MINUTES OF TNI REGULAR COUNCIL MEETING
OF THE CITY COUNCIL OF THE CITY OF DES
PLAINES HELD IN THE COUNCIL CHAMBERS ON
MONDAY, NOVEMBER 20, 1939 AT THE HOUR
OF 8:00 P.M.
CALL TO ORDER: The meeting was called to order by Mayor Hobart M.
Ahbe, presiding, with Aldermen Carroll, Johnson, Henrich, Loos, Carlson, Friott,
Lemke, Schwanbeck and Campagna responding to the roll call. The Clerk reported
a quorum present. (Alderman Dopheide was absent during this roil call but
arrived... soon.. thereafter.)
THE JUDICIARY & ASSESSMENT COMMITTEE through its chairman, Aldermen
Carlson reported..ibat most of the various insurance policies of the City expire
December 31, 1939. The motion wasmade by Alderman Carlson and seconded by
Alderman Loos to instruct the Clerk to advertsie for bids for such insurance
as expires -at -the beginning of 1940. However, the motion was made by Alderman_
Carroll and seconded by Alderman Lemke torefer this matter to the Judiciary
and Assessment.Committee for further study and recommendation. The motion was
voted upon by acclamation whereupon the Mayor declared the motion carried and
tha,matter :.referred to-tbe-Judiciary and Assessment Committee.
THE,POLICE & LICENSE COMMITTEE had m report to offer.
THE STREETS & SIDEWALKS COMMITTEE had no report to offer.
THE COMMITTEE ON PUBLIC WORKS, BUILDINGS & PLATS had no report to
offer.
THE SEWER, DRAINAGE & SANITATION COMMITTEE through its chairman,
Alderman Campagna reported that because of a possibility of getting work
done scion by the IPA the committee asks for more time to prepare its recom-
mendation regarding the matter of providing a suitable culvert to properly
drain the property of John Boeckenhauer lying south of Thacker Street be-
tween Wolf Roadandthe Belt line tracks.
(At this point Alderman Dopheide arrived and took his plods.)
THE WATER COMMITT.E through its chairman, Alderman Lemke reported
thatthepump of the City (Cater) Well has been dismantled for repairs and
is being given a thorough reconditioning.
THE FIRE COMMITTEE through its chairman Alderman Dopheide presented
the following letter:

We have examined the revised Building Code and the new Fire Pre-
vention Ordinance which have recently been enacted by the City of Des Plaines,
Illinois, and we find that the adoption of these ordinances is not suffi-
cient to place the city ina better classification,.
It is our understanding that the city is contemplating the purchase
of additional fire apparatus and when this has been done we will arrange a
complete reinspection of the.fire-fighting facilities.

held by the County Collector and due the City of Des Plaines.
You will note that this audit covers the years from 1931 to
1937 inclusive, and that there is due the City of Des Plaines the sum of
$6,905.10.
We will prepare the proper demands, and will forward them
to you within a couple of days, and ask that you have the Treasurer sign
them and return them to us so that we can make the necessagr demands on the
County Collector, so that in the event it should be nedessary to bring
Mandamus, we will have laid the proper legal foundation.

this City of all general tax moneys due this City on account of general
taxes collected for the year 1931 to 1937, both inclusive, and
BE IT FURTHER RESOLVED that the City Clerk be and he is hereby
instructed to forward a certified copy of this resolution to CHARLES M.

REZONING - R.O. SIGWALT: The Clerk then read the following recom-
mendation..from the Zoning Board of Appeals:

Honorable Sirs:
On October 6, at 8 P.M. the Des Plaines Zoning Board of Appeals held a
public meeting to consider the rezoning of certain properties listed by
Mr. R.O.'Sigwalt from the Northwestern Railroad Company, which property

