CALL TO ORDER: The meeting was called to order by Mayor Hobart M. Ahbe, presiding, with Aldermen Carroll, Johnson, Henrich, Loos, Dopheide, Carlson; Priott, Lemke, Schwanbeck and Campagna responding to the roll 'call. The Clerk reported all members of -the Council present. THE JUDICIARY & ASSESSMENT COMMITTEE: Alderman Carlson, 'chairman of the Judiciary and Assessment Committee then submitted 'the following minority report: MINORITY REPORT February 5, 1940 It is hereby recommended: That the City Clerk be instructed to place the insurance required, meeting will all requirements of the speci- fications, to be effective as of February 6, 1940 for a period of one year, excepting those specified for a longer period, based on rates as quoted in the respective proposals submitted; with the following listed insurance companies through their agents: #i- Workmen's Compensation and Employees Liability Insurance and #2- Automobile Liability Insurance, to be placed with: Employers Liability Assurance Corp. The motion was made by Alderman Loos and seconded by Alderman Dopheide that the Clerk order the discontinuance of the 'WPA Social Dances which have been held on Wednesday evenings in the basement of the Municipal Building, but to permit the continuance of the art and handi- craft adtivities in the Municipal Building until quarters can be provided at some other location. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried. THE SEWER DRAINAGE & SANI a TION COMMITTEE through its chairman A .erman ampagna reported ,a un ess wor, is started soon on the proposed general WPA Project, the City will be forced for its= protection to proceed to build the proposed Boeckenhauer culvert without WPA aid. The motion was made by Alderman Lemke and seconded by Alderman Henrich to refer this matter back to the Sewer, Drainage and Sanitation Committee. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried. THE WATER COMMITTEE had no report to offer. THE FIRE COMMITTEE through its chairman Alderman Dopheide reported that the Des Plaines Volunteer Fire Department is holding its annual dance at the new building at Rand Park on February 24, 1940 and urged all to attend. THE BAND COMMITTEE had no report to offer. THE SPECIAL COMMITTEE ON SKATING through its chairman Alderman Carroll reported good success in providing skating fa- cilities. MALONEY vs THE CITY OF DES PLAINES: Upon the suggestion of Kenneth G. Meyer, City Attorney, the motion was made by Alderman Dopheide and seconded by Alderman Henrich to authorize and direct the City Attorney to file an appeal with the Illinois Supreme Court in the case. of Maloney vs the City of Des Plaines. The Mayor put the question and. the Clerk called the roll with the following result: Ayes; Aldermen Carroll, Johnson, Henrich, Loos, Dopheide, Carlson, Fri'ott, Lemke, Schwanbeck and Campagna. Nays; None. The Mayor thereupon declared the motion carried. WIDENING OF GRACELA]D AVENUE BY MOTOR FUEL TAX: The Clerk then read the following propoXsed resolution. RESOLUTION BE IT RESOLVED by the Council of the City of Des Plaines, Illinois, that the following described street be improved under the Motor Fuel Tax Lsw: Graceland Ave. Arterial St.No. 6, Thacker St. to Miner St. a distance of 1760 ft. BE IT FURTHER RESOLVED that the proposed improvement consist of concrete pavement with concrete curb and gutter. Con- struction :36 feet wide and shall be designated as Section 7 -CS. That there is hereby appropriated the sum of Thirty Thousand and no 100 Dollars (430,000.00) for the improvement of said section from the municipality's allotment of Motor Fuel Tax funds. That said work shall be dotie by contract; and BE IT FURTHER RESOLVED that the Clerk is hereby dir- ected to transmit 2 certified copies of this resolution to the Department of Public Works and Buildings, Division of Highways, through its District Engineer's office at Chicago, Illinois. Friedrich, City Clerk City of Des Plaines Des Plaines, Illinois Dear Sir: With reference to resolution submitted to the Board of County Commissioners by the City of Des Plaines concerning tile along southwest line of Rand Road, i am enclosing herewith copy of Section 1 of the Report of the Committee on Roads and Bridges which was adopted by the Board at its meeting held on January 17th. FEDERAL PUBLIC SALARY ACT OF 1939: The Clerk then read the following proposed resolution: RESOLUTION WHEREAS, the Federal Public Salary Act of 1939 makes it mandatory that salaries of Public Officers and Employees be officially reported to the Federal Government before February 15th of each year, and WHEREAS, it is deemed advisable to specifically des- ignate some officer to file the said reports. THEREFORE BE IT RESOLVED, that the City Clerk be and he is hereby designated as the official charged with the respon- 256 sibility of making the annual report of earnings of City Officers and Employees