PEDDLER'S LICENSE ORDINANCE: The Clerk then read the following letter: KENNETH G . MEYER June 7,1937 City Council City Hall Des Plaine s,Illinois In re: Licensing of Peddlers Gentlemen: The police department arrested the driver for the Lambrecht Creamery Company on the grounds that he was peddling with- in the City of Des Plaines without the license required by our ordinance and in preparing this case for trial and digesting the law on the subject I have come to the conclusion that our present ordinance is unconstitutional for the reason that it includes a section exempting any ex-soldire, sailor or marine or farmer raising his own crop, from the necessity of paying the license fee pro- vided in the ordinance. The Supreme Court in the case of Marallis Vs. City of Chicago, 349 I11 422 held that an act of 1901 exempting soldiers and sailors from the necessity of acquiring a peddler's license was unconstitutional because of the fact that it was discriminatoy, and an ordinance must apply alike to all classes just as it is necessary in a statute. And in the case of City of Elgin vs. Winchester 300 111.214 the Court held an entire ordinance unconsti- tutional where the ordinance contained a section exempting citizens from the necessity of acquiring peddler's licenses. Therefore, in view of the fact that I am of the opinion that our present ordinance is unconstitutional, I submit herewith an ordinance to be adopted by the Council and pul3ished according to law. The motion was made by .Alderman Dopheide and seconded by Hen - rich to suspend the such rules of the Council as might pre vent the passage of this proposed ordinance at this meeting, for the purpose of passing the same at this meeting; and to put the said proposed ordinance upon its final passage. June 5,1937 The City of Des Plaines Honorable Mayor and City Council Gentlemen: In our visitations to new families just moving to Des y laines, we inquire if there is any way in which we can be of assistance to them. The most usual auestion or request is regarding the disposal of garbage or apses, the turning on of a street light or some other priliem pertinent to the adminis- tration of our City. It occured to the writer that each of you gentlemen would make a lasting impression and establish a friend- ship with the new house naives if you had printed a pamphlet outlining the services of the City of Des - Plaines and likewise information regarding the new city library's facilities and services. You will recall that one of the metropolitan newspapers recently called attention to this visitation service and that the local housewives are receiving it very favorably. The motion vas made by Alderman Lemke and seconded by Pflughaupt to authorize the water committee to arrange for the purchase of 200 such cards. PUBLICITY FOR SOFT WATER: Alderman Campagna then reported that the General Outdoor Advertising Company has agreed to give bill board publicity free of charge on about five bill boards regarding our neva soft water. APPROVAL OF MINUTES: Each member of the Council having at hand a cDpy of the minutes of the regular Council meeting held May 17,1937 as well as a copy of the minutes of the special Council meeting held May28,1937, the motion was made by Alderman Pflughaupt and seconded by Dopheide to approve the said minutes subject to a correction, correcting the name of Mayor Kinder to read "Mayor Ahbe".
