03/07/1938586 MINUTES OF THE REGULAR MEETING OP THE CITY COUNCIL OF THE CITY` OF DES PLAINES HELD IN THE COUN- CIL CHAMBERS, MONDAY; MARCH 7, 1938- AT 8:00 P.M. CALL TO ORDER: The meeting was called to order by Mayor Hobart M. Ahbe with Aldermen Carroll, Johnson, Pflughaupt, Henrich, Garland, Friott, Lemke, Schwanbeck, and Campagna responding to the roll call. Alderman Dopheide was absent during this roll call but arrived shortly there- after. REPORTS OF OFFICERS: The Clerk then read the following reports: The report for February, City Clerk. The report for February, City Treasurer. The report for February, City Marshal. 1938 of Edgar J. Friedrich, 1938 of Chas. M. Larson, 1938 of Ernest Drexler, The motion was made by Alderman Carroll and seconded by Henrich to accept these reports. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried. The motion was then made by Alderman Garland and seconded by Lemke to instruct the City Treasurer to in the future provide a copy of his monthly treasurer's report for the Mayor and each alderman. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried. THE POLICE & LICENSE COMMITTEE through its Chair- man Alderman Carroll reported that the proposed new traffic code is being carefully checked and should be ready for presentation in the near future. He also reported that two members of the police force are attending the traffic school at Northwestern University. THE STREETS& SIDEWALKS COMMITTEE had no report to offer. THE COMMITTEE ON PUBLIC WORKS, BUILDINGS, & PLATS had no report to offer. THE WATER COMMITTEE had no report to offer. THE FIRE COMMITTEE through its chairman Alderman Garland reported that the proposed new fire ordinance is being drafted and that before presenting the same a group- of real estate men and building contractors will be called in to criticize the same. Alderman Garland, chairman of the Fire Committee, also introduced the following resolution; RESOLUTION JO -JO a dog gifted with intelligence and training, the exercise of which has a distinct appeal to those of his many friends and acquaintances. He is a dog, very friendly, with a winning attitude. He has endeared himself in the hearts and minds of those who know him well. He was quick to learn and realize the importance and duty of quick action when the fire alarm is given. This has resulted in 'JO -JO" climbing in the seat of the fire truck alongside of the driver. This is his station and very majestically occupied with some - 58 what of an importdnt atr of responsibility. He cannot be coaxed or urged to leave the fire truck, until the apparatus returns to the station. It would be unthoughtful indeed to allpw these achievements to pass unnoticed, although he has been awarded a free dog license #50 for 1938, by council - manic action, it is the further desire of the council to give worthy recognition of JO-TO's allegiance to our city's fire fighting organization with its attendant dangers and risks. THEREFORE: The City of Des Plaines, through its Mayor and City Council, at its regular session Monday, February 21, 1938, does hereby officially accept JO -JO a brown & white springer spaniel setter as a gift to the city and is hereby created mascot of THE DES PLAINN;S FIRE DEPARTMENT. He is to be entrusted to the care of the Fire Marshal,, Captain, and Lieu- tenant. This action follows the official adoption cer- emonies held Saturday, February 19, 1938 at the Firemen's Annual Danes. BE IT FURTHER recorded that in the event of the demise of JO -J0 he is to be accorded a funeral and burial in keeping with the excellent record he has so fax attained. He is intensely loyal, obedient to superiors, friendly, and entertaining. BE IT RESOLVED by the Council that this reso- lution be spread upon the minutes, and that this effort be put in suitable form framed and placed in the firemen's quarters - a record for posterity that there are those people in life whoaan find time far appreciation even though it be by way of A Real Dog. Wishing T0-10 a long, useful, and happy life. The motion was made by Alderman Garland and seconded by Johnson to adopt this proposed resolution. THE SEWER, DRAINAGE, & SANITATION COMMITTEE through its chairman, Alderman Dopheide, introduced a proposed storm sewer ordinance which was read in its entirety by the Clark and is entitled: WAN ORDINANCE AUTHORIZING THE CONSTRUCTION OF IMPROVEMENTS AND .xlr! SIGNS TO THE SEWER SYSTEM OF THE CITY OF DES PLAINES, COOK COUNTY, ILLINOIS, PROVIDING FOR THE ISSUE OF THREE HUNDRED NINETEEN THOUSAND DOLLARS (3319,000.00) SEWERAGE REVENUE BONDS OF SAID