MINUTES OP THE REGULAR MEETING
OF THE CITY COUNCIL OF THE CITY
OF DES PLAINES HELD IN THE COUNCIL
CHAMBERS ON THE 19th DAY OF JULY
A.D. 1937 AT THE HOUR 0P 8:00 P.M.
CALL TO ORDER: Mayor Hobart Ahbe being out of town on
his vacation, the meeting was called to order by Edgar. J. Friedrich,
with Aldermen Carroll, Johnson, Pflughaupt, Garland Dopheide,
Lemke, Friott, Schwanbeck, and Campagna. Alderman Henrich was
absent during the roll call but arrived later during the meeting.
RESIGNATION OF MAYOR PRO -TEMPORE: The motion was made
by Alderman Carroll and Lemke to designate Alderman Pflughaupt
to serve as ]Mayor pro -tem during this meeting. The motion was
voted upon by acclamation whereupon the chair declared the motion
carried.
Alderman Pflughaupt thereupon presided for the remainder
of the meeting.
THE JUDICIARY & ASSESSMENT COMMITT.S: Iiad no report to
offer.
THS; POLICE & LICENSE COMMITTEE: Had no report to offer.
THE STREETS & SIDEWALKS COMMITTEE: Through its chairman,
Alderman Schwanbeck, reported that the Committee has studied the
matter of trimming low annoying branches from trees overhanging
public sidewalks and suggested that the local newspapers publish
a request asking each resident to co-operate by trimming out such
low branches as may be annoying to pedestrians on public walks in
front of his particular residence.
(NOTE:At this point Alderman Henrich arrived at the
meeting.)
THE COMMITTEE ON PUBLIC WORKS BUILDINGS & PLATS: Through
its chairman, Alderman Campagna reported that insect screens for
the Police Headquarters have been ordered and are to be delivered
to -morrow. seconded by
The motion was then made by Alderman Campagna &/Carroll
to also authorize the purchase of insect screens for the City
Clerk's office as well as for the front and rear doors of the
Municipal Building. The chair put the question, and the Clerk
called the roll with the following result-Ayes;Aldermen Carroll
Johnson, Pflughaupt, Henrich, Garland, Dopheide, Friott, Lemke,
Schwanbeck and Campagna. Nays; None. The Chair thereupon de-
clared the motion carried.
THE SEWER,DRAINAOE & SANITATION COMMITTEE: Through its
Chairman, Alderman Dopheide then urged the construction of storm
sewers to alleviate the menance of basement flooding. The motion
was made by Alderman Garland and seconded by Henrich to refer the
problem of Storm Sewers to the Sewer, Drainage, & Sanitation Com-
mitteewith instructions to gather and submit specific data regar-
ding the same. The motion was voted upon by acclamation, whereupon
the chair declared the motion carried.
THE WATER COMMITTEE: Had no report to offer.
THE FIRE C0MMITT.tES: Alderman Garland, chairman of the
Fire Committee called the Councils attention to the necessity of
engaging another full-time fireman in order to have the fire
station manned the full 24 hours of each day. However, no action
was taken by the Council at this time regarding this matter.
APPROVAL OF VOUCHERS: The Clerk then submitted the
following proposed resolution:

Gentlemen:
At your request I have studied the various provisions of the
City Ordinances which, in my opinion are applicable to the
premises located in Homerican Villas. In connection there-
with, I wish to advise as follows:
With respect to the premises upon which an excavation
was dug and bricks were stored it is my opinion that
the only possible section of the Uity Ordinances under
which prosecution can be instituted to remedy the al-
leged unsightly condition is Section 1039 of the City
Ordinances which makes a penalty for any person to per-
mit any grounds or premises to remain for two hours in
a condition as to be offensive to the neighborhood or
dangerously prejudicial to public health.
If a proper complaint is filed before a Judge, I am
prepared to prosecute those responsible for the condition of
this property under Section 1039, although I wish to advise
that I am not entirely convinced that said section vas inten-
ded to cover conditions such as exist on this property.
With respect to the procedure concerning the razing of the un-
finsihed ]building in Homerican Villas, I have prepared and
submit form of complaint to be signed by the building inspec-
tor after the form is properly completed. I also submit form
of notice to be given concerning the hearing to be held by
the Board of Inspectors of Buildings, which board must be
appointed by the mayor and consist of three persons, one of
which should be the building inspector and the other two must
be a builder or a general contractor or an architect or real
estate dealer.

