CALL TO ORDER: The meeting was called to
order by Mayor Hobart J.Ahbe, presiding, with Aldermen
Johnson, Pflughaupt, Henrich, Garland, Dopheide,Lemke,
Priott, Schwanbeck and Campagna responding to the roll
call. Alderman Carroll was absent during this roll
call but arrived shortly thereafter.
REPORTS OF CITY OFFICERS: The Clerk then
read the report for July 1937 of H.A.Becker, Captain
of Police.Mayor Ahbe ordered the report placed on file.
THE JUDICIARY AND ASSESSMENT COMMITTEE had
no report to offer.
THE POLICE AND LICENSE COMMITTEE had no
report ,to offer.
THE STREETS AND SIDEWALKS CONIaTTEE : Th e
Clerk thenread the following report:
To Chairman Schwanbeck, Streets & Sidewalks
Committee, at the meeting of the City Council,
held August 2,1937 the following matter was referred
to your committee:
The dangerous condition prevailing as a
result of tolerating parking on the North
side of Prairie Avenue just west of
the corner of Lee & Prairie Ave.

Your committee on Streets & Sidewalks has
investigated the above and has found: The "no
parking" sign destroyed. Also marking of streets
not completed.
We therefore recommend:That a metal "no
parking" sign be placed on corner.of Prairie &
Lee Sts. also marking of street be completed.

by Garland to concur in this report. The ffiotion was voted
upon by acclamation, whereupon the Mayor declared the motion
carried and the report concurred in.
THE COMMITTEE ON PUBLIC WORKS, BUILDING& & PLATS
through its chairman'Alderman Campagna reported that .Cllr.
Carter Jenkins has been contacted in connection with his
recent offer to provide, at his own expense, a compre-
hensive landscaping plan for the lawn about the .New
Municipal Building, and that Lr.J=enkins is now developing
the plan.
THE SEWER,DRAINAGE, & SANITATION COMM1T►F t: The
Clerk then.read the following report:
To Alderman Dopheide,chairman of Sewer,Drainage & Sanitation
Co.ittee, at the Meeting of the City Council, held Aug.2
1937, the following matter 'as referred to your committee.
The matter of correcting the drainage on property
facing Prairie Avenue between Pearson Street and
Des Plaines Avenue, which was impaired by the
filling in of Prairie Avenue at this location.

Your Committee on Sewer,Drainage & Sanitation has investi-
gated the above and has found: That the drainage of the
property effected by filling in Prairie Ave. is a matter
which falls to the respective property owners in this
locality. The fill has brought the grade of this street
up to that of the other streets in the vicinity and all
lots touching it are by virtue of natural low -land, in
need of filling in by the respective property owners to
meet the street.
We therefore recommend: that the respective property owners
arrange to meet the grade by filling in the low sections
of their lots.

In view of some apparent legal difficulty pointed out by
the City Attorney, this report was re -committee to the
Sewer, Drainage and Sanitation Committee by the Mayor.
THE WATER COMM ITr,; had no report to offer.
THE FIRE COMMITTEE: had no report to offer.
NO -WARNING LIGHTS: Alderman Henrich reported
that apparently nothing has been done about placing red
lanterns or torches to warn passers-by of the building
materials stored at Lee and Lllinwood Streets and at
Pearson and Prairie Ave. Mayor Ahbe referred this matter
to the n uilding Inspector for action.
ENGAGING ADDITIONAL FIREMAN: The Clerk then
read the following letter:

Gentlemen:
During my absence from the Council meeting of Aug 9,1937
the question was discussed before your body relative to
the proper procedure for the appointment of an additional
paid fireman.
In order that you may be fully advised as to the proper pro-
cedure in connection with the appointment of a fireman I wish
to advise that it is my opinion that after an ordinande has
been passed definitely creating the rank -of office of the
paid fireman, that the City Council advise the Board of
Fire and Police Commissioners that another fireman is to be
appointed, and thereupon the fire and Police commissioners
either hold an examination to fill the vacancy or new office
created or fill said office with the highest man on the eligi-
bility list.

