through its chairman Alderman Campagna reported that of all
the bids received on December 20, 1937 for the coal stoker for
the New Municipal Building, none of the said bids conformed
to specifications. The motion was then made by Alderman Lemke
and seconded by Schwanbeck that the bid of the Meyer Coal &
Material Company offering a "Firetender" stoker at a price of
$629.50 be accepted and that the Mayor and City Clerk be author-
ized and instructed to execute a contract therefor. The Mayor
put the question and the Clerk called the roll with the following
result; Ayes; Aldermen Carroll, Johnson, Lemke and Schwanbeck.
Nays; Aldermen Pflughaupt, Henrich, Garland, Dopheide, Friott,
and Campagna. The Mayor thereupon declared the motion lost.

The motion was then made by Alderman Campagna and
seconded by Lemke to reject all bids received for the stoker
for the nev; Municipal Building. The Mayor put the question
and the Clerk called the roll with the following result:
Ayes; Aldermen Carroll, Johnson, Pflughaupt, Henrich, Garland,
Dopheide, Friott, Lemke, Schwanbeck and Campagna. Nays; None.
The Mayor thereupon declared the motion carried and the said
bids rejected.
The motion was then made by Alderman Lemke and seconded
by Campagna to instruct the Clerk to return the bidder's checks
received with the stoker bids. The motion was voted upon by
acclamation, whereupon the Mayor declared the motion carried.
The motion was then made by Alderman Campagna and sec-
onded by Pflughaupt to instruct the Clerk to re -advertise for
bids for a coal stoker for the new Municipal Building. The Mayor
put the question and the Clerk called the roll with the fol-
lowing result: Ayes; Aldermen Campagna. Nays; Aldermen Carroll,
Johnson, Pflughaupt, Henrich, Garland, Dopheide, Friott, Lemke,
and Schwanbeck. The Mayor thereupon declared the motion lost.
The motion was then made by Alderman Carroll and sec-
onded by Pflughaupt to have the specifications for a coal stoker
for the new Municipal Building redrafted, and re -advertise for
bids for the same in the *Des Plaines Suburban Times", The
motion was voted upon by acclamation whereupon the Mayor .; de-
clared the motion carried.
Alderman Campagna, chairman of the Committee on Public
Works, Buildings, and Plats thenintroduced a proposed ordinance,
which was given first reading by the Clerk, entitled:
"AN ORDINANCE AUTHORIZING THE EXE-
CUTION OF A LEASE FOR LOTS 6, 7
AND 8 IN BLOCK 2 IN MECHANIC'S
ADDITION TO DES PLAINES."
The motion was made by Alderman Campagna to suspend
the rules and put this proposed ordinance upon its final pas-
sage. There was no second however and the Mayor declared the
motion lost for want of a second. The Mayor thereupon ordered
the proposed ordinance filed for second reading.
THE SEWER, DRAINAGE, & SANITATION COMMITTEE: The Clerk

Gentlemen:
Please be advised that on December 27 Judge
Fjellman, Justice of the Peace of Niles Center, entered
judgment against the City in the above case for one hun-
dred thirty three dollars and five cents ($133.05) .
It is my opinion that this judgment is contrary
to the law and contrary to the weight of evidence produced
at the trial, and it is my recommendation that the case
be appealed to the Circuit Court. I have already ordered
a transcript to be filed with the Clerk of the Circuit
Court and in due course will attend to the other necessary
steps required to present the appeal.
Your approval or disapproval of my recommen-
dation will be appreciated.

Gentlemen:
I have been interviewed by two prospective
ap;licants for a 1938 Liquor License with respect to
my construction of the amended Liquor Ordinance as appli-
cable to their particular establishments.
Walgreen's Drug Store and the Des Plaines
Drug Company are preparing to have the interior of
their places of business so altered so that all liquor
will be maintained within a partition susceptible of
being securely locked during the hours of the days that
the sale of liquor is prohibited in Des Plaines, and I
have given these parties my opinion that if all liquor
within their places of business were so kept within a
room or partition susceptible of being locked and the
public refused access thereto then the other portion of
their places of business could remain open during the
hours of the days that the sale of liquor is prohibited
in Des Plaines.
It is my opinion that the foregoing situation
if handled in like manner by other applicants would be
in compliance with the Ordinance.
The Liquor Commission Ishould before granting
licenses under such circumstances require the applicant
to furnish satisfactory drawings of the proposed alter-
ations in the premises before issuing a license.

