APPROVAL OF MINUTES: Each member of the Council
having at hand a copy of the minutes of the regular Council
meeting held Odtober 18, 1937, the motion was made by Alder-
man Pflughaupt and seconded by Carroll to approve the said
minutes as written. The motion was voted upon by acclamation
whereupon the Mayor declared the motion carried and the
said minutes approved.
APPOINTMENT - POLICE MATRON: Mayor Ahbe then
reported the resignation of Mrs. Emelie Stemmermann as
Police Matron and announced the appointment of Mrs. Ethel
Hammerl to the office of Police Matron to fill the vacancy
created by tge resignation of Mrs. Stemmermann whose term
was to expire April 30, 1939. The motion was made by
Alderman Pflughaupt and seconded by aenrich to confirm
this appointment. The motion was voted upon by acclamation
whereupon the Mayor declared the motion carried, and the
appointment confirmed.
THANKS TO RETIRING POLICE MATRON: The motion was
made by Alderman Dopheide and seconded by Carroll to instruct
the Clerk to write Mrs. Stemmermann who has moved to i'ew
York, expressing the Councils, appreciation and thanks for
her devoted service to the City. The motion was voted upon
by acclamation whereupon the mayor declared the motion carried.
ADJOURNMENT: The motion was made by Alderman Dopheide
and seconded by Lemke that the Council adjourn. The motion
was voted upon by acclamation whereupon the Mayor declared
the motion carried and the Council regularly adjourned.

On Monday, November lst, I met with the
City Council, meeting as a committee of the whole
to discuss terms of settlement of the above case,
wherein the city was disputing the charge of p1467.00
made by the plaintiff for auditing special assess-
ments 475 and 77, and the committee recommended
authorizing me as City Attorney to consent to the
entering of a judgment of $1,000.00, if 1 dould
induce the plaintiff to make such settlement.
After conferring wi4 the attorneys for
the plaintiff they finally agreed to settle this
matter by taking a judgment for $1,000.00 thereby
reducing their claim $467.00.
In order that the records for the City
may be completed, I am enclosing form of resolution
to be passed by the City Council in connection with
this matter.

RESOLUT ION
WHEREAS, this City Council sitting as a
committee of the whole, heretofore considered the matter
of settling the claim of Jonathon Cook Company for
auditing services, which claim was pending as a law
suit in the Circuit Court of Cook County, case # 46C
9007, and
WHEREAS, this council sitting as a committee
of the whole, was agreed that if the City Attorney could
induce the plaintiff, Jonathon Cook Company, to accept a
judgment of $1,000.00 in satisfaction of their claim of
$1,467.00, that the City Attorney be authorized to appear
in Court and consent to the entering of a judgment for
31,000.00 against the City of Des Plaines, and
WHEREAS, the City Attorney has reported
to this council that he was able to effect an
agreement with Jonathon Cook Company, whereby
they agreed to take a judgment for $1,000.00 in
full satisfaction of their claim, and
WHEREAS, the City Attorney has reported
to this council that judgment was rendered against
the City of Des Plaines on November 5, 1937 for $1,000.00
in favor of Jonathon Cook Company in case #36C 9007,
Circuit Court of Cook County.
THEREFORE, BE IT RESOLVED by the City
Council of the City of Des Plaines, that the action
of the City Attorney in agreeing to the entering of
said judgment on said date, be and is hereby approved,
ratified and confirmed.

by Lemke to adopt this proposed resolution as read. The Mayor
put the question and the Clerk called the roll with the fol-

Gentlemen:
I am herewith presenting to your honorable
body the following resolutions to be submitted in a
regular meeting of the City Council and referred to
the proper authorities for immediate consideration,
their report to be made at the next regular meeting
of the City Council if possible but not later than the
following meeting.