Our present ordinance with respect to the fire depart-
ment was passed at the time all of the men on the force
were volunteers and applies only to the volunteer
firemen. It is my recommendation that the fire com-
mittee meet with the fire marshal and such other, members
of the volunteer fire force as may be deemed proper
for the purpose of determing the proper ranks of the
paid firemen --to be established by ordinance.
Since the creation of the 1$oard of Fire and Police
Commissioners there never has been established in Des
Plaines a Board of Trustees of the Firemen's Pension
Fund, which under the statute shall consist of the
Treasurer, Clerk and Marshall of the Fire Department,
the Mayor and three other persons who shall be chosen
from the active firemen of the City and one other per-
son who shall be chosen from the firemen who have been
retired under the Firemen's Pension Act. The members
of the board to be chosen from the active firemen shall
be elected by ballot at a biennial election at which
all active firemen shall vote.
The pension Fund is not applicable to volunteer fire
departments and it is therefore my opinion that a vol-
unteer fireman has novote in the matter of choosing
the members of the Board of Trustees of the Pension
Fund.
I wish to draw to your attention a clause in the act
creating a firemen's pension fund which may affect the
two paid firemen of our present fire department. This
clause is as follows:
"Ent no person hereafter appointed in the fire de-
partment or fire service shall be considered a
fireman within the provisions of this Act unless
at the time of his appointment he is between the
ages of 21 and 35 years and passes a medical
examination to determine his general physical
condition given by a physician selected by the
board of trustees hereinafter provided for and
also makes application to the board of trustees
to come under the provisions of this Act.*

VETO ON PAYMENT OF SALARIES: The Clerk then read
the following message -A

Gentlemen:
In accordance with the power vested in me by statute,
I hereby veto an ordinance entitled "An Ordinance
directing the payment of fixed salaries" passed by
the City Council of Des Plaines August 9,1937 for
the following reasons:
1. In my opinion there should first be passed
by the City Council an ordinance fixing the
salaries of all officials and major employees.
2. Under the ordinance as passed there may be
some responsibility placed upon the Treasurer,
Clerk, Mayor and Chairman of the Finance
Committee by reason of certain officials
being paid less than the amount prescribed
by ordinance heretofore passed.
3. Said ordinance should also authorize the
Mayor, Clerk and Chairman of the finance
committee to execute the vouchers pertaining
to the fixed salaries. HOBART M.AHBE,Mayor

The motion was made by Alderman Dapheide and seconded by
Carroll that in view of the Mayor's veto, the Council
reconsider the proposed ordinance in question. The Mayor
put the question on the motion to reconsider and, the Clerk
called the roll with the following result: Ayes; Aldermen
Carroll, Johnson, Pflughaupt, lienrich, Harland, Dopheide,
Priott, Lemke, Schwanbeck and Campagna. Bays; lone. The
Mayor thereupon declared the motion to reconsider carried,
and the proposed ordinance again before the Council.
The Clerk then again read for first reading the
proposed ordinance entitled:
AN ORDINANCE DIRECTING THE
PAYMENT OF SALARIES:
The motion was made by Alderman Dopheide and seconded by
Schwanbeck to suspend the rules and put this proposed ordi-
nance upon its final passage. The Mayor put the question on
the motion to suspend the rules and the Clerk called the
roll with the following result: Ayes; Aldermen Carroll,
Johnson, Pflughaupt, Henrich, Garland, Dopheide, ?riott,
Lemke, Schwanbeck and Campagna. Nays; gone. The Mayor
thereupon declared the motion carried, the rules suspended
and the proposed ordinance before the Council for final
disposition.
The motion was then made by Alderman Carroll and
seconded by Lemke to finally pass this proposed ordinance.
The Mayor put the question and the Clerk called the roll
with the following result: Ayes; None. lays: Alderman Carroll,
Johnson, Pflughaupt, Henrich, Garland, Dopheide, Friott, Lemk,
Schwanbeck and Campagna. The mayor thereupon declared the
motion lost and the veto sustained by the Council.
STATE MAINTENANCE CONTRACT: The Clerk then
submitted a proposed contract from -the State highway Depart-
ment and read the following letter accompanying the same:

Dear Sir:
Attached are four copies of an agreement for Maintenance
of City Streets for the period July 1,1937 to June 30,1938.
This agreement covers those State Highways within the
corporate limits of Des Plaines where we may contract for
Maintenacne work.
In order to make the agreement effective, it must be approved
by the City Council, be signed by both the Mayor and the
Clerk, and bear the corporate seal of the City. The certifi-
cation at the close of the contract stating that it was
approved at a re4ular Board meeting and is a matter of
record, must also be filled in, signed, and ealed.
After this has been done, please return all four copies to
me for completion by this Department. ahen the contract is
fully executed, one completely signed copy will be returned
to you for your records.
In order that the fund set up for Maintenance may be used for
this purpose as soon as possible, 1 would appreciate

it if you would have the contract considered at the
next regular Board meeting. The agreement is simi-
lar to the one in effect for the past year.
Should you have any questions concerning work to be
done under the terms of this agreement, or about
the contract itself, 1 should be glad to have you

who is handling the City Maintenance for this District.

The motion was made by Alderman Pflughaupt and seconded
by Garland to instruct the Mayor and City Clerk to sign
the said contract for and in the name of the City, subject
to the approval of the City Attorney. The motion was
votedupon by acclamation whereupon the.Mayor declared the
motion carried.
W.P.A.REQUEST WR FREE OJ?IaCE SPACE: Mayor
Abbe then introduced Mr. Hacker, Area Supervisor of the
W.P.A. who orally requested the Council to permit the Area
office of the W.P.A. to occupy one of the offices in the
New Municipal Building free of charge, for an indefinite
period of time. The motion was made by Alderman Carroll
and seconded by Dopheide to refer this request to the Com-
mittee an Public Works, Buildings and Plats with power to
act. The motion was voted upon by acclamation whereupon
the Mayor declared the motion carried.
THACKER. STREET -A THROUGH STREET: The Clerk
then read the following proposed ordinance for first
reading:
AN ORDINANCE DESIGNATING- THACKER
STREET FROM 171E STREET TO WOLF
ROAD AS A THROUGH STREET.
BE IT ORDAINED by the City Council of the City of
Des Plaines,Cook County, Illinois:
SECTION 1. That Thacker Street between Lee Street
and Wolf Road within the City of Des Plaines be and is
hereby designated a through street.
SECTION 11. Any person driving a vehicle on any
street, avenue, alley or driveway intersecting said.
Thacker Street within the area hereinbefore described
shall bring said vehicle to a complete stop before
proceeding upon or over the right of way of said
Thacker Street.
SECTION III. There shall be placed at all streets
and alleys intersecting said Thacker Street within
the area described appropriate "SDI)" signs.
SECTION' IV. Any person violating the provisions of
this ordinance can be fined not more than 4-200140.
SECTION V. Ali ordinances or parts of ordinances
in conflict herewith are hereby repealed.
SECTION VI. This ordinance shall be in full force
and effect from and after its passage and approval and
publication as required by lay.

PETITION FOR STOP AND GO LIGHT: The Clerk then
read the following petition:
PETITION
We, -the property owners and residents on
Keeney Avenue and the Keeney Avenue-RiverRoad
section ask that the City Council take immediate
steps to consider the following propositions:
1.That a stop and go light be erected at the River
Road Keeney Ave. crossing. The many disturbing
accidents at this corner co ald be readily reduced
to a minimum if this precaution were taken.
2..Eliminate all truck traffic on ILeeney Ave. and as
a suggestion have them routed through I)es Plaines
on Oakton, a wider and more commodious -street
for this purpose.

