THE POLICE AND LICENSE COMMITTEE: Alderman Carroll,
Chairman of the Police and License Committee, stated that
while the said committee has not attempted to reach a formal
decision regarding the application for a license to operate
a shooting gallery, filed by Roy E. Hampton of Evanston, he
believes the committee feels that the request should be de-
nied. The motion was therefore made by Alderman Carroll and
seconded by Alderman Dopheide to deny the Said application.
The motion was voted upon by acclamation whereupon the Mayon
declared the motion carried and the application denied.

CALL TO ORDER: The meeting was called to order by
Mayor Hobart M. Ahbe presiding, with Aldermen Carroll, John-
son, Pflughaupt, Henrich, Garland, Dopheide, Friott, Lemke,
Schwanbeck and Campagna responding to the roll call. The
Clerk reported all members of the council present.
REPORTS OF OFFICERS: The Clerk then read the fol-
lowing reports:
1. The report for the third quarter of 1938, as well
as a report for September, 1938 prepared by Chas.
M. Larson, City Treasurer.
2. The report for September, 1938 of Edgar J. Friedrich,
City Clerk.
THE STREETS AND SIDEWALKS COMMITTEE: The Clerk then
read the following report:
To the Chairman Schwanbeck, Streets and Sidewalks
committee, at the meeting of the City Council, held September
6, 1938, the following matter was referred to your committee:
The matter of eliminating or reducing heavy truck
traffic from several narrow asphalt -surfaced streets on the
north side as reported by Alderman Carroll.
The street particularly mentioned was Harding Ave.

To the Mayor and City Council: Your Committee on
Streets and Sidewalks has investigated the above and has
found that several streets as reported on above are not
adapted for heavy usage, especially for material trucks.
We, your Committee on Streets and Sidewalks, therefore recom-
mend that the limit load be reduced to 8,000 lbs. gross. The
streets to be included under this rating shall be outlined
at a future date in a way of an ordinance by the under signed
committee.

and buildings in the city limits was referred to your com-
mittee for study and recommendation.

has found the matter of street numbering has been completed
somewhile ago, and information can be had at the City

by advising its readers that proper street numbers can be
obtained by applying to the City Clerk's office.

The motion was made by Alderman Dopheide and
seconded by Alderman Friott to indefinitely postpone action
in this matter, because all the present addresses have
been used in the new permanent registration of voters and
to change these addresses now would result in confusion'
in the November, 1938, elections. The motion was voted
upon by acclamation whereupon the Mayor declared the motion
carried and the matter indefinitely postponed.

The matter of removing boulders, carriage blocks,
and other dangerous obstructions from the parkways of the
City was referred to your committee.

September 19, 1938, the following' matter was referred to

The matter of providing some sort of a warning
signal or reflector sign to eliminate the hazard existing
an the south side of Thacker Street at Second Avenue where
the street suddenly narrows down from 83 ft. to 66 ft. was
referred to your committee. Also the north side of Thacker
Street at Fifth Avenue.

committee: The matter of taking care of the necessary
tarring of streets was referred to your committee with full
power to act.

the Supt. of Public Works has been authorized to purchase
25 barrels of tar to take care of our immediate needs.

streets that are in need of tarring at the earliest possible
date.

Clerk then read the following report:
To the Chairman Dopheide, Sewer, Drainage and
Sanitation committee, at the meeting of the City Council,
held September 19, 1938, the following.mataer was referred
to your committee:
The matter of taking out of service the sewer
pumps located at the intersection of Lee Street and Des
Plaines Avenue vas referred to your committee for investi-
gation and recommendation.

