MINUTES OF THE REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF DES PLAINES
HELD IN THE COUNCIL CHAMBERS ON THE
1st DAY OF FEBRUARY 1937 AT THE HOUR
OF 8:00 P.M.
CALL TO ORDER: The meeting was called to order
by Mayor George W.Hinder, presiding with Aldermen Ahbe,
Carroll,-Pflughaupt, Full,Biahop, MacLiackie, Frederick,
Lemke, Schwanbeck and Campagna responding to the roll call.
REPORTS 'OF OFFICERS: The Clerk supplied each
member oftheCouncil with a copy of the Clerk's annual
tIatitt for the 'fiscal year beginning January 1,1936 and
ending December 31,1936.
The Clerk then read his report for the month
of January 1937, as well as the report for January 1937 of
Howard A.Becker, Captain of Police. Mayor Kinder ordered
these reports placed on file.
THE 'JUDICIARY AND ASSESSMENT COMMITTEE had no
report to offer.
THE POLICE AND LICENSE COMMITAst. through its
chairman Alderman Fulle, reported that there -have been a
number of complaints that cartage trucks frequently block
Western Avenue at the Idcago and. North Western Railway's
Freight Depot. The motion was madd by Alderman Fulle and
seconded by MacLuckie to instruct the Clerk towrite the
Chicago and Northwestern Railway ordering it to make the
necessary provisions to prevent trucks from blocking of
Western Avenue while loading and -unloading. The motion was
voted upon by acclamation whereupon the Mayor declared the
motion carried.
THE STREETS AND SIDEWALKS COMMITTRR The Clerk then
read the following report:
To the Chairman Frederick - Streets and Sidewalks - at the
meeting of the City Council, Held January 18,1937 the following
matter was referred to your committee:

To Alderman Schwanbeck,Chairman of Publ.Works and Buildings and
Plats Committee, at the meeting of the City Council held January
18,1937 the following matter was referred to your committee:
The matter of 'making all arrangements for corner -stone
laying ceremonies in the building of the new Municipal
Building.

Your committee on Buildings and Plats has investigated the above
and has found: After considerable consideration regarding the
type stone" that would be best in appearance, the committee suggests
that a granite stone, rather than a rime stone, would be the
proper one. Regarding the color granit, which would be most
appropriate, has not been decided by the committee, and we
love the color of stone to discussion of the City Council.

instruct the Committee on Buildings and Plats to purchase a black
granite 'corner stone for the new Municipal Building. The Mayor
put the question and the Clerk called the roll with the following
result: Ayes; Alderman Ahbe, Carroll, Pflughaupt, Fulle, Bishop,
Ma.cLuckie, Frederick,Lemke, Schwanbeck and Campagna. Nays; one.
The Mayor thereupon declared the motion carried.

THE SEWER,DRAINAGE AND SANITATION COMMITTEE: had
no report to offer.
THE WATER COMMITTEE had no report to offer.
THE FIRE COMMITTEE: Alderman Campagna, chairman of
the Fire Committee, then submitted the Annual Report for 1936
of the Des Plaines Volunteer Fire Department -which was read
by the Clerk. The outstanding point of the report was the
statement that the loss per fire was only $126.83 and the
fire loss per capita 19.4 cents. This, according to the
report is the loyest fire loss ever recorded in the City's
history. The motion was made by Alderman MacLuckie and
seconded by Campagna to place this report on file. The motion
was voted upon by acclamation whereupon the Mayor declared the
motion carried.
The motion was then made by Alderman MacLuckie and
seconded by Lemke to instructe the Clerk to write a letter to
the Des Plaines Volunteer Fire Department expressing the Council's
aPpreciation and thanks for the efficient service rendered
the City by the Fire Department during 1936. The motion was
voted upon by acclamation whereupon the Mayor declared the mot-
ion carried.

PEALS OF THE CITY OF DES
PLAINES,ILLINOIS:
The Wisconsin Central Railway Company, L.A.
Whitman, Receiver, hereby petitions for the modification
of certain provisions of the Zoning Ordinance of the
City of Des Plaines,Illinois, as hereinafter set forth.
The facts pertaining to, and the reasons for,
the propoSed modification of said Zoning Ordinance are
as follows:
"The Wisconsin Central Railway Company is the
owner of the unplatted tract of land extending
along and adjoining the Westerly line of its rail-
road right of way between Graceland Avenue and
Prairie Avenue in the City of Des Plaines,Illinois,
which was acquired for industrial development
along its railroad in said City.
The petitionernot has an opportunity to lease a
Part oftheabove described tract of land tb a corn -
not now operating in said City, as a site
for a net, fireproof building and oil storage tanks
and the Conduct of a business which should be of
substantial benefit to the -citizens of Des Plaines
as well as the petitioner., if said Zoning Ordi-
nanCe-is Modified so as to permit the storage of
bettoleUm products in larger quantities uponthe
Premises proposed to be leased from the petitioner.
Subparagraph 15 of Section Four of the Zoning
Ordinance of the City of Des Plaines, Illinois, re-
lating to the Commercial district fixed therein,
reads as follows:

"'Refining petroleum or storage of crude
petroleum or any derivative thereof, in
quantities exceeding ten thousand gallons in
containers of not to exceed five thousand
gallons capacity each"
The quantity and capacity limits fixed in the
above quoted section of the Zoning Ordinance are toO
love to meet the requirements of the petitioners
prospective lessee. The petitioner respectfully re-
quests that said subparagraph be changed to read as
follows:
"Refining petroleum or storage of crude petroleum
or any derivative thereof, in quantities of exceed-
ing one hundred thousand gallons in containers not
to exceed twenty thousand gallons each".
Wherefore, your petitioner requests that this petition
be filed for record with the City Clerk and with said
Zoning Board of Appeals, and .that after notice thereof
as required by law, and consideration by the City
Council and the Zoning Board of Appeals, the above pro-
posed modification of subparagraph 15 of Section four
of the Zoning Ordinance of the City of Des Plaines,
be made.

man Pflughaupt, chairman of the Yinance Committee then sub-

Bank -of Des Plaines as of the close of business, December
31,1936; as well as the Bank Statement of the Northern
Trust Company of Chicago as of the close of business,
December 31,1936. The motion was made by Alderman Pflughaupt
and seconded by Frederick that the First National Bank of
Des Plaines and the Northern Trust Company of Chicago be
continued aS depositories for the funds of the City. The

APPROVAL OR MINUTES: Each member of the Council

meeting held January 18,1937, the motion was made by Alderman

the Mayor declared the motion carried and the said minutes
approved.

REPEALING ORDINANCE
B IT ORDAINED by the City Council of the City
of Des Plaines, Cook County, Illinois:
Section 1. That an Ordinance entitled "An Ordinance
designating the officers of the City of Des Plaines
to sign and countersign checks, drafts, vouchers, orders,
or warrants of the City of Des Plinese, passed October
7,1935,and approved October 8,1935, be and the same is
hereby repealed.
Section 2. This Ordinance shall be in full force and
effect from and after its passage and approval accord-
ing to law.
Passed this day of February A.D.1937

Mayor Kinder ordered this proposed ordinance filed for
second reading.
DES PLAIDS AVENUE RAILROAD CROSSING: Kenneth
G.Meyer, City Attorney, reported that he, assisted by the
Des Plaines Safety Council, the Accident Prevention Bureau
of the Police Department and other witnesses represented
the City in the hearing on January 13,1937 before the
Illinois Commerce Commission on the petition filed by the
City asking that the Chicago and Northwestern Railroad Pro-
vide gates at its Des Plaines Avenue crossing. He reported
that the City introduced a vast amount of evidence.
SPECIAL ASSSSEFNT No. 62694: Kenneth fz...Meyer,
City Attorney, then reported aiaI bond holders in Special
Assessment Warrant No.62694 (Extension of Ellinwood.Street)
have threatened foreclosure of the principal properties
involved. He reported further 'that on the afternoon of
February 1,1937 (this afternoon) a conference was held in
the offices of Mr. Eckert, attorney for several of the
property owners. The meeting was attended by Kenneth G.
Meyer, City Attorney, Otto W.tTalenrich,City Collector
Treasurer, Edgar T.Friedrich, City Clerk and several
property, owners" and their attorneys. Up to the "present
time there are no definite developements, although it
appears that all parties involved wish to settle the matter.
RESIGNATION FROM: ZONING BO'RD: Mayor Kinder then
reported that Garfield Faffil1er, a member of the Zoning
Board of Appeals, has moved out of town and wishes to resign
from the said board. There being no formal resignation
at hand, Mayor 'Kinder formally declared that ►r. Miller's
seat on the Zoning Board of Appeals vacant.
ADJOURNMENT: The motion was made by Alderman Ahbe
and seconded by ;"ishop to now regularly adjourn this meeting
and meet as a committee of the whole on Monday February 11,
1937. The motion was voted upon by acclamation whereupon
the Mayor declared the motion carried and the meeting
regularly adjourned.
