MINUTES OF THE REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF DES PLAINES
HELD IN THE COUNCIL CHAMBERS ON TUES-
DAY, SEPTEMBER 5, 1939 AT 8:00 P.M.
CALL TO ORDER: The meeting was called to order by Mayor Hobart M.
Ahbe, presiding, with Aldermen Carroll, Johnson, Henrich, Loos, Carlson,
Friott, Lemke, Schwanbeck and Campagna responding to the roll call. Alderman
Dopheide was absent during this roll call but arrived late during the meeting.
Mayor Ahbe stated than because of Monday, September 4th was Labor
Day, a legal holiday, the regular meeting scheduled to be held on that date
was automatically postponed until Tuesday, September 5, 1939.
REPORTS OF OFFICERS:: The Clerk then submitted the following reports:
The report for August, 1939,' -of Edgar J. Friedrich,
City Clerk.
The report for August, 1939, of Chas. M. Larson,
City Treasurer.
The Mayor ordered these reports placed on file.
THE JUDICIARY AND ASSESSMENT COMMITTEE had no report to offer.
THE POLICE AND LICENSE COMMITTEE, through its chairman, Alderman
Carroll then reported on the following letter referred to the said committee
August 7, 1939:

Gentlemen:
At our last Director's meeting it was voted that a letter be
written you recommending that, if it is at all possible, you
appoint our night watchman, John Hammerl, a special policeman,
as per section 708 and 709 City Ordinance, so that he might
be able to administer the law when the occasion arises without
personal risk to himself. This will enable him to be bonded.
Chief of Police Drexler attended our meeting when this sug-
gestion was made and stated that he believed the idea to be
an excellent one.
Thank you for your courtesy in giving this matter yotr sincere
consideration.

The motion was made by Alderman Carroll and seconded by Alderman
Lemke to authorize and instruct the Mayor to appoint John Hammerl as a special
police at a salary of One Dollar ($1.00) per year. The motion was voted
upon by acclamation, whereupon the Mayor declared the motion carried.
Mayor Ahbe thereupon announced the appointment of John Hammerl
as a special police, whereupon the said John Hammerl submitted to the City
Clerk U.S. Fidelity and Guaranty Co. surety bond No. 26098-07-692-39.
(At this point Alderman Dopheide arrived at the meeting.)
THE STREETS AND SIDEWALKS COMMITTEE had no report to offer.

THE COMMITTEE ON PUBLIC WORK$„.,,,, TINGS, AND PLATS through its
chairman, Alderman Loos, reported that the Volunteer Fire Department has
been granted permission to use the Council Chambers for a meeting to be
held Monday evening, September 11, 1939, and asked that no other meetings
be scheduled to be held in the Council Chambers on that evening.
THE SEWER, DRAINAGE, AND SANITATION COMMITTEE had no report to
offer.
THE WATER COMMITTEE had no report to offer.
THE FIRE COMMITTEE through its chairman Alderman Dopheide re-
quested that the City Attorney prepare the necessary resolution required
to eliminate paragraph No. 3 from the City's formal contract form known
as "Agreement for Fire Protection" for properties lying outside of the
City.
THE BUILDING INSPECTOR, Frank 1. bcharringhausen, reported that
he has approved seven building permit applications for new residences
totalling $43,000.00 during the month of August, 1939.
PERKINS' CLAIM FOR M.F.T. PROJECT #3 -CS: The Clerk then read
the following letter:

Dear Sir:
I am returning herewith unapproved all three copies
of Request No. 2 for Approval of Change in Plans with two cost
plus bills. As this request for approval of change in plans
is not being approved, no action by this Department is ne-
cessary on the construction resolution adopted by your City
Council on December 20, 1937.
When the additional traffic light standards were con-
templated for the Lee Street intersection, a request for change
in plans was submitted and approved on November 6, 1937, which
provided for installing these standards at cost plus "not to
exceed $1,600.00". In view of this up -set price which was
agreed to at that time, this Department can not agree to any
additional costs for the work.
I am retaining one copy of the cost plus bill and
receipted invoices as our file copy to substantiate the
$1,600.00 expense.

ANNEXATION OF "CUMBERLAND EAST": The Clerk then read for second
reading a proposed ordinance for the annexation of a subdivision described
as "H.M. Cornell's Cumberland East" entitled:
AN ORDINANCE ANNEXING CERTAIN
LANDS TO THE CITY OF DES PLAINES.
The motion was made by Alderman Lemke and seconded by Alderman
Campagna to finally pass and adopt this proposed ordinance. The Mayor put
the question and the Clerk called the roll with the following result:
Ayes; Aldermen Carroll, Johnson, Henrich, Loos, Dopheide, S;arlson, ¥riott,
Lemke, Schwanbeck and Campagna. Nays; None. The Mayor thereupon declared
the motion carried and the said ordinance passed.