Drainage and Sanitation has investigated the above and
has found upon the recommendation of the 11,tialup. of Public
Works plus an investigation by the Chairman of the Sewer,
Drainage and Sanitation Committee that the power be dis-
connected from said pumps and the City Clerk notify the
Public Service Comapny to act accordingly.
The motion was made by Alderman Dheide and
seconded by Alderman Garland to concur in hes report. The
motion was voted upon by acclamation whereupon the Mayor
declared the motion carried and the said report concur-
red in.
THE WATER COMMITTEE had no report to offer.
TIME FIRE COMMITTEE had no report to offer.
TIME BUILDING INSPECTOR, Frank F. Scharringhausen,
reported that he expects to display a pin -map at the next
council meeting showing locations of the various building
operations in Des Plaines for the current year. He also
reported a considerable gain in building permits issued
this year over last year.
DOWNTOWN PARKING ORDINANCE: The Clerk then read
for second reading a proposed ordinance entitled:
AN ORDINANCE REGULATING THE
PARKING OF VEHICLES UPON CER-
TAIN STREETS WITHIN THE CITY
OF DES PLAINES, COOK COUNTY,
ILLINOIS
The motion was made by Alderman Carroll and secon-
ded by Alderman Lemke to finally pass and adopt this proposed
ordinance. The Mayor put the question and the Clerk called
the roll with the following result: Ayes; Aldermen Carroll,
Johnson, Pflughaupt, R.enrich, Garland, Dopheide, Priott,
Lemke, Schwanbeck and Campagna. Nays; None. The Mayor
thereupon declared the motion carried and the said ordinance
passed.
The motion was then made by Alderman Lemke and
seconded by Alderman Pflughaupt to instruct the Clerk to
cause this ordinance to be published in the Des Plaines Su-
burban Times. The motion was voted upon by acclamation
whereupon the Mayor declared the motion carried.
LIQUOR ORDINANCE REVISION: The Clerk then read
the following report:
To Kenneth G. Meyer, City Attorney, at the meeting
of the City Council, held September 19, 1938, the following
matter was referred to you:
You were instructed to prepare an ordinance amen-
ding the present Liquor Ordinance of the City of Des Plaines
so as to make effective the following:
(1) A $500.00 annual fee for Retail Liquor
Dealer's License.
(2) The elimination of the limitation of the
number of liquor licenses allowed in the
City.
(3) The elimination of the transferable feature
of Retail Liquor Licenses. (While liquor
licenses should be non -transferable with
respect to persons, I believe it would be
well to permit transfer of licenses from
one address to another in case the licensee
changes his place of business.)
NOTE: Mention was also made of prohibiting the
sale of liquors in ice cream parlors.
To the Mayor and City Council: Your Attorney has in-
vestigated the above and has found: I am herewith sub-
mitting a redrafted copy of an Ordinance Regulating the
Sale of Alcoholic Liquors in the City of Des Plaines,
Illinois.

AN ORDINANCE REGULATING THE
SALE OF ALCOHOLIC LIQUORS IN
THE CITY OF DES PLAINES, ILL-
INOIS.
Mayor Ahbe instructed the Clerk to prepare a
copy of this proposed ordinance for each member of the
council and ordered this proposed ordinance filed for
second reading at some future date.
CHICAGO & NORTHWESTERN FLAGMEN TO OPERATE
TRAFFIC SIGNALS: The Clerk then read the following pro-
posed ordinance for second reading:
AN ORDINANCE
AREAS, the City of Des Plaines is establishing
highway traffic signals at the intersection of River Road
and Northwest Highway and also at Lee Street and North-
west Highway adjacent to the tracks of the Chicago & North-
Western Railway Company.
WHEREAS, the City of Des Plaines is desirous of
coordinating the highway traffic signals at said inter-
sections with the crossing protection maintained by the
Chicago & North Western Railway Company at said River Road
and Lee Street, and
WHEREAS, said Railway Company will agree to such
coordination, subject however, to certain conditions:
THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE
CITY OF DES PLAINES, ILLINOIS:
Section 1. That the Mayor of the City of Des
Plaines be and he is hereby authorized for an on behal of
the City of Des Plaines to enter into a written agreement
with Charles P. Megan as Trustee of the property of Chi-
cago & North Western Railway Company which shall outline
the plan for coordinating said highway traffic signals and
railway crossing protection and shall provide certain in-
demnification for said Railway Company. Said agreement
shall be in words and figures as set forth in the form
attached hereto, marked *Exhibit A" and hereby made a
part hereof. Said agreement shall be approved by the Mayor
of the City of Des P1A.ines.
Section 2. This ordinance shall be in force
from and after its passage.
Section 3. All ordinances or parts of ordin-
ances in conflict herewith are hereby repealed.

Inasmuch as there seemed to be considerable objec-
tion to the following paragraph in the agreement attached to
the proposed ordinances
"The City assumes and agrees to disharge all li-
ability for loss and damage to property or in-
jury to or death of persons caused by the actions
of the Railway Company's employee in connection
with the operation of said signals. The City also
assumes all responsibility for injury to or death
of its employees while on the premises of the
Railway Company in connection with the mainten-
ance, renewal, removal or operation of said
signals."
the motion was made by Alderman Garland and seconded by Alder-
man Henrich to authorize and direct the Mayor to appoint a
committee consisting of three Aldermen, the City Engineer, the
City Marshal, a director of the Des Plaines Safety Council and
a representative of the State Highway Department to meet with
the proper officers of the Chicago & North Western Railroad
in an attempt to arrive at a more equitable phrasing of the
paragraph in question. The motion was voted upon by accla-
mation whereupon the Mayor declared the motion carried.

of Des Plaines that the Mayor and City Clerk be author-
ized to execute on behal of the City of Des Plaines an
application for a grant from the Works Progress Adminis-
tration to pay towards the cost of laying water mains for
the furnishing of water to the subdivision designated as
BRANNIGAR'S CUMBERLAND TERRACE in the City of Des Plaines.

be filed with the Works Progress Administration at once.