to the Yederai txovernment as required by the Fed- eral Public Salary Tax Act of 1939. TRAFFIC HAZARD AT MINER STREET & RAND ROAD: The Clerk then read the following letter: DES PLAINES SAFETY COUNCIL Des Plaines, Illinois February 5, 1940 Mayor and City Council City of Des Plaines Des Plaines, Illinois In re: Letter of December, 1939, to Des Plaines Safety Council. Dear Sirs: Relative to the question as to what can be done to make it less hazardous for Maine High School students to cross Rand Road on Miner Street, the Des Plaines Safety Council passed the following recommendation at their last regular meeting. We recommend that the City Council communicate with the State Highway Department requesting that Stop and Go lights be installed at Miner (Dempster Rd.) St. and Rand Road. if this is impossible at this time, the State Department could at least in- stall warning signs directing traffic on Rand Road to slow down to 15 miles per hour and designate this corner a "School Crossing's corner. He called for the election of officers, and V.L. Spiegler, Sec. of the Dept. for the past nineteen years, vas urged by mem- bers of the department to again accept this office, but he de- clined. Therefore, the department, after nominating several members for office of secretary, elected H.A. Wolf to fulfill that office for 1939. W.L. Kinder vas re-elected to the office of treasurer. The Marshal re -appointed A.H. Kuhlman, A.G.Wille, and A.W. Collignon as his 1st, 2nd, and 3rd assistants, res- pectively. Twenty-four regular business meetings were held on the second and fourth Tuesdays of each month, with an average at- tendance of fourteen. Honors for perfect attendance go to E. Geisen and John Hammerl. The honor of responding to the most fire calls Loes to Ray Kolze. We have responded to 40 fire calls that o:eated a loss of 431.00 or more and which have been reported to the State Fire Marshal. Another 50 calls were answere, mostly priaire fires. The Classification is as follows: 20 Buildings, with losses within the city limits 5 Automobiles, with losses within the city limits 16 Miscellaneous calla with losses outside the limits 41 Miscellaneous calls within the city limits, no losses, majority prairie fires. 8 Miscellaneous calls outside the city, no losses. 1 Call for the inhalator lir Total number of calls. A total of 91 calls against 105 calls for the previous year. There was an average attendance for all calls of 11 plus. 258 ANNUAL FIRE DEPART. NT REPORT - cont/d. PROPOSES A CITY SEALER: The motion was made by Alderman Campagna and seconded by Alderman Friott to grant Mr. Otto Lund the privilege of addressing the Council for a period not to exceed five minutes. The motion was voted upon by acclamation whereupon the Mayor declared the motion car- ried. After Mr. Lund, a coal dealer, pointed out the need for a City Sealer, the motion was made by Alderman Campagna and seconded by Alderman Lemke to refer this matter to the Police and License Committee for study and recommendation. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried. APPROVAL OF MINUTES: Each member of the Council having been supplied with a copy of the *Minutes of the Regular Council Meeting held, Monday, January 15, 1940' the motion was made by Alderman Dopheide and seconded by Alderman Johnson to approve the said minutes as written. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried and the said minutes approved. However, the motion was made by Alderman Henrich and seconded by Alderman Loos to amend the motion by striking from the proposed resolution the item in the sum of $1,141,21 payable to the iioek-Road Coratruction Company. The Mayor put the question on the motion to strike and the Clerk called the roll with the following result: Ayes; Aldermen Henrich, Loos, Dopheide, Carlson, and Friott. Hays; Aldermen Carroll, Johnson, Lemke, Schwanbeck and Campagna. The Clerk reported the vote a tie, whereupon the Mayor cast his vote as *Hay* and declared the amendment defeated. The Mayor then put the question of the main motion (to adopt) and the Clerk called the roll with the following result: Ayes; Aldermen Carroll, Johnson, Friott, Lemke, Schwanbeck and Campagna. Nays; Aldermen Henrich, Loud, Dopheide and Carlson. The Mayor thereupon dedlared the motion carried and the said resolution adopted as originally introduced. TO MEET AS COMMITTEE -OF -THE -WHOLE: Mayor Ahbe announced that the Council will meet as a Committee -of -the -whole in the Council Chambers on Monday, February 12, 1940, for the purpose of discussing a number of financial questions called to the Council's attention in a letter from the City Attorney. (Alderman Carroll was absent during the entire meeting.) DESIGNATION OF MAYOR PRO TEM: The motion was made by Alderman John- son and seconded by Alderman Campagna that Alderman Lemke be elected to serve as Mayor pro tem in the absence of Mayor Ahbe.