BE IT ORDAINED by the City Council of the City of Des
Plaines, Cook County, Illinois:
SECTION 1. Sections 546 to 549 both inclusive of Ar-
ticle VII entitled "Dealers in Fireworks" of Chapter 16, and
Sections 1202 to 1207 both inclusive of Article IV entitled
"Fireworks Displays" of Chapter 28 of the Municipal Lode of the
City of Des Plaines of 1928, be and the same are hereby repealed.
SECTION 2. This ordinance shall be in full force and
effect from and after its passage and approval according to law.

AN ORDINANCE FORBIDDING THE USE,
DISPLAY AND SALE OF FIREWORKS AND
PYROTECHNICS EXCEPT AS TO PUBLIC
EXHIBITIONS.
BE IT ORDAINED by the City Council of the City of Des
Plaines, Cook County, Illinois:
SECTION 1. Fireworks Unlawful. It shall be unlawful
for any person, firm or corporation to possess, use, display,
ignite, sell or offer for sale any fireworks, firecrackers, tor-
pedoes, roman candles, sky rockets, cap pistols or other pyr-
technics within the City of Des Plaines.
SECTION II. Exception. Public exhibitions or displays
of fire works or pyrotechnics shall be permitted when such display
or ekhibition is under expert supervision, provided, however,
that no public exhibition or display of pyrotechnics shall be had
without first obtaining the approval of the #ity Fire Marshal of
the place of exhibition, the consent of the City Council and the
payment of a permit fee of to the City Clerk.
SECTION III. Penalty. Any person, firm or corporation
violating any of the provisions of this ordinance shall be fined
not to exceed One Hundred Dollars 0100.00).
SECTION IV.This ordinance shall be in full force and
effect from and after its passage, approval and publication
according to law.

Dear &r. Dopheide:
Some time ago you requested the
Des Plaines Safety Council and this bureau to make
a thorough study of the advisibility of making Thacker
St. a through street from Lee St. West to Wolf Rd.
After considerable study by these
bodies, together with a well known traffic safety en-
gineer, we can see no reason why this change should
not be a good one as it will, with proper enforcement,
eliminate the apparent causes of accidents we have had
at the various streets, intersecting with Thacker St.,
in the past. Also it will invite those drivers who
live close to Thacker St. to use it rather than Prairie
Ave., which is a through street but due to the many
curves and being closely built up has many hazards.
We feel however, that, should the
change meet with the approval of the city council, the
speed limit should not be in excess of the present
twenty-five mile per hour rate and that all signs, which
will be placed at the intersections, be of standard type
to correspond with the standard sign which this city
has adopted and which is approved by traffic engineers.
We appreciate very much your giving us
an opportunity to express our opinion in this matter
and take this opportunity to thank the entire council
for the splendid cooperation they have given us.

Gentlemen:
Although absent a great part of the time, J. desire to
join with the people of Des Plaines in personal appreciation given
the efforts of those concerned in the erection of the new Muni-
cipal Building which marks a definite stride forward in the his-
tory of our city.
However, I have noted that apparently no steps have
been taken to complete the splendid building improvement by a
proper landscape development of the surrounding grounds.
As an interested citizen, therefore, I am offering to
provide, at my own expense, without cost to the city, a compre-
hensive landscape plan for the future detailed development of
the building grounds. The improvements proposed by this plan
need not be constructed at one time, but can be installed pro-
gressibely as your funds and labor are available.
Associated with me are some well known landscape ar-
chitects who have indicated their interest in Des Plaines and
their willingness to be of assistance in helping w ith such a plan.

Kenneth G. Meyer, City Attorney, reported that a copy of this
summons had been forwarded to him by the Clerk, and that he has
filed an appearance in this case for the City. lie reported
further that the suit involves a question of diversions on
$750.00 in Special Assessment bonds.
PAYMENT OF SALARIES: The Clerk then read the fol-
lowing proposed ordinance for first reading: -

MENT OF FIXED SALARIES
BE IT ORDAINED by the City Council of the City of
Des Plaines, Gook County, Illinois:
SECTION 1. That the salary or compensation of
every city official and employee, which by the annual
appropriation ordinance or by special ordinance is a fixed
amount per annum, shall be paid to such official or em-
ployee in equal semi-monthly payments on the first andfif-
teenth days of each and every month, provided there are
funds available therefor.
SECTION 2. That the Uity officials of the City of
Des Plaines charged with the duty of executing and delivering
payroll checks are hereby authorized to execute and deliver
on the first and fifteenth days of each and every month to the
officials and employees entitled thereto, according to the
provisions of this Ordinance, the proper check in payment of
the salary or compensation due such employee or official.
SECTION 3. All ordinances or parts of ordinances
in conflict herewith, are hereby repealed.
SECTION 4. This Ordinance Snail be in full force
and effect from ad after its passage and approval, according
to law.

