MINUTES OF THE REGULAR MEETING OF

ON MONDAY, APRIL 3, 1939 AT THE HOUR
OP 449 P.M.
CALL TO ORDER: The meeting was called to order by
Mayor Hobart M. Ahbe, presiding, with Aldermen Carroll, Tohn-
son, Pflughaupt, Henrich, Dopheide, Friott, Lemke, Schwanbeck
and Campagna responding to the roll call. The Clerk reported
all members of the Council present.
REPORTS OF mramq: The Clerk then read the report
of receipts of the City Clerk's office far March, 1939 and
distributed to each member of the Council a copy of the Treas-
uees Report of receipts and disbursements both for the month
of March, 1939 and for the first quarter (January, February
and March) of 1939. The Mayor ordered thesellmorts placed
on file.

THE XUDICIARY AND ASSESSMENT COMMITTEE had no report
THE QLICE AND LICENSE COMMITTEE; Alderman Carroll
chairman of the Police and License committee reported that he
has personally interviewed two of the principal violators of
the smoke brdinance and has been assured that the nuisance will
be abated.
ARE STREETS AND SIDEWALKS COMMITTEE submitted the
following report which was read by the Clerk:
To the Chairman Schwanbeck, Streets and Sidewalks
committee, at the meeting of the City Council, held Feb. 20, 1939
the following matter was referred to your committee:
The proposal from the Public Service Co. of Northern
Illinois to change the Ornamental Street lighting in the
downtown district from Rate *0* to Rate *105* was referred
to your committee with instructions to study the proposal
with the assistance of the City Engineer and the City At-
torney, and to report the committee's recommendation to the
Council.
A copv of the said proposal is attached hereto.

Your Committee on Streets and Sidewalks has investigated
the above and has found the attached contract advantageous.
We, your Committee, therefore recommend that the con-
tradt be accepted and that the Mayor and City Clerk be authorized
and directed to execute the same for and in the name of the City
of Des Plaines.

The motion was made by Alderman Schwanbeck and seconded
by Alderman Carroll to concur in this report. The motion was
voted upon by acclamation whereupon tne Mayor declared the motion
carried and the said report concurred in.
THE COMMITTEE ON PUBLIC WORKS, BUILDINGS AND PLATS had
no report to offer.
THE SEWER, DRAINAGE AND SANITATION COMMITTEE had no
report to offer.
THE WATER COMMITTEE had no report to offer.

THE BAND COMMITTEE had no report to offer.
THE BUILDING INSPECTOR, Frank F. Scharringhausen,
reported that a total of about 1100,000.00 in building permits
has been issued during the first three months of 1939. He
reported further that prospects are encouraging for the re-
mainder of the year.
SIXTEEN (16) LIQUOR LICENSES. ALLOWED: The Clerk then
read the following proposed ordinance for second reading:
AN ORDINANCE AMENDING AM ORDINANCE
ENTITLED "AN ORDINANCE REGULATING
THE SALE OF ALCOHOLIC LIQUORS IN TH'
CITY OF DES PLAINES, ILLINOIS. PASSED
NOVEMBER 21, 1938."
BE IT ORDAINED by the City Council of the City of
Des Plaines, Cook County, Illinois, that:
SECTION 1. Section 5, entitled tLimitation of
Licenses', of an Ordinance entitled "An Ordinance Regulating
the Sale of Alcoholic Liquors in the City of Des Plaines,
Illinois. Passed November 21, 1938" be and the same is here-
by amended to read as follows:
LIMITATION OF LICENSES. There shall be
no more than sixteen retail liquor dealer
licenses issued and outstanding at any
one time.
SECTION 2. All ordinances and parts of ordinances
in conflict herewith, are hereby repealed.
SECTION 3. Any person, firm or corporation violating
this ordinance shall be fined not less than $5.00 nor more than
$200.00 and a separate offense shall be deemed committed on
each day during or on which a violation occurs thr continues.
SECTION 4. This ordinance shall be in full force
and effect from and after its passage, approval and publication
according to law.

