Schwanbeck CUMBERLAND TERRACE WATER MAINS - WEST OF BELT LINE: Mr. E.N. Fletcher, City Engineer, then submitted to the Council plans and specifications covering a proposed water main project to be carried on with WPA assistance in that part of Branigar's Cumberland terrace lying west of the Belt Line Railroad tracks. He also submitted therewith the necessary application for WPA grant in the sum of $39,453.00 including :200.00 for the City's inspector for this project. The motion was made by Alderman Garland and seconded by Alderman Henrich to approve the said plan* and specifications and to authorize and direct the mayor and City Clerk to execute the said application for and in the name of the City of Des Plaines. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried. OUTSIDE FIRE PROTECTION CONTRACTS: Alderman Garland, Chairman of the Fire Committee introduced the following proposed resolution which was then read by the Clerk: RESOLUTION WHEREAS the City of Des Plaines' paid Fire Department and Volunteer Fire Department are called upon from time to time to ?ender fire protection cervices for the benefit of property lying outside the limits of the City of Des Plaines; and WHEREAS the giving of such service is an expense to the City of Des Plaines for which such non-resident property is not taxes; and WHEREAS certain non-residents desire fire protection from the City of Des Plaines; and WHEREAS it is the desire of the City Council of the City of yes Plaines, provided the City is compensated therefor: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Des Plaines that the paid Fire Department and Vol • - unteer Fire Department of the City of Des Plaines be and they are authorized to render fire protection services to the property of such non-residents as may execute the agreementsmade a part of this resolution. BE IT FURTHER RESOLVED that the paid Fire Department and the Volunteer`Fire Deportment shall not respond to fire calls outside the City of Des Plaines to the premises of any person or person`s other than those who have executed the contracts made a part of this resolution. 85 BE IT FURTHER RESOLVED that the Mayor and City Clerk be and they are hereby authorized to execute on behal of the City of Les Plaines contracts with non-residents for fire pro- tection, the form of such contracts being attached to this resolution and made a part hereof and marked exhibits '*A" and "B"; and BE IT RURTHER RESOLVED that no contract shall be executed unless previously approved by the Fire Marshall in writing; and BE IT FURTHER RESOLVED that the moneys paid to the City of Dee Plaines by virute of said contracts hereinbefore referred to shall be allocated as follows: 75% to the City Fire Protection Fund and 25% to the Volunteer Fire Depattment. AGREEMENT FOR FIRE PROTECTION THIS AGRIEMENT made this day of ,A.D. 1939, co CI be and between the CITY OF DES PLAINES, a municipal corporation, r nereinafter referred to as the City, and _ a non-resident of the City of Des Plaines, hereinafter referred to as the non-resident, WITNESSETH: WHEREAS, tne CITY OF DES PLAINES maintains fire fight- ing equipment for the protection of persons and property within the City of Des Plaines; and WHEREAS, is a non-resident owning property outside the City limits of the City of Des Plaines and desires the protection afforded by the fire fighting equipment of tne CITY OF DES PLAINES: and WHEREAS, the City is reams, willing and able to furnish fire fighting protection to tne said non-resident under the conditionsof this agreement hereinafter stated; NOW, THEREFORE, IT IS UNDERSTOOD AND AGREED by and between the parties hereto, as follows: 1. Tne City agrees to respond to all fire calls that may be received from the said non-resident or anyone on his behalf reporting the existence of a fire involving property on the premises owned by the said non-resident, with a fully equipped pumper truck manned with such volunteer firemen of the Des rlaines Volunteer Fire Department as may respond to such fire call, provided, however, that the City of Des Plaines shall not be required to render such fire protection or services under the following conditions: a. When the CITY OF DES PLAINES Fire Department or any of its members, apparatus, or equipment there- of, is on duty at anotner fire or first-aid case at the time any call is received reporting fire invol- ving property of the said non-resident; b. When, before the' CITY OF DES PLAINES Fire Department has left the fire station, coincident calls are received requesting the services of the CITY OF DES PLAINES Fire Department in both the CITY OF DES PLAINES and at the property of said non-res- ident, or at the property of some dther non-resident, in which case the request Tor the services of the CITY OF DES PLAINES Fire Department within tne CITY OF DES PLAINES will receive preference; c. When the services of the CITY OF DES PLAINES Fire Department cannot be furnished because of the disablement of either the equipment or tne members of tne Fire Department, impossible road conditions, or any other unforeseen cause. 86 2. IT IS EXPRESSLY UNDERSTOOD AND AGREED between the parties hereto, that this contract is only intended to cover fire protection services and is not intended to include the use of inhalator or other first-aid services of the CITY OF DES PLAINES Fire :Department. 