Des Plaines, Illinois.
Gentlemen:
I was no little surprised and immensely
pleased this morning on my way to the train, to see
the beautiful white stripe painted down Prairie
Avenue from the Soo Line Tracks to Laurel Avenue.
I was so impressed by this much-needed
improvement that I halted to contemplate it for
awhile, noting that the white stripe kept every
autoist on his side of the street, forcing him to
keep on that side and to drive not more than twenty-
five or thirty miles per our, 1 should judge.
The effect is marvelous. All that is now
necessary for safe and sane driving, is to have the
police arrest a few drivers, sufficiently rash to be
found on the wrong side of the line. Citizens using
Prairie Avenue will be the beneficiaries.
Gentlemen, you are to be congratulated
and comtlimented for this wise action on your part,
which will win praise and support of our citizens,
especially those of the Third Ward.
I feel, too, that the Safety Council, w ill
be much gratified at your course.

POLICE MAGISTRATE'S BENCH: Alderman Campagna, Chair-
man of the Committee on Public works, Buildings, & Plats then
submitted a sketch of a proposed judges bench for the Police
Magistrate, which,he reported, would cost about 4200.00.
The motion was made by Alderman Carroll and seconded
by Alderman Lemke to refer this matter to the Committee on
Public Works, Buildings And Plats with full power to act. The
motion was voted upon by acclamation whereupon the chair
declared the motion carried.
TREE ROOTS RAISING SIDEWALK: Alderman Lemke reported
that several squares of concrete sidewalk at Third and Walter
Avenues are being raised by tree roots, making it dangerous
for pedestrians. The chair referred this matter to the Streets
and Sidewalks Committee.
DANGEROUS TREE ON THACKER STREETS .Alderman Friott
reported that there is a dangerous, hollow tree on Thacker St.
just east of the West Division School. The chair referred this
matter to the Streets and Sidewalks `'ommittee.
APPROVAL OF MINUTES: Each member of the Council
having at hand a copy of the minutes of the regular Council
meeting held ' uesty, July 6, 1937, the motion was made by
Alderman Schwanbeck and seconded by Alderman Lemke to approve
the said minutes as written. The motion was voted upon by
acclamation whereupon the chair delcared the motion carried,
and the said minutes approved.

ABATEMENT OF NOXIOUS WEEDS: Alderman Garland
called attention to the noxious weed menace in Des Plaines
and urged its abatement. The motion was therefore made by
Alderman Garland and seconded by Altman Lemke that the City
Council carry on an intense three-week weed abatement campaign
beginning Monday, July 26, 1937; that the first week a Mayor's
proclamation be published announcing the weed abatement campaign;
that during the second week notice be given that all noxious
weeds must be cut or the Oity will cut them and assess a fee
for cutting plus possibly a fine, and that during the third
week the City proceed to cut all noxious weeds within its limits
and seek to recover the cost of these weed cutting operations
from the tennants or owners of the areas mowed, either by
means of direct billing, by means of arrest and fine, or by
means of recording a lien against }e properties in question.
The chair put the question and the Clerk called the roll with
the following result: Ayes; Aldermen Carroll, Johnson,
Pflughaupt, Henrich, Garland, Dopheide, *exx*16K Friott, Lemke
Schwanbeck and Campagna. Nays; None. The chair thereupon
declared the motion carried.
LAE -COOK FARM SUPPLY CO: Frank F. Scharringhausen,
Building Inspector, then reported that a building permit appli-
cation has been filed by the Lake -Cook Farm Supply Co. for the
construction of an office and warehouse building intended to be
built along Western Avenue, near the Lord & Burnham's Plant.
He reported further that he, as building inspector, has denied
the permit because of the property upon which the proposed build-
ings were to be located is zoned for residential purposes.
ADJOURMENT: The motion was made by Alderman Dopheide
and seconded by Alderman Lemke to adjourn. The motion was voted
upon by acclamation whereupon the chair declared the motion
carried and the Council regularly adjourned.

Your committee on Judiciary & Assessment has investigated
the above and has found: that the owner's have taken poss-
ession of the building but inasmuch as we have not officially
accepted it, due to some unsatisfactory workmanship: we
recommend that the contractors carry the incurance until
date of official acceptance of building.

THE POLICE AND LICENSE COMMITTEE, through its
chairman Alderman Carroll, reported that the police signal
light located on the Masonic Temple Building should be in
operation in a few days.
