MINUTES OF THE REGULAR COUNCIL MEETING
OF THE CITY COUNCIL OF ' THE CITY OF DES
PLAINS HELD IN TIE COUNCIL CHAM.SERS
ON THE 17th DAY OF OCTOBER, A.D. AT THE
HOUR OF 8:00
CALL TO ORDER: The meeting was called to •order by
Mayor Hobart I. Anbe, presiding, with Aldermen Carroll,
Pflughaupt, Henrich, Garland, Dopheide, Friott, Lemke,
Schwanbeck and Campagna responding to the roll call. Alder-
man Johnson was absent during theentire meeting.
REPORTS OF STANDING COMMITTEES: None of the standing
committees of the Gouncil had reports to offer.
THE CITY- ENGINEER reported that the WPA has now
passed a rule that all projects of one sponsor must be grouped
together into one WPA Project. This, he said, is now being
done for Des Plaines, and .when rewritten, the City's project
will include paving of various streets, tree -trimming, catch -
basin re -building, and re -construction of the ornamental
gates to Des Plaines Villas.
THE BUILDING INSPECTOR, Frank F. Scharringhausen,
then submitted a pin -mach of the City showing the location
and type of the various building operations in Des Plaines •
by means of colored pins. The Gouncil recessed for a snort
time to examine this map.
The motion was made by Alderman Garland and seconded
by Alderman Dopheide to extend a vote of thanks to Mr.
Scharringhausen for his effective work done as building inspec-
tor. The motion was voted upon by acclamation Whereupon the
Mayor declared the' motion carried.
THE CITY ATTORNEY then reported orally regarding the
status of a number of pending suits.

In re: Revised Building Code
In connection with the city's problem concerning the question
of financing the cost of printing the above -captioned code,
I wish to advise that I have studied further into the law on
the question of sufficient publication of the ordinance to make
it legal, the Statutes of Illinois permit the compiling of
ordinances in book or pamphlet form if done so by authority
of the Council and then no newspaper publication is required.
I have always interpreted this to mean the entire set of

ordinances of a city. However, upon checking the
Illinois cases I do find instances where the ordinance
governing particular subjects was put in book or
pamphlet form by authority of the Council nas been
held to be a valid ordinance and in view of these old
cases it is my opinion that if the revised building code
as it was submitted to the council were printed in
pamphlet or book form with a proper provision in the
Code to the effect that it was so printed by authority
of the Council, such Code would be a valid and en-
forceable ordinance without a newspaper publication.
Therefore, if you will return to me the revised
building code wnich I believe is in your hands, I will
include in it appropriate sections to come within the
decisions above -referred to and it then may be that
the bids for printing the Code In pamphlet form will
be within the financial means of the city to cause its
publication.

Alderman Garland, chairman of the Fire Committee and
chairman of the special committee appointed for the purpose of
studying the matter of publishing the said ordinance,stated,
that in view of the above letter his committee will attempt
to have the proposed "Building Code in finished forth for
passage at the next regular meeting of the Council.
R.R. FLAG .N OPERATING TRAFFIC LIGHTS: The Clerk
then read the following report:
To the Chairman E.N. Fletcher, Special Committee, at
the meeting of the City Council, held Oct. 3, 1938, tne following
committee was appointed to confer witn tae proper officials of
the Chicago . N.W.R.R. for the purpose of arranging a more
equitable agreement by which the railroad flagmen would operate
the stop and go traffic signals at Lee Street and Des Plaines
Avenue:

To the Mayor and City Council:
Your Committee met wita Mr. G.C. Schindler, Engineer,
and Mr. u.S. Tomkins, assistant Signal :engineer of the C & NW
R.R. in the City Hall, Des Plaines, Illinois, on October 15,
1938 and it was mutually agreed that the Agreement be re -written
as per attached copy.
Instead of submitting the said 'attac'hed copy" Alder-
man Dopheide orally outlined the terms of a tentative agree-
ment agreed upon by both tne City's committee and tne Nortn-
wes;ern Railroad officials.
Mayor Ahbe recommitted this matter to the committee
with instructions to present a finished draft of tne agreement
in question to the Council at its next regular meeting.
ADDITIONAL R.R. SAFETY GATES: Alderman Dopheide
reported that during the conference held with Northwestern
Railroad representatives on October 15, 1938 these representatives

indicated that if properly approached the Railroad might
be prevailed upon to install safety gates at Pearson Street,
at Lee Street and at Graceiand Avenue. The motion was made
by Alderman Dopneide and seconded by Alderman Garland to
instruct the Clerk to write immediatedly to the Northwestern
Railroad in an attempt to induce the said railroad to install
tree said safety gates. The motion was voted upon by accla-
mation whereupon the Mayor declared the motion carried.
ELIMINATE HAZARD OF PASSIM TRAIN: The Clerk then
read the following letter:

that commuters are alighting from train which leaves Chicago
at 5:11 2.1. and arrives at Des Plaines at 5:41 P..
This matter has been brougnt to the attention of the
Superintendent of our Wisconsin division, for the purpose
of making correction in train schedules, if in any way pos-
sible.

the following proposed resolution:
.RESOLUTION FOR IMPROVEMENT BY MUNICIPALITY
UNDER THE MOTOR FUEL TAX LAW
BE IT RESOLVED, by the Mayor and City Council of
the City of Des Plaines, Illinois, that the following street
be improved under the Motor Fuel Tax Law:

Pearson Street, which is also known as Arterial
Street No. 5 from Thacker St. to Des Plaines Ave.
a distance of approximately 2100 ft. and of which
approximately 1400 lin. ft. is to be improved.
BE IT FURTHER RESOL'ED, 1. Taat the proposed improve-
ment consist of widening 8 feet on each side with concrete pave-
ment and concrete curb and gutter, and shall be designated as
Section 6 -CS.
2. That there is 'hereby approp-
riated the sum of $7,500.00 Dollars for tale improvement of said
section from the municipality's allotment of %rotor Fuel Tax
funds.
3,. That said work shall be done by

Garland to petition the State Highway Department to install ad-
equate Stop and Go Traffic Signals at the intersection of Des Plaines
Avenue and Keeney Avenue. The motion was voted upon by acclamation
whereupon the Mayor declared the motion carried.
BURNING OF LEAVES IN STREET: Alderman Scrnwanbeck requested
that Section 302 of tae City Ordinances prohibiting tne
burning of leaves upon tine streets be enforced.
