01/23/193962 MINUTES OF THE SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES HELD IN THE COUN- CIL CHAMBERS ON MONDAY, JANUARY 23, 1939 AT THE HOUR OF 8:00 P.M. CALL TO ORDER: The meeting was called to order by Mayor Hobart M. Ahbe, presiding, with Aldermen Johnson, Pflug- haupt, Henrich, Garland, Dopheide, Friott, Lemke and. Campagna responding to the roll call. Alderman Carroll arrived shortly after the roll call, but Alderman Schwanbeck was absent during the entire meeting. READING OF THE CALL: The Clerk then read the following call of the meeting: OTICE OF SPECIAL MEETING To the Aldermen of the City Council of the City of Des Plaines, Illinois Gentlemen: Upon call of Mayor Hobart M. Ahbe, there will be a special meeting of the City Council of the City of Des Plaines at 8:00 P.M. Monday evening, January 23, 1939, in the Council Chambers (or committee room), Municipal Building, Des Plaines, Illinois, for the purpose of authorizing the execution of a lease to permit the laying of water mains under the Chicago & Northwestern right-of-way in connection with the Cumberland Terrace water main project; and for the purpose of deliberating upon such other matters as the Council may wish to consider. January 17, 1939 Suhr, Berryman Peterson & Suhr, Inc. Consulting Engineers 130 North Wells Street Chicago, Illinois Gentlemen: Herewith license in duplicate to the City of Des Plaines, Illinois, covering an 8"" sewer main under tracks and two temporary shafts between tracks. Will you kindly arrange to have this presented to th City of Des Plaines for execution and City seal, after which both copies should be returned to me for further handling. Also please arrange to obtain and for°ard to me with return of the license, a certified copy of the resolution adopted by the City, authorizing the acceptance by the Mayor and City Clerk. Eng. and presented the following proposed resolution: WHEREAS the City of Des Plaines is desirous of con- structing and laying an 8 inch water main under the right of way of the Chicago and North Western Railway Company's rail- road tracks in what was formerly known as Seegers Road, west- erly from an existing water main in the Northwest highway; and WHEREAS the Chicago and North Western Railway Com- pany is agreeable to granting permission to the City of Des Plaines to construct such water main provided the City of Des Plaines will execute an easement or license. NOW THEREFORE be it resolved by the City Council of the City of Des Plaines that the Mayor and the Clerk of the City of Des Plaines be and they are hereby authorized to ex- ecute on behalf of the City of Des Plaines the easement or license with Charles P. Megan, not as an individual but as trustee of the property of the Chicago and North Western Rail- way Company, which license or easement is attached hereto and made a part of this resolution. Passed this day of A.D. 1939 City Clerk 63 The motion was made by Alderman Garland and seconded by Alderman Lemke to adopt this proposed resolution. The motion was voted upon by acclamation whereupon the Mayor de- clared the motion carried and the said resolution adopted. STATE HIGHWAY PERMIT - RRANIGAR MAINS: The Clerk then read the following proposed resolution: RESOLUTION WHEREAS, the City of Des Plaines located in the County of Cook, State of Illinois, wishes to locate, construct, and maintain a 6* cast iron pipe water main and appurtenances. Which by law comes under the jurisdiction and control of the Department of Public Works and Buildings of the State of Illinois, and WHEREAS, a permit from said Department is required before said work can be legally undertaken by said City of Des Plaines, now THEREFORE, be it resolved by the City of Des Plaines County of Cook, State of Illinois 64 FIRST: That we do hereby request from the Department of Public Works and Buildings, State of Illinois, a permit authorizing the City of Des Plaines to proceed with the work herein described. SECOND: That we hereby pledge the good faith of the City of Des Plaines and guarantee that all work shall be performed in accordance with the conditions of the permit to be granted by the Department of Public Works and Buildings of the State of Illinois, and to hold the State of Illinois, Department of Public Works and Buildings, harmless on account of any damages that may occur to persons or property during the prosecution of such work, and assume all liability for damages to persons or property due to accidents or other- wise by reason of the work which is to be performed under the provisions of said permit. THIRD: That we hereby state that the proposed work is not to be performed by the employees of the City. FOURTH: That the proper officers of the City are hereby instructed and authorized to sign said permit in beh- alf of the said City of Des Plaines, Cook County, Illinois. The motion vas made by Alderman Henrich and seoonded by Alderman Lemke to adopt this proposed resolution. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried and the said resolution adopted. TESTS FOR CUMBERLAND TERRACE WATER MAINS: The motion was made by Alderman Lemke and seconded by Alderman Friott to require a $25.00 deposit from the Mount Prospect Realty Trust, developers of Cumberland Terrace, as a bond for the payment of tests and inspection of the mains to be laid in Cumberland Terrace, and to require further that the tests and inspect4on be paid for as the same progresses, always leaving the $25.00 deposity as an advance payment, until satisfactory completion of the project. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried. LICENSING VEGETABLE WASHING BUSINESS: Alderman Dopheide, Chairman of the dewer, Drainage and Sanitation Committee then introduced a proposed ordinance which was read by the Clerk for first reading and is entitled: AN ORDINANCE PROVIDING FOR THE REGULATION OF USE OF CITY SEW- ERS BY PERSONS FIRMS OR COR - TO -RATIONS ENGAGED IN THE CLEAN- ING OF VEGETABLES. Mayor Ahbe ordered this proposed ordinance filed for second reading. JUDGMENT - ECONOMY PLUMBING & HEATING COMPANY: Kenneth G. Meyer, 6ity, Attorney, then orally reported that the Economy Plumbing and Heating Company suggested settlement of their judgment in the sum of $189.08 entered against the City in Case No. 38-C-4051. The motion was made by Alderman Hen - rich and seconded by Alderman Friott to instruct the City At- torney to settle for not more than $189.08. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried. DECORATING POLICE HEADQUARTERS: Alderman Campagna, chairman of the Committee on Public Works, Buildings and Plats, requested the decoration of the Police quarters. The motion was made by Alderman Carroll and seconded by Alderman Campagna to authorize the Committee on Public Works, Buildings and Plats to do the necessary interior decorating in the Police quarters. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried. 65 MAKING PROVISIONS FOR SKATING: Aderman Dopheide reported that an agreement has been reached between the Water Department, the Fire Department, the Park District and the Public Schools to provide public ice skating rinks by the following means: The Water Department will furnish the necessary water, the Fire Department will furnish the equip- ment for flooding, the Park District will furnish the labor and the schools will furnish the areas to be flooded. ADJOURNMENT: The, ,motion was made by Alderman Pflug- haupt and seconded by Alderman Henrich to adjourn. THE POLICE & LICENSE COMMITTEE through its chairman Alderman Carroll reported that the revision of the draft of the proposed Uniform Traffic Code is being completed and should be ready for second reading in the near future. THE STREETS & SIDEWALKS COMiVIITTEE: Tne Clerk tnen read the following report: To: Theo. Schwanbeck, Chairman, Streets & Sidewalks Committee Des Plaines Rafety Council C.N. Fletcher, Uity Engineer State Highway Department at the meeting of the City Gouncil, held January 16, 1939 the following matter was referred to you: The matter of studying the Stop and Go Traffic Control system at the intersection of Lee St. and Miner St., as well as at the intersection of Lee St. and Ellinwood St., with a view toward making such alterations or additions as would eliminate alleged hazards at the said intersections. rhe Gouncil should be pleased to have your recommenda- tions as soon as possible.