Petition
To the Cowman Council of the City of Des Plaines,
Illinois, the Zoning Board of Appeals of the City of
Des Plaines,Illinois:
Charles P.liegan, Trustee of the property of the
Chicago and North Western Railway Company, hereby
petitions for a modification of certain provisions of
the zoning ordinance of the City of Des Plaines,Illinois.
The Chicago and North Western Railway Company is
the owner of an unplatted tract of land extending an
both sides of that part of its railroad known as the
Des Plaines Valley Railway between the east and west
center line of Section 1S, Town 4I,North, Range 12 East,
on the north, and the center line of Thacker Avenue on
the south, which land was acquired many years ago for
railroad purposes.

Petitioner now has an opportunity to lease a part
of said tract to the Lake -Cook Farm Supply Company,
a carporation, for the purpose of the conduct of the
business of distributing feed, fertiliaer and petrol-
eum products, which business, in the opinion of the
undersigned, is not in any way objectionable to
other property in the vicinity.
Said property is now within the area designated
as residential, but is not in fact suited to resi-
dential purposes and, in the opinion of the under-
signed, will not in the future be suitable for
residences, by reason of its proximity not alone
to said line of railway but other lines of railway,
including petitionerb coach yard which is situated
to the east and northeast of said land.
WHEREFOR, your petitioner requests that this
petition be filed for record with the City Clerk
and with said Zoning Board of Appeals, and after
notice thereof as requested by law, and consideration
by the City Council and the Zoning Board of Appeals,
said zoning ordinance be modified by classifying
said land as "industrial".

Welfare .Assn. dated July 29,1937 regarding
the employmect of a City nurse. A copy of
the said letter is attached hereto.

Appropriation and levy ordinance provide for the
salary of a full time nurse at 0.25.00 that the City
Attorney prepare the necessary ordinance creating
the position of a full time nurse at 0125.00 per

as of August Ist,1937.

regarding the powers and duties of the said board.

The motion was made by Alderman Pflughaupt and seconded by
Garland to adopt this proposed resolution. The Mayor put
the question and the Clerk called the roll with the following
result: Ayes; AldermenCarroll, Johnson, Pflughaupt, henrich,
Garland, Dopheide, Friott, Lemke, Schwanbeck and. Campagna.
Nays; _None. The Mayor thereupon declared the motion carried
and the said resolution adopted.
APPOINTMENT OF ZONING BOARD MEMBER: Mayor Ahbe
then announced the following appointment:
Theodore Napieralski (succeeding I.2?.Coombs) as
member of the Zoning Board of Appeals for a
five (5) year term ending April 30,1942 or
until his successor has been appointed and
qualified.
The motion was made by Alderman Garland and seconded by
Carroll to confirm this appointment. The motion was voted
argon by acclamation whereupon the Mayor declared the motion
carried and the appointment confirmed.
DANGEROUS BUILDING -BOARD 02 INSPECTION: Mayor
Ahbe then appointed the following board of inspection to
investigate the complaint filed by Frank F.Scharringhausens,
regarding the partly finidhed building located on Lot 7,
Block 10 in Des Plaines Villas:

The motion was made by Alderman Carroll and seconded by Lemke
to confirm these appointments. The motion was voted upon by
acclamation whereupon the Mayor declared the motion carried
and the appointments confirmed.

