CALL TO ORDER: The meeting was called to order by
Mayor Hobart M. Ahbe presiding, with Aldermen Carroll, Johnson,
Pflughaupt, Henrich, Garland, Dopheide, Friott, Lemke, Schwan-
beck, and Campagna responding to the roll call. The Clerk re-
ported all members of the Council present.

THE JUDICIARY AND ASSESSMENT COMMITTEE: The Clerk then

To Mayor & Lity Council:
Your committee on Judiciary and
Assessments recommends that the City Council at this time pass
on the attached policy for Fire Insurance on the new Municipal
Building, because of new legislation creating a fixed rate on
all municipal buildings on and after July 1, 1937. We are
submitting herewith a policy dated June 21, 1937, the acceptanee
of which, will save the city exactly 4679.68.

THE POLICE AND LICENSE COMMITTEE through its chairman
Alderman Carroll, reported that Mt. Leonard Manuel, kresident of the
United Motor Coach Co. has expressed his desire to meet with the
Council sitting as a committee -of -the -whole for the purpose of
discussing the Council's recent order demanding that buses refrain
from making U -Turns on public streets and highways.
Mayor Ahbe thereupon announced that the Council will
meet as a committee -of -the -whole on Monday, november 8, 1937, at
8:00 P.M. to deliberate upon this and other matters.
THE STREETS AND SIDEWALKS COMMITTEE had no report to
offer.

dinance, the city, by permitting the Railroad. Company's
crossing flag men to manually control the stop and go
lights when trains are approaching these crossings,
makes the flag men the City's agents and if an ac-
cident were to occur and if it could be proven that
the flag man's operation of the lights was the prox-
imate cause of the accident, the City might be held
liable.
In all other respects, the ordinance and
agreement are, in my opinion, in proper form.

To Frank Scharringhausen, Building Enspector, at the
meeting of the City Council held Oct. 4, 1937, the following
matter was referred to you:
The complaint regarding a badly smoking dhimeny on the
home of Emil Moehling, 1408 Perry Street, filed by Chas. Mahn,
1410 terry St.
Your Committee on the above complaint has investigated
the above and has found; On questioning the owner of this build-
ing, I find that he purchased this building as is, over ten years
ago from Polt bros. builders, who submitted their plans to former
City Clerk and received a permit there for. The Building on the
adjoing lot was there when this building was put up. The owner
says he can see no reason why he should change this chimney, '

as if it is wvong now, it was wrong when the building and chimney
was put up and City accepted plans, issuing permit.
We, your Committdeon the above complaint, therefore
recommend: That the complaintant and defendant settle this
matter between themselves, as 1 cannot see anything in the
ordinance that i could make them change this chimney.

The application filed by the Standard Oil Co. for
a permit to install 8 - aew 11,200 gals. each, underground gasoline
storage tanks (total torage 89,600 gals.)
Your Committee on Investigation of application of Standard Oil
Co. for storage tanks has found: This application does not comply
with the Ordinance as it is in a commercial district and the zoning
ordinance reads: "Section # 15, Refining Yetraleum or storage of
crude petroleum, or any derivative thereof, in quantities exceeding
10,000 gals in containers of not to exceed 5,000 gals. capacity each.
Their application calls for 8 tanks of 11,200 gals. each.
Totaling 89,600 gals.
We, your committee on the above application therefore
recommend: That the permit not be granted as it does not comply
with the ordinance.
(They how have exceeded the ordinance by 41,000 gal.
as at present they have a total cap. of 51,000 gals.)

The application filed by the Lake Cook Farm Supply Co. for
a permit to erect a bulk gasoline plant along the Belt Line Rail-
road North of Thacker St.
The application covers two 15,000 gal. tanks, one 10,000
gal. tank, and two 1,000 gal. tanks.
Please check this application with the Zoning Ordinance and
make your recommendations to the Council.
Your Committee on investigation of application for bulk
Oil Plant for Lake Cook Farm Supply Co. has found: That this
application complies with specificationsand is in the industrial
District, per recent re -zoning (Sect 435 of Zoning Ordinance reads:

Will you kindly inform the City Council at the next
regular meeting that the Zoning Board of Appeals met
on October 19, 1937 and denied the petition filed by
John Walter requesting that Lot 8 of .'dock 29 in Des
Plaines Manor Tract no. 2. be rezoned from residential
to commercial property.
Business was resumed relative to set -backs in the
commercial district and arrangements were made with
Mr. Napieralski and the City Engineer to obtain trac-
ings from the Fire Insurance Company's maps. These
are quite detailed and will be useful in establishing
building lines on the various business streets. As
soon as possible, we will resume action on this matter.

