05/17/1937MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES HELD IN THE COUNCIL CHAMBERS ON THE .17th DAY OF MA.Y,A.D.1937 AT THE HOUR OF 8:00 P.M. CALL TO ORDER: The meeting was called to order by Mayor Hobart M.Ahbe, presiding, with Aldermen Carroll, Johnson, Pflughaupt, Henrich, Garland, Dopheide, Lemke, Yriott, Schwanbeck and Campagna responding to the roll call. The Clerk reported all members of the Council present. to offer. THE JUDICIARY AND ASSESSLENT COMMITTEE: had no report 383 THE POLICE AND LICENSE COMMIT1`h01; had no report to offer. THE STREETS AND SIDEWALKS COMI`dITT had no report to offer. THE COMMITTEE ON PUBLIC WORKS,BUILDINGS AND PLATS had no report to offer. THE SEtidR,DRAINAGE AND SANITATION had no report to offer. THE WATER COMMITTEE had no report to offer. THE FIRE COMMITTEE, through its chairman Alderman Garland, submitted the following report: To Alderman Garland,Chairman of Fire Committee, at the meeting of the City Council, held May 10,1937 the following matter was referred to your committee: The res-ination of Axel D.Petterson,Fire C%hief,copy of which is attached hereto. EDGAR J.FRIEDRICH The Fire Committee has investigated the above and has found: That said Axel D.Petterson feels that it is to the best interest of the Department and himself to tender his resignation at this time. Having served faithfully for 27 years in this capacity, he wishes to retire as Chief and pass the responsi- bilities of this office onto someone else in the Department. We, the Fire Committee, therefore recommend: That the resignation of Axel D.Petterson as Hire Marshall of the City of Des Plaines be accepted by this Council, to take effect as soon as his successor is appointed, accepts and is qualified. Chas .H .Garland, Chairman Otto W.J.Henrich J.W.Lemke. The motion was made by Alderman Garland and seconded by Lemke to concur in this report. The motion was voted upon by acclamation whereupon the Mayor dechxed the motion carried and the report concurred in. APPROVAL OF SURETY BONDS: then submitted for Council approval serial No.81616 continuing in force in the sum of $2,000.00 as his City Kenneth G.Meyer,City Attorney, his Continuation Certificate ulobe Indemnity Co. .Bond No.826501 Attorney's Bond. The motion was made by Alderman Pflughaupt and .seconded by Garland to approve this bond continuation. The Mayor put the question and the Clerk called the roll with the following result: Ayes; Aldermen XXIX, Carroll, Pflughaupt,Tohns on, Henrich,Garland, Dopheide, Lemke, Friott, Schwanbeck and Campagna. Nays; None. The Mayor thereupon declared the motion carried. The Clerk then submitted the Surety Bond of Harold J.Ahbe, Assistant Collector -Treasurer, described as follows: 384 United States Fidelity And Guaranty Company Bond No.26098-07-483-37 in the sum of $5,000.00 for the period beginning May 1,1937 and ending May 1,1941. The motion was made by Alderman Dopheide and seconded by Lemke to approve this bond. 'the Mayor put the question and the Clerk called the roll with the following result: Ayes; Aldermen Carroll, Johnson, Pflughaupt, Henrich, Garland, Dopheide, Lemke, Friott, Schwanbeck and Campagna. Drays; None. The Mayor there- upon declared the motion carried and the said bond approved. WATER WORKS P.W.A.PROJECT #7270: Kenneth G .leyer, City Attorney, then reported that the Economy Plumbing and Heat- ing Co., contractor on the Water Works has submitted claims for extras on his contract in the additional sum of some eighteen hundred dollars. Mayor Ahbe ordered this claim for extras re- ferred to the Water Committee. REDEEEED SPECIAL ASSESSMENT FUNDS: Kenneth G.ii►eyer, City Attorney, then reported that the County Clerk has invited the City to file its claim for special assessment moneys resulting from the redemption of forfeited property. The motion was made by Alderman Dopheide and seconded by Schwanbeck to authorize Kenneth G.Meyer, City Attorney, to arrange to have an audit made of these funds at the County Clerk's office and to file the City's claim based on such audit. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried. GATES AT DES PILAINES AVE. R.R.CROSSING: The Clerk then read the following letter: KENNETH G . MEYER May 13,1937 City Council Des Plaines,Illinois In Re: City of Des Plaines vs. Chicago Northwestern Railway Gentlemen: I wish to advise you that on May 12,1937 the City and the railroad closed the above case before the Commerce Commission. The railroad, in its defense, practically conceded every point presented by the City and took the position that they are perfectly willing to install gates at this crossing if the Commission should so order and provided that the City pro- ceeded to make certain corrections with respect to changing the present course of travel over this crossing as outlined on the accompanying plat which was an exhibit of the City's in this case. The expert who testified on the City's behalf in this cause recommended that the change of the street as set forth an the enclosed plat be made and it is my recommendation to the council that it take immediate steps to make the change as suggested as I feel quite confident that such a change will lessen the hazard at this crossing and make more certain the possibility of obtaining gates at the crossing. I wish to acknowledge the splendid work of the Safety Council and Sergeant Drexler of the Accident Prevention Bureau in the preparation of the evidence for this case, for without the evidence as given t o me to present before the commission it would have been impossible to establish such an excellent record in this case as we have. STOP AND GO LIGHTS FOR MINER STREET: The Clerk then read the following letter: State of Illinois Dept of Yubl.VPks & Bldgs. DIVISION OF HIGHWAYS May 11,1937 City M.F.T. Des Plaines Section 3 -CS Mr.Edgar J.Friedrich City Clerk Des Plaines,Illinois Dear air: The plans, specifications and estimate for the above section were approved by this Department today. The improvement consists of traffic control signals at the intersection of Miner Street and Lee Street, and at the intersection of Miner Street and Des Plaines Avenue. Miner Street is known as Northwest highway, and is on S.B.I.Route 19. In the proposal we have inserted specifications for automatic traffic control signals, dated January 1,1937. There is no provision made for moving the ex- isting railroad flashers which are shown on the plans to be adjacent to the proposed signals at Des Plaines Avenue intersection. We are approving these plans with the con- dition that provisions be made for mounting the railroad flaehers on new signal posts. The total estimated cost of this section ex- ceeds the amount appropriated. If the contract exceeds the appropriation, it will be necessary to submit a supple- mental resolution increasing the appropriation, as we can- not advance funds in excess of the amount appropriated. One copy of the plans has the sheet showing the detail of traffic control signal and foandation,missing. We are returning this copy of the plans to you. Your file copy of the approved plans is being returned to you herewith. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried. BUILDING PERMIT APPLICATION: Mayor Ahbe then called the Council's attention to the fact that there is still pending the application for a building permit filed by the Commercial Realty Co. requesting permission to build a commercial building on the old City Hall site. The motion was made by Alderman Lemke and seconded by Pflughaupt that the application for permit be granted as applied for. however, the motion was made by Alderman Henrich and seconded by Garland to table this matter. The Mayor put the question on the motion, to table, with the following result: Ayes; Aldermen Carroll, Henrich, Garland, Dopheide and Friott. Nays; Aldermen Johnson, Pflughaupt, Lemke, Schwanbeck and Campagna. The Clerk reported the vote a five to five tie. Mayor Ahbe then cast his vote as %Nay" and declared the motion to table lost. The motion was then made by Alderman Pflughaupt and 386 seconded by Campagna to amend the motion by changing the words "as applied for" to read "based on an Ellinwood frontage of 85 feet" and to grant a permit on this basis. the Mayor put the question and the Clerk called the roll with the following result: Ayes; Aldermen Carroll, Johnson, Pflughaupt, Henrich, Garland, Dopheide, 2riott, Schwanbeck and Campagna. Nays; Alderman Lemke. The Mayor thereupon decb.red the motion carried. 1937 TAX LEVY ORDINANCE PASSED: The Clerk then read for second reading an ordinance entitled: (AN ORDINANCE PROVIDING FOR THE LEVYING OF AN ASSESSLENT OF TAXES FOR THE FISCAL YEAR OF THE CITY OF DES PLAINES,C00K COUNTY,ILLINOIS,COM- JINCING JANUARY 1,1937, AND E?DING DECEMBER 31, 1937. The motion was made by Alderman Pflughaupt and seconded by Campagna to finally pass this proposed ordinance. The Mayor put the quest- ion and the Clerk called the roll with the. following result:Ayes Aldermen Carroll, Johnson, Pflughaupt, Henrich,Garland,Dopheide, Lemke, Priott, Schwanbeck and Campagna. Nays; 151one. The Mayor thereupon declared the motion carried and the said ordinance finally passed. Mayor Ahbe then signed the original of the said 