lies north of Harding Avenue, south of the Des Plaines Valley Railroad and
westofthe Squire Diugee Pickle. Works. This property is described below:
Beginning at the Southeast Corner of the West 450 feet
of Lot 3 of the County Clerks Sub. in the Northeast
of Section 17, Township 41 North, Range_ 12 East, thence
North along. ..the Eastlineof the West 450 feet of Lot
3, 195 feet more or less to a point 10 feet Southeasterly
at right angles from the center line of Lessor's spur
track serving Squire Dingee.plant; thence Southwesterly
parallel with said side track and with Lessor's wye track
to a pointwhichis 10 feet Southeasterly at right angles
to center line of said track, and 175 feet North of the
South line of said Lot 3, thence East 150 feet more or
less to a point which is 175feetNorth of the. South
line of said Lot 3 and at right angles to the South line
of Lot 3, the nse South 175 feet to the South line of Lot
3, thence East on South line 295 feet to the point of
beginning..
The above meeting was called on petition of Mr. Sigwalt who requested that the
tract be zoned for industrial purposes. The parcel previously was unzoned and
would therefore, automatically fall ,into the.: reaidential classification.
Mr. Sigwalt pointed out that the parcel now is used for purposes which could
beclassified as industrial, the property being improved with several warehouses
and having a switch track facilities. Immediately adjacent to this parcelto
the West are storage tanks of the Pennsylvania Oil and to the East is the Squire
Binges plant.
Prior to the meeting, the Secretary of the Zoning Board made a detailed field
investigation and advised the Board of his findings. In the opinion of the
Beard, this tract is admirably situated and suited for industrial usage. It is
situated adjacent to the crossings of the several railroads which pass through
Des Plaines and lies in that. portion of the City in which industrial enterprises
have been establ.iahed .for many. years.
In view of these facts, the Zoning Board of Appeals recommends to your Hon-
orable Body, that an Ordinance be passed permitting the usage for industrial
purposes of the above described tract.

concur in this recommendation. The motion was voted upon by acclamation
whereupon the Mayor declared the motion carried.
Kenneth G. Meyer, City Attorney, then submitted a proposed ordinance
pertaining to the foregoing recommendation which was read for first reading
by the Clerk for first reading as follows:

SECTION 1. That an ordinance entitled "An Ordinance to Classify,
Regulate and Restrict the Locations of Trades and Industries and the Location of
Buildings Designed for Specified Uses; to Regulate and Determine the Area of Yard;

Courts and Other Open Spaces within and Surrounding such Buildings, and to
Establish the Boundaries of Districts for the said Purposes and Prescribing
Penalties for the Violation of its Provisions" passed on the fifth day of
February, 1923, as heretofore amended, be amended by taking out of the un-
restricted area and placing in the industrial area, the following described
territory, to -wit:
Beginning at the Southeast Corner of the West 450 feet of
Lot 3 of the County Clerk's Sub. in the Northeast t of Sec-
tion 17, T. 41 N., R. 12, E., thence North along the East
line of the West 450 feet of Lot 3 470 feet, thence West
and parallel with the South line of lot 3, 195 feet more or
less to a point 10 feet Southeasterly at right angles from
the center line of Lessor's spur track serving Squire Din -
gee plant; thence Southwesterly parallel with said aide
track and with Lessor's eye track to a point which is 10
feet Southeasterly at right angles to center line of said
track and 175 feet North of the South line of said Lot 3,
thence East 150 feet more or less to a point which is 175

SECTION 2. All ordinances or parts of ordinances conflicting
with the provisions of thisordinance are hereby repealed.
SECTION 3. Any person, firm, or corporation who violates, dis-
obeys, omits, neglects, or refuses to comply with or who resists enforce-
ment of any of the provisions of this ordinance, whall be fined not less
than Twenty-five Dollars ($25.00) nor more than Two Hundred Dollars ($200.00)
for each offense. Each day that a violation is permitted to exist shall
constitute a separate offense.
SECTION 4. This ordinance shall be in full force and effect
from and after its passage, approval and publication, according to law.

The motion was made by Alderman Carlson and seconded by Alderman
Johnson to suspend the rules and place this proposed ordinance upon its
final passage. The Mayor put the question on the motion tosuspend the rules
and the Clerk called the roll with the following result: Ayes; Aldermen
Carroll, Johnson, Heinrich, Loos, Carlson, Dopheide, Friott, Lemke, Schwan-
beck and Campagna. Nays; None. The Mayor thereupon declared the motion
carried , the rules suspended and the proposed ordinance before the Council
for final disposition.
The motion was then made by Alderman Carroll and seconded by Alder-
man Lemke to finally pass and adopt this proposed ordinance. The mayor put
the question and the Clerk called the roll with the following result:
Ayes; Aldermen Carroll, Johnson, Henrich, Loos, Carlson, Dopheide, Friott,
Lemke, Schwanbeck and Campagna. Nays; None. The Mayor thereupon declared
the motion carried and the said ordinance passed.
The motion was then made by Alderman Henrich and seconded by Alder-
man Loos to instruct the Clerk to cause this ordinance to be published in
the Des Plaines Journal. The motion was voted upon by acclamation whereupon
the Mayor declared the motion carried.
PARKING REGULATIONS FOR PEARSON STREET: The Clerk then read the
following proposed ordinance for first reading:

CITY OF DES PLAINES TRAFFIC

BE IT ORDAINED by the City Council of the City of Des Plaines,
Cook: _County, Illinois:
SECTION1. That ScheduleIIof the City of Des Plaines Traffic
Code, with respect to the manner of parking on Pearson Street, be and is
hereby amended to read as. follows:.
*PEARSON STREET (Both curbs). Parallel parking
between Des Plaines Avenue and Thacker Street,
except where parking is prohibited by Schedule
I."
SECTION 2. Any person, firm or corporation violating the pro-
visions of this ordinance shall be fined not more than Two Hundred Dollars
($200.oa).
SECTION 3. This Ordinance shall be in full force and effect
from and after its passage, approval and publication, as provided by law.

Inasmuchasfurther study of this proposed ordinance seemed
advisable, mayor Ahbe referred the same to the Des Plaines Safety
Council for study and. recommendation.
DRAINAGE NEAR RAND & WOLF ROADS: Alderman Johnson then intro-
duced the following proposed resolution which was read by the Clerk:
RESOLUTION
WHEREAS there exists a low area (marked "A" on map) near the
intersection of Rand Road and Wolf Road, and lying on the Southwest Side
of Rand Road partly east of Wolf Road and partly on the west side of
Wolf Road, and
WHEREAS the natural drainage course for this the said area was
as follow
Through drainage ditch southeasterly from
the intersection of Rand Road and Wolf Road,
thence through culvert (marked "B" on map)
under Rand Road thence northeasterly to cul-
vert under River Road and into the 24 inch
tile running through A11 Saints Cemetry, to
empty into the Des Plaines River,
WHEREAS it appears that in the year 1927 when Princeton Street and
8th-Avenue,.were constructed in connection with the development of Cumberland
Subdivision no provisions were made to keep the said drainage ditch open,
thus.blocking.the same, and.
WHEREAS the blocking of the said drainage ditch diverts the said
flow of water into the sewer system of the City of Des Plaines, and
WHEREAS the said sewers are not adequate to carry the said waters,
and are thereby overloaded and cause numerous flooded basements,
THEREFORE BE IT RESOLVED by the City Council of the City of Des
Plaines that the Board of County Commissioners of the County of Cook be and
the same is hereby respectfully petitioned to correct the said drainage by
providing a 12 -inch drainage tile along the southwest line of Rand Road from
the low area (marked "A" on map) to culvert (marked "B" on map) under Rand
Road, and
BE IT FURTHER RESOLVED that the City Clerk be and he is hereby
instructed to forward two (2) certified copies of this resolution to the

BOY SCOUTS REQUESTAISE OF COUNCIL CHAMBERS: The Clerk then presented
the follow1ng-memo::
"Mr. Donald Kyger, Scout Baster of the Northwest Soy
Scout Council requests the use of the Court Room for
the purpose of conducting a ten or twelve week's course
infirstaid for Boy Scouts from Des Plaines. The
course would require the use of the room once each
week and could be arranged for either Mondays, Wednes-
days or Fridays from 7:30 to 9:00 P.M."
The motion was made by Alderman Campagna and seconded by Alderman Johnson
to refer this matter to the Committee on Public Works, Buildings and Plats
with full power to act. The motion was voted upon by acclamation whereupon
the mayor declared the motion carried.
TOWNSEND CLUB REQUESTS USE OF COUNCIL CHAMBERS: The Clerk then read
the following letter:

To the Honorable Mayor and
City Council of the City of Des Plaines
Gentlemen:
About a year ago your honorable body granted the Des Plaines Town-
send Club #1 the privilege of conducting a public mass meeting in your Council
Chambers at which the principal speaker was Dr. Francis E. Townsend, author
of the well known Townsend Plan for National Recovery. As you know this
meeting proved very successful..
This year again we have been fortunate in securing as speaker for
our rally a man equally as well, informed on the subject, namely Dr. H.
Truman Gordon. Since we were aware of the fact that Dr. Gordon is very busy,
we were obliged to engage him for his only open date - Monday, December 18, 1939.
We therefore respectfully request permission to again use your
Council Chambers for the purpose of holding a public mass meeting, similar
to the one held last year on Monday evening December 18, 1938.
We have been informed that December 18, 1939 is one of the dates
which your honorable body is scheduled to hold one of its regular council
meetings, which would of course conflict with our mass meeting, but in view
of the fact that our speaker is booked six weeks ahead, and is not available
excepting December 18, we would consider it an unusual favor to our club
if your honorable body would postpone its meeting scheduled for December 18th
or hold it in one of the other roomsin the Municipal Building..
We trust that we may again be favored by your honorable body as we
were last year.