CITY FOR THE PURPOSE OF DEFRAYING PART OF THE COST OF SUCH IMPROVEMENTS AND EXTEN- SIONS, PRESCRIBING ALL DETAILS OF SAID BONDS AND PROVIDING FOR THE COI•T•RCTION, SEGREGATION AND DISTRIBUTION OF THE REVENUES OF THE SEWER:. AGE SYSTEM OF SAID CITY FOR THE PURPOSE OF PAYING THE COST OF OPERATION AND MAINTENANCE THEREOF, PROVIDING AN ADEQUATE DEPRECIATION FUND THEREFOR AND PAYING THE PRINCIPAL OF AND INTEREST ON SAID SEWERAGE REVENUE BONDS." The motion was made by Alderman Dopheide and seconded by Johnson to suspend the rules and place this proposed ordin- ance upon its final passage. The Mayor put the question and 588 the Clerk called the roll with the following result: Ayes; Aldermen Carroll, Johnson, Garland, Dopheide, and Schwanbeck. Nays; Aldermen Pflug- haupt, Henrich, Friott, Lemke, and Campagna. Since the motion lacking the necessary two- thirds majority, the Mayor declared the motion lost and ordered the proposed ordinance filed for second reading. $50.00 WATER DEPOSITS FOR LAUNDRIES: The Clerk then read for second reading a proposed ordinance entitled; "AN ORDINANCE AMENDING SECTION 1290 OF ARTICLE II OF CHAPTER 30 ENTI- TLED *WATER", OF THE MUNICIPAL =1E OF THE CITY OF DES PLAINES OF 1928." The motion was made by Alderman Lemke and seconded by Campagna to finally pass and adopt this proposed ordinance. The Naylor put the question and the Clerk called the roll with the following result: Ayes; Aldermen Carroll, Johnson, Pflughaupt, Henrich, Garland, Friott, Lemke, Schwanbeck and Campagan. Nays; None. Alderman Dopheide was absent during this roll call. The Mayor thereupon declared the motion carried and the said ordinance passed. PROHIBITING SHOOTING & TRAPPING; The Clerk then read for second reading a proposed ordinance entitled; "AN ORDINANCE FORBIDDING THE DISCHARGE OF FIREARMS AND THE KILLING AND TRAPPING OF BIRDS AND ANIMALS IN THE CITY OF DES PLAINES.„ The motion was made by Alderman Garland and seconded by Lemke to finally pass and adopt this proposed ordinance. The Mayor put the question and the Clerk called the roll with the following result: Ayes; Aldermen Carroll, Johnson, Pflug- haupt, Iienrici, Garland, Friott, Lemke, Schwanbeck, and Cam- pagna. Nays; None. (Alderman Dopheide was absent during thin roll call). The Mayor thereupon declared the motion carried and the said ordinance passed. The motion was then made by Alderman Schwanbeck and seconded by Garland to instruct the Clerk to cause this ordinance to be published in the Des Plaines Journal. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried. SALARY ORDINANCE: The Clerk then read in full for first reading a *salary ordinance" entitled: *AN ORDINANCE DEFINING AND PRESCRIBING THE PiRS, SAL- ARIES, AL-ARIES, OR COMPENSATION TO BE PAID TO THE MUNICIPAL OFFICIALS AND EMPLOYEES OF THE CITY OF DES PLAINES." The motion was made by Alderman Carroll and seconded by Henrich to suspend the rules and place this proposed ordi- nance upon its final passage. The Mayor put the question on the motion to suspend the rules and the Clerk called the roll with the following result: Ayes; Aldermen Carroll, Johnson, ?flughaupt, Henrich, Garland, Dopheide, Friott, Schwanbeck, and Campagna. Nays; None. The Mayor thereupon declared the motion carried, the rules suspended, and the ordinance before the Council for final disposition. The motion was then made by Alderman Carroll and seconded by Pf lughaupt to finally pass and adopt this proposed ordinance.- The Mayor put the question and the Clerk called the roll with the following result: Ayes; Aldermen Carroll, Johnson, Pflughaupt, Henrich, Garland, Dopheide, 7riott, Lemke, Schwanbeck, and Campagna. Nays; None. The Mayor thereupon declared the motion carried and the ordinance passed. VEHICLE LICENSE FEES: The Clerk then read for second reading a proposed ordinance extending the discount date of 1938 Vehicle Licenses to March 31, 1938. The motion was wady by Alderman Garland and seconded by Henrich to amend the proposed ordinance to read as follows: AN ORDINANCE AMENDING AN ORDINANCE FIXING THE. FEES TO BE PAID FOR THE PRIVI- LEGE OF OPERATING VEHICLES ON THE STREETS OF THE CITY' 0? DES PLAINES. BE IT ORDAINED by the City Council of the City of Des Plaines, SECTION 1. That on and after the passage of this Ordinance, the registration fees of motor vehicles for the privilege of operating motor vehicles within the City of Des Plaines shall be as follows: 1. For motor vehicles of 35 horse poer and under 33.00 per annum 2. For motor vehicles havin more than 35 horsepower 36.00 per annum SECTION 2. Any person violating