbeck
and Campagna. Nays; Nnne. The Mayor thereupon declared the motion
carried and the said ordinance passed.
Mayor Hobart M._hbe thereupon approved the said ordinance by
affixing his signature thereto, and Edgar J.Friedrich, City Clerk, attested
the said approval by his signature.

PROPOSE PLUMBING INSPECTOR: The Clerk then read the following
report of the City Attorney:
To Kenneth G.Meyor, City Attorney, at the meeting of the
City Council held April 15,1940 the following matter was
referred to you:
Th; matter of preparing proper proposed legislation
for the appointment of a plumbing inspector was referred
to you for legal opinion. ( You will recall that Aldrman Schwanbeck
suggested that the duties of plumbing inspector be taken from
the shoulders of the Supt.of Publ.'Torks and transferred to
the huilLing Inspector, because the Supt. of Pub. ",Torks is
too busy to properly carry out the functions of plumbing
inspector.

Your City Attorney has investigated the above and has found:
that Statute Chapter 111,paragraph 104, provides where
municipalities adopt an ordinance regarding the installation
of plumbing and caring for and inspection thereof, that the
plumbing inspector shall be a master plumber or a journeyman
plumber with a license of a journ,'man plumber in effect for
at least five years.
It is my opinion, however, that because our present plumbing
inspector does not fall within the requi:roments of the statute,
that our building code with respect to plumbing inspectors is
not 'unenforcable .
I, your City Attorney, have no recommendation to make in the
above matter.

then made by Alderman Campagna and seconded by Johnson that the Council
reconsider its action in granting to H.M.Cornell <<w Co a sewer outlet em -
tying into the existing Cumb_r^_and sewer. The motion was voted upon by
acclamation _hereupon the Mayor declared the motion unanimously carried
and the matter before the Council for reconsideration.
The motion was then made by Alderman Johnson and seconded by
Dopheide to rescind the following motion passed April 6,1940 and revoke the
permit granted thereunder;
"to grant H.M.Cornell a Co's request to empty the
proposed sanitary serer of "Cum,erland East" into
the existing Cumberland sewer as shown on the Ln,ineer's
plans, provided H..00rnell. Co. also furnishes and
installs the necessary sump pump."
The motion was voted upon by acclamation whereupon the Mayor declared the
motion unanimously carried, the said action rescinded and said permit revoked.

"CUMBERLAND EAST" SE ER TO WELLER CREEK: The Clerk then

Gentlemen:
At your Council meeting of April 1st a resolution was passed adopting
a proposal for a ': A project to install a sewer and street system in
our Cumberland East Subdivision. This proposal was taken to the WPA
office by your Engineer and the writer and we were informed by Mr.
McCullen that it would take a minimum of 60 days to get this project
approved and that there was no assurance this project would ever be
completed. 7e are, therefore, of the opinion that the proposal is
unworkable as there is no assurance that the work could be completed
in time for necessary use.
At your Council meeting on April 15th a resolution was passed permitting
us to install a sanitary sewer system by private contract in our Cumber—
lane East Subdivision and to connect °rith the Cumberland sewer at 4th
Avenue and Seegers Road by way of a sump pump. Tho cost of this private
system to us would have been approximately n>50O.CC more than the WPA
project.
Because of opposition by Cumberland residents we have attempted to
solve this sewage problem in another manner which shoula meet with no
local opposition and which should serve the subdivision in an efficient
manner

outlet along the Soo Line Railroad to ','eller Creek by way of a 12
inch tile from Seegers Road South. From Seegers Road North to North
Golf Cul De Sac a 10 inch tile and on both North Golf Cul De Sac and
South Golf Cul De Sac a 8 inch tile. The gradesof the 8 and 10 inch
tile to be approximately 4; while the grade ,f the 12 inch tile to
be about approximately
In presenting this proposal we want to call your attention specifically
to the fact that we are called upon to create an outlet over 1000 feet
from our property line and that this outlet is being paid for by us.
eye are also providing this outlet with a concrete head wall and back
water gate for protection in times of excessive rain fall.
In presenting this proposal we want you to know that its cost is in
excess of *1,000.00 over the sump pump connection and is all this
small subdivision of 69 lots will stand.
We trust this proposal :,ill meet with the approval of the Council
and that the necessary resolution will be passed at this meeting.

Gentlemen:
The Des Plaines Chapter of the Izaak Walton League wishes to go
on record as being solidly against the present action of the City
Council in granting permission to empty more raw sewerage into
the bed of the e 'eller Creek.
7ith our motto of "Defender of Goods, raters and 'Wildlife"
constantly before us it is our duty to ask that the future

actions of the.council be guided by some consideration for
the future generations; and that the council act on problems
of this sort only after careful consideration of the need for
conservation, and to this end we must work together.
A sample of the work of stagnation and pollution was in
evidence last year when great quantities of our fish were
killed thru poisoning. This condition will again be had
if the ';','eller Creek is still to carry it's load of poisonous
acids and sewage to the river.
Therefore, it is our wish that the council reconsider the
action taken of allowing additional sewage to be er.ptied
into our -Teller Creek, and to make some plan for piping the
sewage and wastes into the rece__tly completed interceptor
sewer, and to go forward in matters of this nature only after
due consideration of the after effects of this type of pollution.

