APPROVAL OF IVZINUTES: Each member of the Council
having at hand a copy of the minutes of the regular meeting
of the Council Held Monday, Noiieinber 7, 1938, the motion
was made by Alderman Johnson and seconded by Alderman Henrich
to approve the said minutes as written. The motion was voted
upon by acclamation whereupon the Mayor declared the motion
carried and the said minutes apiroved.
FAVOR NINETY -MINUTE PARKING: Mayor Ahbe informed
the Council that there is considerable objection to the one
hour parking reetrict on in the downtown area, and that a ninety -
minute restriction would seem more pbpular. He therefore
urged the members of the Council to give this matter some
thought before the next .meeting of the Council.
ADJOURNMENT. The motion was made by Alderman Gar-
land and seconded by Alderman Lemke that the Council adjourn
to Monday , November 28, 1938 at 8:00 P.d. The motion was
voted upon cy acclamation whereupon the Mayor declared the
motion carried and the Council so adjourned.

Upon call Ofd roll Aldermen Henrich, Pflughaupt, Gar-

AldermenASc1wanbeck and Campagna being absent.
A quorum being present, the Mayor called the meeting
to order at 8:15 P.M. and announced that a continuation of the
reading of the Revised BuilAing Code of 1938, was the agenda for
the meeting.
Whereupon the City Attorney proceeded with the reading
aloud of the Ordinance. During the course of the meeting,
Aldermen Pflughaupt,' Garland and Dopheide also read aloud
portions of the Ordinance.
Upon the reading of Section 99 and prior sections,
the meeting, on motion duly made and seconded, was adjourn'd.

CALL TO ORDER: The meeting was called to order by Mayor
Hobart M. Ahbe, presiding, with Aldermen Carroll, Johnson, Pflug-
haupt, Henrich,`Garland, Dopheide, Friott, Lemke, Schwanbeck and
Campagna responding to the roll call. The Clerk reported all mem-
bers of the Council present.
REPORTS OF OFFICERS: The Clerk then presented the f ol-
lowing reports for the calendar month of November, 1938:

THE JUDICIARY AND ASSESSMENT COMMITTEE: had no report
to offer.
THE POLICE AND LICENSE COMMITTEE: The Clerk then read
the following report;
To the Chairman Carroll, Police and License committee,
at the meeting of the City Council, held November 21, 1938, the
following matter was referred to your committee:
The letter from the City Clerk dated November 21, 1938
asking an expression from the Council with respect to 1939 Vehicle
License Fees and requesting that if a change is made it be made
in time to avoid confusion. A copy of the said letter is attached
hereto.
To the Mayor and City Council: Your Committee on Police
and License has investigated the above and has founds The present
ordinance calls for $3.00 per year, and $1.50 for six months. We,
your Committee on Police and License, therefore recommend: If
there are any recommendations for a change in the ordinance they
should be voiced now. We are therefore turning the matter over to
the Council for recommendation.

The motion was made by Alderma„ Schwanbeck and seconded
by Alderman Henrich to instruct the City Attorney to prepare an
ordinance amending the vehicle license ordinance sous to provide
a $3.00 annual vehicle license fee for passenger automobiles of
thirty-five horsepower and less, with a provision that such fee
shall not be pro -rated for fractions of the license year. The
Mayor put the question and the Clerk called the roll with the fol-
lowing result: Ayes; Aldermen Pflughaupt, Henrich, Dopheide,
Schwanbeck, and Campagna. Nays; Aldermen Carroll, Johnson, Garland,
Friott and Lemke. The Clerk announced the vote a tie, whereupon
Mayor Ahbe cast his vote as *Aye* and declared the motion carried.
A few minutes later the City Attorney read for first
reading the proposed ordinance entitled:
AM ORDINANCE AMENDING SECTION 1045
AND 1046 AND AMENDMENTS THERETO OF
CHAPTER 22 ENTITLED "VEHICLE LICEN-
CES" OF THE MUNICIPAL CODE OF 1928.
The Mayor ordered this proposed ordinance filed for
second reading.