the provisions of the ordinance shall be fined not more than 3250.00. SECTION 3. All ordinances or parts of ordinances in conflice herewith are hereby repealed. SECTION 4. This Ordinance shall be in full force and effect from and after its passage, approval, and publi- cation according to law. PASSED this 7th day of March, A.D. 1938 SEAL EDGAR J. PLAT OF "DES PLAINES ACRES": The Clerk then pre- sented for the Council's approval a plat of subdivision bearing the following title= ARTHUR T. McINTOSH & C0'S. DES PLAINES ACRES Being a Subdivisipn of part of the Northwest Quarter of Section 7, Twonship• 41 Worth, Range 12 East of the Third Principal Meridian in Cook County, Illinois. The motion was made by Alderman Pflughaupt and seconded by Carroll to approve this plat. However the motion was made by Alderman Campagna and seconded by Johnson to refer the said plat to the committee on Public Works, Buildings, and Plats for study and report. The motion to refer was voted upon by accla- mation whereupon the Mayor declared the motion carried and the said plat so referred. AMERICAN WATER WORKS ASSOCIATION: The Clerk then read the following letter: Illinois Section AMERICAN WATER WORKS ASSOCIATION March 4, 1938 Hon. Hobart M. Ahbe, Mayor Des Plaines, Illinois Dear Mr. Ahbe: On looking over the membership list of the Illinois Section of the American Water Works As- sociation it is noted that no employee in your water department is a member. No doubt you find benefit and pleasure in the membership of the Illinois Municipal League. In a like manner your water department staff would find pleasure and benefit in being a memher of and attending the meetings of an association that is de- voted to his particular field of activity. The monthly Journal of the Water Works Association contains valuable material and its use can be of much help in solving your local water works prob- lems. During the five-year period 1932-1936 inclusive the following list of papers were presented to water works men through the Journal. This does not include all the articles but embraces those of more general importance to Illinois water works officials. This Journal and the benefits of membership can be enjoyed by your water department through either individual (active) membership at 310.00 per year or through a municipal (corporate) membership at 315.00 per year. In some places the municipality provides from 35.00 to 38.00 toward an active membership and the interested employee the balance. Whatever may be the disposition of your council toward providing a membership interest for your water department, the Illinois Section extends to you a cordial invitation to attend its next meeting an April 5 and 6 at Decatur, Illinois and hope that you and your council will make it possible for at least one member of the water department and the chairman of your water committee to 4 attend our meeting. WALGREENS - COMPLIANCE WITH LIQUOR ORDINANCE: The Clerk then read the following report: To the Chairman Mayor Hobart M. Ahbe- Chairman Liquor Commission and Frank F. Soharringhausen-Building Inspector at the meeting of the City Council, neld February 21, 1938, the following matter was referred to your committee: The matter of seeing that Walgreen's Drug Store complies with the liquor ordinances with regard to keeping open on Sunday morning. E.J.Friedrich, City Clerk To the Mayor and City Council: Your Committee upon inspection has investigated the above and has found; That the plans submitted by Walgreen's for a locker room in which to store liquor during the time it is not permis- sable to have it in the open. Plans have been approved, and locker room was completed as per plans and instructions. We, your Committee on the above, therefore recommend; That the council act on this matter and accept this locker as complying with the ruling of the liquor commission. Signed: FRANK F. BILLBOARD ON ELLINWOOD STREET: The Clerk then read the following letter: March 7, 1938 To the Mayor and City Council: The General Outdoor Advertising Co. have asked me to again submit the request for reconsideration of permit to erect a 50' sign board on Ellinwood Street directly west of the bank building. Stating that it will be electric lighted and would lighten up that part of the street. Also if necessary would have a light put on the rear of the sign prefent it from being a hiding place. Also could omit the lattice work underneath so as not to encourage a hiding place. Attached Hereto application a permit fee. FRANK F. AMERICAN CITI7FN'S ASSOCIATION: The Clerk then read. the following