Gentlemen:
We are pleased to submit for your consideration
the following proposal for the purpose of financing the
construction of improvements and extensions to your muni-
cipal sewer system:
We hereby offer to loan to the City of Des Plaines
the total sum necessary for the city-wide construction of
a municipal storm sewer, the first section of said construc-
tion being approximately $90,000, that amount necessary to
pay that portion of the cost of said construction which the
City of Des Plaines is obligated to assume according to for-
mal application made to the Federal Emergency Administration
of Public Works.
This loan is to be evidenced by Sewer Revenue
Bonds to be issued by the City of Des Plaines, which bonds
will be payable solely from the revenues derived from the
sewer system; maturities and specifications of the bonds to
be mutually agreed upon.
Said Sewer Revenue ponds are to be in the denomln-
ation of $1,000 with an interest cost of four and one-half
per cent (40) both principal and semi-annual interest to
be payable at some mutually satisfactory bank located in the
City of Chicago.
We agree to furnis# the necessary printed bonds
and the approving opinion of our Attorneys, Messrs. Chapman
and Cutler of Chicago. We will also have our Attorneys, Chap-
man and Cutler, prepare in conjunction with your City At-
torney all ordinances and resolutions that may be necessary
for the authorization and issuance of said Sewer Revenue
Bonds, it being understood that this or is subject to aur
securing from them their unqualified approving opinion cover-
ing the security and legality of said issue. It is there-
fore understood that you agree to promptly furnish us with
all information deemed necessary by our Attorneys. In addi-
tion, this contract is further subject oto the approval of our
engineers as to the sufficiency of income of the contemplated
sewer system.
It is further understood and agreed that your
acceptance of this proposal by resolution shall constitute
a contract between the City of Des Plaines and ourselves
covering the fidnancing of the construction of improvements
and extensions to the sewerage system which is to be evidenced
by the issuance of Sewer Revenue Bonds.
Inasmuch as we have a vital interest in the pay-
ment in full of this loan at the several maturity dates, we
hereby agree to extend to said City the use of our complete
facilities and experience whenever any financial problem does
arise during the term of this loan.
In keeping with good banking practice, this
agreement is to run for a period of ninety (90) days from date.

If at the end of that time, this agreement is not constunated,
we reserve the right to withdraw from this agreement or to
extend this agreement for like period or periods. if this
transaction is completed at any time after ninety (90) days
from date, the price to be paid for the bonds is to be adjusted
from the stated rate, up or down, in direct proportion to the
market fluctuation of United States E Treasury Bonds, due
1955, optional 1949, with a market price ninety (90) days from
date as a base price.
This agreement is subject to the City of Des Plaines
receiving a grant from the Federal Government, and is further
subject to the approval of the proposed sewer system improvement
by the Sanitary District of Chicago, and subject to referendum,
if any. However, if the City elects to proceed with this
project without Feder aid, we hereby agree to finance the cost
of the city-wide construction.

Road), within the City of Des Plaines, accept in such manner that
such vehicle shall be so parked that it will be parallel to, and
its right wheels within twelve inches from the right hand curb.
SECTION 2; Any person, firm or corporation, violating
the provisions of this ordinance shall be fined not to exceed
Two Hundred (UUQO.00) Dollars.
SECTION a: All ordinances or parts of ordinances in
conflict herewith are hereby repealed.
SECTION 4: This ordinance shah be in full force aid
effect from and after its passage, approval and publication ac-
cording to law.

our Safety School will hold, in conjunction with your
Safety Court, a showing of the sound motion picture
entitled, *Challenge to Chance*, a film revealing the
inadequacy of highways and streets for modern traffic
and demonstrating how the chance of automobile accidents
can permanently beremoved.
Other sound films on Fire Department and
hone accidents will be shown.
Our honored guests at this meeting will be
City Officials and representatives from the 29 municipal-
ities of the Suburban City Council.