URGES AUXILLI AdY INTERCEPTOR FOR CUMBERLAND BLAND ARA: Alderman
Dopheide urged that additional impetus be given to the matter of bringing
pressure to bear upon the Sanitary District of Chicago to provide an
auxilliary interceptor sewer for draining sewerage from the Cumberland area
into the River Road Trunk Interceptor. The Clerk then again read the
following letter (see also minutes of March 18,1940);

the matter the consideration that I would like to. However,
I would point out that our budget is made up towards the
end of 1939 and your request arrived too late for consider-
ation at this time. Howeter, I will bear the matter in mind.
Our Chief Engineer has been requested to make a
report on the matter.

";REAS, THE City of Des Plaines heretofore instituted
Special Assessment proceedings known as warrant j132 in the
County Court of Cook County for the construction of sidewalks
on Cora Street and other streets and avenues in the city of
Des Plaines; and
WHEREAS, before the instition of said proceedings the
owner of the following described real estate, to wit,

WHEREAS, subsequently on October 28,1930 an order was
entered in the County Court of Cook County in said warrant,
which erroneously placed an assessment on the afore described
premises at $110.00; and
WHREAS, the owner of the afore described premises paid
the total of $110.00 on afore described premises and interest
thereon, whereas the true and correct assessment against said
premises in said warrant should have been 360.00.
NOW 2HEREFORE, be it resolved by the City Council of the
City of Des Plaines that the City Collector -City Treasurer be and
is hereby authorized to refund to the property -owner of the afore
described promises, who erroneously paid $110.00 and interest
thereon instead of 560.00 and interest thereon, the difference
between $110.00 and interest thereon and $60.0e and interest thereon.
The motion was made by Alderman Henrich and seconded by Carlson to
adopt this proposed resolution. The motion was voted upon by accla-
mation whereupon the Mayor declared the motion unanimously carried
and the said resolution adopted.
CONSIDER PROHIBITING SEPTIC TANKS: The motion was made by
Alderman Dopheide and seconded by Friott to instruct the City Attorney
to prepare an ordinance for the purpose of so amending the septic tank
ordinance as to prohibit construction of septic tanks in Des Plaines
in the future. The motion was voted upon by acclamation whereupon
the Mayor declared the motion carried.
ELECTRICAL CONTRACTORS - REGISTRATION: The Clerk then
read the followin : proposed ordinance for first reading:
AN ORDINANCE REPEALING SECTIONS
154,155 and 158 AND AMENDING
SECTION 157 OF THE REVISED BUILDING
CODE OF 1939.
Be it ordained by the City Council of the City of Des Plaines,
Cook County, Illinois
SECTION 1. That Section 154 entitled "Electrical Contractors,
Registration Required" and Section 155, entitled "Fee" and Section 158
entitled "Out of Town Contractors" of Article 16, entitled "Electrical
Installation", be and they are hereby repealed.
SECTION 2. That Section 157, entitled "Regulations" of Article 16,
entitled "Electrical Installation" of the Revised Building Code of 1939
be amended to read as follows:
"SECTION 157. REGULATIONS - - It shall be
unlawful for any person, firm or corporation
to install any electrical appliances, wiring
or fixtures without struct compliance with

without first having obtained such

APPOINTMENT:- RECREATION COMMITTEE: Mayor Ahbe then appointed
Alderman Loos to serve on the Recreation Committee to supplant former
Alderman Pflughaupt. The Mayor informed the Council that the Recreation
Committee will meet in hand Park Field House on Friday, May 10,1940.
APPOINTMENT - TRUSTEE OF POLICE PENSION FUND: Mayor Ahbe
then announced the following re -appointment:
Fred A.Lessing - as member of the Policemen's Pension
Fund for a three-year term beginning
May 1,1940 and ending April 30,1943.
The motion was made by Alderman Dopheide and seconded by Carlson to
confirm the said appointment. The motion was voted upon by acclamation
whereupon the Mayor declared the motion carried and the said appointment
confirmed.
APPROVAL OF BILLS: The Finance Committee, through its

The motion was made by Alderman Johnson and seconded by Lemke to adopt the
said proposed resolution. The Mayor put the question and the Clerk called the
roll with the following result: Ayes; Aldermen Johnson, Henrich, Loos,
Dopheide, Carlson, Friott, Lemke, Schwanbeck and Campagna. Nays; None. The
Mayor thereupon declared the motion carried and the said resolution adopted.
APPROVAL OF MINUTES: Each member of the Council having been supplied
with a copy of the minutes of the regular meeting of the Council held Monday
April 15,1940, the motion was made by Alderman Dopheide and seconded by
Carlson to approved the said minutes as written. The motion was voted upon
by acclamation whereupon the Mayor declared the motion carried and the said
minutes approved.
URGES PARTICIPATION IN TAX SALE CLIP"iS: Mr.Frank Zaleski,attorney,
then addressed the Council urging the City to file cross complaints to re-
cover past due special assessments installments should any property in Des
plains be sold at tax sales.
ADJOU_N18ENT: The motion was made by Alderman Lemke and seconded
by Friott that the meeting adjourn to 8:00 P.M. Monday May 13,1940. The
motion was voted upon by acclamation, w-upo- '':a .r declared the

CALL TO ORDER: The meeting was called to order by Mayor Hobart
M.Ahbe, presiding, with Aldermen Johnson, Henrich, Loos, Dopheide,Carlson,
-Friott, Lemke and Campagna responding to the roll call. (Aldermen Carroll
and Schwanbeck were absent during the entire meeting.) The Clerk reported
eight aldermen present.
Mayor Ahbe then stated that this is an adjourned regular
'meeting adjourned from Monday, May'6th,1940.
