01/02/1940240 MINUTES OF THE REGULAR COUNCIL MEETING OF THE CITY COUNCIL OF THE CITY OF DES PIAINES HELD IN THE COUNCIL CHAMBERS ON TUESDAY, JANUARY 2, 1940 AT 8:00 P.M. CALL TO ORDER: The meeting was called to order by Mayor Hobart M. Ahbe, presiding, with Aldermen Carroll, Johnson, Henrich, Loos, Dopheide, Carlson, Lemke and Schwanbeck responding to the roll call. (Alderman Friott and Campagna were absent during the entire meeting.) Mayor Ahbe ordered these reports placed on file. THE• JUDICIARY & ASSESSMENT COMMITTEE had no report to offer. THE POLICE & LICENSE COMMITTEE had no report to offer. THE STREETS & SIDE"IALKS COMMITTEE through its chairman Alderman Schwanbeck, reported that the street marking to prevent parking in front of fire hydrants, which was referred to the committee, has been completed. He also reported that the green "right—turn" arrow at Miner Street and Lee Street has been satisfactorily installed. THE COMMITTEE ON PUBLIC ;CORKS, BUILDINGS AND PLATS had not report to offer. I THE SEWER, DRAINAGE & SANITATION COMMITTEE had no report to offer. THE WATER COMMITTEE had no report to offer. 1 THE FIRE COMMITTEE had no report to offer. THE BAND COMMITTEE had no report to offer. THE ELECTRICAL INSPECTOR then submitted the following annual report which was read by the Clerk: 241 REYORT of ELECTRICAL INSPECTOR Jan. 1,1939 to Dec. 31, 1939 Number 5 - Signe 11- Industrial property 9 - Commercial 60- Residential remodeling and wiring for ranges, oil -burners, stockers and new services. 2 - American Legion Festival and Business Men's Fair 133 for Wiring on 89 new buildings. CHANGE "KEENEY AVENUE" TO "ALGONQUIN ROAD": The Clerk then read the following report: To Kenneth G. Meyer, City Attorney, at the meeting of the City Council, held December 18, 1939, the following matter was referred to you: The matter of preparing an ordinance for the purpose of changing the name of Keeney Ave. in the City of Des Plaines to Algonquin Road in accordance with a petition submitted to the City Council in its meeting of December 18, 1939. E.J. Friedrich, City Clerk To the Mayor and City Council: Your Attorney has investigated the above and submits ordinance on the subject matter herewith. Signed, KENNL'2H G. MEIER, City Attorney and followed the same by reading the said proposed ordinance for first read- ing as follows: AN ORDINANCE CHANGING THE NAIL OF KEENEY AVENUE IN THE CITY OF DES.PLAINES, TO ALGONQUIN ROAD. ITEREAS, A petition has been filed with the City Council of this City, signed by more than sixty per cent (60%) of the owners of property abutting on Keeney Avenue, requesting this Council to change the name of Keeney Avenue to Algonquin Road; therefore BE IT ORDAINED, by the City Council of the City of Des Plaines; SECTION 1. That the name of Keeney Avenue in the City of Des Plaines, be and is hereby changed to Algonquin Road. SECTION 2. That the proper authorities of this City proceed to acquire street signs reading "Algonquin Road", and to rerect said new street signs in place of those now reading "Keeney Avenue". SECTION 3. That the legal residence and address of those persons now or hereafter residing on the street heretofore known as Keeney Avenue, shall be "Algonquin Road". SECTION 4. That the City Clerk shall forward a certified copy of this Ordinance to the United States Postmaster for the City of Des Plaines. 242 SECTION 5. This Ordinance shall be in full force and effect from and after its passage and approval, according to law. PASSED this day of January, A.D. 1940. EDGAR J. The motion was made by Alderman Schwanbeck and seconded by Alderman Carroll to suspend the rules and place this proposed ordinance upon its final passage. The Mayor put the question on the motion to suspend the rules and the Clerk called the roll with the following result: Ayes; Aldermen Carroll, Johnson, Henrich, Loos, Dopheide, Carlson, Lemke and Schwanbeck. Nays; None. The Mayor thereupon declared the motion carried,the rulesaispened and the said proposed ordinance before the Council for final disposition. The motion was then made by Alderman Schwanbeck and seconded by Alderman Lemke to finally pass and adopt this proposed ordinance. The Mayor put the question and the Clerk called the roll with the folIwing result: Ayes; Aldermen Carroll, Johnson, Henrich, Loos, Dopheide, Carlson, Lemke, and Schwanbeck. Nays; None. The Mayor thereupon declared the motion carried and the said ordinance passed. Mayor Ahbe then instructed the Streets and Sidewalks Committee to arrange to remove the old "Keeney Avenues' street signs and replace them by new street signs reading "Algonquin Road". PURCHASE vs CITY OF DES PLAINES: The Clerk then read the following letter: City Council Municipal Building, Des Plaines, Illinois MADDEN, MCC IA & MEER Attorneys at Law Chicago January 2, 1940 In re: Mabel S. Purchase Vs. City of Des Plaines, Circuit