MRS. BESSIE DUNNIE - CLAIM FOR INJURIES: The clerk then read the
following letter:
Des Plaines, Illinois
November 13, 1939
City Council of Des Plaines,
Des Plaines, Illinois
Gentlemen:
This morning, while crossing the street at the corner of Thacker
and=r'irat Ave., my mother met with an accident - she uses crutches. The
sewer cover in the street was completely covered with leaves, and one crutch
went into the hole, causing her to fall, of course, and cutting and injuring
her knee, and the crutch broke in two. This might easily have happened
to anyone waling across the street, and getting.. a_heel caught .in the hole.
Thera were several people at that corner when she fell., and they
assisted her - and a Mr. C. W'olfgram, of 1315. herding Ave., in Des Plaines,
who happened, to be at that corner with his car, drove her home as she could
not, of course, manipulate without the crutch. We also have the names of
the . other people, - should you care to.. =have. them.-
She immediately telephoned the City Hall and reported this, and
was asked to write the report to the City Council of Des Plaines, where it
would be given immediate attention. It is necessary, of course, to purchase
her some new ,crutches...
Particular n ote was made of the fact that other streets and sewer
covers had been. cleared of leaves, but this corner was not so cleaned.
My mother, Mrs. Bessie Dunnie, lives with me at 570 Arlington Ave.,
Des Plaines. Her elbows and arms _are also bruised as a result of the fall
and you can understand what a shock would be sustained, if suddenly your own
support were to disappear from under you.

COMMERCIAL DRIVEWAY ORDINANCE: The Clerk then read for first reading
a proposed ordinance entitled:
AN ORDINANCE GOVERNING THE CONSTRUCTION AND
MAINTENANCE OF DRIVEWAYS OVER PARKWAYS AND
SIDEWALKS, AND REPEALING SECTIONS 282 to 287,
BOTH INCLUSIVE; OF THE MUNICIPAL CODE OF THE
CITY OF DES PLAINES OF 1928.
Mayor Ahbe ordered this proposed ordinance filed for second reading.
ADVERTISE FOR BIDS FOR CITY'S GASOLINE REQUIREMENTS: After some dis-
cussion on the question as to whether the City should install its own gasoline
pump or purchase its gasoline as needed, the motion was made by Alderman
Carroll and seconded by Alderman Lemke to instruct the City Clerk to advertise
for bids in the Des Plaines Suburban Times for the City's gasoline requirements
for the year 1940 based upon a total minnimum of ten thousand gallons. The
motion was voted upon by acclamation whereupon the Mayor declared the motion
carried.
DANGEROUS TILE ON JEANNETTE AVENUE: The motion was made by Alderman
Henr.ich and seconded by Alderman Loos to refer to the Streets and Sidewalks
Committee the matter of eliminating the hazard caused by two, four -inch drain
tiles in the parkway on the east side of Jeannette Avenue just north of 1019
Jeannette Avenue, which are open and have no grills or covers covering the
same. The motion was voted upon by acclamation whereupon the Mayor declared
the motion carried.

REQUESTS TO HAVE AbLLY'S CLEANED: The motion was made by Alderman
Carroll and seconded by Alderman Johnson to instruct the Streets Department
to clean up the alley in the rear of the Des Plaines Masonic Temple Building
and to take the necessary steps to see that all other alleys in the City are
put into presentable condition. The motion was voted upon by acclamation
whereupon the Mayor declared the motion carried.
APPROVAL OF BILL$: The Finance committee, through its chairman
Alderman Johnson introduced the following proposed resolution:

The motion was made by Alderman Johnson and seconded by Alderman Schwanbeck
to adopt this proposed resolution. The Mayor put the question and the Clerk

ADJOURNMENT: The motion was made by Alderman Lemke and seconded by
Alderman Loos that the Council adjourn. The motion was voted upon by accla-
mation whereupon the Mayor declared the motion carried and the Council regu-
larly adjourned.