1937 Tax Levy Ordinance in approval thereof. The Mayor's signature was attested by Edgar J.Friedrich,City Clerk, who also impressed the corporate seal of the City upon the ordinance. The motion was then made by Alderman Pflughaupt and seconded by Garland to instruct the Clerk to cause the 1937 Tax Levy Ordinance to be published in the Des Plaines Suburban Times. The Mayor put the question and the Clerk called the roll with the following result: Ayes; Aldermen Carroll, Johnson, Pflughaupt, Henrich,Gariand,Dopheide,Lemke, Priott and Schwan- beck. Nays; Alderman Campagna. The Mayor thereupon declared the motion carried. BUILDING INSPECTOR: The Clerk then read for second reading an ordinance entitled: AN ORDINANCE CREATING THE OFFICE OF BUILDING INSPECTOR AND PRESCRIBING THE DUTIES AND FIX- ING THE COMPENSATION OF SAID OFFICE, AND RE- PEALING SECTIONS 103,104 and 105 OF ARTICLE 9, CHAPTER 23, AND SECT IONS 740,741,742 and 743 OF ARTICLE 2 of CAHPTER 19 OF THE MUNIC- IPAL CODE OF THE CITY OF DES PLAINES OF 1928. Upon the request of the City Attorney,Maayor Ahbe referred this proposed ordinance to the Buildings and Plats Committee and the City Attorney. REWUEST FOR DOCKET EXTENSIOIT:P.W.A.7270: The Clerk then read the following proposed resolution: RESOLUTIO N Requesting Docket Extension - P.W.A.Docket 7270-111. WHEREAS,because of delays caused by the default of the:15-W Construction Company, contractor, it was necessary to extend the time of completion of the Des Plaines Water Works,known as P.W.A.Project 7270-111, and 387 WHEREAS, the City Council of the City of Des Plaines did by resolution passed on the 5th day of April41937 approve an extension of time to may 1,1937 for the com- pletion of contracts for Sections A,B and C of the said P w A Project 7270 -Illinois, subject to the approval of the State Director P W A for Illinois. THEREFORE BE IT RESOLVED by the City Council of the City of Des Plaines that the Federal Emergency Adminis- tration of Public Works be and the same is hereby re- quested to issue a formal docket time extension for the said P.W.A.Docket 7270 and that the said docket be extended to May 1,1937 and BE IT FURTHER RESOLVED that the City Clerk be and he is hereby instructed to forward five (5) certified copies of this resolution to the State Director,P.W.A. for Illinois. CONTRACT AND DOCKET EXTENSION:P.W.A.PROJECT 1692 -Ds The Clerk then read the following: RESOLUTION Granting Extension of Time to Complete Contract on P.W.A.Proj.Illinois 1692-D AREAS, the Uity of Des Plaines has previously entered into a contract with Charles B.Johnson & Son. Inc. for the construction of a New Municipal building known as P.W.A.Docket Illinois I692 -D to be completed June 1,1937, and WHEREAS,because of delays in delivery of steel window sash, and delay in delivery of interior metal window trim due to a strike in the factory of the window trim manufacturer, and t' 1HEREAS,Charles B.Tohnson & Son Inc. has requested by letter that the City Council of the City of Des Plaines grant an extension of time for completion to June 30th, 1937. THEREFORE BE IT RESOLVED: by the City Council of the City of Des Plaines,Cook County,llinois that Charles B.Johnson and Son Inc. be granted an extension of time for completion of the contract for the constru- ction of the said Municipal Building known as P.W.A. Project Illinois 1692-D, subject to the approval of the State Director P.W.A. for Illinois, and BE IT FURTHER RESOLVED that the City Clerk be and he is hereby instructed to forward five (5) certified copies of this resolution to the State Director P W A for Illinois for his approval. My dear Mr.Ahbe: It is noted that the above project is nearly completed and we are writing to inquire whether or not you contemplate any dedication ceremonies. The Public Works Administration was created by an act of Congress and approved by the .president on June,16,1933. This date offers an auspicious occasion to celebrate the fourth anniversary of the Public Works Administration.lt is therefore, desired to plan activities for the week of June 13 - and particularly for June 16,the birthday date - that would be the means of informing the public what the Federal Government,through the Public Works Administration, has done, for it in the way of creating employment and building useful and permanent public works. 