MINUTES OF THE REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF DES PLAINES
HELD IN THE COUNCIL CHAMBERS ON MONDAY,
OCTOBER 16, 1939 AT THE HOUR OF 8:00 P.M.
CALL TO ORDER: The meeting was called to order by Mayor Hobart M.
Ahbe, presiding, with Aldermen Carroll, Johnson, Henrich, Loos, Dopheide,
Friott, Lemke, Schwanbeck and Campagna responding to the roll call. (Alderman
Carlson was absent during the entire meeting.)
THE JUDICIARY & ASSESSMENT COMMITTEE: had no report to offer.
THE POLICE & LICENSE COMMITTEE: had no report to offer.
THE STREETS & SIDEWALKS COMMITTEE: had no report to offer.
THE COMMITTEE ON PUBLIC WORKS, BUILDINGS AND PLATS submitted the fol-
lowing report which was read by the Clerk:
To the Chairman Fred Loos, Pub.Wks., Bldgs. & Plats committee, at the
meeting of the City Council, held Oct. 2, 1939, the following matter was referred
to your committee:
The bids received for supplying the season's coal for heating the
municipal building which were received and opened Oct. 2, 1939, were referred

Idiayor Ahbe then announced the appointment of Adam bchillo to the post
of City inspector on the Pearson Street widening project (MFT SECTION 6 -CS).
The motion was made by Alderman Johnson and seconded by Alderman Campagna to
confirm the said appointment. The motion was voted upon by acclamation where-
upon the Mayor declared the motion carried and the said appointement confirmed.
STATE PERMIT FOR WOLF ROAD SIDEWALK: The Clerk then read the following
proposed resolution:
RESOLUTION
WHEREAS, the City of Des Plaines located in the County of Cook,
State of Illinois, wishes to locate, construct, operate and maintain a 5'
concrete sidewalk on the west side of Wolf Road, which by law corns under
the jurisdiction and control of the Department of Public Works and Buildings
of the State of Illinois, and
WHEREAS, a permit from said Department is required before said
work can be legally undertaken by said City of Des Plaines, now
THEREFORE, be it resolved by the City of Des Plaines, County of
Cook, State of Illinois
FIRST: That we do hereby request from the Department of Public
Works and Buildings, State of Illinois, a permit authorizing the City of
Des Plaines to proceed with the work herein described.
SECOND: That we hereby pledge the good faith of the City of Des
Plaines and guarantee that all work shall be performed in accordance with
the conditions of the permit to be granted by the Department of Public Works
and Buildings of the State of Illinois, and to, hold the State of Illinois,
Department of Public Works and Buildings, harmless on account of any damages
that may occur to persons or property during the prosecution of such work, and assume
all liability for dam ages to persons or property due to accidents or other-
wise by reason of the work which is to be performed under the provisions of
said permit.
THIRD: That we hereby state that the proposed work is not to be
performed by the employees of the City of Des Plaines.
FOURTH: That the proper officers of the City of Des Plaines are
hereby instructed and authorized to sign said permit in behalf of the City
of Des Plaines.

Johnson to adopt this proposed resolution. The motion was voted upon by
acclamation whereupon the Mayor declared the motion carried and the said

C 8c N.W. RR. PERMIT FOR WATER MAIN: The Clerk then read the fol-
lowing proposed resolution:
RESOLUTI O N
WHEREAS, the laying of water mains in that portion of Branigar's
Cumberland Terrace lying west of the Y-connection of the Chicago and North-
western Railroad, requires the construction, maintenance and use of an 8 inch
water main under the Chicago and Northwestern Railway Company's right-of-way, and
WHEREAS, the Chicago and Northwestern Railroad has submitted for
execution by the proper City officials a form of agreement and blue -print
dated September 22, 1939 showing specifications covering the said main instal-
lation, which agreement and blue -print are attached Lereto and are hereby made
a part of this resolution.
THEREFORE BE IT RESOLVED, by the City Council of the City of Des
Plaines, Cook County, Illinois, that the said agreement ,be and the same is
hereby approved and accepted, and
BE IT FURTHER RESOLVED, that the Mayor and City Clerk be and they
are hereby authorized and directed to execute the said agreement for an din
the name of the City of Des Plaines, and
BE IT FURTHER RESOLVED, that the City Clerk transmit one certi-
fied copy of this resolution to the Chicago and Northwestern Railway Com-
pany.
ADOPTED by the City Council of the City of Des Plaines,

A copy of the judgment decree is in possession of the City Treas-
urer for use in connection 'kith making payment on the special assessment
bonds involved in said suit. If you need a certified copy of this decree
for your records, will you please have one of your girls make a copy of the
decree, which is in possession of Mr. Larson, as it exceeds fifty pages in
size and the cost of having a photostatic copy made of each page would be
quite large.

lowing letter and the claim attached thereto:

Enclosed please find bill for the amount of Six Dollars and 75,6
($6.75) for damages which occured to me while I was driving down Illinois

Street near Oakton St. in Des Plaines, I11. on the 8th day of October, 1939
at about 5:30 P.M.
Hitting a manhole in street which is projecting above the street
about a foot, damaging the oil pan of the car causing me to lose all the oil.
The damages for temporary repairs cost me Two Dollars to get home.
I did not see any danger sign or barricade, or sign reading ,"Street
under construction", "Drive under your own risk".
I reported this to your Police Dept. which has report of the accident,
also residence of the street saw it.
Please have the Council consider this matter and reimburse the bill
for all damages to me.