APPROVAL OF MINUTES: Each member of the
Council had at hand a copy of the minutes of the regular
Council meeting held August 2,1937 as well as of the ad-
journed regular Council meeting held August 9,1937. The
motion was made by Alderman Pflughaupt and seconded by
Lemke to approve the said minutes as written. The motion
was voted upon byacclamation whereupon the mayor declared
the motion carried and the said minutes approved.
ANNOUNCEMENT OF COMMITTEE MEETING: Mayor Ahbe
then announced that he requests a meeting of the Judiciary
and Assessment Committee for Friday evening August 21,1937.
BUILDING LINES IN COMMERCIAL DISTRICTS: Alderman
Garland then introduced the following proposed resolution:
RESOLUTION
A RESOLUTION REGARDING THE ESTABLISH
DENT OF BUILDING LINES IN COMMERCIAL
DISTRICTS.
WHEREAS, building lines have for many years been
in existance in most of the Residential Districts of
Des Plaines, and
tVHEREAS, the City Council of the City of Des
Plaines deems it necessary that the Zoning Ordinance
of the City of Des Plaines be modified by creating
building lines also in Commercial Districts of this
City,
THEREFORE Be It Resolved by the City Council of
the City of Des Plaines that the Zoning Board of
Appeals proceed according to law, to consider the
establishment of Building Lines in Commercial districts
within the City of Des Plaines and that the City Clerk
be and he is hereby instructed to forthwith send to
the Secretary of the said Zoning Board of Appeals
a copy of this resolution.
The motion was rrrade by Alderman Garland and seconded by

APPLICATION FOR LICENSE AS PHRENOLOGIST: The
Clerk reported that an application has been made for a
license to practice "phrenology" and that the City Ordinances
neither provide for such a license nor prohibit the practicing
of phrenology as a profession, but are silent on the matter.
The motion was made by Alderman Carroll and seconded by
Dopheide to deny this application for license. The motion
was voted upon by acclamation whereupon the Mayor declared
the motion carried and the license denied.
LIMITING FILLING STATIONS : Kenneth G .Meye r, City
Attorney, then orally presented the request of ar.J.R.Wesley
of the Retail Gasoline Dealers Assn. requesting the restriction
of the number of gasoline filling stations to one filling
station for every 750 feet of frontage. The motion was
made by Alderman Lemke and seconded by Carron to refer this
matter to the City Attorney with instructions to prepare
the proper ordinance for the Council's consideration.The
motion was voted upon by acclamation whereupon the Mayor
declared the motion carried.

CITY'EMPLOYEES NOT TO HOLD MORE THAN ONE JOB: -Mayor
Ahbe then asked the Council's authority to write a letter to
all employees of the City informing them that no City employee
shall in the future be permitted to accept additional employ-
ment in his spare time. The motion was evade by Alderman
Garland and seconded by Carroll to grant the Mayor authority
to write such a letter. The motion was voted upon by acct&-
mation whereupon the Mayor declared the motion carried.:
DRINKING PROHIBITED IN MUNICIPAL BUILDING: The
motion was made by Alderman Campagna and seconded by Garland
to instruct the City Attorney to prepare an ordinance prohibi-
ting the sale or consumption of beer or other intoxicating
beverages in the Municipal Building. The motion was voted
upon by acclamation whereupon the Mayor declared the motion
carried.
HAZARD AT DES PLAINES AVE. & C & N W. R. R.TRACKS :
Alderman Dopheide reported that two auto accidents have occurred
on Des Plaines Avenue at the point where it was narrowed down
to accommodate the safety gates proposed for the intersection
of Des Plaines Avenue and the Chicago and northwestern Railway
Tracks. The motion was made by Alderman Dopheide and seconded
by Carroll to refer this matter to the Streets and Sidewalks
Committee with full power to act. The motion was voted upon
by acclamation whereupon the Mayor declared the motion carried.

Mayor Hobart M.Ahbe with Aldermen Carroll, Johnson, Pflughaupt,
Henrich, Garland, Dopheide, Lemke, Priott, Schwanbeck and
Campagna responding to the roll call.

Upon order of Mayor Hobart M.Ahbe there will
be a special meeting of the City Council of the City
of Des Plaines at 8:00 P.M. on Monday evening,
August 23rd,1937 in the Council Chambers at the City
Ball, Des Plaines,Illinois for the purpose of discussing
the advisability of allowing the P.W.A. authorities to
occupy an office space in the City Hall free of charge;
and to discuss what proportion of building operation
expenses should be charged to the Library and Fire
Department; and to discuss any other business which
might come before the Council.