Pursuant to the suggestions of your mayor and members
of your body comprising the Sewer Committee, we submit
the following:
We propose to make structural examinations of
all of the buildings or other structures, sit-
uated along the route of the Sanitary District
Sewer, about to be constructed in your city.
All of the said structural examinations to be
made by competent engineers ander our personal
supervision; the said examinations to show the
existing structural condition of the said
buildings or othet structures; all of which
reports shall be individually certified to by
this proponent and bound in single volume in
the sequence of their respective street ad-
dresses, for the sum of Seven Dollars 4$7.00)
per report regardless of the size or type of
building or other structure inspected.
le further propose to establish the necessary
level circuits whowing the established eleva-
tions of all buildings or other structures,
streets, curbs, electric -light posts, street-
car or railroad tracks, etc.; all of said
data to be incorporated in a plat to be pre-
pared by us showing the relationship of said
points of elevation to one another, all for
the sum of One Hundred Twenty-five Dollars
4125).
Subject to accurate check, it is our understanding
that forty (40) buildings or other stnnctures
are located along said tunnel route which under
Paragraph One of this Proposal would approximate a
total expenditure of Two Hundred Eight Dollars
($280) or a combined total expenditure of Four
Hundred Five Dollars ($405) .

le are submitting for consideration at the next meeting of the
City Council a proposal for certain work in connection with the
Sanitary District Sewer Project about to be constructed in
your City.
in order that you have some knowledge as to the nature of this
proposal we are taking this means of acquainting you with the
primary purppse thereof.
Several municipalities through which the Sanitary Sewers have
been constructed have experienced some very unhappy situations
with the property owners residing along the routes of these
sewers, and despite the provisions contained in the Easement
Agreement indemnifying the City against such damage, these
citizens look to the City Administration for protection. Lack
of prior information has on numberous occasions proven extremely
embarrassing to the City Officials and has proven a considerable
source of annoyance to the particular aldermen involved.
Enclosed herewith for your examination is a sample
copy of *Certified Reports* in the form they are pre-
pared by us. Our neutral position enables us to
certify as to the structural condition of these
buildings both before and after sewer construction.
This fact is of prime importance in litigation because
we are not parites in interest.
These reports wc*id be placed in the hands of your City
Attorney for the purpose of protecting the City's in-
terest against future claims, litigation, etc., and
undoubtedly, Mr. Meyer will verify the value of these
reports to his office.
The writer will be on hand at your Council Meeting
and shall be happy to answer any additional inquiries
you might care to make.

RAWEST TO EXTEND INTERCEPTOR SEWER: The Clerk then
read the following letter written by Mayor Hobart M. Ahbe to the
Sanitary District of Chicago*

Dear Sir
In looking over the plans for construction of
that section of the Sanitary Sewer here in Des Plaines
for which you recently let a contract, it is noted that
the sewer is to end at the center of the intersection of
Rand Road and River Road.
We were under the impression that this sewer
was to be extended to the Horth Line of Hills Avenue
estended. We believe that this sewer should not only
be extended to Hills Avenue but that it should be extended
as far north as the North Line of Golf Road.
The two important reasons why we wish this
sewer to be extended beyond the present proposed limit
are
1. To provide for the sewage of that section
of developed property lying East of River
Road and between Rand Road and the Chicago
and Northwestern Railroad. This property
is not now a part of the City of Des Plaines
but may be annexed in the future.
2. To provide for the sewage of that section
in the North West part of Des Plaines called
the Cumberland Addition. to Des Plaines. At
the present time this sewage empties into
Weller Creek and thence into the Des Plaines
River. The logical place for an outlet far
this section appears to be Bast on GolfRoad
to the River. Since you have arranged to
intercept all sewage along the Des Plaines
River within the Sanitary District, it seems
only reasonable that provision Should also

