MINUTES OF THE REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF DES PLAINES
HELD IN THE COUNCIL CHAMBERS ON THE 20th
DAY OF DECEMBERs1937.
CALL TO ORDER: The meeting was called to order
by Mayor Hobart M.Ahbe presiding with Aldermen Carroll,
Johnson, i'flughaupt, henrich, Garland, Dopheide,Friott,
Lemke, Schwanbeck and Campagna responding to the roll call.
The Clerk reported all members of the Council present.
THE JUDICIARY AND ASSESSMENT COMMITThh: had no
report to offer.
THE SEWER DRAINAGE & SANITATION COMMITLEh: The
motion was made by Alderman Dopheide and seconded by Garland
to instruct the City Attorney to prepare the necessary ordi-
nances for financing and constructing a 41,300,000.00 re-
lief sewer system and to instruct the City Clerk to file
an application with the Federal Works Progress Administration
(M.P.A.) for a 41,000,000.00 grant to aid in the financing
of this said 41,300,000.00 relief sewer system. The Mayor
put the question and the Clerk called the roll with the
following result: Ayes; Alderman Carroll, Johnson, henridh,
Garland, Dopheide, Lemke and Schwanbeck. Nays; Aldermen
Pflughaupt, Friott and Campagna. The Mayor thereupon de-
clared the motion carried.
The Committee on Public works, Buildings and
PLATS: The motion was made by Alderman Campagna and seconded
by Henrich authorize an expenditure of not to exceed $75.00
(Seventy-five dollars) for the purpose of decorating and
improving the basement room under the Library so as to render
it presentable for use as headquarters for the Giri Scouts.
The Mayor put the question and theClerk called the roil with
the following result: Ayes; Aldermen Carroll, Johnson,
Pflughaupt, Henrich, Garland, Dopheide, ;rullirv, Lemke,
Schwanbeck and. Campagna. Nays; ifone. ThellaYor thereupon
declared the motion carried.
The motion was then made by Alderman Campagna
and seconded by Lemke to instruct the Cletk to open the bids
received for furnishing and installing a stoker in the New
Municipal Building. The motion was voted upon by acclamation
whereupon the Mayor declared the motion carried. Mayor
Ahbe then asked if anyone present had a bid to present.There
being no further bids to present, the Mayor declared the
time for receiving bids closed and instructed the Clerk to
open the bids. The Clerk opened the bids and read them as
tabulated:

THE POLICE AND LICENSE COMMITrk: The Clerk read the
following report:
To Chairman Carroll, Police and License committee, at the
meeting of the City Council held Sept 7,1937 the following
matter was referred to your committee:
The matter of inforcing the U-turn Ordinance with respect
to United Motor Coach _busses, and helping the _sus Co. to
solve this problem was referred to your committee together
with the Streets and Sidewalks Committee.
Will you please therefore consult the chairman of the
Streets and Sidewalks Committee regarding this matter.

and has found: That acting upon a recommendation of the committe
of the whole, this matter was disposed of at the last regular
meeting of the Council.

The Clerk then read the following report:
To C1 rman Carroll - Police & License Committee, at the meeting
of the City Council, held Nov.15,1937, the following matter was
referred to your committee: The following letter from the Des
Plaines Business Mens' Assn:
It has been called to our attention recently that an individual
has been selling potatoes direct from a railroad car located
on a siding at the corndr of Graceiand Ave and Northwest
Highway without a license. Our directors have instructed me
to protest this and suggest that our local merchants should
be protected, and that a peddlers' license should be insisted
upon in such cases.

and has found: Altho above condition existed at the time,
the parties involved applied for and received a license for
425.00 to cover their activities.
We therefore recommend: That the matter be dropped at this
time and that actions or recommendations for a license revision
be acted on at a future date.

matter was referred to your committee:
The practice of certain merchants of putting boxes or
crates in the gutter near the curb in front of their stores for the u
purpose of reserving parking space for their own truck was re-
ferred to your committee for study and report.

