Mayor Hobart M. Ahbe, presiding with Aldermen Carroll, John-

THE SEWER, DRAINAGE & SANITATION COMMITTEE: The
only standing committee of the Council having a report to
offer was the Sewer, Drainage, .and Sanitation Committee
wnicn reported tnrough'its chairman, Alderman Dopheide, that
the matter of the proposed sewer in Cumberland has been re-
ferred to the City Engineer for study.
CLAIM - MRS. ANNA SC:WIESOW: The Clerk tnen read
the following report:
To Kenneth G. Meyer, Gity Attorney, at the meeting
of the City Council held November 7, 1938, the following,
matter was referred to you: The letter dated November 7, 1938
from Mrs. Anna. Schweisow at 1311 unite Street, Des Plaines,
Illinois, claiming damages from tie city in the sum of )800.00
for a broken wrist claimed to be caused by the city's neglect
to repair sidewalk.
A copy of the said letter is attached hereto.

To the Mayor and City Council:
Your City Attorney has investigated the above and finds
from the facts that the condition of the sidewalk in ques-
tion was not such as to be extra hazardous and it is the
general rule of law that a City is not liable for such
defects unless it has actual notice thereof, and I unq.er-
stand that tne City did not nave notice of the condition
which existed at the site in question on Octorer 3, 1938.
I, your Attorney, therefore advise you that in my opinion the
City of Des Plaines is not 1Pgally liable. I may advise,
however, tnat in such cases as this where the trial is by
Jury, tne sentiment of the jury is usually against the City
and from a lawyer's point of view, they are difficult cases
to win.

finds treat the tatter in question is not such a matter that
constitutes a problem for the City to solve. In other words,
the situation facing the property owners in tree subdivision
in question is one concerning, the personal interest of the
property owners inasmuch as tne title to their respective lots
is involved. I, your Attorney, therefore advise you that
it is my opinion that the property owners can, by the filing
of the proper document, extend the restrictions now in effect
against their property but the extension of sucn restrictions
would only be effective against tnose lots owned by persons
signing tne document tnat would have to be filed.

City of Des Plaines.
Gentlemen:
The above case, which was a suit by the Plaintiff against
the City for damages caused to Plaintiff's automobile
when driven off the River Road crossing of the Chicago
Northwestern Railroad tracks, came on for trial before
Judge Caverly November 15, and the court agreed with my
theory of the law that the City was not liable in this
case and the Plaintiff on the suggestion of the Court took
a(non suit which is a voluntary dismissal.
The Plaintiff, of course, has the right to file a new suit
at any time within five years from date of the accident.
However, I believe that the Attorney for the Plaintiff
snould be fully convinced after tne remarks by Judge Gaver-
ly that tne City is not liable.
I wish to express my appreciation of the excellent coopera-
tion of Cnief Drexler and City Engineer Fletcner in prepa-
ration of evidence which we planned to use in triis trial.

Nov. 17, 1938
In response to your request for an opinion as to whether doctor
bills and hospitalization can be paid to a disabled policeman
from the Police Pension Fund, I wish to advise that the Statute
only provides for the payment of -- the salary attached to the
rank of the injured officer, and makes no provision for addition-
al payments to cover doctor bills, medicine, aid hospitalization.
If the city has paid officer Stremple his full salary during the
time he was disabled, then the Pension Board should issue checks
to officer Stremple for an amount equal to a of what the city paid
him during the disability and these checks shoull be endorsed
by officer Stremple and delivered to the City for redeposit to
the General Corporate Fund.
With respect to tile procedure to obtain payments from the Pension
Board, the Statute requires a certificate of disability to be
filed by the disabled officer, wnica snould be sworn to and the
same certificate or another one should also be signed and sworn
to by tae Police Surgeon, if there is one, and two practicing
physicians in the city.

WIDENING OF PEARSON STREET: Edgar N. Fletcner, City
Engineer then reported that the State Highway Department has
formally approved the appropriation of $7,500.00 from trie City's
Motor Fuel Tax Allotments for the widening of Pearson Street
with W.P.A. aid.