be made to care for the sewage from
Cumberland, which lies within the cor-
porate limits of the City of Des Plaines.
The reason for writing you at this time is
that Maine Township is now contemplating the construction
of an 18* sewer from Central Road south to connect with
your Sanitary Sewer now under contract. This 18' sewer
is to service the St. Mary's Training School which is
located some distance north of Central oad.
The City of Des Plaines cannot expect the Maine
Township to build a sewer large enough to handle the
sewage of both the Training School and the Cumberland
Subdivision 4 however, we see no reason why an agreement
can not be reached between the Sanitary District and. Maine
Township whereby a larger sewer could be laid from the
end of that section you now have under contract to Golf
Road.
We estimate that a 30" sewer will be required.
Will you please give this some consideration,
and advise us of your opinion.

Council at this time.
REQUESTING AN APOLOGY: Mx. Gene Puhl, Engineer of the
W.P.A. on the Rani Park Project of the Des Plaines Park District
addressed the Council seeking a public apology for allege mis-
treatment.
The motion was made by Alderman Dopheide and seconded
by Renrich to refer this matter to the Council sitting as a
committee -of -the -whole on Monday, November 8, 137. The motion
was voted upon by acclamation whereupon the Mayor declared the
motion carried, and the matter so referred.
JONATHAN COOK & CO. vs THE CITY: Menneth G. Meyer,
City Attorney, then reported that the case of Jonathan Cook & Co.
vs the City of Des Plaines is sdheduled to come up for hearing on
November 5, isa7.
SMOKE FROM C&NW STATION: The motion was made by Alder-
man Carroll and seconded by Renrich to instruct the Clerk to write
to the Chicago and northwestern Railroad calling attention to the
intensive black smoke pall emitted from the chimney of the C&NW
Railroad Passenger Station, and asking that this nuisance be
remedied at once. The motion was voted upon by acclamation
whereupon the Mayor dedlared the motion carried.
OBSTRUCTIONS IN STREETS: Alderman Schwanbeck reported
that several merchants persist in putting boxes and crates into
the gutters in front of their stores in order to keep others
from parking and thus reserve the parking space for their business
trucks. Mayor Ahbe referred this matter to the Police and License
Committee for investigation and report.
LOW AWNINGS: At the request of Alderman Pflughaupt,
Mayor Ahbe referred to the Building Inspector the matter of seeing
that low awnings in front of business places be raised to the
proper height above the sidewalk.
DES PLAINES FORWARD MOVEMENT: The motion was made by
Alderman Pflughaupt and seconded by Carroll to record that fact
that the plan of the "Des Plaines Forward Movement' was formally
introduced to the Council at a meeting of the Council sitting as
as a committee -of -the -whole on Monday, October 25, 1937. The
motion was voted upon by acclamation whereupon the Mayor declared
the motion carried.

APPROVAL OF MINUTES: Each member af the Council
having at hand a copy of the minutes of the regular Council
meeting held October 18, 1937, the motion was made by Alder-
man Pflughaupt and seconded by Carroll to approve the said
minutes as written. The motion was voted upon by acclamation
whereupon the Mayor declared the motion carried and the
said minutes approved.
APPOINTMENT .7. POLICE MATRON: Mayor Ahbe then
reported the resignation of Irs. Emelie Stemmermann as
Police Matron and announced the appointment of Mrs. Ethel
Hammerl to the office of Police Matron to fill the vacancy
created by tge resignation of Mrs. Stemmermann whose term
was to expire April 30, 1939. The motion was made by
Alderman Pflughaupt and seconded by si'enrich to confirm
this appointment. The motion was voted upon by acclamation
whereupon the Mayor declared the motion carried, and the
appointment confirmed.
THANKS TO RETIRING POLICE MATRON: The motion was
made by Alderman Dopheide and seconded by Carroll to instruct
the Clerk to write Mrs. Stemmermann who has moved to liew
York, expressing the Councils' appreciation and thanks for
her devoted service to the City. The motion was voted upon,
by acclamation whereupon the mayor declared the motion carried.
ADJOURNNENT: The motion was made by Alderman Dopheide
and seconded by Lemke that the Council adjourn. The motion
was voted upon by acclamation whereupon the Mayor declared
the motion carried and the Council regularly adjourned.