To Chairman Carroll Police and License Committee, at the meeting
of the City Council held Dec.6,1937 the following matter was
referred to your committee:
The question of eliminating the hazard created by the fact
that about 8 A.M.every morning a united Motor Coach Bus
stops in the middle of the street at Center and Ellinwood
Streets, in front of Walgreen's Drug Store and unloads a
bus load of high school students. The fact that this
corner is very busy at the said hour makes this arrangement
a real hazard.

and has found: The condition referred to actually existed and
the necessary steps were taken, as set forth in the attached
letter from the police department.
We, your committee on Police & License, therefore recommend;
That the City Council accept the report as submitted, be assured

ordinances.

Mayor Ahbe ordered this report placed on file.
Alderman Garland, chairman of the Fire Committee, also
reported that while answering a fire call one of the old fire
trucks cauht fire from a broken gasoline line. He reported
further that while the front part of the truck was badly burned,
the fire department will be able to repair it with comparatively
little expense.
UNFINISHED BUILDINGS ON WILLOW AVE: Mayor Ahbe then
appointed the following as an inspection board for the inspection
of the unfinished buildings on willow Avenue:

The motion was made by Alderman Lemke and seconded by Carroll
to confirm these appointments. The motion was voted upon by
acclamation whereupon the Mayor declared the motion carried.
LIgUOR ORDINANCE AMENDMENTS: The Clerk then read for
second reading the proposed ordinance entitled:

The motion was made by Alderman Garland and seconded by
Lemke to amend Section 3 of the proposed ordinance by adding
thereto the words: "Nor shalithere be any refund in case of
revocation of said license or for any other cause." The
motion was voted upon by acclamation whereupon the Mayor
declared the motion carried.
The motion was then made by Alderman Garland and
seconded by Lemke that Section 2 of the proposed ordinance
be amended by inserting the following clause immediately after
the word "privilege" : "and shall not be transferable and
shall be". The motion was voted upon by acclamation whereupon
the Mayor declared the motion carried.
The motion was made by Alderman henrich and seconded
by Pflughaupt to amend Section 5 of the proposed ordinance by
adding the word "or" after the word "township", by inserting

the word "election" after the words "park district" and by
striking therefrom the words "or school election"..The Mayor
put the question and the Clerk c ailed the roll with.t he follow-
ing result: Ayes; Aldermen Carroll, Johnson, r'flughaupt, tienrich,
Schwanbeck and pagna.Nays; Aldermen uarland, Lopheide, riott
and Lemke. The Mayor thereupon declared the motion carried.
The motion was then made by Alderman Dopheide and se-
conded by Garland to re -consider the immediately preceding action
pertaining to the elimination of the words uor school election'
from Section 5 of the proposed ordinance. The motion was voted
upon by acclamation whereupon the Mayor declared the motion
to reconsider unanimously carried. The motion was then made
by Alderman Dopheide and seconded by Garland to rescind the
action of a previous motion and re-insert the vords "or school
elections" into Section 5 of the proposed ordinance. The Mayor
put the question and the Clerk called the roll with the follow-
ing result: Ayes; Aldermen Pflughaupt, Garland, Dopheide, 2riott
acid Lemke. mays; Aldermen Carroll, Johnson, tienrich, Schianbeck
and Campagna. The Clerk reported the vote to. be a 5-5 tie. ia.yor
Ahbe thereupon cast his vote as "Nay" and declared the motion
lost.
The Clerk then read the proposed ordinance in its
entirety as altered and amended. The motion was made by
Alderman Schwanbeck and seconded by Carroll to finally pass and
adopt the.proposed ordinance as altered and amended. The Mayor
put the question and the Clerk called the roll with the follow-
ing- result: Ayes; Carroll, Johnson, Pflughaupt, Henrich,Garland,
Dopheide, 'riott, Lemke, Schwanbeck and Campagna.. lays; ione.The
Mayor declared the motion carried and the ordinance.
Mayor Ahbe then signed the said ordinance in approval
thereof, which signature was attested by the City Clerk.
The motion was then made by Alderman Schwanbeck and
seconded by Lemke to instruct the Clerk to cause this ordinance
published in the "Des Plaines Suburban Times." The motion was
voted upon by acclamation whereupon the Mayor declared the
motion carried. •
FINAL APPROPRIATION FOR STOP a GO LIGHTS ON MINER ST .
The Clerk then read the following proposed resolution:
RESOLUTION FOR IMPROVEMENT BY MUNICIPALITY
UNDER THE MOTOR FUEL TAX LAW.
BE IT RESOLVED by the Council of the City of DesPlaines,
Illinois, that the following described street be improved
under the Motor Fuel Tax Law:
Northwest Highway which is also known as Rt.Na.1i
at the intersection of Lee Street and at the intersection
of Des Plaines Ave. and
BE IT FURTHER RESOLVED (i)That the proposed improvement
consist of furnishing and installing Stop and Go traffic
control lights at the intersection of Liorthwest highway and
Lee Street and at the intersection of Northwest highway
andlEs Plaines Avenue and shall be designated as Section 3CS.
2)That there is hereby appropriated the additional sum of