3. The parties hereto further agree that the said non- resident shall not hold the CITY OF DES PLAINES liable for, and will protect the CITY OF DES PLAINES against any claims which may be made growing out of any personal injury or property damage resulting from any accident for which any member of the CITY OF DES PLAINES Fire Department or the CITY OF DES PLAINES Volunteer Fire Department may be responsible while accompanying the apparatus or equipment of the CITY OF DES PLAINES Fire Department in proceed- ing to or returning from any fire call to the said non-resident, including any claims for personal injuries to members of the CITY OF DES PLAINES Fire Department or the CITY OF DES PLAINES Volunteer Fire Department while on duty in response to any call from the said non-resident for. fire protection. 4. -The parties hereto also agree that the said non-res- ident small not hold 'the CITY OF DES PLAINES or any member of its Volunteer Fire Department or its paid Fire Department liable for and will protect the CITY OF DES PLAINES, its paid Fire Depart- ment, and the members of the Volunteer Fire Department against any claims which may be made because of injury to the public or damage to property which may occur while the members of the CITY OF DES PLAINES Fire Department or its Volunteer Fire Department are working at a fire at the premises of said non-resident. 5. IT IS FURTHER EXPRESSLY AGRRED between the parties hereto that upon fire call to the premises of said non-resident, the Ghief of the Des Plaines Fire Department shall be in complete authority in the manner and methods used in fighting such fire. 6. The said hon -resident hereby agrees to pay to the CITY OF DES PLAINES for all the services in this agreement provided. for, the sum of 125.00 as a readiness to serve charge, receipt of which is hereby acknowledged, which said payment shall snake this agreement effective for a period of five years from the day of its execution, unless terminated`by the parties hereto in accor- dance with the provisions of paragraph 7 of this agreement. If terminated by the City there shall be a pro rata refund of said $25.00 to the said non-resident. In addition to said readiness to serve charge of $25.00, said non-resident agrees to pay to the CITY OF DES PLAINES the sum of $25.00 for each call for fire pro- tection service responded to by the CITY OF DES PLAINES paid Fire Department or the CITY OF DES PLAINES Volunteer Fire Department to the premises of said non-resident, 'which sum `shall be due and payable at the office of the City Clerk on the 15th day of the month following the month in which such service may have been ren- dered. 7. The parties hereto further agree that this agreement shall be subject to termination by tree City giving written notice thereof by registered mail to the non-resident at his last known address orby the non-resident notifying the City by registeeed• mail directed to the Gity Glerk. Said agreement shall thereupon bei cancelled 30 days after the mailing of such notice as herein provided for. The said non-resident Hereby agrees to pay to the CITY OF DES PLAINES for all the services in this agreement provided for, the sum of 410Q.00 for each call for fire protection services responded to by the CITY OF DES PLAINES paid Fire Departrnent or the CITY OF DES PLAINES Volunteer Fire Department to the premises of said non - resident. Said sum of,:$100.00 shall be payable at the office of the City Clerk on the 15th day of the month following the month in which such service may have been rendered. 7. The parties hereto further agree that this agreement shall be subject to termination by the City giving written notice thereof by registered mail to the non-resident at his last known address or by the non-resident notifying the City by registered mail directed to the City Glerk. CrJ Gentlemen: •eMay we, the members of the Band, call to your attention to the ct delinquency of payments to members arranged some years ago by the City Council and to be paid from the Band fund. These payments, some six months in arrears, amount to 35 cents per meeting for members and a small additional sum for the director. Although in 1928 the people of Des Plaines voted favorably to support a band, no moneys have been levied and support came exclusively from the payment of delinquent taxes. finis source we are informed., ip lately insufficient for the Band's upkeep which is the reason for the suspension of payment to the Band. Concerted effort over the years nas been directed to build one of the finest community bands in the country, a unit numbering 50 pieces. Each week during the summer the Band has presented concerts to appreciative audiences -- plus calls at Veterans' nospitals several times a year and parades on :Memorial and independence Days. These are just a few good -will dividends returned, dividends favorable to any city. 89 STRJI HT PERMIT FOR BOY SCOUT STREAMER: Mayor Ahbe then orally submitted to.tne Oouncil-a-request from the Boy Scouts asking permission to nang a 30" x 30" streamer sign across one of the downtown streets advertising the annual Boy Scouts Fund Drive. -rhe motion was made by Alderman Garland and secon- ded by Alderman Carroll to grant, this request. City Council City of Des Plaines Des Plaines, illinois Years go into the making of such an organiaation and a city proud an appreciative of such a Band will not thank triose through whose neglect it was allowed to disintegrate. We trust. that some way can be found to continue this civic spirited organization. Approximately 1750.00 per year is the modest requirement to maintain your Band.