BLEEELE BUILDING ON OAKTON STREET: Frank F.
Scharringhausen, Building Inspector, then briefly reported
that while there nave been a number of complaints regarding
the erection of a garage building very close to the street
on the soutn side of Oakton Street between White Street
and Cora Street, ne was unable to force the owner to build
the building back farther because there is no set -back
line restriction governing the property in question.
The motion was made by Alderman Garland and secon-
ded by Alderman Lemke to instruct the Clerk to write the
Zoning Board of Appeals asking the said board to submit
its recommendations pertaining to set -back lines in com-
mercial areas, at tne next regular meeting of tne Council.
The motion was voted upon by acclamation whereupon the Mayor
declared tne motion carried.
LIQUOR CONTROL ORDINANCE: Tne Clerk then read
for second reading a proposed ordinance entitled:
AN ORDINANCE REGULATING THE SALE
OF ALCOHOLIC LIQUORS IN THE CITY
OF DES PLAI IES , ILLINOIS.
The motion was made by Alderman Dopheide and se-
conded by Alderman Schwanbeck to insert the words "and guests"
�--� after the words "bona fide members" in Section 7 of tne pro-
posed ordinance. Tne motion was voted upon by acclamation
whereupon the Mayor declared tne motion carried.
Tne motion was then made by Alderman Dopheide and
seconded by Alderman Schwanbeck to strike from the proposed
ordinance tne following:
"Section 5. Limitation of Licenses: There shall
be no limitation on the number of licenses to be
issued under this ordinance."
and insert in place thereof the following:
"Section 5. Limitiation of Licenses: Not more than
fifteen (15) retail liquor dealer licenses shall
be issued and outstanding at any time."
The Mayor put the question and the Clerk called the
roll with the following result: Ayes; Aldermen Pflughaupt,
Henrich, Dopheide, Friott, Schwanbeck and Campagna. Nays;
Aldermen Carroll, Johnson. Garland and Lemke. Tne Malror there-

seconded by Alaernran Carroll to reconsider the matter of
license limitations. The Mayor put the question on tne motion
to reconsider, and the Clerk called tne roll with tne follow-
ing result: Ayes; Alde ren Carroll, Johnson, Pflugnaupt, Hen-
ricn, Garland, Lemke and Campagna. Nays; Aldermen Dopheide,
Friott, and Schwanbeck. Tnere being more than a two-thirds
majority in favor of reconsideration, the Mayor declared the
motion to reconsider carried.
Alderman Dopheide then repeated his original motion
setting the limit of the number of liquor licenses at fif-
teen, wiicn motion was again seconded by Alderman Schwanbeck.
The Mayor put the question and the Clerk called the roll
with the following result: Ayes; Aldermen Pflughaupt, Jen-
ricn, Dopheide, Friott, Schwanbeck and Campagna. Nays;
Aldermen Carroll, Jonnson, Gariard and Lemke. The Mayor
thereupon declared tne motion carried.
Tne motion was then made by Alderman Dopheide and
seconded by Alderman Johnson to strike the words "Five Hun-
dred Dollars (1500.00) in Section 4 of tne proposed Ordin-
ance and insert therefor the words ''Three Hundred Fifty
Dollars (350.00)': The Mayor put the question and the Clerk
called tne roll with the following result: Ayes; Aldermen
Johnson, Dopheine, Lemke, Schwanbeck and Campagna. Nays;
Aldermen Carroll, Pflughaupt, Henrich, Garland, and Friott.
The Clerk reported the vote a tie whereupon the Mayor cast
his vote at "Nay" and declared the motion defeated.
The motion was then made by Alderman Carroll and
seconded by Alderman Friott to strive from Section 13 of the
proposed ordinance the words "One of the said aldermen so
appointed to assist tne Mayor in the performance of his duties
as Liquor Commissioner shall be of different city political

November 3, 1938, regarding a request of tine Historical
Records Survey for the use of space in the Municipal Build-
ing, and verbal statement of Mr. Campagna at a conference
at 1515 Whitcomb Ave. tries city, on Armistice Day, 3 2.M.,
the undersigned respectfully submit tele information that
the Historical Records Survey desires to take an inventory
of the proceedings of the former village and tree present
city council, as well as of the court docket, and such ()tiler
records as may be needed to ascertain tree nature of, and
reasons for, measures taken. Tne compilation is in line
with tne extensive efforts made by the Survey in the state
and elsewhere, to facilitate, both for tne Survey and coun-
ties and cities involved, statistical tabulation, arid in-
cjidentally to employ persons now on the relief rolls.
It is contemplated to employ from six to eight
persons at 6- hours of tne day for five nays of the week,
and for such period as the volume of the material will
determine.
The Survey in its pub.i'ation has no intention
to disclose names, and will refrain from publishing any

submitted by Suhr, Berryman, Peterson and Surer, acting as
your agents, and which plans, consisting of one sheet,
are designated as "Plan of proposed WPA water extension for
City of Des Plaines, Illinois".
Tries authority is granted in accordance with the provisions
of paragraph 3 of Section 55 of "An Act in relation to the
Civil Administration of tne State Government and to repeal
certain acts therein named". (Approved 141erch 7, 1917, in
force July 1, 1917 as amended) and subject to the provisions
hereof.

