Water Fund in the sum of $5,000.00 in favor of the construction
Account for P W A Project #1692 D (tew Municipal Building)
in order to repay the loan of $5,000.00 referred to in the above
letter and provide sufficient funds in the Construction Account
for P W A Project #7270. The Mayor put the question and the

CHAMBERS ON THE 4th DAY CF OCTOBER,
A.D.1937.
CALL TO ORDER: The meeting was called to order by
Mayor Hobart M.Ahbe presiding, with Aldermen Carroll, Johnson,
Pflughaupt, Garland, Dopheide, Friott, Lemke, Schwanbeck and
Campagna responding to the roll call. Aderman Henrich was absent
during this roll call but arrived shortly thereafter.
REPORTS OF OFFICERS: The Clerk then read the report
for September 1937 of R.A.Becker, Captain of Police. as well as
the report for September 1937 of Edgar J.Friedrich, City Clerk.
MAYOR AHBE ordered these reports placed on file.
THE JUDICIARY AND ASSESSMENT COMTUTT ,: had no report
to offer.
THE POLICE AND LICENSE COMMITTEE had no report to offer.
THE STREETS AND SIDEWALKS COvVIT'1EE: had no report to
offer.
THE COMMITTEE ON PUBLIC WORKS, BUILDINGS & PLAT ,through
its chairman, Alderman Campagna then introduced Mr.Carter Jenkins,
who presented a proposed landscaping plan for the park about the
new Municipal Building, and carefully explained the plan to the
Council.
The motion was made by Alderman Campagna and seconded
by Carroll that the Council thankfully accept this plan, and that
the Clerk be instructed to send Mr.Jenkins and his associates a
letter of thanks for this fine civic contribution. The motion was
voted upon by acclamation whereupon the Mayor declared the motion
carried.

The motion was then made by Alderman Campagna and
seconded by Lemke to give this landscaping plan to the City
Engineer and to refer the matter of grading the park about
the City Hall to the committee on Public Works, Buildings and
Plats with power to act. The motion vas voted upon by accla-
mation whereupon the Mayor declared the motion carried.
THE SEWER, DRAINAGE AND SANITATION COMMITTEh through
its chairman, Alderman opheide requested the members of the
Council to meet as a committee of the Whole on Monday October 11,
1937 in order to informally discuss the proposed storm sewer
project.

NANCE TO CLASSIFY, REGULATE AND RESTRICT THE LOCATIONS
OF TRADES AND INV'DUSTRIES AND THE LOCATION OF BUILDINGS
DESIGNED FOR SPECIFIED USES: TO REGULATE AND LIMIT THE
INTENSITY OF THE USE OF LOT AREAS AND TO REGULATE AND
DETERT'IINE THE AREA OF YARDS, COURTS AND OTHER OPEN
SPACES WITHIN AND SURROUNDING SUCH BUILDINGS AND TO
ESTABLISH THE BOUNDARIES OF DISTRICTS FOR THE SAID PUR-
POSES AND PRESCRTRING PENALTIES FOR THE VIOLATION OF

The motion was then made by Alderman Dopheide and
seconded by Johnson to order the Clerk to publish this ordinance
in the Des Plaines Suburban Times. The Mayor put the question and
the Clerk called the roll with the following result: Ayes; Alder-

BUILDING LINES IN DOMTOWN AREA: The motion was made
by Alderman Garland and seconded by Henrich to instruct the
Clerk to write the Zoning Board of Appeals culling the said
board's attention to the matter of establishing "building lines"
in the downtown area, recently committed to the toning Board
by the City Council, and requesting that the Zoning Board sub-
mit its recommendation on this matter in the near future. The
motion was voted upon by acclamation whereupon the Mayor declared
the motion carried.

Gentlemen:
In accordance with your request, I have investi-
gated the law with respect to the liability of the City,
if any, for the alleged damages sustained by Mr.Ernest
Nolte by reason of his car having been driven off the
right of way of Des Plaines Avenue (River Rd) at the -
Chicago and Northwestern Railway Company's right of way,
and find that pursuant to provisions of Chapter 144
entitled "Railroads", of the Illinois Statutes Paragraph
62, that corporations in Illinois are required to con-
struct and maintain said crossings and approaches
thereto within their respective rights of way so
that at all times they should be safe/to persons and
property. as
The Supreme Court decisions construing this
section of the statute clearly placed the responsibility
on the railroads to create suitable barricades to
warn the people of the repairs being made.
It is therefore my opinion that the city of
Des Plaines is not liable to Ernest Nolte.

