TO MEET AS CCITTEE-OF-THE-WHOLE: Upon the request of

P.M., for the purpose of discussing various pending matters such
as tree trimming, repair of Des Plaines Villas gates, and speci-
fications for the publication of the proposed Revised Building
Code.

CALL TO ORDER: The meeting was called to order by Mayor
Hobart M. Ahbe, presiding, with Aldermen Carroll, Johnson, Pflug-

written includes trimming of trees, removal of dead
trees, cleaning and repair of catchbasins, and also

Plaines Villas. While this project can not be built
at a cost of $100.00, the greater portion of it c n
be done at a cost not to exceed $500.00, but not `in
cluding office rental, and not including one truck to
be furnished by the City of Des Plaines.

Garland reported orally that the committee is endeavoring to
get the publication cost of the proposed new Building Code
down to the appropriated amount of 500.00.

PROPOSED PARKING ORDINANCE: The Clerk then read the
following report:

Dear Sir:
This is in reply to the request of the City Council made
on Monday evening, August 15., 1938, requesting our recom-
mendation relative to a parking ordinance for the City
of Des Plaines, Illinois. As you know the Committee of
15 appointed by you had apparently submitted their vier ;s
on the matter at the above meeting. We wish to inform
you that this Safety Council has had the matter of park-
ing regulations under consideration for the past 15 mon-
ths, the results of which are submitted herewith. It is
the consensus of opinion of this organization that if the
following restriction are adopted, it will be a fair and
equitable regulation for all motorists.
The attached sketch indicates the number of cars that
can be legally parked in the restricted area as 429 which
means that a total of 4290 cars can be accommodated in a
ten hour period. It is, therefore, our recommendation that

a one hour parking limitation be established by ordinance
in the City of Des Plaines and the parking hours be estab-
lished as follows:
1. One hour parking from 8:00 AM to 6:00 Phil on week days.
2. One hour parking from 8:00 AM to 8:00 PM on Saturdays.
3. No parking restriction on Sundays and Holidays.
Miner Street
One hour parking between Pearson Street west to Graceland
Avenue, both curbs.
No parking limitation between Pearson Street east to Des
Plaines Avenue, both curbs.
Ellinwood Street
One hour parking along the south curb of the street from
Graceland Avenue east to the east property line of 1563
Ellinwood Street. (This includes the frontage of the
Middle States Telephone Company) and along the north curb
from Lee Street east to Pearson Street.
No parking limitation along the north curb of Ellinwood
Street from rearson Street east to Des Plaines,Avenue and
from Lee Street west to Graceland Avenue, also the south
curb from the east property line of 1563 Ellinwood Street
east to Des Plaines Avenue.
Center Street
One hour parking along the east and west curbs from Ellin -
wood Street south to Prairie Avenue.
Pearson Street
One hour parking along east and west curbs from Miner Street
north to Des Plaines Avenue.
No parking limitation along east and west curbs from Ellin -
wood south to Prairie Avenue.
Lee Street
One hour parking along the east and west curbs from the
Miner Street alley south to Prairie Avenue (with the ex-
ception of the east curb on Lee Street from Ellinwood
Street south 112 feet).
No parking limitation along east and west curbs rom
Miner Street alley north.
Prairie Avenue
No parking at any time along north and south cures from
Lee Street east to Pearson Street and the south curb from
Lee Street to Graceland Avenue.
One hour parking along north curb from Lee Street west to
first alley.
It is further our recommendation that the City Council
purchase standard signs to be placed in sufficient num-
ber to enable our Police Department to carry out an in-
telligent parking enforcement program.
Further it is recommended that the City Council purchase
standard signs to be placed in the unrestricted parking
areas which will invite the "long time parker" into these
areas.

In connection with the question, whether or not the city has
the right to elect whether to post or publish the new Build-
ing Code, I wish to advise that by Provision of Paragraph 75,
Chapter 24, of the Illinois Statutes, it is necessary that
all Ordinances of the city imposing any fine or penalty or
making an appropriation must, within one month ter they are
passed, be published at least once in a newspaper published
in the city, and if no newspaper is published in the city,
then posted copies of the Ordinance in three public places
is permitted.
In view of this provision, it is my opinion that the building
code would be ineffective if it were posted instead of pub-
lished.

SIXTEEN (16) LIQUOR LICENSES ALLOWED: The Clerk then
read the following report:
To Kenneth G. Meyer, City Attorney, at the meeting of
the City Council, held August 15, 1938, the following matter was
referred to you: You were instructed to prepare a repealing or-
dinance repealing the provisions of the Liquor Ordinance which
Provide that liquor licenses may be transferred upon the payment
of a transfer fee of 4100.00. The intention is to make liquor
licenses non -transferable.
You were also instructed to amend the present Liquor
Ordinance so as to set the maximum allowable number of liquor
licenses outstanding at any one time at sixteen (16) instead
of fifteen (15) .
Perhaps the best thing to do would be to re -write the
entire Liquor Ordinance. I believe the poor thing needs it.