ACCEPT PARK AREA IN "CUMBERLAND EAST": The Clerk then submitted
the following offer:

Gentlemen:
I herewith submit for your formal approval a plat of
subdivision entitled:
H.M. CORNELL'S CUMBERLAND EAST
Being a subdivision in the S.W. 4 of Section
8, Township 41 North, Range 12 East of the
3rd Principal "eridian in Cook County, Ill.
and do hereby offer and agree to set aside and properly dedicate
for park and recreational purposes all of Lots one (1) and two
(2) in Block one (1) in the said subdivision with the understand-
ing that the Des Plaines Park District or the City of Des Plaines
accept the said Lots one (1) and two (2) for the said purposes
and agree to maintain the same. It is further agreed that unless
the Des Plaines Park District or the City of Des Plaines formally
accept the said offer on or before January 1, 1940 this agree-
ment will be void.

Mr. Cornell was present and explained that the area offered for
park purposes lies outside of the Des Plaines Park District and therefore
suggested that the City accept the said area.
The motion was made by Alderman Lemke and seconded by Alderman
Johnson that the City accept Lots one (1) and two (2) in Block one (1)
of H.m. Cornell's Cumberland East for park and recreational purposes as
set forth in the foregoing letter. The motion was voted upon by accla-
mation whereupon the Mayor declared the motion carried.
CORRECTING DRAINAGE AT GEISEN GARAGE: The Clerk then read the
following letter:

Received your letter of August 24th complaining of
drainage condition on Northwest Highway and t'erry Street. We
have instructed our field engineer, Mr. Catt, to look into
this matter and see what could be done to remedy the condition.

PAINTING CROSS -WALKS AT SCHOOLS: The Clerk then read the fol-
lowing letter:

Gentlemen:
Just prior to the opening of the school season it behooves
us to call to your attention the splendid work done by patrol boys at
the schools. To promote this laudible work may we suggest that the
City arrange to paint the cross walks at the several schools in the
same manner as cross walks are now marked on the main streets.
We consider marked cross walks at the several schools
most desirable to impress the children, especially the new faces,
where to cross the street and thereby discourage so-called "jay walk-
ing".

The Mayor referred this letter to the Streets and Sidewalks
committee with power to act.
SOO LINE CROSSING REPAIR: Alderman yopheide asked that the Clerk
again write the booline Railroad requesting action regarding the repair of
all Soo Line crossings in Des Plaines.
COST OF FIRE PROTECTION AT COMMUNITY FAIR: Alderman Dopheide re-
ported .that upon request of the Des Plaines Business men's Ass'n. the City
maintained a special fire -prevention patrol at the recent Des Plaines Com-
munity Fair at a cost of $14.40. The motion was then made by Alderman
Dopheide and seconded by Alderman Carroll that this service the paid for by
the Des Plaines Business Men's Ass'n. The motion was voted upon by accla-
mation whereupon the Mayor declared the motion carried.
ACT TO RECOVER DAMAGE TO TRAFFIC CONTROL SIGNAL: Alderman Schwanbeck,
chairman of the Streets and Sidewalks committee, reported that one, Howard
Funk, recently drove his automobile into the control box of the "Stop and Go"
traffic control lights at the intersection of Des Plaines Avenue and Miner
Street and caused considerable damage. The motion was made by Alderman
Schwanbeck and seconded by Alderman Lemke to instruct the City Attorney to
take the necessary action to recover the said damages. The motion was voted
upon by acclamation whereupon the Mayor declared the motion carried.
SIDEWALKS IN BRANIGAR'S CUMBERLAND TERRACE: Kenneth G. Meyer, City
Attorney, reported that he has contacted the Federal Housing Administration
and inquired whether the FHA could possibly withdraw its demand for sidewalks
in front of residences built in Cumberland Terrace. He reported further that
the FHA insisted that such sidewalks, even if intermittent along the street,
must be provided.
FLAG IN COUNCIL CHAMBERS: Alderman Campagna called the Council's
attention to the fact that the American Flag recently presented by the
American Legion for the Council Chambers seems to have been stolen, and
asked that an attempt be made to recover the same or that a new flag be
provided.
UNSIGHTLY LOT AT IDA AND PERRY STREETS: Mayor Ahbe instructed
Kenneth G. Meyer, City Attorney, to investigate the possibility of deystroying
an old foundation and filling in the old basement on the lot located at Ida
and Perry Streets.
APPROVAL OF BILLS: The Finance Committee through its chairman,
Alderman Johnson, then introduced the following proposed resolution:

DUE AND PAYABLE AND THAT THE MAYOR AND
CITY CLERK BE AUTHORIZED TO ISSUE PROPER

The motion was made by Alderman Johnson and seconded by Alderman Lemke
to adopt this proposed resolution. The Mayor put the question and the Clerk
called the roll with the following result: Ayes; Aldermen Johnson, Carroll,
Henrich, Loos, Dopheide, Carlson, Friott, Lemke, Schwanbeck and Campagna.
Nays; None. The Mayor thereupon declared the motion carried and the said
resolution adopted.
APPROVAL OF MINUTES: Each member of the Council having been supplied
with a copy of the minutes of the regular council meeting held Monday, August 21,
1939, the motion was made by Alderman Dopheide and seconded by Alderman Lemke
to approve the said minutes as presented. The motion was voted upon by accla-
mation whereupon the Mayor declared the motion carried and the said minutes
approved.
ADJOURNMENT: The motion was made by Alderman Lemke and seconded by
Alderman Carroll to adjourn. The motion was voted upon by acclamation whereupon
the Mayor declared the motion carried and the Council regularly adjourned.