389 The coincidence of your dedication with the birth- day irth-day of the Public Works Administration would furnish added interest to the ceremony, and with the cooperation of the local press, we are sure a very successful affair could be arranged. however, if you have already made plans for a dedication to take place on another date,please advise. DOGS RUNNING AT LARGE: The Clerk then read the following letter: CITY OF DES PLAINES BOARD OF HEALTH May 17,1937 To the Honorable Mayor Members of the City Council Gentlemen: At the beeting of the .Boa -rd of Health held on May 10, the following resolution was unanimously passed. That the Secretary be instructed to write a letter to the City Council,recommending that this body take more drastic action regarding dogs running at Targe in this City. The Board advises the inoculation of all dogs against rabies. The condition of the dog pound should be improved and more adequate quarters for impounded animals be provided. The route numbers of these decisions do not necessarily agree with the designations used for the guidance of traffic, but are the numbers corresponding with the routes set up in the State Bond Issue Acts. Chapter 24 paragraph 893 reads as follows: "Two members to be appointed by the Mayor,one to serve one year beginning the second l'uesday of May, and the other to serve for two years, the successor of each.such trustee shall serve two years, The third member shall be,elected from the regular Police Force or from any beneficiary under the provisions of this act. The motion was made by Alderman Carroll and seconded by Lemke to confirm this appointment. The motion was voted upon by acclamation whereupon the Mayor declared the motion unanimously carried. APPROVAL OF LINUTES:Each member of the Council having at hand a copy of the minutes of theiegular Council meeting held May 3, 1937 as well as a copy of the minutes of the special Council meeting held May 10,1937, the motion was made by Alderman Pflughaupt and seconded by Dopheide that the minutes of may 10,1937 be so correc- ted as to show the City Attorneys salary payable in "semi-monthly" installments instead of in "bi-monthly" installments, and to then approve both of the said sets of minutes. The motion was voted upon by acclamation whereupon the Mayor declared the motion unanimously carried and the said minutes approved. CORRECTION IN DRAINAGE ON LEE STREET: Alderman Carroll reported bad drainage on Lee Street in front of nern`s Meat Market. The motion was made by Alderman Carroll and seconded by Lemke to refer this matter to the Streets and Sidewalks Committee and the Superintendent of Public Works. ACCEPTANCE OF FIRE TRUCK: Alderman Garland reported that the Volunteer .t°ire Department has found the new Mack Fire Truck to be fully in accordance with the specifications and recommends its formal acceptance. DES PLAINES FORWARD MOVEMENT: Mayor Ahbe then intro- duced Jack Crowley of Maine Township nigh School who read the following Mayoral message: - MESSAGE FROM THE OFFICE OF THE MAYOR Des Plaines,illinois May 17,1937. To the City Council 395 Gentlemen: Believing that what are termed "Times of Depression" are but periods of preparation for greater and more pro- nounced successes, I believe that in our City of Des Plaines there are opportunities to work out problems which will be for the benefit of all its people. I believe in the future of our City - the past is secure. J. believe in her resources, her possibilities,yes more, her wonderful certainties. I believe in the people of Des Plaines, their genius, their brain, and their brawn. I believe in their honesty, their integrity, their dependability and cooperation. believe that nothing can stand in the way of their commercial advancement and prosperity. 1 believe the time has arrived for a co-ordinated effort by all the citizens, to place Des Plaines in the front ranks of the successful cities of our country. There was a news item in the metropolitan section of the Sunday herald and Examiner, on Sunday May 16th,which had a conspicuous scare head reading "You're Somebody in Des Plaines" in which it disclosed a system of greetings to new comers in Des Plaines, and praised our city for its proposal of beautification of railroad park by the Business Men Organization. Also, the Public Service had a recent publicity stunt of "Des Plaines enjoys Soft Pure Water.'t 396 This favorable advertising, 1 believe, is indicative that the people of Des Plaines are ready and willing, and imbued with the spirit of community patriotism, to whole- heartedly back this Forward movement. 1 anticipate with much hope and pleasure, the time when The Des Plaines For- ward Movement will have fullfilled its purpose of a sound and lasting success. This attainment, 1 am sure, will have gained for Des Plaines and its people, a rating of a community that we may well be proud.: of.