In Re: Claim for damages arising
from grading of Prairie Avenue

Gentlemen;
-In accordance with your reQuest, I have investi-
gated the law and the- facts -relative to the claim of
certain property owners for alleited damages to real estate
lying between EllinvQood Street and Prairie Avenue because
of the grading of Prairie Avenue and find that Prairie
Avenue was opened through condemnation proceedings in the
County Court- of Cook County being Case #52590 and in the
city's petition for -condemnation, was included a -prayer
to -have the- j u.ry determine the amount due the property
owners for Land -taken, the damage if any to the property
not taken and the benefit to the property owners by reason
of improvement.
The jury in its verdict fixed the award to be paid
the various property owners for land taken and fixed the
amount of the assessment to be 'assessed to -the property owners
as benefits by reason of opening the street but awarded no
damages for land not taken.
It is my opinion that the judgment entered by the
court on the verdict in this ease is conclusive of the fact
that the property was not and would not be damaged by reason
of the extending of Prairie Avenue -and that the question of
possible -damages to the land in question from flood waters
could have been raised in the condemnation case especially
in view of the fact that the particular land in question
was very much lover than surrounding lands.
-It is my opinion thatthe city is not liable to
these property owners because of any Water that Might not
drain from the land and that theremedy is to construct at
their expense necessary drains to connect with city sewers.

Gentlemen:
At 10:20 A.I. September 8,1937 while crossing the
Northwestern R.R.tracks at River Road,Des Plaines, i met
with an accident to myself and my 1937 Pontiac.
This accident like a number of others was due prim-
arily to tie negligence of the City of Des Plaines in not
protecting traffic against the changes being made on
Ri/er Road crossing of the Northwestern R.R. These changes
were sanctioned by the City of Des Plaines and while same
were made by employees of the railroad it was neverthe-
less the duty of your city to protect traffic crossing
at this point either by the use of a watchman or signs
Or barricaded. which would have informed motorists of the
changes made from the former roadway.
On the advice of counsel I hold the City of
Des Plaines liable for personal injuries sustained which
consisted of damages to my chest walls, my left lower jaw,
shoulders and a shaking Up generally which incapacited me
from, pursuing my usual activities for a period of 10 days.
I consider these personal injuries and after effects as-
representinE damages of 200.00. I also hold the Village
or City of Des Plaines liable for damages sustained to
my Pontiac car and which per receisted bill herewith
cost me 133.05.
I consider this total of :333.05 as entirely
reasonable under the circumstaces and Present this as
my claim for recovery of damages suffered, and believe it
incumbent on the authorities -to make good this loss.
Kindly acknowledge receipt and advise me what I
my expect in the matter of roust settlement.

Gentlemen:
The building next door to my place is'a
bungalow structure owned -by .mil Moehling of 1408
Perry St. and my building 1410 Perry St is a two-
story building and the smoke and coal gas from their
stack comes directly into my windows, because of the
fact that the chimney is so log in between this house
and the corner house of P.Madden another two-story
building.
In my estimation the only remedy for this
would be to have the -chimney raised so as not to have
the smoke and coal gas conte into my WindOts especially
my -bed -room ones as they are directly across from the
stack.
It makes no difference that time of day or
night the furnace is fired it repeats that trouble.
thorough inspection (day or night) of this
condition -absolutely will prove without a doubt that
the situation is a nuisance and some such remedy, as I
have su ested would eliminate and further trouble with
the smoke and gas coming into my building.

Gentlemen:
WHEREAS the present stop and go signals at Miner and
Lee Streets,- very definitely bring out the hazardous
condition that had always existed for the motorist and
WHEREAS the City Council is tow considering to remedy
the hazard now existing and which is very definitely
brought out by the above installation at the intersection
of Lee and Ellinwood Streets and
WHEREAS with the proposed installation of signals for the
Lee and Ellinwood intersection nova assured both by the
City Council and the State Highway Department and
WHEREAS the Signalizing of both these intersections has
been recommended by this safety council in January, 1936
Lith every consideration for better railroad crossing pro-
tection,and
WHEREAS as the present sy:.ter of signals and the placing of
a flagman who at times endeavors to direct traffic before
he reaches the control switch for the signals or instead of
flagging a stop for motorists and pedestrians on the approach
of a train, and

WHEREAS this condition introduces the hazard of direct-
ing traffic both vehicular and pedestrian against the
red light and
WHEREAS The State Law prohibits diagnal parking on
Lee Street and
Whereas the proposed signalizing of Lee and Ellinwood
Streets will cause north bound traffic on Lee Street
to jam up and create an unsafe condition fOr local
motorists who will want to turn right on Ellinwood.
NOW THEREFORE BE IT RESOLVED that this safety Council
recommends to theCity Council of the City of Des
Plaines with due consideration for the safety of the
motorist and the Pedestrian alike, that the protection
be provided at the railroad crossing between these two
intersedtions, i.e. Lee Street and Ellinwood, and Lee
Street and Miner Street by the Chicago and Northwestern
Railroad Company and that immediate stel)s be taken to
Protect this crossing with standard railroad gates,
to which the stop and.go signal circuit should be
connected so that when the gates are lowered for trains
passing through, the red signal will appear for north
and southbound motor traffic to stop and automatically
indicating green for east and west bound motor traffic
and
BE IT FURTHER RESOLVED that it be recommended that a
right turn channel be stenciled along the east curb
on Lee Street on the approach of the oroposed stop and
go signal t o be located on the southeast corner of Lee
and Ellinmood Streets further that a right turn green
arrow for right turns be installed to permit local
traffic to turn right on the red after a complete stop
into Ellinwood Street.
BE IT STILL FURTHER RESOLVED that the Des Plaines Safety
Council goes -on record favoring the enforcement of the
State Law prohibiting diagonal parking on Lee Street.