1. This approval shall not be donsidered in any
manner affecting the title to the premises upon which any
of the waterworks in question is or is to be located.
2. This authority does not in any way release the
city from any liability for damaFe<to person or property
caused by or resulting from the installation, maintenance
or operation of the waterworks system, located and construc-
ted in accordance with the plans and specifications herein
referred to.
3. The State Department of Public Health in is-
suing this approval has relied upon the statements and
representations made by the city in the application< nerefor
and in case any statement or representation is said ap-
plication is found to be incorrect this approval may be re-
voked without further notice and the city thereupon waives
all rights thereunder.
4. There shall be no deviations from the plans
and specifications submitted with the application for this
approval unless revised plans and specifications therefor
snail first nave teen submitted to the State Department
of Public Health and a supplemental written approval is-
sued therefor.
5. The State Department of Public Health or any
person duly autnorized by it may, at any time during the
progress of the construction or the installation of the
waterworks system or any part thereof under authority here-
of, nave the right and authority to inspect such work dur-
ing the progress thereof; and, such Department or its duly
authorized agent shall have the authority at any and all
times` after the erection or tae installation of such water-
works system to inspect' the same or the operation thereof.
6. This approval takes into consideration only
the adequacy and sanitary and mineral qualities of the pub-
lic water supply for drinking and general domestic use and
not the structural stability nor durabilittr of any units or
parts of the waterworks that will not affect tae quality of
the water, nor the costs or construction and financial sound-
ness of the project and it is assumed that the waterworks
when completed will receive reasonable care, maintenance
and operation.
7. The Department of Pub4,9 Health shall be noti-
fied when the waterworks provided/ty the plans has been con-
structed and is going to be placed in service.

Tne motion was made by Alderman Pflughaupt and seconded
by Alderman Garland to adopt this proposed resolution. Tne Mayor
put the question and the Clerk called tne roll with tne following
result: Ayes; Aldermen Carroll, Jonncon, Pflugnaupt, Henricn,
Garland, Dopneide, Friott, Lemke, Scnwanbeck and Campagna. Tne
Mayor thereupon declared the motion carried.

APPROVAL OF 14IINUTES; Eacn member of the Council
having at Nand a copy of tae minutes of the regular meeting
of the Council held Monday, November 7, 1938, the motion
was made by Alderman Johnson and seconded by Alderman Henrich
to approve the said minutes as written. The motion was voted
upon by acclamation whereupon the Mayor declared the motion
carried and the said minutes approved.
FAVOR NINETY -MINUTE PARKING: Mayor Ahbe informed
the Council tnat there is considerable objection to the one
hour parking reetrict-on inthe downtown area, and that a ninety -
minute restriction would seem more pbpular. He therefore
urged the members of the Council to give this matter some
tnougnt before the next meeting or the Council.
ADJOURNiu►FNT. The motion was made by Alderman Gar-
land and seconded by Alderman Lemke that the Council adjourn
to Monday* November 28, 1938 at 8:00 P.i. The motion was
voted upon oy acclamation ,whereupon the Mayor declared the
motion carried and the Council so adjourned.

OF DES PLAINES HELD IN THE COUN-
CIL CHAMBERS ON THE 21 t h DAY OF
NOVEMBER, A.D. 1938 AT THE HOUR
OF 8:00 P.M.
Mayor Ahbe presided.
The Clerk being absent, the Mayorappointed Walter
Pflughaupt clerk pro tem.
Upon call gfjoll Aldermen Henrich, Pflughaupt, Gar-
land, aeide, Lemke,, and Johnson answered "present*,
AldermenAScliwanbeck and Campagna being absent.
Auorum being present, the Mayor called the meeting
to order at 8:15 P.M. and announced that a continuation of the
reading of the Revised BuilAing Code of 1938, was the agenda for
the meeting.
Whereupon the City Attorney proceeded with the reading
aloud of the Ordinance. During the course of the meeting,
Aldermen Pflughaupt,`Garland and Dopheide also read aloud
portions of the Ordinance.
Upon the reading of Section 99 and prior sections,
the meeting, on motion duly made and seconded, was adjourne.d.