The motion was made by Alderman Henrich and seconded
by Alderman Campagna to finallypass and adopt this proposed
ordinance. The Mayor put the question and the. Clerk called the
roll with the following result: Ayes; Aldermen Carroll, John-
son, Ff?ughaupt, Henrich, Friott, Lemke, Schwanbeck and Campag-
na. Nays: Alderman Dopneide. The Mayor thereupon declared
the motion carried and the said ordinance passed.
Mayor Ahbe then approved the said ordinance by af-
fixing his signature whien was attested by Edgar J. Friedrich,
City Clerk.
Tne Motion was made by Alderman Lemke and seconded by
Alderman Carroll to instruct the Clerk to cause the said ordin-
ance to be published in the Des Plaines Suburban Times. The
motion was voted upon by acclamation whereupon the Mayor declar-
ed the motion carried.

EXTRA -CITY FIRE _CQN'T'RACTS REVISED Alderman Johnson
chairman of the I`ire Committee, then introduced the following
proposed resolution which was read by the Clerks
R E S OLUT I ON
WHEREAS the City of Des Plaines' paid Dire Depart-
ment and Volunteer Fire Department are called upon from time
to time to render fire protection services for the benefit
of property lying outside of the limits of the City of Des
Plaines; end
AREAS the giving of such service is an expense
to the City of Des Plaines for which such non-resident
property is not taxed; and
WHEREAS certain non-residents desire fire protection
from the City of Des Plaines; and
WHEREAS it is the desire of the City Council of the
City of Des Plaines to furnish such protection provided the
City is compensated therefor;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Des Plaines that the paid Fire Department and
the Volunteer Fire Department of the City of Des Plaines be
and they are authorized to render fire protection service to
the property of such non-residents as may execute an agreement
in the form attached to and made a part of this resolution,
provided such non-resi4ents pay at the time said contract is
executed the sum of $2.00 as a readiness to serve charge for
a period of one year or pay the sum of $5.00 when said contract
is executed as a readiness charge for a period of three years
from the date of the execution of such contract.
BE IT FURTHER RESOLVED that the paid Fire Department
and the Volunteer Fire Department shall not respond to fire
calls outside the City of Des Plaines to the premises of any
person or persons other than those who have executed the con-
tracts made a part of this resolution.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
be and they are hereby authorized to execute on beha]Fof the
City of Des Plaines contracts with non-residents for fire pro-
tection the form of such contract being attached to this resol-
ution and made a part hereof and marked Exhibit B. provided,
however, that no contract shall be executed by the Mayor and
City Clerk unless the Fire Marshall of the City of Des Plaines
has approved such contract for execution:
BE IT FURTHER RESOLVED that the moneys paid upon the
execution of said contract and representing the readiness to
serve charge, shall be deposited to the credit of the Fire
Protebtion Fund of the `. City and that 50 percent of the fees
collected for services rendered under said contracts for fire
protection shall be deposited to the credit of the Fire Pro-
tection Fund of the City and 50 per cent thereof paid to
the Treasurer of the Volunteer Fire Department.
BE IT FURTHER RESOLVED that any previous resolution
on the subject matter contained in this resolution is hereby
revoked and held for naught.