Court No. B-165628 City of Des Plaines Vs. Mabel S. Purchase, Gentlemen: Circuit Court Case B-167908 Some time ago, I discussed the above cases with the City Council sitting as a committee of the shale, and informed you that I had worked out an offer of settlement of this litigation, for the sum of $350.00. The litigation in this case dates back to 1923 and concerns the claim of Mabel S. Purchase to the effect that the City is possessing a part of her lot for street purposes. The land in question is at the southwest corner of Arlington and Woodlawn Avenues, in the City of Des Plaines. As the Caption of this letter indicates, there are two cases now pending covering this subject matter, one being an ejectment suit filed by Mrs. Purchaae against the City, in which proceedings Mrs. Purchase prays the court that the City be compelled to remove its streets, sidewalks, water mains, etc., as may be upon her property. The second suit is an injunction action brought by the City against Mrs. Purchase to enjoin her from proceeding with her mandamus action. It is needless to say that the costs of litigating these suits would exceed $350.00, and it is my honest opinion that the settle— ment that I have worked out should be accepted and officially ratified by the City Council in keeping with the sentiment expressed by the committee of the whole. I therefore recommend that you authorize a warrant to be drawn, payable to the order of Mable S. Purchase and John A. Brown, her attorney, for the sum of $350.00, and that the Treasurer be authorized to honor said warrant just as soon as funds are available. Respectfully submitted, Signed: KENNETH G. The Mayor put the question and the Clerk called the roll with the following result: Ayes; Aldermen Carroll, Johnson, Henrich, Loos, Dopheide, Carlson, Lemke and Schwanbeck. Nays; None. The Mayor thereupon declared the motion carried. VEHICLE LICENSE TAGS FOR VOLUNTEER FIREMEN: The motion was made by Alderman Dopheide chairman of the Fire Committee, and seconded by Alderman Carlson to instruct the City Clerk to issue free of charge to each member of the Volunteer Fire Department a 1940 City of Des Plaines vehicle license tag. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried. APPROVE PLAT OF FOREST RIVER ADDITION: The Clerk then submitted for approval a proposed plat of subdivision entitled: FOREST RIVER ADDITION Being a Subdivision in the South of the Southwest 4 of Section 21, Township 41 North - Range 12 east of the 3rd Principal Meridian in Cook County, Illinois. The motion was made by Alderman Dopheide and seconded by Alderman Johnson to approve the said plat and to authorize and direct the Mayor and City Clerk to sign the said plat for and in the name of the City of Des Plaines. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried and the said plat approved. ACCEPT POLICE SQUAD GAR AS GIFT: Alderman Carroll, Chairman of the Police and License Committee then read the following letter: January 2, 1940 Mr. James J. Carroll, Chairman, Police Committee, Des Plaines, Illinois Dear Mr. Carroll: The members of the Des Plaines Police Benefit Association take this opportunity to express their sincere appreciation for the whole- hearted cooperation of the Mayor and Members of the City Council during the past year. Pursuant to a resolution adopted by the association mem- bership at its annual meeting on December 19th, 1939, the sum of Eight Hundred Dollars (p800.00) was set aside for the purpose of purchasing a new Police Car for the use of the City of Des Plaines. The motion was made by Alderman Carroll and gratefully accept this gift and to instruct Benefit Assn. thanking the association for was voted upon by acclamation whereupon the seconded by Alderman ]Lemke to the Clerk to write the Police this generous gift. The motion Mayor declared the motion carried. TO DISCUSS VARIOUS WPA PROJECTS: Alderman Dopheide inquired as to when the various proposed TPA projects for the City are scheduled to begin, whereupon the Mayor announced that the Council is to meet as a committee -of - the -whole at 7:30 P.M. (prior to the regular council meeting) on Monday, January 15, 1940, in order to discuss the various WPA projects which the City intends to sponsor. TO PROVIDE Dopheide, Mayor Ahbe Carroll Loos, Lemke, problem of providing SKATING FACILITIES: Upon the suggestion of Alderman appointed a special committee consisting of Aldermen and Johnson and referred to the said committee the facilities for skating during the winter months. 244 APPROVAL OF MINUTES: Each member of the Council having been supplied with a copy of the minutes of the regular Council meeting held Monday, December 18, 1939, the motion was made by Alderman Dopheide and seconded by Alderman Schwanbeck to approve the said minutes as submitted. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried and the said minutes approved.