letter: February 23, 1938 DES PLAINES CITY COUNCIL: Tuesday evening, February 22nd, we held the Citizenship Reception at Maine Township High School as requested by a joint committee of several Des P1mines civic and patriotic organizations comments upon the success of the undertaking we leave to those who witnessed the ceremonies. The representative committee organized at Des Plaines Council of the American Citizens Associ- ation to aid in sponsoring such a reception as an annual event in Des Plaines and to encourage the adoption of similar plans in other communities. Tho -e of us who have worked on the program have felt that it was a very much worth while activity. But we must know if it is the will of the sponsoring organizations to continue. Will you please discuss this letter in your organization and give us a very frank answer to the following questions. 1. Is the citizens reception a sufficiently worth -while activity for your organization to cooperate to the extent of an organiza- tion membership of $1.00 per year and some active help from some of you members in the work involved? 2. Do you consider the reception given Tuesday evening a success? 3. If a meeting is called to consider the question of continuing or dropping the American Citizens Association will a member of your organizationbbe present? The motion was voted upon by acclamation whereupon the Mayor declared the motion carried. Mayor Ahbe thereupon appointed Alderman Pflughaupt, Garland, and Johnson to this committee. The motion was then made by Alderman Campagna and seconded by Henricn to authorize and instruct the Mayor and City Clerkto draw a warrant in favor of the American Citizens Association in the sum of one dollar. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried. DOG POUND TO BE IMPROVED: The motion was made by Alderman Campagna and seconeea by Garland to refer the matter of improving the dog pound to the Committee on Public Works, Buildings, and Plats and to authorize the expenditure of not to exceed 330.00 for this purpose. The Mayor put the question and the Clark called the roll with the following result; Ayes; Aldermen Carroll, Johnson, Pflughaupt, Henrich, Garland, Dopheide, Friott, Lemke, Schwanbeck, ane Campagna. Nays; None. The Mayor thereupon declared the motion carried. APPROVAL OF BILLS: The Finance Committee through its chairman alderman Pflughaupt then introduced a resolution authorizing the payment of bilis and salaries. However, the motion was made by Alderman Johnaon and seconded by Carroll to amend the proposed resolution by striking therefrom an item described "H.L. Rietz, Renewal - Group Accident Insurance for Firemen Policy FDM-1497- $218.754. The Mayor put the question on the amendment and the Clerk dalled the roll with the following result: Ayes; Aldermen Carroll, Johnson, Pflughaupt, Henrich, Lemke, Schwanbeck and Campagna. Nays; Aldermen Garland, Dopheide, and Friott. The Mayor thereupon declared the amendment carried and the item stricken. The motion was then made by Alderman Garland and se- conded by Dopheide to further amend the said proposed resolu- tion by striking therefrom an item described "Des Plaines Realty Co. - Insurance for 1 yr. 3981.46". The Mayor put the question on this amendment and the Clerk called the roll with the following result: Ayes; Alderman Pflughaupt, Henricn, Gar- land, Dopheide, and Friott. Nays; Aldermen Carroll, Johnson, Lemke, Schwanbeck, and Campagna. Nays; Aldermen Henrich, Dopheide, and Friott. The Mayor thereupon declared the motion carried and the resolution adopted. APPROVAL OF MINUTES: Each member of the council having at hand a copy of the minutes of the regular council meeting held February 21, 1938, the motion was made by Alder- man Pflughaupt and seconded by Henrich to approve thesaid minutes as written. The motion was voted upon by acclamation whereupon the Mayor declared the :notion carried and the said minutes approved. STREET IMPROVEMENT PROGRAM: Alderman Schwanbeck, chair- man of the Streets & Sidewalks Committee then announced that his committee is about to plan a three-year street improvement pro- gram including the erection of street name signs and asked the aldermen to furnish information as to where street signs are needed in their respective wards. Mayor Ahbe thereupon ordered a meeting of the council as a committee of the whole on Monday evening, March 14, 1938 at 8:oo P.M. for the purpose of discussing the proposed street improvement program. ADJOURNMENT: The motion was made by Alderman Lemke and seconded by Alderman Carroll that the meeting adjourn.