480 OF ARTICLE IV ENTITLED
OWLING ALLEY" OF CHAPTER 15
OF THE MUNICIPAL CODE OF 1928.
BE IT ORDAINED by the City Council of the City
of Des Plaines, Cook County, Illinois.
SECTION 1. That Section 480 entitled "Hours
of Operating" of Article IV entitled "Bowling Alleys"
of Chapter 15 of the Municipal Code of the City of Des
Plaines of 1928 and the same is hereby amended to read
as follows:
"Section 480. Hours of Operating: No
person shall keep open, operate or
play upon any bowling alley, pin or
ball table licensed as aforesaid dur-
ing the hours of 1:00 o'clock A.M. and
6:00 o'clock A.M.".
SECTION 2. A11 ordinances or parts of ordinances
C4 in conflict herewith are hereby repealed.

ENDORSE HORThwiST ELEVATED HIGHWAY: The Clerk then
read the following proposed resolution:
RESOLUTION
WHEBEAS an elevated highway on the northwest
side will save lives of citizens of northwest
suburban towns, and
WHEREAS such a structure will save our residents
a minimum of 18 minutes in a trip from the city
limits to downtown Chicago, and
UMW numberous civic groups have endorsed such
a proposal, and
WHEREAS the first step necessary is the prepara-
tion of engineering studies by the state, county,
and city,
NOW THEREFORE BE IT RESOLVED that the idea of a
northwest elevated highway be endorsed and that
such a request be made of the City of Chicago,
County• of Cook, and the State of Illinois.

ASK ENFORCEMENT OF U-TURN ORDINANCE:The motion
was made by Alderman Dopheide and seconded by Alderman Gar-
land to instruct the Police Department to enforce the U -Turn
Ordinance. The motion was voted upon by acclamation where-
upon the Mayor declared the motion carried.
The motion was made by Alderman Carroll and secon-
ded by Alderman Dopheide to instruct the Streets and Side-
walks Committee to see that they could provide better signing
of the downtown area with respect to parking limitations
and the prohibition of U -Turns. The motion was voted upon
by acclamation whereupon the Mayor declared the motion carried.
SUGGESTS AMENDING U-TURN ORDINANCE: The motion was
made by Alderman Garland and seconded by Alderman Friott to
refer to the Streets and Sidewalks Committee the matter of
amending the present U -Turn Ordinance with instructions to
study the matter with a view toward making the provisions
of the said ordinance effective only in the business area and
upon such streets as may need such restriction. The motion
was voted upon by acclamation whereupon the Mayor declared the
motion carried.
REMOVE ELLINWOOD HOTEL SIGN FROM POSTS: Alderman
Pflughaupt called attention to signs advertising the Ellin -
wood Hotel mounted upon several ornamental light posts in
the downtown area. The motion was made by Alderman Pflug-
haupt and seconded by Alderman Lemke to instruct the Streets
and Sidewalks Committee to order the said signs removed at
once. The motion was voted upon by acclamation whereupon
the Mayor declared the motion carried.
HAZARD TO 5:11 COMMUTERS: Alderman Dopheide pointed
out that commuters alighting from the 5:11 C & NW train (leav-
ing Chicago at 5:11 P.M.) are exposed to a serious hazard
because of the fact that a fast train pulls through Des
Plaines shortly after the 5:11. The motion was made by Alder-
man Dopheide and seconded by Alderman Carroll to instruct
the Clerk to write the proper officials of the Northwestern
railroad asking them to eliminate this hazard. The motion
was voted upon by acclamation whereupon the Manor declared the
motion carried.
TREE ASH COLLECTION SERVICE: The motion was made by
Alderman Carroll and seconded by Alderman Lemke that the City
begin free ash collection service as soon as the matter has
been given sufficient publicity. However, the motion was
made by Alderman Dopheide and seconded by Alderman Henrich
to refer this matter to the Sewer, Drainage and Sanitation
Committee for study and recommendation at the next regular
meeting of the Council. The motion was voted upon by ac-
clamation whereupon the Mayor declared the motion carried
and the matter so referred.