said section from the municipality's allotment of Motor
Fuel Tax Funds.(3)that said work shal11 be done by contract;

The Des Plaines Safety Council would like to take
this opportunity to commend -the Chairman of the
Streets and Jidewalk Committee, and the men of
that department for the prompt and efficient
manner in which they served Des Plaines when the
recent ice storm struck aur city.
We know that the citizens of our City appreciate
the men of the department getting up in the middle
of the night and making the streets safe for travel.
It is prompt and efficient action such as this
that saves lives and makes our city a safe place to
live.

The motion was then made by Alderman Ffluglaaupt
and seconded by Garland to adopt this proposed resolution as
altered, The Mayor put the question and the Clerk called the
roll with the following result: Ayes; Aldermen Carroll,.johnson,

the motion carried and the said resolution adopted.
CLOSING OUT CONSTRUCTION ACCOUNT FOR P.W.A.1692D: The
Clark then read the following proposed resolution:
RESOLUTION
PERMANENTLY TRANSFERRING THE RESIDUE
LEFT IN CONSTRUCTION ACCOUNT FOR PWA
PROJECT 1692 D AND CLOSING OUT THE SAID
ACCOUNT.
WHEREAS, when construction vas started on the iiew
Municipal Building known as 'PWA Project 1692-D" the
PWA required that there be placed into a special
bank account known as "Construction Account for PWA
Project 1692 D, a sum sufficient to pay all contracts
in connection with the said project plus a substantial
additional sum to meet emergencies and to pay for such
changes as might be authorized, and
WHEREAS, after paying all contracts and authorized
changes there is on hand in the said bank account a
cash residue in the sum of ;203.38,
THEREFORE BE IT RESOLVED by the City Council of the
City of Des Plaines that the Mayor and City Clerk' be and
they are -hereby authorized and directed to dfacw a Cash
Transfer Warrant upon the Treasurer of the City of Des
Plaines closing out the said account and permanently
transferring the said residue in the sum of 420.38
from the "Construction Account for PWA Project 1692-D"
to the "General Corporate Fund" of the City of Des Plaines.

APPOINTM1 NT OF LIBRARY TRUSTEE: Mayor Ahbe then
announced the appointment of Miss Olga Siede as a member of the
Library Board of Trustees to fill the vacancy created by the
resignation of Mr.Erich H.Schalk effective January 1,1938.The
motion was made by Alderman Johnson and seconded by Carroll to
confirm this appointment. The motion was voted upon by acclamation
whereupon the Mayor declared the motion carried and the said
appointment confirmed.
SOUTH GRACELAND AVE A THROUGH STREET: Alderman Garland
then introduced the following proposed ordinance which as read
by the Clerk for first reading:

SECTION 1. That Graceland. Avenue between the
Northlarly right of ray line of Prairie Avenue and
the southerly right of way line of the Chicago
and dlorthrestern Railway Company's right of way,
be and is hereby designated as a preferential street.
SECTION 2. It shall be unlawful for any person
operating or controlling a motor vehicle, to enter
upon or across said Graceland Avenue within the area
hereinbefore defined, without first bring said motor
vehicle to a complete stop.
SECTION 3. The proper officials are hereby dir—
ected to place appropriate "stop signsu at such streets
intersecting said Graceland.Avenue within the area herein-
before defined.
SECTION 4. Any person, firm, or corporation violating
the provisions of this ordinance shall be fined not less
than Two Dollars ($2.00) nor more than One Hundred. Dollars
($100.00).
Section 5. This ordinance shall be in full force and
effect from and after its passage, approval and publication,
according to lar.
SECTION 6. All ordinances or parts of ordinances in
conflict herewith are hereby repealed.