THE STREETS AND SIDEWALKS COMMilad had no report
to offer.
THE COMMITTEE ON PUBLIC WORKS, BUILDINGS AND PLATS
had no report to offer.
THE SEWER DRAINAGE AND SANITATION COMMITTEE" through
its chairman Alderman Dopheide reported that he has again
received a number of complaints regarding sewer gas near the
corner of Perry and Alles Streets in spite of the fact that
three catchbasins have ,recently been re -built at this loca-
tion in an attempt to eliminate this sewer -gas odor.
THE WATER COMMITTEE had no report to offer.
THE FIRE COMBMITTEE through its Chairman Alderman
Garland reported that the Volunteer Fire Department has pur-
chased 400 feet of hose from its 2% Foreign Insurance Tax
Fund and its Benefit Ball Fund. he further reported that
an examination of the appropriation expenditures of the Fire
Protection Fund deem to indicate that the Fire Department will
operate about $1,600.00 below its appropriation' far 1938.

ADDITIONAL SAFETY GATES: The Clerk then read the
following letter

Dear Sir:
Referring to your letter of October 20, 1938,
which I acknowledged October 31st, relative to the City
Council of Des Plaines instructing you to request that
the C & N W Ry take the necessary steps to make the ne-
cessary preparation so that safety gates may be installed
at Pearson Street, Lee Street and Graceland Avenue in the
City of Des Plaines as soon as possible.
We admire the City of Des Plaines for its safety
record and can readily appreciate its desire to have the
maximum of protection at its crossings.
The C & N W Ry too has a very enviable record as
to its safety and if it were possible we would like to pro-
vide the maximum of protection at all of the highway cross-
ings along our line. Unfortunately our financial condition
is such that this is an impossibility.
We have endeavored to co-operate with the City of
Des Plaines in the past and would like to do so now. You
will recall that during the past year we spent approximately
$4,500.00 to improve protection at Des Plaines Avenue.
Our investigation of the three crossings at which
you propose gates indicates that it mould require an expen-
diture of approximately $20,000.00 to provide automatic
gates with manual supervision from a central point.
Lee Street is the route of U.S. Highway 45 through
Des Plaines, and Pearson Street and Graceland Avenue might
be considered as feeders to tnis route.
We understand that Feder funds are available far
protection of such crossings and that they can be secured

if proper influence is brought to bear on the State Highway
Department at Springfield. The automatic short arm gate with
flashing light signals is a favorite type of protection with
the Highway Department and we are sure that if the proper in-
fluence is used that they would agree to such an installation
on each of these three crossings.
If the matter is referred to us by the Highway Dei.;
partment we will be glad to ce-operate by agreeing to accept-
ing these installations on our railroad and agreeing to accept
the cost of their maintenance and operation.

The motion was made by Alderman Dopheide and seconded
by Alderman Garland to authorize the Mayor to appoint a comm-
ittee to meet with the proper officials of the C & NW Railroad
and the State Highway Department in an attempt to have the said
safety gates installed. The motion was voted upon by acclamation
whereupon the Mayor declared the motion carried.
Mayor Ahbe thereupon appointed the Aldermen Garland,
Dopheide and Carroll as well as E.N. Fletcher, Ernest Drexler
and A.C. Kadlec as the members of the said committee.
BRANIGAR'S CUMBERLAND TERRACE WATER MAINS: The Clerk
then read the following letter:
TO: Hon. Mayor and City Council
City of Des Plaines
Dee. 5, 1938
FROM: E.N. Fletcher, City Engineer
Some six weeks ago Mr. Emmet Kennedy appeared before
your honorable body with a request that the City of Des Plaines
sponsor a W.P.A. project for the installation of water mains
in the Branigar Subdivision now being developed at Wolf Road
near Sieger's Road.
This request was granted at that time.
Before this project is allowed to be started there are
two things that should be done:
First - Plans and specifications should be submitted
to the Engineer for the City for approval and
by him to the City Council.
The specifications should provide for adequate
tests to be made on the pipe line after laying
and before backfilling in order to prevent ex-
pensive leaks.
The same make of valves and hydrants as now in
use in the majority of glades in the City should
be used.
Hydrants and pipe sizes should be adequate for
fire protection.
At the time this subdivision was before the
Council several members expressed a desire to
see watermains installed in order that adequate
fire protection be provided.
The writer talked to Mr. Ben Suer, Engineer for
Branigar, this day and was informed that no hy-
drants are to be installed in this improvement.
.The ommission of hydrants at this time means that
at some future date they will have to be installed

and paid for either from the General Corpor-
ate or the Water Fund.
Second A definite understanding should be had in
regard to the purahase`of the material for
this project.
As sponsor the City of Des Plaines is repon-
sible for the greater amount of the material
to be used on this project, in fact, for all
the material not furnished by the Government.
The writer recommends that the City Clerk be instructed
to write a letter to the Branigar Company instructing them that
no work will be permitted on this project until the above con-
ditions have been met anA .that a copy of the letter be sent to
Mr. H.M. McCullen, District Director of WPA, Merchandise Mart,
Chicago, Illinois.