The motion was made by Alderman Pflughaupt and secon-
ded by Alderman Lemke to adopt 'this proposed resolution. The
Mayor put the question and the Clerk called the roll with the
following results Ayes; Aldermen Cnrroll, Johnson, Pflughaupt,
Henrich, Garland, Dopheide, Friott, Lemke, Schwanbeck, Campagna.
Nays; None. The Mayor thereupon declared the motion carried and
the resolution adopted.
APPROVAL OF MINUTES: Each member of the council
having at hand a copy of the minutes of the regular council
meeting held Monday, September 19, 1938, the motion was
made by Alderman Dopheide and seconded by Alderman Schwanbeck
to approve the said minutes as submitted. The motion was voted
upon by acclamation whereupon the Mavor declared the motion
carried and the said minutes approved.

MINUTES OF THE REGULAR COUNCIL MEETING
OF THE CITY COUNCIL OF 'THE CITY OF DES
PLAINES HELD IN THE COUNCIL CHAMBERS
ON THE 17th DAY OF OCTOBER, A.D. AT THE
HOUR OF 8:00 P.M.
CALL TO ORDER: The meeting was called to order by
Mayor Hobart M. Anbe, presiding, with Aldermen Carroll,
Pflugaaupt, Henricn, Garland, Dopneide, Friott, Lemke,
Schwanbeck and Campagna responding to the roll call. Alder-
man Johnson was absent during theentire meeting.
REPORTS OF STANDINx COMMITTEES: None of the standing
committees of the Council had reports to offer.
THE CITY- ENGINEER reported tnat the WPA has now
passed a rule that all projects of one sponsor must be grouped
together into one WPA Project. This, he said, is now being
done for Des Plaines, and when rewritten, the City's project
will include paving of various streets, tree -trimming, catch -
basin re -building, and re -construction of the ornamental
gates to Des Plaines Villas.
THE BUILDING INSPECTOR, Frank F. Scharringhausen,
then submitted a pin -map of the City showing the location
and type of the various building operations in Des Plaines
by means of colored pins. The Council recessed for a short
time to examine this map.
Tae motion was made by Alderman Garland and seconded
by Alderman Dopneide to extend a vote of thanks to Mr.
Scharringhausen for his effective work done as building inspec-
tor. The motion was voted'upon by acclamation whereupon the
Mayor declared the- motion carried.
THE CITY ATTORNEY then reported orally regarding the
status of a number of pending suits.

In re: Revised Building Code
In connection with the city's problem concerning the question
of financing the cost of printing the above -captioned code,
I wish to advise that I have studied further into the law on
the question of sufficient publication of the ordinance to make
it legal, the Statutes of Illinois permit the compiling of
ordinances in book or pampnlet form if done so by authority
of tae Council and then no newspaper publication is required.
I have always interpreted this to mean the entire set of

ordinances of a city. However, upon checking the
Illinois cases I do find instances where the ordinance
governing particular subjects was put in book or
pamphlet form by authority of the Council has been
held to be a valid ordinance and in view of these old
cases it is my opinion that if the revised building code
as it was submitted to the council were printed in
pamphlet or book form with a proper provision in the
Code to the effect that it was so printed by authority
of the Council, suca Code would be a valid and en-
forceable ordinance without a newspaper publication.
Therefore, if you will return to me the revised
building code which I believe is in your hands, I will
include in it appropriate sections to come within the
decisions above -referred to and it then may be that
the bids for printing the Code In pamphlet form will
be within the financial means of the city to cause its
-publication.

Alderman Garland, chairman of the Fire Committee and
chairman of the special committee appointed for the purpose of
studying the matter of publishing the said ordinance,stated,
that in view of the above letter his committee will attempt
to have the proposed "Building Code"- in finished form for
passage at the next regular meeting of the Council.
R.R. FLAGMEN OPERATING TRAFFIC LIGHTS: The Clerk
then read the following report:
To the Chairman E.N. Fletcher, Special Committee, at
tree meeting of the City Council, held Oct. 3, 198, the following
committee was appointed to confer witn tine proper officials of
the Chicago ,fir N.W.R.R. for the purpose of arranging a more
equitable agreement by which the railroad flagmen would operate
the stop and go traffic signals at Lee Street and Des Plaines
Avenue:

To the Mayor and City Council:
Your Committee met wit Mr. G.C. Schindler, Engineer,
and Mr. v.S. Tomkins, assistant Signal ingineer of the 0 & NW
R.R. in the City Hall, Des Plaines, Illinois, on October 15,
1938 and it was mutually agreed that the Agreement be re -written
as per attached copy.
Instead of submitting the said "attached copy" Alder-
man Dopheide orally outlined the terms of a tentative agree-
ment agreed upon by both tine City's committee and the North-
wedern Railroad officials.
Mayor Ahbe recommitted this matter to the committee
with instructions to present a finished draft of the agreement
in question to the Council at its next regular meeting.