The motion was made by Alderman Garland and seconded by
Dopheide to suspend the rules and put this proposed ordinance
upon its final passage. The Mayor put the question and the
Clerk called the roll with the following resultAyes; Aldermen
Carroll, Johnson, Pflughauot, Henrich, Garland, Dopheide, Friott,
Lemke, Schwanbeck and Campagna. Nays; None. The Mayor thereupon
declared the motion carried, the rules suspended and the proposed
ordinance before the Council for final disposition. The motion
was then made by Alderman Garland and seconded by Henrich to
finally pass and adopt this proposed ordinance. The Mayor put
the question and the Clerkcalledthe roll with the following result
Ayes; Aldermen Carroll, Johnson, Pflughaupt, Henrich, Garland,
Dopheide, Friott, Lemke, Schwanbeck and Campagna. Nays; 1A.one.The
Mayor thereupon declared the motion carried and the ordinance
passed.
Mayor Ahbe then signed the said ordinance in approval
thereof, which approval was attested by Edgar T.Friedrich,City
Clerk.
The motion was then made by Alderman Friott and seconded
by Dopheide to instruct the Clerk to cause this ordinance to be_
published in the Des Plaines Journal. The motion was voted upon
by acclamation whereupon the Mayor declared the motion carried.
STOP & GO LIGHTS: The motion was made by Alderman
Henrich and seconded by Pflughaupt that the matter of setting the
stop and go lights along Miner Street so as to have the amber
lights burning steadily during the late hours of the night
when traffic is not heavy. Mayor Ahbe referred this matter to
the Safety Council for investigation and report.
INTO WHICH WARD DOES CUMBERLAND BELONG: Alderman
Johnson reported that it has been called to his attention that
Cumberland is, by ordinance, in the Fourth Ward and not in the
First Ward as has been generally assumed in the past.Mayor
Ahbe referred this matter to the City Attorney for investigation
and recommendation.
SPREADING ASHES ON ICY WALES: Alderman Henrich asked tha

residents be encouraged to spread sand or ahses upon
icy walks to prevent accidents to pedestrians.
THOMA1d vs THE CITY OF DES PLAINES: Kenneth
G.Meyer, City Attorney reported that the -Case of Thoman
vs. the City of ices Plaines will come up for decision
on December 27,1937.
APPROVAL OF MINUTES: Each member of the
Council having at hand,a copy of the minutes of the reg a-
lar Council mmeting held December 6,1937, the motion was
made by Alderman Pflughaupt and seconded by Lemke to approve
the said minutes as written. The motion was voted upon by
acclamation whereupon the Mayor declared the motion carried
and the said minutes approved.
ADJOURN ENT : The motion was made by Alderman
Dopheide and seconded by Lemke to adjourn. The motion was
voted upon by acclamation whereupon the Mayor declared the
motion carried and the Council regularly adjourned.

the bids received on December 20, 1937 for the coal stoker for
the New Municipal Building, none of the said bids conformed
to specifications. The motion was then made by Alderman Lemke
and seconded by Schwanbeck that the bid of the Meyer Coal &
Material Company offering a "Firetender" stoker at a price of
$629.50 be accepted and that the Mayor and City Clerk be author-
ized and instructed to execute a contract therefor. The Mayor
put the question and the Clerk called the roll with the following
result; Ayes; Aldermen Carroll, Johnson, Lemke and Schwanbeck.
Nays; Aldermen Pflughaupt, Henrich, Garland, Dopheide, Friott,
and Campagna. The Mayor thereupon declared the motion lost.