Referring to discussions at the Convention
of the "'Retail Liquor Dealers Assn.'s held at the Hotel
Sherman wherein the following statement was made, *The
tavern must go*, it was further stated by tir. E. Meyer,
Secy. of this group that there should be at least a
certain limitation as to the amount of taferns in each
community and suggested one tavern for every 700 pop-
ulation.
Whereas the amount of taverns in Des Plaines
are far in excess of the suggested population and have
proven a handicap in increasing the number of residents
in our community.
1. Be it resolved that we raise the issue in
Des Plaines to one tavern for each 1,000 popu-
lation and increase the license fee to *500.00
per year, this fee to be paid in full 10 days
prior to Jan. 1st of each year, the full amount
only to be accepted by our City Clerk.
2. Resolved that no Liquor License be issued
to cigar, confectionery stores, nor restaurants
of any character.
3. Resolved that all taverns be assessed the
regular license fee as established by our City
Ordinance for any commodity sold other than
liquor, such license also to be paid in full
prior to Jan. lst of each year.
4. Resolved that where licenses are not paid
in full by Jan. 2nd of each year the owner of
such tavern should have his license revoked and
place of business padlocked by Jan. 3rd.
5. Resolved that any type of amusement such as
dancing etc. conducted in rear rooms of taverns
requires an entertainment license fee as per our
City Ordinance, violation of this law to be
sufficient reason for revocation of license, this
also applies to operating slot machines or other
gambling devices on the premises which is also
a State Law violation.
6. Resolved that adhereance to the closing law
be strictly enforced and that all lights be ex-
tinguished and doors locked.
7. Resolved that when a tavern owner discon-
tinues business his or her license should be can-
celled immediately and no licenseiesued to new
owner until the character of the new applicant':
is thoroughly investigated, this report to be
made to our City Council at one of their regular
sessions for their opinion favorable or otherwise,
this should be done in order to establish bona
fide ownership and responsibility.
8. Resolved that the entire liquor ordinance be
rechecked and revised so as to meet the require-
ments of the resolutions as submitted to your
honorable body, after this has been done 1 sin-
cerely hope and pray for its immediate passage.

Gentlemen:
We conclude from Engineer H. A. Spafford's
inspection made Oct. 7, 1937 of the Des Plaines public
water supply and new treatment plant that the supply
is of safe sanitary quality and should continue to
deliver water safe for drinking as long as the.supply
remains protected against contamination and is contin-
uously and adequately chlorinated.
We also conclude that the redently completed
waterworks improvement, including water treatment plant
has been completed substantially in accordance with
plans and specifications as approved by this office.
Attached copies of results of analyses of
samples of water collected since the inspection show
that the water was safe for drinking at the time the
samples were collected. Partial mineral analyses also
indicate that the hardness of the water and the iron
content has been satisfactorily reduced.
We wish to commend the municipality upon the
completion of this waterworks improvement which provides
a water supply that is not only of safe sanitary quality,
for domestic and industrial use.
Enclosed is a copy of the Attorney General's
opinion relative to the responsibility of villages, cities
and water companies for the sanitary quality of the water
supply.
If the engineers of this department cante of
any service in connection with your water supply or sewer-
age problems, we shall appreciate being advised.

the license of the C.N.W. R.R. Co. granting the City permission to
relocate a cement walk on the east side of Graceland Ave. across
the C.&N.W. Right of Way between Ellinwood St. and Miner St.
To the Mayor and City Council:
I, as City Attorney, respectfully report: That the
Chicago and Northwestern Railway Company has agreed to my sug-
gestion to have paragraph 4 in the license read as follows:
*The licensee assumes and agrees to pay for all
cost or damages to property, and injuries to or
death of persons, including costs and expenses
incident thereto arising out of any defect in
the repair or maintenance of said sidewalk.'
I, as City Attorney, therefore recommend: That para-
graph 4 of said license be changed as above suggested and that
the Mayor and City Clerk be authorized by the City Council to
execute the license as modified.

Gentlemen:
At your request, 1 have examined the proposed
ordinance which authorizes the Mayor and City Clerk to
execute an agreement with the Chicago & N.W. R.R. Co.,
relative to the highway traffic signals at River Rd. at
N.W. Highway and Lee St. at N.W. Highway.
Under the agreement referred to in said ordin-
ance, the City, by permitting the R.R. Company's cross-
ing flag -men to manually control the stop and go lights
when trains are approaching these crossings, makes the.
flag men the City's agents and if an accident were to
occur and if it could be proven that the flag man's op-
eration of the lights was the proximate cause of the
accident, the City might be held liable.
In all other respects, the ordinance and agree-
ment are, in my opinion, in proper form.