AGREEMENT FOR FIRE PROTECTION
THIS AG made this day of a
A.D. 1939, by and between the CITY OF DES PLAINES, a municipal
corporation, hereinafter referred to as the City, and
a non-resident of the City of 7Des
Plaines, hereinafter referred to as the non*resident, WITNESS
ETH:
WHEREAS, the CITY OF DES PLAINS" maintains fire
fighting equipment for the protection of persons and property
within the City of Des Plaines; and
WHEREAS, is a nonresi-
dent owning or renting property outside the City limits of
the City of Des Plaines and desires the protection afforded
by the fire fighting equipment of the CITY OF DES PLAINES; and
WHEREAS, the City is ready, willing and able to fur-
nish fire fighting protection to the said non-resident under
the conditions of this agreement hereinafter stated;
NOW, THEREFORE, IT IS UNDERSTOOD AND AGREED by and
between the parties hereto, as follows:
1. The City agrees to respond to all fire cane
that may be received from the said non-resident or anyone on
his behalf reporting the existence of a fire involving prop-
erty on the premises owned by the said non-resident, with a
fully equipped pumper truck manned with such volunteer firemen
of the Des Plaines Volunteer Fire Department as may respond
to such fire call, provided, however, that the CITY OF DES'
PLAINES shall not be required to render such fire protection
or services under the following conditions:
a. When the CITY OF DES PLAINES Fire
Department or any of its members, apparatus,
or equipment thereof, is an duty at another
fire or first-aid case at the time any call
is received reporting fire involving prop-
erty of the said non-resident;
b. When, before the CITY OF DES PLAINES
Fire Department has left the fire station,
coincident calls are received requesting the
services of the CITY OP DES PLAINES Fire
Department in both the CITY OF DES PLAINES
and at the property of the said non-resident,
or at the property of some othimr non-resi-
dent, in which case the request for the ser-
vices of the CITY OF DES PLAINES Fire Depart-
ment within the CITY OF DES PLAINES will re-
ceive preference;
c. When the services of the CITY OF DES
PLAINES Fire Department cannot be furnished
because of the disablement of either the
equipment or the members of the Fire Depart-
ment, impossible road conditions, or any
other unfrresseen cause.
2. IT IS EXPRESSLY UNDERSTOOD AND AGREED between the
parties hereto, that this contract is only intended to cover
fire protection services and is not intended to include the
use of the inhalator or other first-aid services of the CITY
OF DES PLAINES Fire Department.
3. The parties hereto further agree that the said
non-resident shall not hold the CITY OF DES PLAINES liable
for, and will protect the CITY OF DBS PLAINES against any
claims which may be made growing out of any personal injury
or property damage resulting from any accident .for which any

member of the CITY OF DES PLAINES Fire Department or the
CITY OF DES PLAINES Volunteer Fire Department may be re-
sponsible while acoompanying the apparatus or equipment
of the CITY OF DES PLAINES"Fire Department in proceeding
to or returning from any fire call to the said non-res-
ident, including any claims for personal injuries to mam-

bers of the CITY OF DES PLAINES Fire Department or the
CITY OF DES PLAINES Volunteer Fire Department while on
duty in response to any tall from the said non-resident
for fire protection.
4. The parties hereto also agree that the said
non-resident shall not hold the CITY OF DES PLAINES Or
anf member of its Volunteer Fire Department or its paid
Fire Department liable for and will protect tine CITY OF
DES PLAINES, its paid Fire Department, and the members
of the Volunteer Fire Department against any claims which
may be made because of injury to the public or damage to
property which may occur while the members of the CITY
OF DES PLAINES Fire Department or its Volunteer Fire De-
partment are working at a fire at the premises of said
non-resident.
5. IT IS FURTHER EXPRESSLY AGREED between the
parties hereto that upon fire call to the premises of said
non-resident, the Chief of the DES PLAINES Fire Department
Shall be in complete autriority in the manner and methods
used in fighting such fire.
6. The said non-resident hereby agrees to pay
to the CITY OF DES PLAINES for all the services in this
sgreemPnt provided for, the sum of $2.00/or $5.00, as a
readiness to serve charge, receipt of wwiich is hereby
acknowledged, whish said payment shall make this agreement
effective for a period of l ,gear/ or 1 years from the day
of its execution unless terminated by the parties hereto
in accordance with the provisions of paragraph 7 of this
agreement. If terminated by the City there shall be a pro
rata refund of said S21.00Air *5.00, to said non-resident.
In addition to said readiness to serve charge of
said non-resident agrees to pay to the
CITY 4F DES PLAINES, the sum of *100.00 for each call for
fire protection services responded to by the CITY OF DES
PLAINES paid Fire Department or the CITY OF DES PLAINES Vol-
unteer Fire Department to the premises of said non-resident,
which sum shall be due and payable at the office of the
City Clerk on the 15th day of the month following the month
in which such services may have been rendered.
To assure the payment of said $100.00, the said
non-resident hereby 'agrees to keep in full force and effect
upon his premises adequate fire insurance with a "rider"
attached thereto, providing for the payment by such Insurance
Company of not to exceed $100.00 for services rendered by
Fire Departments for fire protection.
7. The parties hereto further agree that this
agreement shall be subject to termination by the City giving
written notice thereof by registered mail to the non-resident
at his last known address or by the non-resident notifying
the City by registered mail directed to the City Clerk. Said
agreement shall thereupon be cancelled 30 days after the mail-
ing of such notice as Herein provided for.
8. It is agreed by the parties hereto that the
premises of the non-resident, intended to be covered by this
agreement are located at
IN WITNESS WHEREOFTHE CITY OF DES PLAINES, by its
Mayor and City Clerk, pursuant to authority of the City Council
of the CITY OF DES PLAINES, have signed this agreement in their