The motion was made by Alderman Campagna and seconded by Alderman
Friott to refer this claim to the City Attorney. The motion was voted upon
by acclamation whereupon the Mayor declared the motion carried.
The motion was then made by Alderman Dopheide and seconded by
Alderman Henrich to instruct the Streets and Sidewalks Committee to take
the necessary steps to prevent further accidents at the said location.
The motion was voted upon by acclamation whereupon the Mayor declared the
motion carried.
THANKS TO MR. KENNETH W. DOWNING: The Clerk then read the following:
RES 0 L U T I 0 N
WHEREAS, Mr. Kenneth W. Downing has recently resigned from the
Des Plaines Zoning Board of Appeals, to accept service with the Federal
Government which necessitated his frequent absence from the City of Des
Plaines, and
WHEREAS, Mr. Downing has performed valuable services to the City
and contributed much of his time as a member and secretary of the Zoning
Board of Appeals without compensation of any kind.
THEREFORE, be it resolved that the Des Plaines City Council send
Iur. Downing a letter of appreciation or in some other suitable way recognize
the civic spirit and theunselfish contribution which Mr. Kenneth W. Downing
has made toward the welfare of our community.

Henrich that the Council concur in this resolttion of the Zoning Board of
Appeals. The motion was voted upon by acclamatibn whereupon the Mayor

CONDEMN OLD RIVERVIEW HALL: The Clerk then read a formal order
from the Fire Marshal; dated October 9, 1939, ordering the City to make
the following repairs on the old xiverview Town Hall:
(1) Replace broken windows by either boarding up same
or replacing broken window lights.
(2) have fire-resistant roof placed on building.
Mayor Ahbe refered the said notice to the Committee on Public
Works, Buildings and Plats.
APPROVE STREET DEDICATION PLATS: The Clerk then submitted for
the Council's approval three street dedication plats bearing the following
titles:

The motion was made by Alderman Campagna and seconded by Alderman
Johnson to approve the said plats and to authorize and direct the i.yor and
City Clerk to sign the said plats for and in the name of the City of Des
Plaines. The motion was voted upon by acclamation whereupon the Mayor
dedlared the motion carried and the said plats approved.
CUMBERLAND TERRACE - Fire Hydrants: Alderman Dopheide, Chairman
of the Fire Committee reported that the Fire Marshal, Walter Lagerhausen,
has inspected the fire protection facilities of Branigar's Cumberland Ter-
race, and has found that an insufficient number of fire hydrants have been
provided. The motion was made by Alderuan Dopheide and seconded by Alder-
man Lemke to instruct the Clerk to write the Mt. Prospect Realty Trust,
subdividers of the subdivision in :.uestion, ordering them to provide such
additional fire hydrants as the Fire Marshal and the City Engineer may
specify. The motion was voted upon by acclamation, whereupon the Mayor
declared the motion carried.
S00 LINE - IR.F, STREET CROSSING REPAIR: The City Engineer, E.
N. Fletcher, reported that the State Highway Department refused the City
permission to use Motor Fuel Tax moneys to purchase the materials for
rebuilding the Soo Line crossing at Lee Street as was suggested by the
Soo Line Railroad's letter dated September 15, 1939 (see minutes 9/18/39).
The Clerk was requested to inform the Soo Line Railroad of the State's
rejection of their proposal.
APPROVAL OF BILLS: The Finance Committee through its chairman
Alderman Johnson then introduced the following proposed resolution:

The motion was made by Alderman Johnson and seconded by Alderman
Lemke to adopt the said proposed resolution. The Mayor put the question
and the Clerk called the roll with the following result: Ayes; Aldermen
Carroll, Johnson, Henrich, Loos, Dopheide, Friott, Lemke, Schwanbeckand
Campagna. Nays; None. The Mayor thereupon declared the motion carried
and the said resolution adopted.
APPROVAL OF MINUTES: Each member of the Council having been
supplied with a copy of the minutes of the regular Council meeting held
Monday, October 2, 1939, the motion was made by Alderman Schwanbeck and
seconded by Alderman Lemke to approve the said minutes as submitted.
The motion was voted upon by acclamation whereupon the Mayor declared the
motion carried and the said minutes approved.
ADJOURNMENT: The motion was made by Alderman Lemke and seconded
by Alderman Schwanbeck to adjourn. The motion was voted upon by acclamation
whereupon the Mayor declared the motion carried and the Council regularly
adjourned.