APPEAL FOR BUILDING PERMIT: The Clerk then read the

Gentlemen:
In an effort to obtain a building permit for a
service station to be located at the Northwest corner of
Des Plaines Avenue and Thacker Street, we have contacted 1 r.
Frank F. Scharringhausen, Building Inspector, and he has

advised us that because the construction of a service station
at this site would violate certain parts of the ordinance
regarding their construction, he must refuse to issue the
necessary permit.
This letter is -tieing directed to you in an effort
to clarify the situation regarding the type of building in
mind, and how we feel it will benefit the community in general.
We had in mind a Texaco type station with concrete drives, new
computing pumps, and two enclosures for lubrication and wash-
ing. The building is modern in every respect, of brick con-
struction throughout, to be painted white with green trim.
We feel that the construction of a modern and clean
service station on this corner will improve it, rather than
detract from it. The corner at present is unimproved, and it
is our thought that it will present a much better appearance
improved as described above.
We plan to lease the station to a local man to oper-
ate, if you see fit to grant it's construction. This way the
operator will spend his earnings in Des Plaines, which will
help everyone. We feel that there is room in Des Plaines for
a modern, up to date service station, complete in every respect,
and one which will be an asset to the city.
Knowing that the Honorable City Council meets tonight,
we are addressing this letter in time to be considered at this
meeting. Your consideration of the above mentioned facts will
be greatly appreciated, and you may rest assured that all the
facts above mentioned will be adhered to.

A RESOLUTION
WHEREAS the Des Plaines Safety Council has recently
adopted a resolution which is hereby made a part of this resol-
ution, and of which a copy is attached hereto, and
WHEREAS in the said resolution the Des Plaines
Safety Council recommends:
that the County Board erect a bridge at
Thacker Street and provide a new entrance
to Northwestern Park thereby eliminating
the present hazardous and undesirable en-
trance into Miner Street near the junction
of Miner Street and Busse Highway, and that the
County Board make Thacker Street a state
aid road and extend the same to continue
on eastward around the Des Plaines Camp
Grounds to connect with the present state
highway No.62,
and
WHEREAS the City Council of the City of Des Plaines
has investigated this proposed improvement and has found that
the said improvement will greatly facilitate traffic movement
in and out of Northwestern Park aid the Des Plaines Camp Grounds,
and will promote public safety on Busse highway,
THEREFORE BE IT RESOLVED that the said improvement
be endorsed and vigorously supported by the City Council of the
City of Des Plaines, and
BE IT FURTHER RESOLVED that the Board of Commissioners
of Cook County be and it is hereby urged to proceed as soon as

THEREFORE BE IT RESOLVED, by the Gity Council of the
City of Des Plaines that the Gity Treasurer be and he is hereby
authorized and directed to cancel and void the said tax anti-
cipation warrants and return the same to the City Clerk, and
that the City Clerk and City Treasurer are hereby diredted and
authorized to write off the said tax anticipation warrants both
from the investments of the Road and Bridge Fund and from the tax
warrants payable of the General Corporate Fund, and
BE IT FURTHER RESOLVED, that the Mayor and City Clerk
be and they are hereby authorized to draw a cash transfer warrant
upon the treasurer transferring the cash applicable to the
redemption of the said tax anticipation warrants to the free cash
account of the General Corporate fund.
BE IT FURTHER RESOLVED, that the City Clerk be and he
is hereby directed to forward to the City Treasurer of the City
of Des rlaines a certified copy of this resolution.

of the financial structure of the City of Des Plaines that
the said tax anticipation warrants be cancelled and voided.

WHO IS FAIRBAIRN?
On July 31, 1937, a gentleman by the name of Fairbairn came
into my office, and represented himself as an assistant
building engineer for the City of Des Plaines. He asked
us to install electrical work for thermostatically operated
heat valves.
Assuming thatthis man was acting in this capacity, we instal-
led this work. The amount of labor and materials was 176.75.
To this date we have bee/. unable to get much information on
Mr. Fairbairn's position. inasmuch as the work is installed
and is quite necessary on the type of heating plant you have,
1 would appreciate your disposition in regards to payment.

HEAVY TRAFFIC ON ASPHALT STREETS: Alderman Carroll then
voiced complaints of. a number of property owners stating that heavy
truck 'traffic should be eliminated or at least reduced on a
number of north side asphalt -surfaced streets. Lor Ahbe ref-
erred this matter to the Streets and Sidewalks Committee for
study and report.