Gentlemen:
During the past week I have received
numerous calls from residents in this district
relative to the removal of "Stop Signs" at the
intersection of Woodlawn Ave. and Second Aves.
As I recall it these stop signs have
been at this location for some four or five years
and were placed there by order of the City Council
because of a petition by'residents in this im-
mediate area, due to existing hazards caused by
speeding traffic.
What the residents wish to know is how
an individual or group of individuals have the
authority to issue an order to remove these "Stop
Signs" without first presenting the matter before
the City Council for definite action, this body
originally issued the order for the installation
of these signs at this particular intersection.
Because it is impossible to determine
definetely who assumed this authority and because
of the hazard this situation has created at this
intersection the residents suggest of your honor-
able body that these "Stop Signs" be replaced on
the original pedestals still on location.

The motion was made by Alderman Lemke and seconded by
Garland to refer this letter to the Streets and Sidewalks commi-
ttee for study and report. The motion was voted upon by accla-
mation whereupon the Mayor declared the motion carried.
PURCHASE vs THE CITY OF DES PLAIIES: Kenneth G. Meyer,
City Attorney, then reported that the lease of "Purchase vs The
City of Des Plaines" which has been pending for about ten years
is finally coming up for hearing. He reported further that in
order to properly defend the suit it will be necessary to have a

survey made by a non -interested party, and suggested that the
Chicago Guarantee Survey Company be engaged to make the survey
and testify if necessary at a cost of 4100.00. The motion was
made by Alderman Henrich and seconded by Friott to concur in
the suggestion of the City Attorney. The Iayor put the question
and the Clerk called the .roll with the following result: Ayes;
Alderman Carroll, Johnson, Pflughaupt, Henrich, uarland, Dopheide,
Friott, Lemke, Schwanbeck and Campagna. Nays; None. The Mayor
thereupon declared the motion carried.
BIDS FOR POLICE SQUAD CAR: The motion was made by
Alderman Carroll and seconded by plipheide to authorize the Clerk
to advertise for bids for the purchase of a new Police Scluad Car,
with alternate bids for the rental of a squad car on the mileage
basis, according to specifications to be furnished by the Police
and License Committee. The motion was voted upon by acclamation
whereupon the Mayor declared the motion carried.
The motion was then made by Alderman Dopheide and
seconded by Garland that the said advertisement for bids be
published in the "Des Plaines Suburban Times". The motion was
voted upon by acclamation whereupon the Mayor declared the motion
carried.
MORE SMOKE COMPLAINTS: Alderman Henrich reported three
more smoke complaints. The motion was made by Alderman Lemke and
seconded by Friott to refer these complaints to the Building Ins-
pector for investigation and report. The motion was voted upon
by acclamation whereupon the Mayor declared the motion carried.
HUNTING & TRAPPING IN CITY LIMITS: The motion was made
by Alderman Garland and seconded by Henrich to instruct the City
Attorney to propose an ordinance prohibiting hunting and trapping
within the limits of the City. The motion was voted upon by
acclamation whereupon the Mayor declared the motion carried.
APPROVAL OF MINUTES; Each member of the Council having
at hand a copy of the minutes of the Regualr Council Meeing
held November 1, 1937, the motion was made by Alderman Schwanbeck
and seconded by Carroll to approve the said minutes as written.
The motion was voted upon by acclamation whereupon the Mayor de-
clared the motion carried and the said minutes approved.
WELCOME TO JUNIOR HIGH SCHOOL VISITORSt Inas much as
there was a large group of visitors present from the Junior High
School, the motion was made by Alderman Garland and seconded by
Friott to extend a hearty rising vote of welcome to this group.

Mayor declared the motion carried.

and seconded by Garland to adjourn.
