CALL TO ORDER: In the absence of Mayor Hobart M. Ahbe, the meeting was called to order by Edgar J. Friedrich, City Clerk. The roll call found all members of the Council absent. The meeting was therefore adjourned to Wednesday, July 5th,1939 at 8:00 P.M. CALL TO ORDER: The meeting was called to order by Mayor Dobart M. Ahbe, presiding with Aldermen Carroll, Johnson, Henrich, Looe, Dopheide, Carlson, Friott,Ldmke, Schwanbeck and Campagna responding to the roll call. C4 The Clerk reported all members of the Council present. ,d, Mayor Ahbe then announced that this is an adjourned regular meeting adjourned from Monday, July 3, 1939 because of lack of a quorum on that date. REPORTS OF OFFICERS: The Clerk then presented the following reports: The report for June 1939 of EdgFa.r J.Yriedrich, City Clerk The report for June 1939 and the report for the 2,12,d quarter of 1939 of Charles L Larson, City Treasurer. The Mayor ordered these reports placed on file. THE COMMITTEE ON PUBLIC WORKS, BUILDINGS AND PLATS: (which was the only standing committee to report) reported through its chairman Alderman Loos that the Dog Pound is being satisfactorily repaired. THE BUILDING INSPECTOR, Frank I.3charringhausen reported 635,600.00 in building permits issued during June 1939. UNLAWFUL PICKETING ORDINANCE: The Clerk then read for second reading in ordinance entitled: AN ORDINANCE PROHIBITING 1 PICKETING OF PLACES OF BUSINESS BY PERSONS WHO ARE NOT PAST, PRESENT OR EXPECTANT EMPLOYEES OF THE PLACE OF BUSINESS BEING PICKETED. and followed the same by the reading of the following letter: KENNETH G. MEYER June 28,1939 City Council Municipal Mldg Des Plaines,Illinois Gentlemen: T enclose a redraft of the Picketing Ordinance as I would recommend it being passed when it is up for second reading. While I can find no case of record involving an ordinance passed by a municipality making picketing unlawful, it is my opinion after a thorough analysis of the law on the subject, that the ordi- nance as prepared and enclosed has a fair chance of standing the test in the event its constitutionality is questioned. With respect to the manner of enforcing the ordinance I have written a letter to the Chief of Police giving my views as to the manner in which it should be enforced. Respectfully submitted KENNETH G. Mayor and Councilmen: Gentlemen: I have been on motion requested to appeal to you in regards to the proposed Anti -Picket ordinance now before the Council for consideration. We protest the passage of this ordinance because it will hinder us in our effort to keep our class of work for Des Plaines contractors. For instance, if some out of town contractor should come here to do some work with underpaid, unskilled and amateur employees using second grade material, carrying no insurance and spending no money in our town, we could do nothing to protect our members,contractors or owners. We are an orderly organization of One Hundred and Fifty seven members, mostly Des Plaines Citizens and we feel that the businessmen should consider our feelings and our organization. ELI STRAUS vs THE CITY OF DES PLAINES: The Clerk then reported having received a summons in mandamus in the case of Eli Straus vs. the City of Des Plaines, Case 39-C-7149. The Mayor referred this summons to the City Attorney for attention. DES PLAINES COMMUNITY FAIR: The Clerk then read the following letter Des Plaines Business Men's Assn. dune 24,1939 City of Des Plaines Mos Plaines, Illinois Attention: Honorable M. Ahbe - Mayor The Des Plaines Business Men's Association is sponsoring its fourth annual civic celebration to raise money for charity, service work and the civic fund. This event will be different from the other three in that it will take the form of a county fair, and will be held under a tent 100 feet by 250 feet in size. This tent will house displays of local busi- ness men and industries. We invite the city to participate and to display anything you care to of interest to the puying public in this area. Our Community Fair is being staged five days, August 15th -19th inclusive. Booths are 10 feet by 10 feet in size, and are available at $25.00 each. All that it is necessary for you to do is to decorate your booth. We furnish all publicity, professional entertainment, etc., to