WHEREAS This Safety Council had promoted the
hearing and furnished all the facts in the case,"City
of Des Plaines versus the Chicago and Northwettern Rail-
road Company" for better protection at the River Road
C &NVERcrossing and
WHEREAS The case was heard before the commiss-
ibner of the Illinois Commerce Commission in its entirety
and
WEREAS- as the factt from the findings of this
Safety -Council were accepted without denial by the Rail-
road Company and
WHEREAS no definite action. or decision had
been rendered in the case for the elimination of this
so-called "Death crossing". -
Be it therefore -resolved that the Des Plaines
Safety Council petition the City Council of the City of
Des Plaines,Illinois, for immediate requests to be made
by the City's Attorney to complete the case With instru-
ction to insist on the inttallation of railroad gates
to Complete the crossing from a safety point of voiew;
also that the railroad gates should be connected with the
stop and go signals so that when the gates are lowered for
trains passing, then the red signal will appear for north
and southbound motor traffic to stop and automatically
indicating green for east and west bound motor traffic.

Gentlemen:
WHEREAS the com.letion of stop and go sig-
nals at the intersection of Hiner and River Road has
very definitely proved to be an improvement from a
safety standpoint and
WHEREAS this intersection along with that
located at Hiner and Lee, and Lee and Ellinwood Streets
has been designed as the most hazardous conditions
in the State of Illinois and probably in the country
and
WHEREAS also considered two of the most
difficult existing projects to properly signalize
from a safety engineering point of view and
WHEREAS the installation of a railroad
gate at tis railroad crossing is being delayed and
WHEREAS Ellinwood Street dead ends at
River thereby making it a part of this- pro ject"and
WHEREAS Left turns are -being made by
motorists into River Road north against the red
light and
WHEREAS as action has been taken to elimi-
nate the left turn off Miner Street going south on
River Road.
THEREFORE BE IT RESOLVED that motor traffic
making left turns north into River Road be regulated,
by channelizing a left'turn at the River Road dead
end of Ellinwood Street" by painting on the Street.
The channel vihich should be established
about 300 feet west of River Road for "LETT TURKS ONLY"
and turning the face of the stop and go signal on the
west side of River Road more southwest, with a sign
affixed "For LEFT TURN WATCH THIS LIGHT. GO CAUTIOUSLY
ON GREEN ONLY". Also a stop bar to be painted on the
pavement before entering River Road.

Clerk then read the following proposed resolution:
RESOLUTION FOR IMPROVEMENT BY MUNICI-
PALITY UNDER THE MOTOR FUEL TAX LAW.
BE IT RESOLVED by the Council of the City of Des
Plaines,Illinois that the following described street (s)
be improved under the Motor Fuel "Tax Law:
Northwest Highway which is also known as Rt No.19
At the intersection of Lee Street and at the intersection
of Des Plaines Ave,
BP; IT FURTHER RESOLVED,1-That the proposed improvemeit
consist of furnishing and installing Stop and Go traffic
control lights at the intersection of Northwest Highway
and Lee Street and at the intersection of Northwest High-
way and Des Plaines Avenue and shall be designated as Sec.
3-CS.(2) That there is hereby appropriated the attitional
sum of Sixteen Hundred Dollars ($1,600.00) for the improve-
ment of said section from the municipality's allotment of
Motor Fuel Tax funds.

resolution to the Department of Public Works and. Buildings,
Division of Highvays, through its District Engineer's

The motion vas made by Alderman Pflughaupt and seconded by
Carroll to adopt this proposed resolution. The motion was
voted upon by acclmation whereupon the Mayor declared the
motion carried and the resolution adopted.
PERMISSION TO U('2 COUI:CIL GI:AMBERS: Alderman
eampacna, iairman of the Committee on Public Works,Buildings
and. Plats reported that a number of requests have been made
to use the Council Chamber for public dances and card parties.
The motion was made by Alderman Campagna and seconded by
Dopheide that the Council go on record as prohibiting the
use of the Council ChaMber for public dances, card parties
or any other form of amusement or entertainment. The motion
was voted upon by acclamation, whereupon the Layor declared
the motion carried.
Drainage -TXF, AND THACKER UNDERPASS: Alderman
Henrich called the Council's attention to theconstant drain-
age of water into the Lee -Thacker Pedestrian Underpass,
and aksed that action be taken to correct this apparent
fault in construction. Mayor Ahbe referred this matter to
E.N.Pletcher, City Engineer for investigation and report.
APPROVAL OF MINUTES: Each member of the Council
had at hand a copy of the minutes of the regular Council
meeting held September 20,1937. The motion vas made by
Alderman Garland and seconded by Lemke to approve the said
minutes as written. The motion was voted upon by acclamation
whereupon the Mbyor declared the motion carried and the
said minutes approved.
ADJOURNMENT: The motion was made by Alderman
Dopheide and seconded by Lemke to adjourn. The motion was
voted upon by acclamation whereupon the Mayor declared the
motion carried and the Council rgularly adjourned.