Gentlemen:
Our Organization recently held a meeting
regarding city license fees, and we were in favor
of merchants paying the present charges, but we
wished to present to you the following thoughts.
1. We request that local merchants be protected
against peddlers.
2. Teeth should b e put in the ordinance to cover
the Lambrecht case and force all firms having
no local headquarters to play the 75.00 peddler's
license, regardless of whether they do business
for one day or twelve months. In other words our

idea of the definition of a peddler is one who
does business in our community having his source
of supply and headquarters elsewhere. The case
of the potato peddler who recently sold direct
from a railway car to the consumer hurt every food
store in town. We understand he paid some sort of
a license fee but that it was much less than $75..00.
In other words the local merchants who are paying
you approximately $10,000 in annual licenses were
not protected, while the peddler was favored.
3. in return for the license fee that local merchants
pay, they should be inspected every three months
by a competent person who is in a position to look
over an ice box and tell at a glance the quality of
the food and its condition. These inspections should
be made every three months, and this was not done
last year.
4. We do not feel that local merchants who are paying
regular license fees should be charged for selling
Christmas trees, but the outsider who sells Christmas
trees' only during the Christmas season should be
charged $25.00 as a transient merchant.
5. We favor the passing of a nuisance ordinance covering
the promiscuous distribution of handbills. Residents
complain that many of these handbills are thrown about
their premises causing them extra work in keeping their
yards clean. We are attaching for your consideration a
copy of ,the La Grange handbill ordinance.
We want you to know that we are in favor bf the present city
license ordinance with the exception of these few suggestions,
and we hope you will incorporate them in the 1938 laws.

DELEGATES TO SUBURBAN SAJi TY COUNCIL: Mayor Ahbe then

as delegates to the Suburban Safety Council. The motion was

improved under the Motor Fuel Tax Law:

a distance of approximately 2,590 ft. and
BE IT FURTHER RESOLVED, that the proposed improvement
consist of removal of trees, grading, draining and surfacing.
The surfacing to consist of a base course of 6 inches of water -
bound macadam and a top course of 2 inches of MC -2 road -mix
macadam, construction twenty feet wide.
2. That there is hereby appropriated the sum of Nine-
teen thousand and ninety-seven Dollars ($19,097.00) for the
improvement of said section from the municipalitys allotment of
the Motor Fuel Tax funds.

reported that the "Water Users Accounts Receivable" of the Water
Department have been reduced about $1500.00 during the fiscal year
ending December 31, 1937.
The motion was made by Alderman Lemke and seconded by
Pflughaupt to instruct the City Attorney to prepare an ordinance
demanding that all Laundries and Dry Cleaning establishments pay a
deposit of $50.00 for water service instead of $5.00. The motion
was voted. upon by acclamation whereupon the Mayor declared the

SAFETY GATES AT DES PLAINES AVE. & C.&.N.W. TRACKS: The
Clerk then read the following report:
To Kenneth G. Meyer, City Attorney, at the meeting of
the City Council held Oct. 4, 1937, the following matter was
referred to you: The resolution from the Des Plaines Safety
Council demanding the closing of the Case regarding R.R. gates
at Des Plaines Ave. and C&NW R.R. tracks, a copy of which is
attached hereto. E.J.F.,City Clerk.
To the Mayor and City Uouncil: Your Attorney has inves-
tigated the above by interviewing the examiner who heard the
ease and was informed that the matter was in the hands of the
commerce commission engineers for report.
I therefore recommend that that matter rest a few more
weeks and I will again call on the commerce commission for a