assure you a crowd. Free samples may be distributed. To be assured a booth, we suggest that you reach a decision soon, as orders are coming in rapidly, and we expect that booths will be at a premium in the near future. DEMOLISHED DES PLAINES VILLAS POST: The Clerk then read the follow- ing letter: LAKEWOOD BUILDINERS June 28, 1939 Hen. Hobart M. Ahbe 2118 Miner Street Des Plaines, Illinois Honorable Sir: It has come to our attention that someone in your vicinity has broken down the gate at Third Avenue and Algonquin hoad in Des Plaines and completely demolished the same. These gates were a rational expense to our syndicate and were a beautiful asset to the subdivision as a marker thereof, and we believe that anyone who may so destroy the same ought to be arrested and prosecuted to the fullest extent of the law, and we are therefore requestion of you as mayor of the city of Des Plaines that you bring about the arrest of the party so guilty and notify us of the time and place of the hearing to be heard thereon. NORTHWESTERN RAILROAD -SMOKE COMPLAINT: Alderman Johnson then read the following letter: 1341 Jefferson St Des Plaine s, I11. June 27th, 1939 Mr. Elmer Johnson 33 otratford Road Des Plaines, Ill. Dear Elmer: Wonder if you cannot bring some pressure to bear which will eliminate the smoke nuisance, caused by the C & N W engines which park within 200 feet of the Graceland Ave. crossing each morning. These engines remain parked at this location all the way from seven to twenty minutes each morning, pouring out black smoke and gas, making it quite miserable for us folks here on the north side within a block or so from the track. SALARIES OF BUILDING INSPECTOR AND ELECTRICAL INSPECTOR: The Clerk then read the following proposed ordinance for second reading: AN ORDINANCE FIXING AND ESTABLISHING COMPENSATION OF BUILDING INSPECTOR AND ELECTRICAL INSPECTOR OF THE CITY OF DES PLAINES. BE IT ORDAINED: by the City Council of the City of Des Plaines, Cook County, Illinois, that: SECTION 1. All building inspection fees and building permit fees and other fees required to be paid under the provisions of the building Code of the City of Des Plaines concerning permits and, in- spections under the jurisdiction of the Building Inspector shell be deposited into the general corporate fund, and monthly an amount equal to 75%(seventy--five percent) of such fees shall be paid to the Building Inspector as and for his compensation and salary as Building Inspector. SECTION 2. A11 permit and inspection fees required to be paid under the provisions of the Building Code of the City -of Des Plaines in connection with electrical inspection or installations shall be paid into the general corporate fund, and monthly anamount equal to 757,, (seventy-five percent) of such fees so paid shall be paid to the Electrical Inspector of the City of Des Plaines for and as his com- pensation and salary as Electrical Inspector. SECTION 3. This ordinance shall be and is declared retroactive so as to be effective January 1,1939. SECTION 4. All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 5. This ordinance shall be in full force and effect from and after its passage and approval according to law. PASSED THIS DAY OF 1939. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried and the said minutes a approved. 162 CONTINUE DELIBERATION ON PICKETING ORDINANCE: Consideration and discussion was then resumed regarding the proposed ordinance entitled: AN ORDINANCE PROHIBITING THE PICKETING OF PLACES OF BUSINESS BY PERSONS WHO ARE NOT PAST, PRESENT OR EXPECTANT EMPLOYEES OF THE PLACE OF BUSINESS BEING PICKETED. The motion was made by alderman Lemke and seconded by Dopheide to pass this proposed ordinance as read. The Mayor put the question and the Clerk called the roll with the following results: Ayes; Aldermen Carroll, Johnson, Henrich, Loos, Dopheide, Carlson, Friott and Lemke. Nays; Aldermen Schwanbeck and • Campagna. The Mayor thereupon declared the motion carried and ordinance passed. Mayor ahbe thereupon approved the said ordinance by affixing his signature which was attested by Edgar +.Friedrich, City Clerk. The motion was then made by Alderman Dopheide and seconded by Henrich to order the Clerk to cause this ordinance published in the Des Plaines Journal.