official capacity and affixed the corporate seal of said
city, and the said non-resident has affixed his hand a*!d
seal, all on the day and year first above written.

The motion was made by Alderman Pflughaupt and seconded

APPROVAL OF MINUTES: Mach member of the Council having
been supplied with a copy of the minutes of the regular Council
meeting held Monday, March 20, 1939, the motion was made by
Alderman Schwanbeck and seconded by Alderman Carroll to approve
the `said minutes as written. The motion was voted upon by
acclamation whereupon the Mayor declared the motion carried and
the said minutes approved.
APFOINTM NTS: Mayor Ahbe then announced the re -appoint-
ment of the following persons as members of the Library Board of
Trustees:
Kenneth W. Downing For a three year term
Wilbur R. S-ulzback beginning Mayl, 1938 and
Mrs..Edward Shuler ending April 30, 1941.
He also announced the appointment of the following
person to the office of Health. Inspector.
Mrs. Elsie Willer - For a one (1) year term
beginning May 1, 1938 and
ending April 30, 1939.

The America„ Brotherhood for the Blind hereby requests per-
mission to hold its annual *Flower Sale* in Des Plaines on
Saturday, April 15th. The Sale will again be sponsored by
a local Committee of clergymen, club women, and other prom-
C4 inent citizens, and organized by our representative, Mrs.
Hazel Ferber.
.r� The American Brotherhood is a national non-profit, non-
sectarian organization, embossing and publishing books and
magazines in Braille and distributing them free to institutions
for the Blind and to blind individuals throughout the county.
We also render assistance to the blind in many personal ways
not covered by any other organization. All our services, as
well as our publications, are available free.
The work of the, Brotherhood is supported entirely by friendly
contributions and by the proceeds of *Flower Sales' --the
artificial flowers used being made by the blind. We are sure
the citizens of Des Plaines would welcome the opportunity to
give support again to this worthy cause; and we trust you will
grant our request, as you have in previous years.

The motion was made by Alderman Friott and seconded
by Alderman Campagna to grant this request. The motion was
voted upon by acclamation whereupon the Mayor declared the motion

PARKING LOT DRIVEWAY: Alderman Henrich called the Coun-
cil's attention to the fact that vehicles entering the parking
lot at the northeast corner of Center and Prairie Aven4e drive
over the curb and sidewalk. Alderman Henrich asked that a drive-
way be provided as required by ordinance in order to prevent
breaking down of tree curb. The Mayor referred this matter to the
Streets and Sidewalks Committee for attention:
DETERMINING OWNERSHIP OF ALLEY: Alderman Henrich then
asked that steps be taken to determine the ownership of the alley
shown on the City plat between Walnut Avenue and Henry Avenue at
Des Plaines Avenue. The Mayor referred this matter to a joint
committee consisting of the Building and Plats Committee and the
Streets and Sidewalks Committee.
ADJOURNMENT: The motion was made by Alderman Lemke and