COMMERCIAL SET -BACK LINES: The Clerk then read the
following report:

REPORT OF ZONING BOARD OF APPEALS
Subject: BUILDING SET BACK LINES
IN COMMERCIAL DISTRICTS
TO THE HONORABLE MAYOR, CITY CLERK, AND CITY COUNCIL:
Pursua^t to the request of the City Council, for a revision
of the Zoning Ordinance of the City of Des Plaines, and the
establishment of set -back lines for buildings, the Zoning
Board of Appeals has for some time past made exhaustibe
study and has given serious thought to the problems.. The
services and advice of the City Engineer were enlistd and
numerous field investigations by members of the Zoning Board
were made. Public hearings were held in which numerous
changes in commercially zoned areas were effected, in most
cases with the full consent of the owners of such property.
In order that all might be treated fairly, every opportunity
has been extended to owners by the Board for the voicing
of their opinions and objections. 'This work, of neces-
sity, has been slow; however, there now remains only one
section to come under c^nsideration of the Board. The par-
cels concerned are a unit holding, and argument will be
heard at an early date. A complete report of this far reach-
ing undertaking is withheld pending the disposition of the
final case.
Since the matter of set -back lines in commercial areas can
be regarded as independent of the Board's efforts toward
elimination of grossly excessive commercial zoning, the
Board has instrut,ted me to submit the following report and
suggestions on this phase of the work:
SET -BACK LINES:
In the last published revised ordinance of the City
of Des Plaines, on page 217 under title - Area
Diatrict C - designated as section 16, appears
`the following: "In area District C there shall
be no restriction of the intensity of useof
any lot, piece or parcel of ground thereon."
It is recommended to the Honorable Council that
the above quoted section 16 be abolished, and
the following regulations instituted --

Commercial District C - SET -BACK: No part of
any building or accessory building shall be
erected or altered on any Iot in the_ C. Commercial
District so that any part of said building or
accessory buildings is closer than five feet from
the street line, or lines adjoining said lot,
providing that in a blockin which a building or
buildinLs has or have been erected, no building
or accessory building fall Hereafter be erected
in said block closer to the adjoining street lines
than the nearest building in said block.
INTENSITY OF USE OF LOT:
No building with its accessory buildings shall
occupy more than ninety percent of a lot.
It is urged that the above recommendations be incorporated
at once in the existing ordinance as a precautionary measure.
`They will be embelished and supported in the complete con-
solidated revision of the Zoning Ordinance which the Board
expects to submit to your Honorable body at the earliest
possible date.

Alderman Garland expressed his thanks and appreciation
for the time and effort which the members of tree Zoning Board
have spent in bringing the City's zoning up to date.
ASK REDUCTION OF LIQUOR LICENSE FEE: The. Clerk then read
the following letter:

November 30, 1938
City Council,
Des Plaines, Illinois
Gentlemen:
We, the undersigned licensed Retail Liquor Dealers
of the City of Des Plaines, Illinois, beg your reconsideration
of the Liquor Ordinance recently passed by yourselves, which
when in effect will impose a $500.00 annual license upon`us.
Under existing conditions our net profits do not
warrant the payment of this exorbitant fee.
Our competition without the limits of the Gity of
Des Plaines, cuts heavily into our local field of prospective
customers, where for a $200.00 annual local license, they
operate 24 hours per day, Sundays included.
Limited as we are in selling our wares, in addition
to the depressed business experience of the past year, should
be reasons sufficient to allow us to operate during 1939 under
the Ordinance now in effect.
Will you not therefore please legislate, to keep in
effect the present Liouor Ordinance, and thereby aid the fif-
teen highest taxes businesses in the City of Des Plaines, Ill-
inois.

CUMBERLAND TERRACE WATER MAINS: The Clerk then read
the following letter:

Attached please find one blue print of the proposed water
main improvement for Brapigar's Cumberland Terrace addition to
the City of Des Plaines.
The writer recommends that the following changes be made
in these plans:
Change No. 1 The proposed 6* main along Seegers Road be changed.
to an 8" main.
Change No,. 2 - Three Fire -Hydrants be installed, one at Wolf Road
near Washington Street, one at Wolf Road near Col-
umbia Avenue and one on Oxford Road between Colum-
bia Avenue and Washington Street.
Change No. 3 - One additional 6" valve be installed on Harvey
Street just south of Seegers Road.
All recommended changes have been noted in red on
the attached plan.
